Dear Bob:
Thank you for submitting your correspondence dated August 14, 1996 regarding the
property ovmer's desire to convert 900 square feet of warehouse/storage space at 2742
State Street to 900 square feet of retail. Based on the information you provided to me
which indicates that the Arts & Antiques Warehouse currently has 2528 square feet of
warehouse/storage space and a total of 36 parking spaces, staff researched the project to
determined if the property owner could be permitted to convert some warehouse space to
retail space.
Staffs research on this matter resulted in the following:
1. The Arts & Antiques Warehouse was approved by Redevelopment Permit 89-05 with
9404 square feet of retail, 1851 square feet of office and 3323 square feet of
warehouse. The parking requirement was determined to be 35 onsite spaces. The
project plans provided for 36 onsite spaces.
2. Per our discussions on the project together with your recent correspondence, you
indicated that the actual square foot measurements are: 9500 sf retail, 1364 sf office
and 2528 sf office (with removal of 206 sf enclosed entryway). This results in a
parking requirement of 33 onsite spaces. This means that the project has a surplus of
3 parking spaces which could be used to permit a conversion of a portion of the
warehouse to retail.
3. The new proposed uses in terms of total square feet is 11,764 for retail/office and
1618 square feet of warehouse/storage. This results in a total parking requirement
again of 35 onsite parking spaces (which takes into consideration the original 15%
parking reduction approved by the Design Review Board). With the provision of 36
onsite parking spaces, the project will continue to meet its parking requirement if 900
square feet of warehouse space is converted to retail space.

Based on the above understanding of the project as existing and now proposed, the
change in permitted land uses will not result in an increased parking requirement.
Therefore, the proposed conversion of use as stated within your letter dated August 14,
1996 can be approved by the Redevelopment Agency and is not subject to additional
review under the Redevelopment Permit Process as set forth in the Village Master Plan
and Design Manual (effective January 12, 1996). This letter will serve as documentation
that the proposed project is exempt firom the Redevelopment Permit. The property owner,
however, will still be required to obtain all appropriate building permits for any interior
improvements to the building.

THE WAREHOUSE PORTION OF THE PROJECT FOR $.50/SQUARE FOOT. TO
MAKE IT MORE MARKETABLE, WE WOULD LIKE TO PROPOSE A
SALES/WAREHOUSE CONFIGERATION. WE WOULD BE WILLING TO DEMOLISH
THE ENTRY WAY REMOVING 206 SQUARE FOOT. THIS LEAVES A NET OF 2528
SQUARE FOOT, USING 3 AVAILABLE PARKING SPACES WOULD ALLOW 900
SQUARE FOOT OF RETAIL AND 1618 SQUARE FOOT OF WAREHOUSE. THIS
ALLOWS US TO MAKE A MARKETABLE RENTAL OF $.70 PER SQUARE FOOT, A
PRICE THAT WOULD ENABLE US TO FILL A LONG EXISTING VACANCY.

SUBJECT: RP 89-5 - ARTS AND ANTIQUES WAREHOUSE
This letter is to explain the terms of approval for the above referenced Redevelopment Permit, as
you requested, located at 2742 State Street. This project was approved by the Design Review
Board on February 7, 1990.
The approving resolution, Design Review Board Resolution No. 151, is attached for your
reference. It contains all the conditions of approval for the project. Any violation or form of
non-compliance with these conditions will result in action by the City to achieve compliance.
Ultimately, the Redevelopment Permit can be revoked if any condition of approval continues to
be violated. If there are any specific questions about whether something would be allowed or
not, feel free to contact me. The approved use, purpose and conditions of approval for this
project are clearly outlined in Resolution No. 151. If any change is proposed to the project it will
require a formal amendment to RP 89-5.
The project is approved for an initial period of 5 years as stated in Condition No. 7. This
condition goes on to state it may be renewed for another 5 year period unless the permit is
revoked. It clearly describes what will cause the permit to be revoked, including non-compliance
with the conditions of approval as explained above. If the project compUes with all conditions
of approval, does not create any detrimental effects or situations and does not disrupt the normal
functioning of the area, it is unlikely a renewal application would be denied.

The following represents a summary of the action taken by the Design Review Board at their
meeting of April 20, 1994:
1. RP 89-5(A) - ARTS AND ANTIOUES WAREHOUSE;
The Design Review Board approved (3-0) a request for a 10 year extension of minor
redevelopment permit 89-5. The permit allows continued operation of the Arts and Antique
Warehouse at 2742 State Street until February 7, 2005.
The property owner intends to convert a 6000 square foot retail suite within the building at the
noted site to approximately fourteen (14) individual retail suites. The interior improvements will
actually reduce the net leasable space within the building by approximately 1300 square feet.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Redevelopment Permit, application no. RP 89-5, as to
its completeness for processing.
The application is Incomplete. Attached are two lists. The first list is information which
must be submitted to complete your application. All list items must be submitted
simultaneouslv at the Communitv Development Buildinq counter, and to the attention of
Erin Letsch. A copv of this list must be included with your submittal. No processing
of your application can occur until the application is determined to be complete. The
second list is issues of concern to staff. When all required materials have been
submitted as outlined above, the City has 30 days to make a determination of
completeness. If the application is determined to be complete, processing for a
decision on the application will be initiated. In addition, please note that you have six
months from the date the application was initiallv filed, August 29, 1989, to either re-
submit the application or submit the required information. Failure to resubmit the
application or to submit the materials necessary to determine your application complete
shall be deemed to constitute withdrawal of tiie application. If an application is
withdrawn or deemed withdrawn, a new application must be submitted.
