The Planning Department has reviewed your Redevelopment Permit, application nq, RP 89-6, as to its completeness for processing. The application is incomplete. Attached are ftvo lists. The first list is information which must be submitted to complete your application. All list items must be submitted simultaneouslv at the Community Development Buildina counter, and to ttie attention of Erin Letsch. A copv of this list must be included with vour submittaL No processing ofyour application can occur until the application is determined to be complete. The second list is issues of concern to staff. When all required materials have been submitted as outlined above, the City has 30 days to make a determination of completeness. If the application is determined to be complete, processing for a decision on the application will be initiated. In addition, please note that you have six months from the date the application was initiallv filed, October 17, 1989, to either re- submit the application or submit the required information. Failure to resubmit the application or to submit the materials necessary to determine your application complete shall be deemed . to constitute withdrawal of the application. If an application is withdrawn or deemed withdrawn, a new application must be submitted. Notification was given on November 17, 1989 that the application was incomplete, along with a list of items/information needed to complete the application. The application is still incomplete. As a result, this letter is notification to you that RP 89-6 has been withdrawn per Chapter 21.54.010 of the Carlsbad Municipal Zoning Ordinance: "When a determination that an initial application is incomplete has been transmitted to the applicant, the applicant shall have six months from the date the application was initially filed to either resubmit the application or submit the information specified in the determination. Failure of the applicant to resubmit the application or to submit the material in response to the determination within the six months shall be deemed to constitute withdrawal of the application, if an application is withdrawn or deemed withdrawn a new application must be submitted." Please review items marked on the attached Engineering checklist 2. Also attached is a redlined checkprint which must be returned with the resubmittal. ISSUES OF CONCERN PLANNING: 1. The site may be too intensely developed by the proposed expansion. Staff is conducting site inspections and will review the resubmittal to assess the adequacy of the proposal. ENGINEERING: 1. The improvement plans for Elm Avenue - Streetscape Phase IV are not proposing an access to Carl's Jr. or the alley (Dwg. no. 291-7 Sheet 6 & 7 of 53). Carl's Jr. should explore reciprocal access through the driveway for Sixpence inns, othenA/ise the driveway for Carl's Jr. will need to be right-in/right-out only. If reciprocal access is attained we will condition immediate construction of new access and closure of old access. 2. Additional right-of-way will be required by Streetscape - Phase IV on Elm Avenue. You will be conditioned to provide the right-of-way. Show proposed right-of-way on site plan. Contact Sherri Howard in the Engineering Department for the dedication requirements. 3. Increase planter lengths in the parking lot to the length of the parking stalls so cars do not appear to be in the driveway. 4. Alley can J/i/'be used as a loading area. Use parking space near drive thru pick-up window and designate as a loading area. Adjust lot lines through an adjustment plat to move northwest boundary to fence at rear of property. Include the distance from the fence to the property/lease line on the site plan. This distance is necessary for backup if you are going to use this as a two-way lane. 6. There are two trash containers on site. Designate trash areas for two containers on site plan. 7. Paint curb red and label "no parking" at entrance to Carl's Jr. Restaurant as shown on the site plan checkprint 8. Clearly show all existing and proposed facilities. 9. Show adjacent buildings and dimension distances to property line. For projects with an average daily traffic (ADT) generation rate greater than 500 vehicles per day: Two (2) copies of a Circulation Impact Analysis for the project. The analysis must be prepared by an appropriate registered Engineer. The analysis must show project impacts to all intersections and road segments identified as impacted within the included Local Facilities Management Plan. The following should be included with the study: a) 8 1/2" X ir or 8 1/2" x 14" plats showing zone impacted roads, background and project AM and PM peak hour impacts and traffic distribution. b) Project traffic generation rates c) Necessary calculations and or analysis to determine intersection and road segment levels of service. d) Any proposed mitigation requirements to maintain the public facility standards. Two copies of preliminary soils/geologic report for all project with cut or fill depths exceeding 5 feet.
