REQUEST FOR A TWO YEAR EXTENSION OF MAJOR REDEVELOPMENT PERMIT
(89-8) - BEVERLY CENTRE
RECOMMENDED ACTION;
Recominend that the Housing and Redevelopment Cominission grant a
one (1) year extension of Major Redevelopment Permit 89-8 for
construction of a three story mixed-use office/retail structure
on property generally located on the southeast corner of State
Street and Laguna Drive.
ITEM EXPLANATION:
Attached is a letter from Mr. Robert Mance requesting a two (2)
year extension of Major Redevelopment Permit (89-8) to allow the
construction of a three story mixed-use office/retail structure
on corner of State Street and Laguna Drive. The request to extend
the approved redevelopment permit was received by the City of
Carlsbad on March 25, 1992.
The Design Review Board recommended approval of this project on
December 19, 1990 and the Housing and Redevelopment Commission
approved the project on March 19, 1991. The resolution approving
the permit was adopted by the Commission on April 2, 1991.
Per the conditions of project, the "approval was to become null
and void if building permits were not issued for this project
within one year from the date of project approval." It is staff's
understanding that the previous applicant was very ill during the
past year and recently died. The new applicant would like the
opportunity to continue the project. However, he needs additional
time to clarify project approval requirements with staff. It may
be necessary for Mr. Mance to process an amendment to this permit
at a later date if he is unable to continue with the previously
approved project as presented to the Design Review Board and
Housing and Redevelopment Commission.
Staff is recommending that the Design Review Board and Housing
and Redevelopment Commission grant a one (1) year extension of
Major Redevelopment Permit 89-8 rather than the two (2) year
extension requested in the attached letter. Staff and the Master
Plan Advisory Committee are currently working with a consultant
to identify "a vision and strategies program" for future
development in the Village Redevelopment Area. We anticipate that
the "Master Plan and Implementation Program" for the Village will
be completed within one (1) year. In his initial Phase 1 report.
the consultant has recommended that the property for this project
be considered for a housing project (24 units or less) rather
than additional office/retail space.
Staff does not wish to discourage the applicant in his endeavors
to develop the identified property. However, we would like to
reserve the right to reconsider the permit for the office/retail
center upon completion of the Master Plan if the proposed project
has not be constructed within a one (1) year period. The Master
Plan Advisory Committee will be meeting with staff and the
consultant over the next few months to discuss various issues
such as land use in the Village Area. Upon completion of these
meetings and the Master Plan, we may wish tp encourage the
applicant to construct an alternate project at the noted site.
If the Design Review Board concurs with staff's recommendation,
it is requested that Resolution No. 187 be approved by the Board.
The request will be forwarded to the Housing and Redevelopment
Commission for final action.

Dear Mr. Orenyak,
Please consider this letter as a forma^^Squest for the
extention of the Beverly Centre Major Redevelopment Permit.
Issued on April 2, 1991, requirements for compliance to meet
the conditions of the permit are very extensive and require
design, processing and implementation before construction
may commmence. Therefore, the time period for the extention
request is to April 2, 1994.
The previous applicant, Beverly Centre, is no longer in
existence. The new applicant is Ford Associate IX, Beverly
Centre, Ltd. c/o Robert F. Mance. The owner of the property
is Willow Properties, Cons, c/o Mr. Thomas Hawthorne.
Approval for the assignment of the permit to Ford Associates
IX is granted by the signature of Mr. Hawthorne below.
Extention of the permit "as is" is requested. However,
some of the requirements are unclear and some of them will
require that the new applicant request change in order to
develop a more market senstive project. At this time those
items that might be changed are not certain therefore the
extention of the permit should be exactly as it is granted.
A copy of the permit is enclosed as an exhibit to this
letter. Since it is due to expire on April 2, 1992 it is
requested that it be made clear that the request has been
made before that date. If any acts are necessary to be
performed by the applicant prior to April 2, 1992 please
inform me immediately so that we are not prevented from
extention because of time constraints.

Dear Faramarz:
During a recent review of you revised plans dated January 14, 1991 for the above
mentioned project, it was discovered that you are showing some incorrect information on
the plans. Specifically on Sheet 4, the tiltimate radii for Laguna Drive centeriine and north
and south right-of-way lines are incorrect. The correct radii are:
1. north ultimate right-of-way line the radius will be 530 feet.
2. for the centeriine the radius will be 500 feet, and
3. the south ultimate right-of-way line the radius will be 470 feet (see copy of
sheet included).
Please make these changes to your drawings prior to submitting and scheduling this project
for City Council.

Dear Mr. Chairman 8f Board Members:
As owners of 2548-54 State Street, Carlsbad which is contiguous
to the site of the proposed Beverly project we wish to state that
the project proposed would be a very nice addition to downtown
Carlsbad.
However we do have two main concerns regarding this project. We
are concerned with the location of the entry and exit of the
underground parking. This is located near our property and we
are very concerned with the exhaust fumes of the vehicles entering
and exiting the building and the evacuation of carbon monoxide, etc
from the garage area. We would prefer that this entry/exit be
located on Laguna Drive across from the park.
Our second concern is building set backs from the property line.
We would hope that you insure that the proposed building meets
all requirements pertaining to set backs as now exists in the
City of Carlsbad building code and also meets the objectives as
outlined in the city "Village Design Manual" which I believe was
adopted in 1981.

Dear Mike:
We have reviewed the plan dated 11/23/89 for the Beverly
Centre. The location of the bins and space allocated for
the refuse bins appear to be adequate for the planned
project dependant on the tenant mix and number of tenants
using using the facility.
Servicing the facility will more than likely require the
bins to be serviced from the public street with the bins
being rolled out from their location to the truck.
If you have any question regarding our review, please give

The Plarming and Engineering Departments have completed their review of the resubmitted
application for completeness and issues. The Project application is now complete for the
purpose of continued review effective June 1, 1990.
The outstanding issues are as follows:
Planning: ^
1. Please provide total building height from grade leve^J^p of building from southeast
comer of site.
2. Please check building square footage.
Engineering:
1. Please show proposed topographical contours both on and off site for drainage.
Detail street drainage and relocation of existing grated storm drain inlet to curb
inlet.
2. Please provide letter from Coast Waste Management that they approve of and will
be able to serve trash dumpsters as proposed.
3. Please detail existing street lights and power poles.
4. Please make changes as shown on the checkprint to the typical road sections for
State street and Laguna Drive in regards to existing and proposed property lines
(right-of-way) and existing proposed and future public improvements. Also attached
is a red-lined check print of the site plan. Please retum the redlined print with the
corrected site plan to assist in or review.

Dear Brian:
Pursuant to my meeting with yourself and Mr. Jim Murray, and
also my phone conversation with Jim on January 30, 1990, the
following is a summary of solutions and remedies for each issue
of concern expressed in the Planning Department's letter of
January 03, 1990, which were discussed and agreements reached
in our meeting:
List of items to complete application:
PLANNING:
1. The application will be revised and signed by my client.
2. The number of standard and compact parking spaces will
be incorporated into the plans.
3. The revised application will clarify the issue of
ownership.
ENGINEERING:
As I mentioned in our meeting this office will revise the
drawings to incorporate missing information in items 1 through
8; for items 9 and 10 preparation of the reports is in the
process and the reports will be a part of the second submittal
package.
Regarding item 11, enclosed please find a copy of the title
report with more information on SDG&E easement. Please examine
it and if it does not satisfy your needs let me know to obtain
a more updated one.

PLANNING:
Items 1 and 2: The drawings will be revised to address these
issues.
3. As we discussed this item, the proposed design had the
area between the building and the easterly boundary
designated as the service area. Street loading and
unloading as well as on-site loading area as a truck
back-up space would both be possible.
Items 4 and 5: The drawings will be revised to address these
issues. In addition to that, a colored site plan and street
elevation will be a part of resubmittal package.
6. As I mentioned in our meeting, I would like to propose
the landscape concept as proposed with the tree grates
next to the curb. Although this may not be in complete
harmony with the landscape ordinance but as you favored
it also, it creates a pleasant space at the pedestrian
level without which the sidewalk will not be as invit-
ing. Regarding Alectryon Excelsus, please find a coy
of the information furnished by my landscape architect
for your review.
ENGINEERING:
1. The slope of the ramps will be revised from 7% to 5% in
response to Jim's comment.
2. As I mentioned it to you and Jim, the building has been
designed in such a way as to be able to utilize the area
between the building and the easterly property line as
a truck loading area. However, due to the size of the
lot, this area could only be used as a space for the
truck to back up into. In my conversation on January
3 0 with Jim he mentioned that the option of street
loading will be more acceptable in this particular case.
3. Since the booth is just for the parking attendant and
is not a security control as Jim agreed with me, the
design could be left as proposed at the entry ramp.
However, a hammerhead will be provided at the lowest
level of parking by eliminating two stalls to accom-
modate the turnaround.
4. The parking stalls next to the wall at the lowest level
of parking will be revised to address this issue.

5 and 6: Both items are fully understood by my client and I,
however, regarding item 6, I need more information
regarding the method by which the extent of my client's par-
ticipation will be determined.
7, 8, 9 and 10: As Jim and you agreed, these item could be
addressed as a condition of approval and to be met
before obtainment of the construction permit.
11 and 12: My client and I are in agreement with the
Engineering Department concerning these two items and
believe that they could help to enhance the project.
13. Even though Jim mentioned that in his second site visit,
investigating this "hump", it did not appear to be a
serious problem. During the course of preparation of
construction documents we will take a close look at this
area.
I would like to take this time to thank you and Jim for your
time, patience and professionalism in discussing all these
issues and assisting me in seeking proper remedies for each one
of them. I am looking forward to working with you and Jim on
this asi well as my other projects in Carlsbad.

ISSUES OF CONCERN
PLANNING:
1. Identify trash dumpster location.
2. Setback along Laguna Drive/State Street Project entries should not conflict with
pedestrian circulation in public r-o-w.
3. Service entries for retail are not indicated suggesting street loading.
4. East elevation needs to show planter/concrete deck at first floor roof, southern
side.
5. Elevations need to call out all materials and color.
6. Landscape plan needs to be revised (in public r.o.w. and within 3 feet of it) to
adopted Landscape Guidelines standards. Please provide reference on
Alectryon Excelsus. I am unfamiliar with its cultivation.
ISSUES OF CONCERN (CONTINUED):
ENGINEERING:
1. You are proposing parking stalls on 7% ramps City standards only allow
parking on a 5% cross fai I....this would require a standards variance. You will
need to provide additional information to try and justify a standards variance.
Provide any other local agency standards which may allow parking on 7% cross-
falls that we can visit and review how they work.
2. Need to provide a truck loading area (8 ft. x 40 ft. min.) and provide truck access
and circulation to and from the loading area (use Caltrans 407E - 42 ft. radius-
truck turning template.
3. Need to provide vehicular turn arounds at the gated/control booth entry and at
the end of the 2nd level underground parking lot
4. All parking spaces adjacent to walls need to be an additional 5 feet wider.
5. The project will require a sump pump drainage system for the underground
parking lots.
6. The project will be required to participate in the construction of the Master
Drainage Plan Facility AA-2 (48" RCP storm drain down Laguna Dr).
7. You will need to obtain an approved site (grading plan and permit) for the
placement of the excavated material from your underground parking lots.
8. Your site lacks an adequate construction staging area. You will need to provide
for this.
9. You will need to have S.D.G.&E. quitclaim the existing easement
10. You will need to process an adjustment plat to eliminate the existing property line
between the two parcels.
11. You will be required to dedicate a 20 ft. radius corner cut-off (property line) at
State Street and Laguna Drive.
12. The existing overhead utilities will need to be undergrounded.
13. Laguna Drive, along the project frontage has a vertical "hump" ...this will be
required to be graded out with the improvements of Laguna Drive.
