Dear Mr. Carson:
For your consideration, this letter outlines the City of Carlsbad's position for completing the right-of-
way acquisition for the Streetscape Phase V Road Widening Project. We would like to process the
dedication along your frontage as soon as possible.
If you proceed with the AM/PM project before the City of Carlsbad installs the improvements along
Carlsbad Village Drive, you will be required to dedicate the required right-of-way and you wili be
required to install the improvements along your frontage as required by the Conditions of Approval
for your project. We will, however, enter into a reimbursement agreement with you for the cost of
the streetscape related features. Upon completion and acceptance of the improvements by the City,
the City will reimburse you for the cost of the improvements. If the City proceeds with the
improvements before you build, then you will be required to dedicate the required right-of-way and
the City will install the improvements at our cost.
The construction schedule has not been determined at this time. We will keep you informed of our
schedule, however, as we develop more information and as key decisions are made.

TIMING OF REVENUES FROM ARCO GAS STATION & MINI MART PROJECT
On May 19, 1992 the Housing & Redevelopment Commission approved a major
Redevelopment Permit (91 -4) for an ARCO AM/PM gas station and mini mart. The project
was proposed to be located on the northeast corner of Harding and Carlsbad Village Drive
in the Village Redevelopment Area. This project is anticipated to generate significant
revenues for the General Fund and the Redevelopment Agency when completed. Each year
this project is delayed, the General Fund loses $42,000 in sales tax revenue and the
Redevelopment Agency loses $8,020 in t^x increment revenues.
One of the conditions included for this project is contributing to the delayed redevelopment
of this site. The condition relates to improvements to Carlsbad Village Drive and states that:
"Plans, specifications, and supporting documents for all public improvements shall be
prepared to the satisfaction of the City Engineer. Prior to issuance of building permits in
accordance with City Standards, the applicant shall install, or agree to install and secure with
appropriate security as provided by law, improvements shown on the site plan and the
following improvements:
A. Half street improvements along Carlsbad Village Drive and necessary traffic
signal modifications.
B. Alley improvements as shown on the site plan with striping to the satisfaction
of the City Engineer.
However, the Streetscape project is anticipated to begin in mid-late 1993 and will require
nine months of construction. This Redevelopment Agency funded project has anticipated
the costs to fund these improvements on Carlsbad Village Drive between 1-5 and the railroad
tracks.
The applicant has indicated that construction of the ARCO project is not anticipated to begin
until after the half street improvements are constructed as part of Streetscape Phase V.
Based on the potential revenue gain of $50,000 annually, I am suggesting that we review the
ARCO requirement to do the half street improvements and consider entering into an
agreement to reimburse them with Streetscape funds for the portion of the improvements
that are already Incorporated as part of Streetscape Phase V. It is my understanding that
we do not have a future improvement agreement with this property owner to do the half
street improvements and if the applicant opts not to build until after Streetscape is
completed, then they will not be obligated to pay for the improvements any ways. If the City
and the Agency are not negatively impacted financially and we could add $50,000 worth of
new revenues annually, why not?

HOUSING & REDEVELOPMENT COMMISSION RESOLUTION NUMBER 209
The Housing & Redevelopment Commission adopted Resolution 209 on June 2, 1992.
Resolution 209 approves Redevelopment Permit 91 -4, for the ARCO AM/PM Mini Mart and
Gas Station project in the Village Redevelopment Area. It appears that there is
contradictory language within this resolution.
Housing & Redevelopment Commission Resolution 209 accepted the Design Review
Board recommendation for approval of the project based on the findings and conditions
contained within Design Review Board Resolution 179 and 180, and approved
Redevelopment Permit 91-4. However, item four of the resolution also states that "This
action of denial is final the date this resolution is adopted by the City Council." It looks
like this language is contradictory to the rest of the resolution because item four indicates
denial of the project even though the Housing & Redevelopment Commission took action
on May 19, 1992 to approve the redevelopment permit.
Please review Housing & Redevelopment Commission Resolution 209 and let me know

Congratulations! The major Redevelopment Permit for the ARCO AM/PM Gas Station and
Mini Mart has been approved by the Housing & Redevelopment Commission.
The Carlsbad Design Review Board adopted Resolutions 179 and 180, on April 1, 1992
and recommended approval of RP 91-4 to the Housing & Redevelopment Commission.
The City of Carlsbad, Housing & Redevelopment Commission held a public hearing on
May 19, 1992 approving Resolutions 179 and 180 and directed the City Attorney to
prepare the required documents. At a subsequent meeting of the Housing &
Redevelopment Commission on June 2,1992, Resolution 209 was adopted and officially
approved RP 91 -4. A copy of Resolution 209 is attached for your reference.
The conditions for approval are in effect for a period of one year. Building Permits should
be obtained prior to June 2,1993 or a request for an extension must be approved. If you

The referenced project will be located on the northeast comer of Carlsbad Village Drive
(CVD) and Harding Street and will replace the existing Gasco Service Station. Some traffic
issues regarding this site have been raised which I will attempt to clarify.
The project has the concurrence and approval of the Engineering Department. Several
design features associated with the Arco AM/PM project will provide overall traffic safety
benefits to the general public and reduce traffic impacts.
One such feature would be the removal of an existing driveway on Carlsbad Village Drive
that serves the Gasco Service Station. Traffic conflicts are minimized on Carlsbad Village
Drive by having only one point of ingress/egress to the proposed site. Additional access
to the site will be possible from the alley located on the easterly side of the new station
and which serves other businesses and residents. Alley ingress and egress will be enhanced
by the proposed project by widening the alley from 20 feet to 30 feet in width and by
installing additional signing and striping in the alley.
Phase V of the Streetscape Project, tentatively scheduled for construction in 1993, will
construct a mediaii^ in Carlsbad Village Drive. This median will be in the road segment
fronting the proposed project. As a result, the one driveway that will serve the site that
is located on CVD will become a RIGHT-IN/RIGHT-OUT only driveway.
To facilitate design features of the Streetscape Project and to permit "U-Tums" on Carlsbad
Village Drive at Harding Street, this project will be required to dedicate six feet along the
project frontage for road widening purposes. Westbound vehicles will negotiate a U-tum
at Harding Street to retum to the Interstate 5 on-ramps. However, vehicles with long
wheelbases such as tractor/trailer combinations, motorhomes, etc. will not be able to
complete the "U-tum."
The proposed raised median in Carlsbad Village Drive has been discussed and approved by
the City Coimcil several years ago. Impacts to businesses along CVD were considered in
the discussion but safety features associated with the median were very important. To

minimize impacts to businesses between Harding Street and 1-5, a left-tum only median
opening will be implemented at the Poinsettia Plaza (Big Bear) driveway. The design of
the median opening will not permit vehicles to proceed from one side of CVD to the other.
The median was proposed and approved to help reduce the high number of collisions that
have occurred in this road segment during the past.
Carlsbad Village Drive is a four-lane secondary arterial and has sufficient capacity to
accommodate traffic volumes generated by the proposed project. In addition, the
intersection of CVD/Harding is operating at an acceptable level of service. However, traffic
voltmies at this intersection are large at certain times of the day. These volumes will be
reduced when a traffic signal is installed on Carlsbad Village Drive at the Jefferson Street
intersection during Streetscape Phase V construction. Drivers accustomed to using Harding
Street will begin using Jefferson Street to access Carlsbad Village Drive. Because of this
futtire traffic signal it is not proposed to install left-tum phasing for Harding Street traffic
tuming to Carlsbad Village Drive.

The staff report should indicate the following resolutions to issues cited in your memo of
April 3, 1992.
1. Projected volumes and tuming movements at buildout show an acceptable
level of service for Harding and Carlsbad Village Drive.
2. The alley entrance is being widened from 20 feet to 30 feet by this project.
This will provide additional room for maneuvering near the alley entrance
at Carlsbad Village Drive. The 30 foot wide entrance will allow tanker
tmnk access to the station. This widened alley allows one access to be
eliminated on Carlsbad Village Drive. Another access on Harding is being
moved further away from the intersection.
3. Make no comment in the report, since this issue is not specific to the project.
4. The issue stated here is the existing condition and will remain the condition
until the trafflc signal at Jefferson street and Carlsbad Village Drive is
constmcted in conjunction with Streetscape Phase V. With the proposed
project, the Harding Street access is being moved further north away from
the intersection. Therefore, building of this project will provide some
possible mitigation for the condition.

REVISED ECONOMIC IMPACT INFORMATION FROM ARCO
Revised economic information about annual sales and the cost of proposed improvements has
recently become available from Desert Petroleum, the applicant for RP 91 -4, ARCO AM/PM Gas
Station and Mini Mart. The result is an increase in the tax increment revenues and a significant
increase in the amount of sales tax revenues that would be generated by this project.
The revised figures were not available prior to development of the staff report or the Design
Review Board Meeting of April 1,1992. The most recent figures have been incorporated into the
agenda bill for the Housing & Redevelopment Commission meeting.
The applicant has increased the estimate for the improvements to the site by $150,000. In
addition, 1 % of the total annual sales is the amount the City would receive as a result of sales
taxes. However, the previous revenue estimate was reported as 1 % of 1 % of the total annual
sales figure, instead of 1 % of the total annual sales.
The following is a summary of the differences between what was initially reported and the new
updated figures.

We are trying to get the ARCO project scheduled for either the
April 21 or April 28 Housing and Redevelopment Commission
meeting.
Some of the issues raised at the meeting by the surrounding
service station owners and later by the Shell Station owner are:
1. A claim has been made that ARCO will generate 4-5 times as
much traffic as the existing GASCO station. This additional
traffic will create gridlock on Carlsbad Village Drive. The
example cited was the ARCO station in Rancho Bernardo.
2. Traffic flow through the alley will be severely impacted by
traffic entering and exiting the ARCO station.
3. The median to be constructed on Carlsbad Village Drive will
create a hardship for the other service stations and necessitate
that all traffic be routed west to Harding Street to access the
freeway.
4. Harding Street will be impacted by traffic exiting the
driveway on Harding Street. Cars turning left from Carlsbad
Village Drive onto Harding Street (heading north) will be unable
to enter the Unocal driveway on Harding due to the additional
traffic.
Karen Sauer from Redevelopment was also at the DRB meeting and
will provide you with a list of traffic concerns.

ECONOMIC IMPACT FOR ARCO STAFF REPORT
Thank you for the opportunity to provide the economic impact information for the staff report on
the ARCO Redevelopment project that will be going to the Design Review Board in April.
I would suggest that the economic impact section say:
ECONOMIC IMPACT:
The positive economic impact of the proposed ARCO project is tremendous for the City
and the Redeveiopment Agency. The City General Fund would receive approximately
$4,200 annually and the Redevelopment Agency would receive approximately $6,520 in
annual revenue.
The Redevelopment Agency revenues are based on one percent of the increase in total
assessed value of property (land plus improvements) in the form of tax increment
revenues from any project located within the Village Redevelopment Area. The proposed
ARCO redevelopment project would Increase the assessed value by approximately
$500,000 and would result in a total assessed value of approximately $652,037.
Therefore, the annual tax increment revenues that could be realized by the
Redevelopment Agency would be approximately $6.520 annually.
The City receives one percent of the annual sales generated from taxable sales from local
businesses. This project is anticipated to generate sales of about $420,000 and would
result in new sales tax revenues of approximately $4.200 annually for the General Fund.
In addition, the proposed ARCO project wouid result in the creation of approximately
fifteen jobs within the Village Redevelopment Area. Therefore, the Redevelopment Agency
supports RP 91 -3 based on the significant potential for positive economic enhancement
and the employment benefits that this proposed project would generate.

green "soft" look with semi-tropical foilage (small palms and agapanthus for foliage and
color, etc.).
As you are aware, this is a very visible site in the redevelopment area and landscaping is

schedule the project for public hearing.

This is to inform you that your submittal responding to the issues detailed in the
correspondence dated October 22, 1991, for your Redevelopment Permit, application no.
RP 91-4, have been received and reviewed by the Plannmg Department. Please note that
although the application was considered complete on October 22, 1991, the following
Planning issues remain:
1. A conceptual landscape plan reflecting the increased planter areas and including
mounding and vertical landscaping to break up building planes and screen parking
area must be submitted and agreed upon prior to scheduling this project for public
hearing.
2. Specify on the plans that the existing stmctures (1-stoiy brick building and 6" curb
w/2.5' high guard rail are to be removed. Also specify as Constmction Note #13
that existing tanks are to be removed and state the regulations involved.
3. Correct the monument sign detail to show a maximum height of 6' per Chapter
21.41.074 of the Sign Ordinance (attached).
4. The proposed parapet appears to be 4'8" above the roof line. Please verify on the
architectural plans that this is sufficient height to entirely screen the mechanical
units fi-om surrounding areas.
5. Please revise and retum the enclosed color sample board deleting the Gasoline
Canopy section.
These issues must be resolved prior to scheduling for a public hearing. In addition, the
City may request, in the course of processing the application, that you clarify, amplify,
correct, or otherwise supplement the information required for this application.

In response to your inquiry of the
District has reviewed subject project and has the following
comments:
1. The entire potable and non-potable water systems for subject
project shall be evaluated in detail to insure that adequate
capacity and pressure for domestic, non-potable and fire
flow demands are met.
2. The Developer's Engineer shall schedule a meeting first with
the City Fire Marshal and then with the District Engineer to
review the preliminary water system layout prior to
preparation of the water system improvement plans.
3. The Developer will be responsible for all fees and deposits
plus the major facility charge which will be collected at
time of issuance of building permit.

ISSUES OF CONCERN
PLANNING:
1. Increase the depth of the proposed recessed elements along the front building
elevation to 6" and indicate on the plan. Propose trellised vines in these recessed
areas on the landscape plan to enhance this architectural feature.
2. Enhance the west elevation by proposing a more detailed window treatment.
Provide interest on the north and east elevations by proposing additional
vertical/horizontal architectural elements such as scoring and/or reveals. The
landscaped planters proposed along the northem property lines on each side of the
stmcture should include vertical landscaping and mounding to break up the building
planes. Replace the rear portion of the walk proposed along the westem side of the
stmcture with landscaping.
3. Propose a 3' wide X 3' high masonry planter along the front elevation on each side
of the door and window section of the building. The planters may provide
additional opportunity for colored tiles.
4. Replace the canopy exterior with a metal finish to match the metal roof proposed
for the stmcture. (See Item 7a.).
5. Reduce the 4 parking spaces proposed on the west side of the stmcture to 8.5' wide
and add 2' to the planter proposed along the westem property line.
6. Specify on the plans that existing stmctures or other features are "to be removed".
7. Signage: Submit a sign program detailing the sign types (i.e. wall, monument),
type of lettering, location, area, and materials of each sign. The sign program does
not have to indicate the exact sign copy. Do not propose plastic canned signage.
a. Remove the spandrel between canopy columns and the am/pm colors on the
canopy fascia; signage is limited to the monument sign and building frontage.
b. As previously stated, one freestanding "monument" sign may be permitted for
this site; the proposed 27' 9 1/2" pole sign is unacceptable. The monument
sign should be consistent with the architectural style proposed for the
stmcture. This sign cannot interfere with sight distance at this comer.
8. As previously requested, provide Arco's estimates of ADT (Average Daily Traffic)
broken down by each of the proposed uses: 1) Gas station; 2) Mini-mart. This
proposal constitutes an intensification of use; therefore, this information must be
provided and specified on the site plan.

1. Review of the resubmitted site plan has revealed that a standard 24' wide alley
approach would allow tanker tmck access to work if a portion of the island was made
mountable. Mountable could mean a rolled curb for that portion needed with paving. If
this direction is followed, less dedication for public right of way would be required and
more landscaping could be added. This would also require less valley ribbon gutter to be
relocated, and the striped median could be eliminated. If this direction conflicts with your
project needs, please provide us with a written justiflcation.
Also attached is a redlined check print of the site plan for corrections and changes as noted.
Please retum the redlined print with the corrected site plan to assist us in our continued
review.

PROPOSED ARCO AM/PM MINI MART ON ELM AVE AT HARDING STREET
Thank you for sending the application information regarding the
proposed Arco am/pm Mini Mart to the Housing & Redevelopment
Department. As requested, the plans for this project (in the
Village Redevelopment Area) have been reviewed. Our comments on
this project are as follows:
1. BENEFITS; We are supportive of the concept and believe the
project would improve the property value, increase sales
taxes for food and gas, increase the number of jobs, as well
as improve the appearance of this high profile site in the
Village Redevelopment Area.
2. LANDSCAPING; We are concerned about the landscaping plan
that indicates no improvements would be made to existing
landscaping near Elm Avenue, immediately south of the gas
islands and near Harding Street, next to the sidewalk. The
existing landscaping leaves much to be desired. We would
like to see the landscaping expanded and enhanced in future
landscaping plans for the Arco am/pm Mini Mart project.
We appreciate the opportunity to provide comments on projects
that are proposed in the Village Redevelopment Area. Please add
the Housing & Redevelopment Department to the Review & Comment
Memo. It may be useful for other departments to know that this
department will also be reviewing the proposed project.

STREETSCAPE PHASE V, PROJECT NO. 3347
A staff meeting of August 28th was called to discuss ways to facilitate the right-of-way acquisition
for the Gasco and Carl's Jr. properties which are required for Streetscape, Phase V. Both
property owners have pending development permit applications and have indicated an
unwillingness to consider voluntarily granting the required right-of-way until the City determines
its requirements for driveway access to the street and alley on Eim Avenue.
The attached conceptual plan was produced by Municipal Projects to summarize and illustrate
the preferred locations ofthe driveway entrances onto Elm Avenue as expressed by Engineering.
The plan shows Gasco's existing easterly driveway approach as closed. The existing Cari's Jr.
driveway approach is relocated next to the alley and the side access to the alley is also closed.
Please let us know if the plan correctly reflects your comments from the meeting and
Engineering's position with respect to both applications.
If the City's position is going to be that the property owners will not be able to keep their existing
driveway locations, it is unlikely we will be able to obtain a voluntary, no-cost, and timely right-of-
way dedication from either property owner. Both applicants have recently resubmitted their site
plans, and Land Use Review should inform them exactly what the City will require for street
access and site circulation. At that point, we will know whether the City has any hope of a
voluntary dedication or whether we will have to proceed with the appraisal and condemnation
process.
Municipal Projects has obtained all other required right-of-way dedications, voluntarily and at no
cost to the City, for the upcoming Streetscape, Phase V project. These two (2) remaining
acquisitions, Gasco and Carl's Jr., are also required for Phase V. If we are forced to proceed
to condemn the required right-of-way, we should be knowledgeable of the costs and additional
time required. It is very likely that the cost of appraising the property, making offers, lawyer's
fees to file and administer the condemnation action, staff time, etc., will exceed the value of the
right-of-way. Additionally, we should weigh the potential of withstanding a property owner's
appeal to dosing off existing driveways for commercial uses on Elm Avenue in which the City will
be installing, in Streetscape Phase V, a raised median on Elm Avenue preventing left turns into
and out of these two (2) businesses. Finally, I'm not sure that condemning privately owned
rights-of-way is consistent with either the intent or the spirit of the downtown Redevelopment
Streetscape projecL Maintaining existing driveways seems to be a small price to pay for
harmony with some downtown merchants considering the inconvenience we will be causing them
with the upcoming final phase of the Streetscape project.

Even if the City goes to the trouble of condemning the required rights-of-way to widen Elm
Avenue consistent with the approved Streetscape design, the attached driveway location plan
for Gasco and Cari's Jr. may still not happen. These two (2) property owners can afford to wait
us out. The driveways would be replaced in their present locations as a part of the Streetscape
construction with expensive brick pavers consistent with the established Streetscape materials
theme. It would then be likely that the owners of the Gasco and Cari's Jr.'s properties would
reinstate their applications with the goal of appealing the condition that they be forced to remove
newly installed and costly driveways. It is possible, perhaps probable, that Gasco and Cari's Jr.
would be successful in their appeal. If so, the City will have paid for the right-of-way, delayed
the Streetscape Phase V construction, and still not removed the driveways.
1 feel it is important that we ask these questions during our formulation of a City position with
respect to the Gasco and Carl's Jr. access issues. Gary Kellison, from this office, has been
dealing with both property owners for several months attempting to secure right-of-way
dedications and has been participating in the staff meetings on this subject. Please indicate to
Gary what the City's position will be concerning Gasco and Cari's Jr. Alternatively, perhaps
another meeting to discuss the larger policy implications would be appropriate.
