I reviewed your request for the City to waive the requirement for landscape plan approval
prior to the approval of grading plans for the Crean/Atkinson Hall with the Planning
Director.
Condition number 13 of Design Review Board Resolution Number 183 for the project
requires the approval of a detailed landscape and irrigation plan prior to the issuance of
a grading permit. The Planning Director is not able to grant your request to allow the
issuance of a grading permit prior to the approval of landscape and irrigation plans.
The timing ofthe approval of the landscape and irrigation plan is a standard requirement.

I am writing to inform you that the proposed new dormitory at Army
and Navy Academy will not impact the Academy's parking situation.
As a boarding school, Army and Navy Academy students live on campus
and are not allowed to have cars. No substantial increase in the
number of day students who may drive, or employees, is anticipated.
Currently our day student population is less than 5% of our 200
enrolled students. The new dormitory will, in fact, replace
existing structures. Therefore, no new parking plates are
necessitated by the planned construction.

REQUEST TO DEFER CYPRESS AVENUE IMPROVEMENTS (RP 92-04)
Your request to defer a portion of the public improvement requirements for the
construction of Crean Atkinson Hall was brought to my attention for consideration.
The requirement to improve Cypress Avenue adjacent to the project is a condition of
approval which was specifically discussed at the Design Review Board and the
Housing and Redevelopment Commission. Therefore, the matter requires formal
amendment of the project conditions of approval which must be approved by both the
Design Review Board and the Housing and Redevelopment Commission.
Given the level of information known at this time about the proposed master plan and
the need for pubiic access to the surrounding land uses, staff would not support a
request for vacation of the Cypress Avenue right-of-way between Ocean and Garfield
Streets. However, we understand the dilemma you face and are willing to consider a
six month extension of the Army/Navy's development improvement agreement to
allow your client additional time to prepare the Master Plan and street vacation
submittals. If during this time, staff is convinced to alter its current position on the
proposed vacation, we would then provide support to your request to defer the
improvements or eliminate them altogether.
As presently conditioned, the street improvements are not tied to the occupancy of
the new structure. Typically, the Engineering Department requires only that the
adjacent frontage improvements be in such a condition as to provide safe passage to
and around the project site and that the construction zone is secured against drainage
and erosion control problems. Delaying construction of the road improvements can,
therefore, be accommodated within the existing conditions of approval. With regards
to the undergrounding of the existing overhead utilities, this work may also be
delayed; however, regardless of the outcome of the street vacation request, the
undergrounding of the utility lines will be required. Utility service to the new structures
must still be provided underground pursuant to City ordinances prior to occupancy.

Dear Tom:
In order to resolve the remaining outstanding issues for the proposed dormitory and
schedule the project for a Design Review Board hearing the following revisions must be
made to the project exhibits and the requested information provided:
1) Technical Site Plan
A) One of the proposed walls in the clear sight triangle for Cypress Avenue and
Ocean Street exceeds the maximum 30 inch height limit. Please revise to
comply with City Code.
B) The maximimi combined allowable total height of all walls within the 15 foot
street setbacks is 6 feet. The plan shows a total combined wall height of 7
feet. Please reduce the total combined wall height by one foot.
C) The legend on this exhibit lists a total of 129 parking spaces. The Existing
Campus Plan submitted shows 95 parking spaces. Please revise the exhibits
so that they do not contain conflicting information.
2) Illustrative Site Plan
A) Revise the structure location to match its location on the Technical Site Plan.
Specifically the 15 setbacks must be complied with.
B) Revise the tree legend on the exhibit to read as follows:

C) Replace the existing tree symbols on the plan with symbols which better
represent the new species noted above which will be utilized.
D) Delete from the plans the eastem most tree proposed on the north side of
Cypress Avenue south of the dormitory building. This area can only
accommodate three trees.
3) Exterior Elevations
A) On the west elevation show the proposed tree adjacent to Ocean Street.
B) On the south elevation delete the eastem most tree and show the proposed
tree on the west side of the building adjacent to Ocean Street.
C) Please revise the south and east building elevations to accurately show how
the pitched roof elements will appear as they are located closer to the
opposite sides of the building as viewed from these two elevations. Please
refer to the west elevation and the roof composite plan.
4) Roof Composite Plan
A) Delete "composition shingles" from the legend and replace it with "concrete
tile roof.
5) Count of Existing Faculty & Student Enrollment
It was previously agreed to that a letter would be submitted by the Academy
describing the total existing faculty at the school, maximimi number of faculty at the
school at one time, the total student enrollment, and the number of students that
drive to school. This information is needed to justify a parking standard which is
less than that specified in the Zoning Ordinance for High Schools.
6) Previous Buildings Containing Capacitv for 96 Beds
A letter was also to be provided by the Academy to indicate where the 96 bed
capacity being created is being transferred from as the buildings to be demolished
do not contain 96 beds. This letter is needed in order to aid in justifying a decision
to find the proposal categorically exempt from the Califomia Environmental Quality
Act.
7) BV2 X 11" Exhibits
Please provide 8V2" x 11" exhibit of the revised Technical Site Plan and
Bliilding Elevations.

above information must be received by Monday, April 20, 1992 or the scheduling of the

STREET VACATION AND DEDICATION
The Army-Navy Academy has requested a street vacation and a street dedication in order to realign
Cypress Avenue near the intersection with Ocean Street The existing alignment approximates the
requested alignment. This action, street vacation and dedication is being requested to correct the
record alignment of right of way and to allow reconstruction of buildings presentiy encroaching in
the record public right-of-way. A variance from street standard right-of-way width is also being
requested and will need to be approved before the street vacation in its present form can be
recommended for approval by the City Coimcil.
The action on the Variance is part of an overall Redevelopment Permit (RP 92-3) application. The
Design Review board will hold a public hearing on the overall project and approve or deny the
request for variance. The Housing and Redevelopment Commission will make a final determination
on the DRB recommendation also at a public hearing. The street vacation and dedication will be
heard by the City Council and summary action will be taken by the Council. Summary vacation
proceedings are being followed because the areas to be vacated have not been used by the public
in the last five years . An easement for existing public utilities will be reserved from the vacation.
Please reply by April 27, 1992 or your failure to reply will be interpreted to mean that you have
no issues, objections or conditions to apply to the vacation.

The area of concern to the Police Department with this plan is:
General building security.
General security for residents.
Plan review recommendations
Lighting- Aisles, passageways, and recesses related to and within
the building complex shall be illuminated with an intensity of at least
twenty-five one hundredths (.25) footcandles at the ground level during
the hours of darkness. Lighting devices shall be protected by weather and
vandalism-resistant covers.
Landscaping- The exterior landscaping should be kept at a
minimal height and fullness giving police, security services and the
general public surveillance capabilities of the area.
Residential Consideratlons-
A Crime Prevention measure which should be used throughout the
entire project would be the installation of high quality burglar resistant
hardware on doors and windows. The doors and windows should also be of
sufficient strength to resist break-ins.
Doors-It is recommended that dead-bolt locks be installed on all
access doors of any residential building.

Dead-bolts shall have a minimum protection of one inch and be
constructed so as to repel cutting tool attacks. The dead-bolt shall have
an embedment of at least three-fourths inch into the strike plate area.
Strike Plate and dead-bolt are to be installed with wood screws that are
three inches in length.
All entry and exit doors to dwelling units should be arranged so that the
occupant has a view of the area immediately outside the door without
opening the door. Except for doors requiring a fire protection rating which
prohibits them, such view may be provided by a door viewer having a field
of view of not less than 180 degrees. Mounting height shall not exceed
fifty-four inches from the door. It is not recommended to place glass
panels within in forty inches of a locking device..

37. Unless a standards variance has been issued, no variance from City Standards is
authorized by virtue of approval of this
38. The applicant shall comply with all the rules, regulations and design requirements
of the respective sewer and water agencies regarding services to the prpject.
39. The applicant shall be responsible for coordination with S.D.G.&E., Pacific Bell
Telephone, and Cable TV authorities.
65. Additional drainage easements may be required. Drainage stmctures shall be
provided or installed prior to the issuance of grading or building permit as may be
required by the City Engineer.
• The owner shall make an offer of dedication to the City for all public streets and
easements required by these conditions:
A. Cypress Avenue from the easterly line of Ocean Street to the easterly line of
Garfield Street shall have sufficient right of way dedicated for a right of way
width of 47 feet based on the proposed southerly right-of-way line as shown
on the site plan. This requires an offsite dedication on a portion of APN 203-
141-01.
B. Ocean Street along the westeriy-side from the northerly line of Cypress
Avenue to the project boundary as shown on the site plan shall have an
additional five feet of right of way dedicated based on a center line to right
of way distance of 25 feet.
The offer shall be made prior to issuance of any building permit for this project. All
land so offered shall be granted to the City free and clear of all liens and
encumbrances and without cost to the City. Streets that are already public are not
required to be rededicated.
72. Some improvements shown on the (TENTATPi/r ft'lAB/SITE PLAN) and/or required
by these conditions are located offsite on property which neither the City nor the
owner has sufficient title or interest to permit the improvements to be made vvdthout
acquisition of title or interest. The applicant shall conform to Section 20.16.095 of
the Carlsbad Municipal Code. This conditional approval is null and void if title to
said property is not obtained, unless the City Engineer and Plaiming Director make
findings of substantial confonnance without constmction of said improvements.

• The applicant shall underground all existing overhead utilities along the project
boimdary prior to issuance of building permits. The project boundaries shall be
lengthened or shortened as needed for feasibility of the project and installation of
public improvements.
• Prior to issuing a building permit a street vacation for portions of Cypress Avenue
(formerly known as Del Mar Ave.) must be processed through the Cit^approved by
the City Coimcil and recorded in the office of the County Recorder. In the event the
proposed street vacation is not granted this project approval shall be null and void.
76. Plans, specifications, and supporting documents for all public improvements shall
be prepared to the satisfaction of the City Engineer. Prior to issuance of building
permit in accordance with City Standards, the applicant shall install, or agree to
install and secure with appropriate security as provided by law, improvements
shown on the site plan and the following improvements:
A. Full public improvements on Cypress Avenu^ including curbs, gutters,
sidewalks and street lights as may be required from the easterly line of Ocean
Street to the easterly line of Garfield Street.
B. On Ocean Street along the easterly side from the northerly line of Cypress
Avenue to the project boundary as shown on the site plan, including curb,
gutter, sidewalk and street lights as required plus sufficient paving to match
existing and control drainage.

In response to your inquiry of MAyz^c^ SO j 2- the
District has reviewed subject project and the Carlsbad Municipal
Water District conditions for potable water, reclaimed water and
sewer systems are as follows:
1. The entire potable water system, reclaimed water system and
sewer system shall be evaluated in detail to insure that
adequate capacity, pressure and flow demands are met.
2. The Developer shall be responsible for all fees, deposits and
charges which will be collected at time of issuance of the
building permit. The San Diego County Water Authority
capacity charge will be collected at issuance of application
for meter installation.
3. Sequentially, the Developers Engineer shall do the following:
A. Meet with the City Fire Marshall and establish the fire
protection requirements.
B. Prepare a colored reclaimed water use area map and submit
to the Planning Department for processing and approval.

C. Schedule a meeting with the District Engineer for review,
comment and approval of the preliminary system layout
useage (G.P.M. - E.D.U.) plan for potable, reclaimed and
seWer systems prior to the preparation of improvement
plans.
This project is approved upon the expressed condition that
building permits will not be issued for development of the
subject property unless the water district serving the
development determines that adequate water service and sewer
facilities are available at the time of application for such
water service and sewer permits will continue to be available
until time of occupancy. This note shall be placed on the
final map.

Army and Navy Academy
On behalf of the Army and Navy Academy, we hereby request that
the City vacate Del Mar Avenue and a portion of Cypress Avenue, and
accept a dedication for roadway purposes for portions of Ocean
Street and Cypress Avenue. The proposed vacations and dedications
are shown specifically on the enclosed exhibits, which have been
prepared in accordance with city standards.
We are proposing a 40* right of way for Cypress Avenue between
Ocean Street and Garfield Street. We understand that this may
change as a result of Design Review Board action; however, at this
time we request that the City proceed with other aspects of this
request, such as soliciting comments from Utilities, Police, Fire
and Planning.

ARMY NAVY ACADEMY APPLICATION FOR CREAN/ATKINSON HALL (RP 92-
4/CDP 92-3)
Attached please find a copy of the letter forwarded to the
Community Development Director regarding processing of the
previous Master Site Plan and the Crean/Atkinson Hall (dormitory)
application for the Army Navy Academy. This letter was requested
by the Community Development Director as an indication that the
applicant understands that processing of the Master Site Plan
application may be delayed to provide "priority" processing for
the dormitory application.
The Housing and Redevelopment Department is supportive of the
Army Navy Academy's efforts to upgrade the campus through
renovation of existing buildings and/or new construction to
replace obsolete buildings. We have no problems with the
applications for redevelopment (92-4) and coastal development
(92-3) permits submitted by Musser & Cox Architects on February
21, 1992.

Gentlemen:
On behalf of the Army and Navy Academy, I hereby request that
a variance be granted for the dedication of Cypress Avenue as a 40'
right of way street between Garfield Street and Ocean Street. The
proposed street dedication/vacation is shown on the attached
exhibit.
We believe that this variance should be granted for the
following reasons:
1. The proposed extension of right of way is consistent with the
existing Cypress Avenue right of way width between Garfield
and Carlsbad Blvd.
2. The proposed right of way width is consistent with other local
streets within the area.
A 40' right of way is the maximum width that can be
accommodated without encroaching into the existing structure
at the southwesterly corner of Cypress and Garfield.
4. A 40' right of way will accommodate a 30' wide roadway section
with 5' parkways. A 30' road section will accommodate 2 lanes
of traffic with no on-street parking. If on-street parking is
required, it can be accommodated on the inland side of Ocean
Street north of Cypress when Ocean Street is improved to a 40'
road section within a 50' wide right of way.
5. The Academy desires that an ocean view corridor be maintained
from Carlsbad Blvd. between Atkinson and Crean Halls. If
Cypress is widened to a width greater than 40', the
dormitories would have to be shifted northerly, effectively
blocking the view corridor.
6. Dedication of this right of way will correct a longstanding
problem that has existed wherein the existing road crosses
private property.

Dear Marty:
This letter is submitted to you at your request to outline our
understanding of submittal particulars for the two Army and Navy
Academy projects submitted to Planning for Redevelopment Permit
review.
In conversations with Debbie Fountain at the City of Carlsbad
Housing & Redevelopment Department, we have learned that the
submittal of the Atkinson/Crean dormitory for Redevelopment
Permit may affect the processing for the already submitted Master
Site Plan for the campus. We understand that it is your position
that the processing of the Master Site Plan for the campus may be
delayed and that the processing of the dorm building may affect
some or all of the master site plan exhibits already submitted
for Major Redevelopment Permit.
Our understanding prior to submittal of these projects was that
they could be reviewed simultaneously, and due to the
circumstance that a potential donor has stepped up to provide
funding for phase 1 of the Master Site Plan development (the
dormitory building) we have submitted the two projects one after
the other, causing the processing of the two to overlap.
The application for the Army and Navy Academy Master Site Plan
was submitted to the City Planning Department on November 21,
1991 and we received notice on December 19, 1991 that the
application was "incomplete". We understand that we have six (6)
months from the date of application, or until April 21, 1992, to
either re-submit the application or submit the required
additional information before the application is deemed
"withdrawn" by the City. We do not wish to withdraw or have the
Master Site Plan application be deemed withdrawn by the City due
to expiration of the six (6) month period. Therefore, if

processing of the Master Site Plan must be placed on hold while
processing of the dormitory application proceeds, we request that
an extension to the 6 month time period for the Master Site Plan
application be granted by the Planning Department. We request an
extension equal to the amount of time it takes to approve the
dormitory application and/or remove the temporary "hold status"
on the Master Site Plan application.
It is our hope that the Master Site Plan processing continue with
no delay due to the dormitory submittal. However, if it is
necessary to process the items one at a time, the dormitory
submittal will take priority due to the limited window of
availability of funds being offered by the dorm's sponsor/donor.
