They confirmed that there is an existing 20-foot easement along the northerly property line. Therefore, that portion of the property is encumbered by a legal easement and should not be used for the project's expansion unless it is vacated. There is also the possibility that the easement may also be a part of the lease agreement with the Village Faire project. We do not have a copy of the lease agreement, but have been told that the same 20-foot easement may be a part of the agreement. Therefore, that lease agreement would also have to be amended before we would recommend the project going fon^^ard. The other concern that Engineering has is for the parking shown along Washington Street. NCTD is in the process of improving Washington Street, thereby changing the 90° parking shown to parallel parking and not having any available parking on Washington Street on the east side. Therefore, both Washington Street and the existing NCTD right-of-way that has been used for Ralph & Eddie's parking will no longer be available to them. ROBERT J. WOJCIK Principal Civil Engineer RJW:jb March 23, 1994 TO: PLANNING DEPARTMENT, TERRI WOODS FROM: REDEVELOPMENT DEPARTMENT, DEBBIE FOUNTAIN RE: CDP 94-3/RP 93-3, RALPH & EDDIE'S GARDEN PATIO Attached for your review is some recent correspondence forwarded to Ralph Bumette, Jr. and Bob Burke of Village Faire regarding the easement used for driveway purposes behind Ralph & Eddie's Cardroom. According to the Bumette's agreement with Village Faire (TIO-TIL, LTD.), there is a 20' easement mnning behind Ralph and Eddie's which must be maintained for driveway purposes. I can't tell from the plans for the garden patio whether or not the patio will block this access. If the patio does block the driveway, we need to note that in the report to DRB and indicate that the project would need to be redesigned to maintain the easement. In addition to maintenance of the easement, Redevelopment Department's only other comment would be related to the shortage of parking which you have already indicated would be the reason for denying the project. Exit doors shall swing in the direction of exit travel when serving an occupant load of 50 or more. Special Doors- Revolving, sliding and overhead doors shall not be used as required exits. Power-operated doors complying with UBC Standard No.33-1 may be used for exit purposes. Addditional Doors- When additional doors are provided for egress purposes, they shall conform to all the provisions of UBC chapter 33. See item 32 for specific requirements for your exit doors. Deficiency Item: 22 Exit Door Hardware Pending Exit doors shall be openable from the inside without the use of a key or any special knowledge or effort. Exception: In group B occupancies, key locking hardware may be used on the Main Exit when the main exit consists of a single door or pair of doors if there is a readily visible, durable sign on or adjacent to the door stating, "This door to remain unlocked during business hours." For State Fire Marshal, sign shall read, "This door to remain unlocked whenever the building is occupied." See item 32 for additional exit door hardware requirements. Deficiency Item: Pending 23 Panic Hardware In A.E and I occupancies doors serving an area with an occupant load of 50 or more shall not be provided with a lock or latch unless it is panic hardware. Panic hardware, when installed, shall comply with the requirements of UBC Std. No.33-4. When two or more exits from a story are required by Section 3303, exit signs shall be installed at stair enclosure doors, horizontal exits and other required exits from the story. When two or more exits are required from a room or area, exit signs shall be installed at the required exits from the room or area and where othenwise necessary to clearly indicate the direction of egress. EXCEPTIONS: 1. Main exterior exit doors which obviously and clearly are identifiable as exits need not be signed when approved by the building official. 2. Group R, Division 3, and individual units of Group R, Division 1 Occupancies. 3. Exits from rooms or areas with an occupant load of less than 50 when located within a Group I, Division 1.1,1.2 or 2 occupancy or a Group E, Division 3 day-care occupancy. Illumination: Signs shall be internally or externally illuminated by two electric lamps or shall be of an approved self-luminous type. Power Supply: Current supply to one of the lamps for exit signs shall be provided by the premises' wiring system. Power to the other lamp shall be from storage batteries or an on-site generator set. 26 Exit Illumination Deficiency Item: Pending Exits shall be illuminated at any time the building is occupied with light having intensity of not less than 1 footcandle at floor level. The power supply for exit illumination shall normally be provided by the premises'wiring system. In the event of its failure, illumination shall be automatically provided from an emergency system of Group I, Division 1 Occupancies and for all other occupancies where the exiting system serves an occupant load of 100 or more.
