Dear Ms. Fountain:
Thank you for your letter of December 15, 1995. I have
discussed the changes to Mr. Alvarez's flower stand which we
propose to make with Pat Kelly of the Building Department.
Essentially what we will be constructing is a removable shade
screen to protect Mr. Alvarez's flowers during the day. The semi-
permanent shade screen which is presently in place will be removed.
I am advised that there will not be a need for a Building Permit to
install the improvements contemplated.
I will advise Mr. Alvarez of the February 16, 1996 expiration
of his Minor Redevelopment Permit. I am sure Mr. Alvarez will make
every effort to complete the work by then.

Dear Mr. MacGum:
As the representative for Mr. Silvino Alvarez, please accept this letter as a reminder notice
that the minor redevelopment permit approved for the Alvarez Flower Stand located at 2815
Jefferson Street will expire on February 16, 1996 if applicable building permits are not
issued for the project, or formal approval is not received from the City's Building Official,
by that date. If the redevelopment permit expires, the Alvarez Flower Stand will be required
to completely cease operations until a new redevelopment permit can be issued and the
appropriate building permits are obtained.
As of this date, Mr. Alvarez has approximately two months to complete the building permit
approval process before his redevelopment permit expires. It is my understanding that a
building permit has not yet been approved by the City's Building Department. I "encourage
you to complete the building permit process and meet all other conditions of the
redevelopment permit as soon as possible in order to prevent any action against Mr. Alvarez
which may result in the closure of his flower stand.
Again, this is a reminder notice. If you have any comments or questions regarding this
matter, please contact my office at 434-2935.

As you requested, attached is a copy of the correspondence I forwarded to Mr. Macgum on
October 26, 1994 regarding the redevelopment permit required for the flower stand operated
by his client, Silvino Alvarez. This is the correspondence he noted in his letter of November
28, 1994.
Just for background information, I thought it might be helpful to fill you in on what has
happened with Mr. Macgum and his client to date. The actions to date are briefly highlighted
below and copies of various letters are attached.
1. Property owner, S.I Financial Corporation, of 2815 Jefferson received notice from
Code Enforcement related to various violations of the Carlsbad Municipal Code.
Letter from Pat Kelley on December 28, 1993 indicated that a Redevelopment Permit
was required.
2. Redevelopment received a business license application for the flower stand and spoke
with Pat Kelley regarding code enforcement violations. Redevelopment forward the
property owners, SI Financial Corporation, correspondence date December 28, 1993.
This letter outlined the issues related to Redevelopment and the process for obtaining
the required redevelopment permit.
3. In response to the letter from Redevelopment, the property owner indicated, via a
telephone conversation with me, that the flower stand owner, Mr. Silvino, would be
processing the required redevelopment permit. I told the property owner that it was
OK for Mr. Alvarez to file the application.
4. On Febmary, 8, 1994, Mr. Richard MacGum contacted me, via telephone, and stated
that he would be assisting Mr. Alvarez to obtain the required redevelopment permit.
He asked that I work with him directly because Mr. Alvarez does not speak English. I
agreed to work with him. I also indicated that the property owner would ultimately
still be held fully responsible for the use on the property until the permit is issued. I
faxed him a copy of the letter I had forwarded to the property owner on December
28, 1993.
As of March 30, 1994, the application for the redevelopment permit had not been
submitted to the City. Since staff wanted to stay on top of this matter (to the extent
possible), another letter was forwarded to the property owner on March 30, 1994
stating that they had fifteen (15) days to submit their application before further action
would be taken against them. A copy of this letter was faxed to Mr. Macgum on this
same day.
6. Mr. Macgum responded on April 7, 1994 indicating that "due to recent case load
demands", he was not able to respond promptly to the City's request to complete and
submit the required redevelopment permit application. Mr. Macgum stated that the
application would be submitted by the end of April, 1994. Staff felt this was
acceptable so no further action was taken.
7. On June 1, 1994, the application for the redevelopment permit was finally submitted
to the Planning Department by Mr. Macgum. On July 6, 1994, the applicant received
written correspondence from the Planning Department (Elaine Blackbum is the
Planner) that the application was incomplete.
8. After receiving a call from Pat Kelley to find out the status on the redevelopment
permit for the subject flower stand and prior to forwarding my letter of October 26,
1994 to Mr. Macgum, I contacted Elaine Blackbum to find out the status on the
application. Elaine indicated that she had not heard anything from Mr. Macgum since
she sent her letter on July 6, 1994. So, I sent the letter dated October 26th to Mr.
Macgum to remind him about the obligation to submit the application in a timely
fashion.
9. On November 7, 1994, Mr. Macgum sent a letter to Elaine (and a copy to me)
reminding her that he had spoken to her on September 2, 1994 and said he would
have the application in within the six month period allowed by law; deadline was
December 8, 1994.
10. I did not receive any correspondence directly from Mr. Macgum regarding my letter
to him of October 26th. The next correspondence I received was the "nasty" letter of
November 28, 1994. I immediately contacted Mr. Macgum upon receipt of his letter
on December 5, 1994. I explained that I had not ever been in contact with his client.
I also told him that just because the law allowed him six (6) months to complete his
application after submittal does not mean that the Redevelopment Agency was
required to allow Mr. Alvarez to continue to operate his flower stand while the permit
was being processed. I explained that in a spirit of cooperation, the City and Agency
were allowing Mr. Alvarez to continue his operations during the processing with the
understanding that Mr. Macgum would process the application in a timely fashion.

Dear Ms. Fountain:
This is a follow-up to our telephone conversation yesterday
and my letter of November 28, 1994. Thank you for your telephone
call. I appreciate you advising me that you did not make the
remarks to my client which were reported to me and addressed in my
letter of November 28, 1994. My clients were not aware of the
person's name who made those comments to them and believed that the
woman was from Housing and Redevelopment. I am still concerned
about the city employee who did make those remarks to my client.
You said you would investigate to see if you could find out who it
was that spoke to Mr. Alvarez.
As I indicated to you I met with Elaine Blackburn and Ken Quan
on Tuesday, November 29, 1994 and reviewed our application and
plans. On December 1, 1994, we submitted all the requested
documents and information to Elaine Blackburn. My paralegal spoke
to Ms. Blackburn today and she said that she was confident that our
application was complete although she had not had an opportunity to
review it. I believe that we are on our way to receiving approval
of our application for a Housing and Redevelopment Permit. Thank
you for your courtesy and cooperation.

On December 5, 1994, I received a letter from Mr. Richard Macgum, who represents Mr.
Silvino Alvarez, regarding the flowerstand at 2815 Jefferson Street. The letter indicated that I
was "hostile and mde" to his client due to the fact that a complete application has not been
submitted for a redevelopment permit. He considered my letter of October 26, 1994 to be
"mde and hostile" and that I was trying to intimidate his client through a site visit last week.
Attached is a copy of the letter.
I contacted Mr. Macgum on December 5, 1994 after receiving the letter. I told him that I
have never contacted his client on or off the site. I indicated that my correspondence has
always been directly with him or the property owners. I explained the reason for my letter of
October 26, 1994. I told him that it has been almost one year since the property owners were
contacted and told to obtain a redevelopment permit for the flowerstand. I further explained
that because Elaine Blackbum had indicated that she had not received correspondence since
July, 1994 that from our perspective the applicant was not making a good faith effort to
obtain the permit which is why the letter was forwarded to him. I apologized for the letter
seeming mde but I told him that I had to be stem because of the amount of time that had
elapsed. He said he had sent correspondence to Elaine Blackbum in September, 1994.
Unfortunately, Elaine did not indicate to me that she had received any correspondence in
September.
I also told Mr. Macgum that I had not made a visit to the site to discuss the permit with Mr.
Alvarez. He said that his client told him that I did and that he apologizes for the letter if it
was not me. He indicated that he would send a letter apologizing for the November 28, 1994
letter accusing me of being mde and hostile. He stated that communications are somewhat
strained between him and his client due to the language problems.
I contacted Elaine Blackbum and asked her about the status on the project. She said that Mr.
Macgum resubmitted the missing application materials on December 1, 1994. Although she
has not had the opportunity to completely the review the information submitted, she believes
that the application will probably be complete this time. I asked her if she had visited the site
recently. She said "no". She said that about a week ago the daughter of Mr. Alvarez came to
the Community Development Counter concemed about the letter Elaine had sent to her father
but that she (Elaine) has not visited the site since the application was first submitted. I asked
if Mr. Alvarez's daughter was angry. Elaine said "no" just concemed because they had been

paying Mr. Macgum to process the permit and were concemed that the application was still
not complete. Elaine said she told Mr. Alvarez's daughter to contact Mr. Macgum to find
out what was going on because she (Elaine) did not know; this was before Mr. Macgum
submitted the additional materials to Planning on December 1st.
I apologized to Mr. Macgum for any communication problems between Elaine and myself
that resulted in a misservice to his client. I told him that this permit needs to get processed
and that I will work with Elaine to make sure that it gets processed as quickly as possible
from this point on.

Dear Ms. Fountain:
This is in response to your letter of October 26, 1994 and
your recent visit to my client's flower stand. I previously chose
to ignore the hostile and rude tone of your letter, however your
comments to my client during your visit to his stand necessitate a
reply.
When I was retained in this matter I arranged to meet with you
on April 25, 1994 to discuss the City's requirements. Although you
were cordial you seemed to have a very negative attitude towards
Mr. Alvarez's desire to conduct his business within the
Redevelopment District. I advised you that we fully intended to
comply with the city ordinances and looked forward to receiving the
cooperation of the City Planning Department and the Housing and
Redevelopment Department.
On June 8, 1994, we submitted our plans in considerable
detail. I personally delivered the application to the City
Planning Department with a cover letter and a business card. I
advised the Planning Department if there was additional information
they needed, to please contact me. Additionally, all of the maps
that we prepared had my name and address on them. Unfortunately,
the forms provided by the City do not provide a place for the name
of the applicant's representative. Mr. Holzmiller's response to
our application was dated July 6, 1994. However, since the
response was directed to my client (who does not read or speak
English), I was unaware of the request for additional information
until August 24, 1994. Since that time we have been diligent in
preparing the additional documentation requested. I currently have
a meeting scheduled with Elaine Blackburn for December 1, 1994 to
review what we have prepared to be certain that we comply with the
city's request.
Although Elaine Blackburn wrote to me on October 26, 1994,
which I received on November 2, 1994, you also wrote me on
October 26, 1994, which I received on November 3, 1994. The
difference between the two letters is that your letter is rude and

hostile. I am aware of what the time limits were within which to
submit the completed documentation. I am sure you will agree that
the documentation required is considerable.
Although prior to submitting the application I was assured
(and common sense would dictate) that an Environmental Impact
Assessment Form - Part 1 was not necessary, now one is being
required. Although the nature of this project is certainly one
that should not require many of the things needed for the large
commercial projects, it seems that we are being treated as if we
were constructing an office building, instead of operating a flower
stand.
The complexity of the application process for a redevelopment
permit does not trouble me as much as your comments to my client.
I am advised that you indicated to him that I was rude, presumably
to you. You also indicated that you had a generally negative
opinion of lawyers. If the comments are properly attributable to
you, I suggest they are inaccurate, inappropriate and
unprofessional. I also suggest that your letter and visit was
designed to intimidate my client. Mr. Alvarez has a right to live
and work in this city like all the other citizens of Carlsbad. I
believe the City of Carlsbad has an excellent reputation for
treating its citizens fairly. I am very concerned about your
behavior and am copying this letter to Mr. Michael Holzmiller,
Mr. Martin Orenyak, and Mr. Ronald Ball so they will be aware of
the situation. If you continue to be rude and hostile or make
additional efforts to intimidate my client during the application
process, I will file a formal complaint against you.

Thank you for your correspondence of October 26, 1994 and for
reaffirming the December 8, 1994 deadline for submission of the
remaining information required to complete Mr. Alvarez' application
for a Redevelopment Permit. The day after I received your letter,
I also received correspondence from Debbie Fountain regarding this
same matter.
In reference to both letters, please note that, in
correspondence to you of September 2, 1994, I confirmed Mr.
Alvarez' receipt of the two lists prepared by Mr. Holzmiller which
indicated the items necessary to complete the flowerstand
application. At that time, I stated Mr. Alvarez' intent to
complete his application within the six month deadline established
by Mr. Holzmiller.
I agree that there is still adequate time to submit the
information necessary to complete Mr. Alvarez' project application
within the December 8, 1994 deadline. It remains my client's
intention to submit to you a completed application on or before
that date.
As previously requested, keep me apprised of all communication
made to Mr. Alvarez regarding this matter. Please remember, Mr.
Alvarez reads and speaks only Spanish. Although I prepared and
submitted the Application for a Redevelopment Permit, the City's
initial response was sent to Mr. Alvarez and not to me, which has
delayed our response.
If you have any questions or require additional information,
please do not hesitate to contact me.

Dear Mr. MacGum:
Since December 28, 1993, the Carlsbad Village Redevelopment Agency has been requesting that
your client, Mr. S. Alvarez, obtain a redevelopment permit for the flower stand he has installed
on property located at 2815 Jefferson Street in Carlsbad, Califomia. As previously stated, the
flower stand has not been approved and, therefore, should not be in operation on the noted site.
The Redevelopment Agency has permitted the operation to continue with the specific
understanding that every effort must be made to obtain a redevelopment permit as soon as
possible. As of this date, a completed redevelopment permit application has not yet been
submitted to the City's Planning Department for the flower stand and, per the project planner,
the last correspondence made was on July 6, 1994. At this time, it no longer appears that you,
or your client, are making a good faith effort to process the required application for this permit.
The Redevelopment Agency believes that Mr. Alvarez has been given more than reasonable time
to obtain the required permit for his flower stand. If immediate action is not taken to submit a
complete application to the Planning Department, the Redevelopment Agency will request that
code enforcement action be initiated and that operation of the flower stand be immediately
terminated. If you have any questions regarding the information that must be submitted to
complete your application, please contact the project planner, Elaine Blackbum, at (619) 434-
4471.
Your inmaediate attention to this matter is required to prevent further legal action against Mr.

5 blueprint copies of the Proposed Site Plan and 5 blueprint copies
of the Elevation/Floor Plan showing Construction Materials,
Photographs of the site (North, East, South, West views of
property) and a Property Profile submitted in support of Silvino
Alvarez's application for a Redevelopment Permit.
This project, as noted in the enclosed documents, is a small
flowerstand located just within the Redevelopment Area of Carlsbad.
The property is for sale by the owners, but an agreement has been
made which allows Mr. Alvarez to grow and sell his flowers there
until the close of escrow. I have met with Debbie Fountain
regarding the documents which the City requires to allow Mr.
Alvarez to continue operating his business on the subject site, and
every effort has been made to timely comply with those
requirements.

Dear Ms. Fountain:
Thank you for the copy of your March 30, 1994 correspondence
to S.I. Financial Group which was faxed to me by your office. Due
to recent case load demands, I was not able to respond as promptly
as I desired.
As you are aware, my client, Silvino Alvarez operates a flower
stand on the 2815 Jefferson Street property. He is very concerned
about the redevelopment permit issue which you addressed and is
anxious to rectify this situation promptly, as the flower stand is
his livelihood.
In good faith and in compliance with the Carlsbad Building
Department's request, Mr. Alvarez has had both electrical and water
meters installed on the property and off street parking has been
provided. A design for a more attractive structure is currently
being prepared and it is anticipated that, barring any unforeseen
difficulties, the permit application and checklist will be
completed within three weeks, or by the end of April.
Mr. Alvarez is doing his best to comply with the City's
requests and your continued courtesy and cooperation is
appreciated.

On December 28, 1993, the attached letter was forwarded to you regarding the current use of
your property located at 2815 Jefferson Street in Carlsbad, Califomia. As stated at that time,
the current use (flower stand) of the property has not been approved by the City of Carlsbad's
Redevelopment Agency. A redevelopment permit must be issued for the flower stand; the permit
should have been obtained prior to the initiation of the retail operation on the site.
To date, the City has not received a redevelopment permit application from you or the tenant
for the change in use of the property. In a spirit of cooperation, we have allowed three (3)
months to pass before contacting you again on this issue. We believe that we have given more
than reasonable time for you, as the property owner, or the tenant to submit the required
application(s) for permit(s). At this time, we are prepared to forward this matter to the City
Attomey's office for legal action. However, we are willing to give you a maximum of fifteen
(15) additional calendar days to submit an application before taking further action. Please submit
the required application with appropriate exhibits to the Community Development Counter no
later than April 15, 1994. Attached is a copy of the application and checklist for your use, or
use by the tenant, in preparing the required documentation.
As stated previously, the temporary-type stmcture currently located on the property is not
acceptable. A flower stand stmcture similar to those located on Carlsbad Boulevard is acceptable
if adequate on-site parking is also provided. Your immediate attention to this matter is required
to prevent further legal action. If you have any questions regarding this issue, please contact my

This letter has been forwarded to you to inform you that the current use of your property located
at 2815 Jefferson Street in Carlsbad, Califomia has not been approved by the City of Carlsbad.
Therefore, it is not allowed and will not be issued the required business license until you have
obtained all of the appropriate permits by the City. The existing flower stand requires a
redevelopment permit because it is located in the Village Redevelopment Area. This permit

A major redevelopment permit was approved for the subject property on April 7, 1992 for
constmction of a 8700 square foot two-story professional office building with subterranean
parking. No approval has been given for a retail business, such as the flower stand, on the
property. If you would like to receive approval to operate a retail business on the subject
property, you must submit an application for a redevelopment permit, with appropriate fees, to
the Community Development Counter at 2075 Las Palmas Drive in Carlsbad. Enclosed is an
application form and an information checklist. Also enclosed is a copy of the City of Carlsbad's
Facility Finder to assist you in locating the Community Development Office.
For information purposes, it will take a minimum of approximately 3 to 4 months to process an
application for a redevelopment permit. In addition, the permit will not be approved if
appropriate improvements are not made to the site, such as the constmction of a paved parking
lot and installation of adequate landscaping. The temporary stmcmre which is currently located
on the subject property is not acceptable. If you wish to continue the flower stand operations,
a more permanent-type stmcture will need to be constmcted on the site and on-site parking will
need to be provided. For examples of acceptable stmcmres, please see the flower stands located
at 2802 and 3136 Carlsbad Boulevard. The flower stand use requires one (1) parking space per
300 square feet of gross floor space witiiin the building/stmcture. The stmcture will also be
required to meet all applicable building code requirements.

Regarding: Flower sales on APN 203-110-29, 2815 Jefferson Street,Carlsbad,CA
This office has received complaints regarding the current use of the property identified
above. An inspection made on December 27, 1993 revealed the following violations
of the Carlsbad Municipal Code:
1. A Redeve[ppment Permit is required for buildings in this zone (VR).
2. A building permit is required for buildings which exceed 120 square feet
of roofed area.
3. Employees may be using the rear portion of the lot as a sanitary facility.
4. Extension cords run as a substitute for permanent wiring are prohibited.
5. A Business License is required for the new location of the business.
To remedy this situation in an informal manner please take the following actions:
1. Secure a redevelopment Permit from the Redevelopment Agency in
downtown Carlsbad. The address is 2965 Roosevelt Street, 434-2811.
2. Remove the portion of the roof covered with a tarpaulin to the extent the
structure does not exceed 120 square feet in roofed area.
3. Desist in using the field as a sanitary facility.
4. Secure a change of address for the business license for Alvarez Flowers
when all of the above is complete.
