11, 1995.
Mr. MacGum was forwarded a copy of the draft report on July 31, 1995. He was asked to
call if he had any questions or conmients. I have not been contacted by Mr. MacGum to
date. It is assumed that the project conditions were acceptable. Therefore, the report was
finalized and distributed with the agenda for the August 16, 1995 Design Review Board
meeting.

take action on the permit for Mr. Alvarez's flower stand on August 16, 1995 at 5:00pm in
the City Council Chambers located at 1200 Carisbad Village Drive.

Dear Ms. Fountain:
Thank you for your letter of May 24, 1995. Enclosed herewith
please find six blueline copies of the revised plans for the
Alvarez Flowerstand. As you can see from the plans, Mr. Alvarez
desires to maintain the flowerstand with its present dimensions.
You have indicated that you believe the stand will require a
building permit because the "building" includes the square footage
that is not enclosed, but rather is covered by shade screen
material. It is my understanding that you will condition your
recommendation of approval for the project with the requirement
that Mr. Alvarez comply with the building code.
I will contact Mr. Kelly and discuss with him the requirements
of the building code as it relates to this flowerstand.

Dear Mr. Macgum:
Thank you for your letter of May 18, 1995 regarding Mr. Silvino Alvarez's written waiver
of the time limit for a hearing before the Design Review Board on the subject application for
a minor redevelopment permit (94-04). Mr. Silvino's request for a thirty (30) day extension
of the Design Review Board hearing has been granted by the Housing and Redevelopment
Department. However, due to scheduling conflicts with other items to be heard by the Design
Review Board, the hearing on the flower stand application will not be held until July 19,
1995. As I requested previously, I still need to have the revised plans for the flower stand in
my office by the end of May, 1995.
Since I recently leamed that Mr. Silvino is unable to read and/or understand letters regarding
this matter written in English or Spanish, all written conespondence will now be forwarded
directiy to your attention as representative of the applicant. It is my assumption that you will
consult directly with your client, Mr. Alvarez, on all matters related to the subject
application. If at any tune, you discontinue as Mr. Silvino's representative on the subject
application, please forward written conespondence immediately to my office mdicating this
fact and the name of the appropriate contact.
It is my understanding that Mr. Silvino desires to pursue the option to complete appropriate
building code hnprovements to the flower stand at 2815 Jefferson to receive a
recommendation from staff to allow the stand for a maximum period of five (5) years. In
pursuing this option, I want to make sure that two issues are very clear to Mr. Alvarez as
related to the selection of this option. First, the building code improvements may be quite
costly. These improvements may include the requirement that the restroom facilities be
constmcted within the building itself. The Building Code may not allow for
temporary/portable restroom facilities for a retail establishment. It is very important that you
and/or your client contact Pat Kelley, of the Building Department, directiy to identify the
improvements which will be required for the buildmg to receive a building permit. It may
not be financially feasible for Mr. Alvarez to meet these requirements. Second, it needs to be
clearly understood that Mr. Alvarez will not be able to receive a building permit until the
redevelopment permit is approved by the Design Review Board. The requirements may be

obtained from the Building Department but no work may commence until the redevelopment
permit is approved. Mr. Alvarez should not complete any additional improvements to the site
or the building until he knows that the land use has been approved; his financial investment
will be at risk until the redevelopment permit is approved.
Enclosed for your information are the two (2) most recent conespondence which have been
forwarded to Mr. Alvarez. It is imperative that this project move forward with no additional
delays. Therefore, your assistance is greatly appreciated in this matter. If you have any
additional questions or need clarification for revisions to the flower stand plans, please do not
hesitate to contact my office at 434-2935. I look forward to receiving the revised plans as
soon as possible and completing the permitting process for the Alvarez Flower Stand.

Per Anita Ramos-Bonas, Administrative Secretary for the Housing and Redevelopment
Department, Mr. Silvino Alvarez and a woman came into the office today (5/17/95) to M" '3.20fX
discuss their redevelopment permit. I was out of the office. However, Anita was able to
discuss the permit with Mr. Alvarez. Mr. Alvarez has not yet revised his plans, which were
due to my office by no later than today, but he indicated that he wanted to pursue "Option 1"
which is to continue the 420 sq.ft flower stand and make the required building
improvements. Per Mr. Alvarez and the woman with him, he was going to go speak to his
lawyer, Mr. Richard MacGum, who initially prepared the set of plans so that he could get
the attomey to revise the site plan.
Mr. MacGum left a voice mail message for me which stated that he would be working with
Mr. Alvarez to revise the plans but that there was no way that they could get them to my
office by today. He would get them done as soon as possible and tum them into me. He
asked that I call him. I retumed Mr. MacGum's call on 5/17/95 at approximately 4:15pm.
He was in conference; the secretary took a message.
A letter was faxed to Mr. MacGum indicating what action could be taken to extend the
deadline for submitting the requested materials.

APPLICATION FOR REDEVELOPMENT PERMIT FOR FLOWER STAND
I contacted Ms. Flores by telephone again today at 1:45pm because I did not hear back from
her after our last conversation on May 1, 1995. Ms. Flores stated that she tried to call me
several times but was unable to reach me. However, I received no messages from her on my
voice mail or through the front office. Ms. Flores indicated that she contacted her father
(Mr. Alvarez) and he said he did not receive the package of information that I sent to him on
April 6, 1995. I told her that I was very concemed about that because we did not receive the
information back in our office and it was sent to the flower stand address as stated on their
application.
I told her that I would leave a copy of my correspondence to Mr. Alvarez at the front desk
for her to pick up.
Approximately five (5) minutes after I spoke with Ms. Torres, she called me and stated that
her father did, in fact, receive the package I sent him but did not tell her. She said she would
look at it tomorrow to find out what they needed to do. I told her that her father does not
have much more time. A response was requested by April 21, 1995. If they do not soon
decide what they are going to do, staff will need to take the project forward to the Design
Review Board for denial. She said she would call me after she looked at the letter.

I contacted Ms. Flores today (approx. 2:00pm) to inquire as to the reason her father, Mr.
Silvino Alvarez, had not yet contacted my office with a response to my letter of April 6,
1995. She indicated that she did not know but that she would call him and find out. She said
he usually always tells her when he gets a letter but he had not said anything. Ms. Torres
said she would call hhn and ask about the letter.

Dear Mr. Alvarez:
On April 6, 1995, a letter was forwarded to you outlining additional actions required by you
to complete the process for obtaining a redevelopment permit for flower production and on-
site flower sales at 2815 Jefferson Street. In the subject letter, it was requested that you
select one of the two options presented regarding size of the building stmcmre for the on-site
flower sales. The two building options were: 1) a 420 square foot stmcmre (including
building and overhang) which requires substantial improvements to meet applicable building
codes; or 2) a 120 square foot stmcture (no overhang) with no additional building code
improvements requirements. The plans retumed to you with the subject letter needed to be
revised to reflect the building option you have selected.
The subject letter requested a response from you to my office by April 21. 1995. As of the
date of this letter, I have not received a response from you. I spoke with your daughter, Ms.
Hope Torres, on May 1 and May 9, 1995 regarding your permit and the subject letter dated
April 6, 1995. Ms. Tones indicated to me that she would discuss this matter with you. It is
critical that we receive revised site plans from you indicating the building size option you
have selected for the flower stand by no later than May 17, 1995. The revised plans must
include the location of the paved parking (1 or 2 spaces, depending upon the size of building
you select) and the manner in which you will screen the portable restroom on the site. As a
note for clarification purposes, the portable restroom must be completely screened from view
by persons on the street or sidewalk.
If revised plans are not submitted to my office by May 17, 1995, it will be necessary for me
to take a report forward to the Design Review Board which recommends denial of your
application for a minor redevelopment permit. Please understand that if your permit is denied
by the Design Review Board, you will be required to immediately remove the flower stand
and will no longer be permitted to sell flowers from the site. Your permit will be considered
by the Design Review Board on June 7, 1995. If you submit plans which are satisfactory to
staff by May 17tii, staff will recommend that the Design Review Board approve your permit.
However, if you are unable to submit plans which address the issues outiined within my
April 6th letter to you, then staff will find it necessary to recommend denial of the permit.

Due to the difficulty you have experienced with providing plans for your flower stand which
will meet the design and development standards established for the Village Redevelopment
Area, the following suggestions are offered to you in the event that your permit is denied by
the Design Review Board:
1. Within the new Village Transit Station located on Grand Avenue (north side) between
State Street and the railroad tracks, the North County Transit District will offer
opportunities for a local business person to rent a 10' X 10' retail space to sell such
items as coffee, muffins, newspapers, etc. Jt may be possible for you to rent one of
these retail spaces to sell flowers produced on the site at 2815 Jefferson. If you would
like to get your name on the waiting list for one of these retail spaces within the
station, please contact Ms. Betty Laurs at 967-2862. Constmction on the new station
is expected to be completed within the next couple of months.
2. The Village Business Association currently sponsors a Village Farmers' Market which
is held every Wednesday aftemoon from 2:00pm to 5:00pm in the public parking lot
located on the east side of Roosevelt Street between Carlsbad Village Drive and
Grand Avenue. If you would like to sell your flowers at the Market, contact Ms.
Cynthia Bueker at 720-9161. She can provide you with information for obtaining a
space at the Market.
The above two suggestions allow you to continue to produce the flowers at 2815 Jefferson
Street but sell them at an altemate location.

El 6 de Abril, 1995, una carta fue avanzada a ud. perfilando acciones adicionales necesarios de ud. para
completar el proceso para obtener su permiso de Redevelopment para la produccion de flores y para ventas
de flores en la propiedad de 2815 Jefferson Street En la carta, fue solicitado que ud. escogera una de las
dos opciones que fueron presentadas con respecto del tamano de la estructura del edificio para las ventas

Street Si ud. desea poner su nombre en la lista de espera para uno de esos espacios para ventas
dentro la estacion, por favor de comunicarse con Betty Laurs al telefono (619) 967-2862. La
construccion de la estacion nueva sera completada antes de unos cuantos meses.
2) La Asociacion de Negocios del pueblo corrientemente patrocina el Mercado de Grangeros del pueblo
que tienen cada Miercoles en la tarde, que comiensa a las 2:00 PM - 5:00 PM, en el estacionamiento

Dear Mr. Alvarez:
It is my understanding that you have requested that all correspondence regarding your
redevelopment permit application (94-04) be forwarded to you rather than Mr. Richard
Macgum, your previously identified attomey. As indicated in a letter to you from Michael
Hokmiller, the City's Planning Director, your redevelopment permit application was deemed
complete for further processing on January 9, 1995.
First, please accept my apologies for the delay in forwarding this conespondence to you. We
recently changed our procedures and the Housing and Redevelopment Department is now
responsible for processing all redevelopment permits. Previously, you were working witii
Elaine Blackbum of the Planning Department. I will now be your point of contact as we
contmue the processmg of your permit.
At the time your application was deemed complete, it was forwarded to several City
Departments for review, fmal comments and permit conditions. The purpose of this letter is
to outiine issues which were raised during the fmal review and to summarize the remaining
process for you. I hope it helps to provide this letter written in Spanish. The Housing and
Redevelopment Department Secretary speaks Spanish. So, she is able to assist with
translation if necessary. Her telephone number is 434-2815. I understand that Ms. Hope
Tones has been assisting you and that she speaks English. If she would like to speak to me
directly about this conespondence, she may contact me at 434-2935.
In general, staff can support the proposed temporary land use for the subject property (2815
Jefferson) which provides for flower production and on-site flower sales. However,
Redevelopment Staff can only support this land use for a temporary period of time (2 to 5
years). The flower field and small flower retail site does not ultimately represent the highest
and best use for the subject property. But, we can support it for a specific period of time.
Basically, two (2) issues arose during the final review of your project plans. The first issue
involves the size of your building and applicable building code and parking requirements.
The second issue involves driveways for the proposed use.

The Building Department has indicated that any building stmcture which exceeds 120 square
feet in size must comply with applicable building codes; this would require you to apply for
and receive a building permit for the building. "Building Stmcture" includes the buildmg as
well as tiie overhand^ area which basically creates a patio. Your current proposal is for a 120
square foot building with a 300 square foot patio, or overhang area. This means that you will
have 420 square feet of building stmcmre which will make the building permit applicable to
the project. To meet building code, you would need to make a number of improvements
which may be quite costly. You should contact the Building Department directiy to discuss
the building code in more detail.
If you restrict your operations to the 120 square foot building only (no patio or overhang
stmcture), you will not be required to obtain a building permit or comply with the building
codes. This means you would need to revise your plans to remove the patio or overhang
area.
Regardless of the option you choose, Redevelopment Staff will recommend a restriction on
the total period of time that you will be allowed to operate the proposed flower stand at the
subject site. If you select the option to maintain the 420 square feet and make the necessary
improvements to comply with the building code and obtain a building permit, staff will
recommend a five (5) year term for the flower stand and production field. If you select the
option to remove the patio or overhang and restrict operations to the 120 square foot
building, staff will recommend only a one (1) year permit for tiie flower stand and
production field.
For information purposes, with a 420 square foot building stmcture, you will need to provide
two (2) paved parking spaces. With a 120 square foot building stmcture, you will only be
required to provide one (1) parking space.
Your plans will need to be revised to reflect the option you select to pursue for your project.
Issue #2:
Engineering Staff can support the existing driveway only. You will not be required to
provide a second driveway nor will staff recommend approval of a second driveway. Your
plans will need to^revised to remove the second (proposed) driveway.
Also, you will need to provide adequate tum around space on-site for the required parking
spaces. Engineering Staff is unable to support a situation which results in persons being
required to back their vehicles onto Jefferson Street. So, people will need room to back out

of a parking space on the site and enter Jefferson Street in a forward position. Since the site
has more than adequate space for the parking spaces, it is my assumption that the required
turnaround should not present a problem for you.
A final note on the proposed flower stand and field involves the restroom facilities. As
indicated to Mr. Macgum in prior conversations, Redevelopment staff requests that the
portable facility noted on your plans be screened from view of the public. The portable
restroom must not be visible from the street. You may either place it behind the building or
leave it at its current location but it must be screened. Please identify the type of screening
you will be using on the plans. It was previously suggested that some white lattice work be
used to screen the portable restroom.
Please contact my office no later than April 21, 1995 to let me know how you wish to pursue
resolution of the above issues. As indicated above, your plans will need to be revised as
quickly as possible to address the above issues. When you have completed the revisions,
please submit a total of six (6) copies of the plans to my office for fmal processing.
Upon retum of the revised plans to my office, I will prepare the report to be presented to the
Design Review Board (DRB) for final action. If you are able to make the requested revisions
and remm the plans to my office by the end of this month (April 30, 1995), it is anticipated
that the project will be submitted to the DRB for action on May 17, 1995. The term of your
permit will correspond to the date your redevelopment permit is approved by the DRB or
upon receipt of your building permit, dependmg upon which option you select for resolving
the building stmcture size issue.

y tambien la area que cuelga por encima que crear un patio (terraza). Su propuesto corriente es para un
edificio de 120 piezes cuardados con un patio de 300 piezes cuardados, o una area que cuelga por encima.
Esto quiere decir que ud. va a tener 420 piezes cuardados de estructura de edificio que hace el permiso de
construccion aplicable.con el proyecto. Para salir adelante con el codijo de construccion, ud. va a tener que
hacer varios mejoramientos que puedan ser muy costosos. Ud. necesita comunicarse directamente con el
Departamento de Construccion para discutir el codijo de construccion para mas detalles.
Si ud. limite su operaciones del edificio a solamente 120 piezes cuardados (sin area de patio o estructura
que cuelga por encima) ud. no va necesitar de obtener un permiso de construccion o obedecer con los
codijos de construccion. Esto quiere decir que ud. va tener que revisar sus planes para eliminar el patio

A pesar de todo, o de la opcion que quiera, nosotros vamos a recomendar una arestriccion en el tiempo total
que vd. va hacer permitido para operar su propuesta de parada de flores en este sitio. Si ud. escoge la
opcion de mantener los 420 piezes cuardados y hacer los mejoramientos necesarios para obedecer con el
codijo de construccion y obtener un permiso de construccion, nosotros vamos a recomendar un plazo de
cinco (5) anos para la parada de flores y el camp de produccion. Si ud. escoge la opcion de eliminar el

El Departamento de Ingenieria solamente soporta el camino de entrada esistente. Ud. no tiene que proveer
otro camino de entrada y nosotros tampoco vamos a recomendar de aprobar otro camino de entrada. Sus
planes tienen que ser revisados para eliminar la segunda entrada.
Ademas, ud. tiene que proveer espacios adecuados para vueltas en el sitio para los espacios de
estacionamientos. El Departamento de Ingenieria no puede soportar una situacion que resulte en que
personas tengan que dar marcha atras con sus vehiculos encima de la calle de Jefferson. Entonces, la gente
va necesitar campo para dar marcha atras de un espacio de estacionamiento, en el sitio y entrar a ia calle
de Jefferson en posicion delantero. Porque el sitio tiene mas de espacios adecuados para estacionamientos,
es mi asunsion que los espacios necesarios para vueltas no sera una problema para ud.
Una nota final de la propuesta para la parada de flores y campo incluye las facilidades de banos como fue
indicado a Mr. Macgurn en conversaciones anteriormente. Nosotros solicitamos que la facilidad portatil
notada en sus planes tengan una pantalla y sin vista del publico. El portatil de banos tampoco no puede
ser visible de la calie. Ud. puede poner ei portatil atras del edificio o dejarlo donde esta, pero tiene que
tener una pantalla. Favor de identificar el tipo de pantalla que va a usar en los planes. Antes una sugestion
fue que usaran enrejado bianco para la pantalla del bano portatil.
Por favor de comunicarse con mi oficina antes de April 21,1995, para que me diga como quiere arreglar
los puntos indicados anteriormente. Como es indicado anteriormente, sus planes tienen que ser revisados
lo mas pronto possible para tratar los puntos indicados. Cuado ud. complete las revisiones, por favor de

Thank you for your correspondence of November 15, 1994. I
have just had a conference with my client regarding the permit
application and the visit Debbie Fountain recently made to the
Alvarez flowerstand regarding this matter. I am disturbed by the
tone of Ms. Fountain's communications, but I will address my
concerns to her.
My letter to you of November 7, 1994 was intended to clarify
the information that had been communicated to me and to my client
regarding the permit process and to assure you that we are
proceeding in this matter in good faith. I believe it is evident
that Mr. Alvarez has put a tremendous amount of effort into this
project to improve the appearance of his stand while his
application is being completed and his permit is being processed.
In your reply to my letter, you state that there was nothing in the
application submittal to indicate that I am Mr. Alvarez'
representative, however, my name, address and telephone number
appears on all the plans and on the business card and cover letter
(a copy of which is enclosed for your reference) which I hand
delivered to the Planning Department and submitted with the
application packet. As you are aware, the Land Use Review
Application prepared by the City does not designate a space for
such information. Further, I discussed my representation of Mr.
Alvarez and his English language limitations with the Planning
staff person whose name appears on the enclosed acknowledgment
dated June 6, 1994.
I was able to obtain a copy of Mr. Holzmiller's July 6, 1994
letter of application incompleteness on August 24, 1994, only after
contacting your office regarding the status of the Alvarez
application. I promptly communicated with you on September 2, 1994
regarding your assignment to this project and my representation of
Mr. Alvarez.
It is my hope that we can continue to keep the lines of
communication open and work together in this matter. Again, I
appreciate your confirming the upcoming December 8, 1994 deadline

Dear Mr. Macgum:
Planning staff has received your letter of November 7, 1994, regarding the above referenced project.
My reminder letter to you (and to Mr. Alvarez) was a courtesy letter which is routinely sent to an
applicant when a legal deadline is approaching and staff has had no communication from an appiicant
or his named representative. This is particularly Important to an applicant in Mr. Alvarez's situation,
where the applicant is pursuing a permit following a Code Enforcement identification of an unpermitted
use. The property owner was notified of the need for a Redevelopment Permit (RP) on December 28,
1993, and received several follow-up notbes. While regulations allow an applicant a maximum six
months' time from initial submittal to make his application complete, most projects do not require six
months. Further, a lack of any response to any of the incompleteness items identified in our
con-espondence of July 6, 1994, does not seem to be a good faith effort to comply with Code
Enforcement/Redevelopment Agency direction to Mr. Alvarez. The City has allowed Mr. Alvarez to
continue operating the flower stand without a permit only on the basis that a good faith effort be made
to obtain the necessary permit. The City, however, is not obligated to allow the continued use while the
required permit application is being processed. If the City does not feel that a good faith effort is being
made to obtain the permit in a timely fashion, the City can require Mr. Alvarez to cease operation of the
flower stand.
Finally, you suggest in your letter that any delay in making a resubmittal was due to the fact that the City
incorrectly sent its correspondence to Mr. Alvarez rather than to you. Staff must, therefore, remind you
that there was nothing in the application submittal to indicate that you were to be the applicant's
representative. The land use review application and the disclosure form both indicate that Mr. Alvarez
is the applicant and Mr. & Mrs. Kelso are the property owners. Your name does not appear on any of
these forms, nor is there any letter or other statement to the effect that you are to be the applicant's legal
representative or that you are to be copied on any correspondence. In the absence of any such
statement or request, staff would, of course, direct all correspondence to the applicant.

reaffirming the December 8, 1994 deadline for submission of the
remaining information required to complete Mr. Alvarez' application
for a Redevelopment Permit. The day after I received your letter,
I also received correspondence from Debbie Fountain regarding this
same matter.
In reference to both letters, please note that, in
correspondence to you of September 2, 1994, I confirmed Mr.
Alvarez' receipt of the two lists prepared by Mr. Holzmiller which
indicated the items necessary to complete the flowerstand
application. At that time, I stated Mr. Alvarez' intent to
complete his application within the six month deadline established
by Mr. Holzmiller.
I agree that there is still adequate time to submit the
information necessary to complete Mr. Alvarez' project application
within the December 8, 1994 deadline. It remains my client's
intention to submit to you a completed application on or before
that date.
As previously requested, keep me apprised of all communication
made to Mr. Alvarez regarding this matter. Please remember, Mr.
Alvarez reads and speaks only Spanish. Although I prepared and
submitted the Application for a Redevelopment Permit, the City's
initial response was sent to Mr. Alvarez and not to me, which has
delayed our response.

The above-referenced application was submitted on June 8, 1994. On July 6, 1994, Planning
staff sent an "incomplete" letter identifying the items needed to complete the application and
identifying some preliminary potential issues. In September, Elizabeth Gifford at your office
contacted me regarding the application. She indicated that Mr. Alvarez does not speak
English and that your office would be handling the processing of the application. I sent her a
copy of our July 6 letter originally sent to Mr. Alvarez. Since that time I have heard nothing
further regarding the project. Consequentiy, I wanted to follow up on the status.
The City's Municipal Code directs that an applicant has six months from the date an
application is initially filed to submit sufficient information for the application to be deemed
complete for review. For the subject application, the six months will expire on December 8,
1994. Tlie application will be automatically withdrawn on that date if it is not complete.
However, there is still adequate time to submit the necessary information to make the project

Dear Mr. MacGum:
Since December 28, 1993, the Carlsbad Village Redevelopment Agency has been requesting that
your client, Mr. S. Alvarez, obtam a redevelopment permit for the flower stand he has installed
on property located at 2815 Jefferson Street in Carlsbad, Califomia. As previously stated, the
flower stand has not been approved and, therefore, should not be in operation on the noted site.
The Redevelopment Agency has permitted the operation to continue with the specific
understanding that every effort must be made to obtam a redevelopment pemut as soon as
possible. As of this date, a completed redevelopment permit application has not yet been
submitted to the City's Planning Department for the flower stand and, per the project planner,
the last correspondence made was on July 6, 1994. At this time, it no longer appears that you,
or your client, are making a good faith effort to process the required application for this permit.
The Redevelopment Agency believes that Mr. Alvarez has been given more than reasonable time
to obtain the required permit for his flower stand. If immediate action is not taken to submit a
complete application to the Planning Department, the Redevelopment Agency will request that

This is to acknowledge receipt of correspondence from Michael
Holzmiller to my client, Silvino Alvarez, dated July 6, 1994, a
copy of which was forwarded to this office and received on August
24, 1994, and which identified you as the staff planner assigned to
the above referenced project.
Please be advised that Mr. Alvarez has retained me to
represent him in this matter. He is an older gentleman who speaks
and reads virtually no English and it is important in order to
facilitate the processing of the above referenced Application for
Minor Redevelopment Permit that I be kept apprised of all
communication from the City to Mr. Alvarez regarding this matter.
Mr. Alvarez was recently visited by two representatives from
the City at the Jefferson Street flowerstand. He was unclear as to
the substance of the visit or the identity of the people he spoke
with and I am requesting your assistance in clarifying this visit
so that proper response may be made to any oral requests that may
have been made.
I am in the process cf reviewing and responding to the List of
Items Needed to Complete Application and anticipate your receipt of
this information prior to six months frcm the date the application

1. Please add the telephone numbeis of the applicant and owner to the plans.
2. Please add the project niunber (RP 94-04) to the upper right comer of future submittals.
3. The plans contain contradictoiy infoimation regarding sizes/areas and between written
dimensions and scaled distances. An example is the flower stand. Sheet 1 indicates an 8'
X15* flower stand. However, the diawing shows a T dimension which appears to be longer
than the 8' dimension. On Sheet 2, the legend again indicates an 8' x 15* building.
However, the drawing dimensions say 23'(8''f 15^ x 15*, and the building scales to
approximately 17* x 24*. These inconsistencies cany over to the building area square
footage which is stated as 120 sf but scales to approximately 345 square feet Staff suggests
you review the plans fully to correct the inconsistencies and verify (or add where
appropriate) dimension lines to clarify the stated dimensions.
4. The existing zoning and land use shown in the legend should be conected. The zoning on
the site is "V-R". The existing land use designation (Le., General Plan designation) is
•TIMH/O".
5. The legend contains a projected Average Daily Traffic Generation figure of "17-20". How
was this figure determined? The number of Average Daily Trips (ADT) should be
deteimined by using the latest version of "Brief Guide of Vehicular Traffic Generation Rates
For The San Diego Region" published by SANDAG.
6. An EIA Part I must be submitted for this project
1. Please indicate on the plans the method of deteiminiiig the Average Daily Traffic.
2. Please dearly indicate the propeity lines of the site.
3. Please identify the location of any existing driveways on both this property and adjacent
properties. Also, indicate the dimensions of the proposed driveway and its distance to the
propeity line. Please note that Qty standards require a miniinmn 3' dear distance between
driveways and propeity lines.
4. Please indude on the plans a typical street cross section of Jefferson Street
5. Please identify on the site plan the existing street improvements on Jefferson Street
6. Please show the dimensions of the parking stall, and how vehides are intended to circulate
on the site.
7. Please show the location of fire hydrants within 300 feet of the site.
8. Please check the dimensions used on the site plan as several of the dimensions do not match
