Since there was a huge consensus against doing most of this, I am not sure why we are caving in to most
of their requests. I fully understand the implication of going to the Council, but I also fully understand the
implications of allowing them to bring in music and crafts people. If we say no and the Council overturns
us, then their fingerprints are on it if it becomes a problem. It is extremely difficult to reduce something
after you have allowed it to grow, so once you allow them to do it, even for a short period of time, it will get
a life of its own and then they will want to do it for longer and longer. I think you open the door to this thing
becoming a huge problem in terms of parking and other issues. I was the Special Events coordinator
when the Village Faires started out as a small, village event, and we ultimately had to go to war to prevent
them from getting any larger than they are now. The Farmers Market was approved as a farmers market,
now suddenly it is a craft fair with entertainment. I think this is a BAD idea and perhaps all interested
parties from the city should sit down and have a face to face discussion about this before all of these
items are approved. As it stands now, if this thing goes south, you are going to be out on that limb all by
yourself, with the rest of the city staff saying we told you so (that is the nature of the beast you know).
E-mails are nice, but it is a difficult way to really talk about issues and come up with solid decisions that we
can all live with.

OK, so everyone was a little less than thrilled with the proposal for the Farmers Market. I've never seen

However, the reality of the situation is that if we say no to the Carlsbad Village Business Association (they
sponsor the event), the CVBA will go to the Council, and then we will be directed to come up with some
type of solution. So, in an attempt to be proactive, the Housing & Redevelopment Dept. is proposing the
following:
Signs: We are going to treat this as we would a special event and limit them to 4 signs not to exceed 16
sq. ft. The signs will be allow in the locations the typical locations that we allow for special events - Cannon
Park, Carlsbad Bl. & at Jefferson & Marron.
Music: We are going allow the music from 5-8 pm.
Arts & Craft Vendors: We are going to allow this from 5-8 pm.
Again, the revised operations will only apply for a 10-week period, from the last Wed. in June to the 1st
Wed. in Sept. The existing conditions say that the H&R Director will review the permit on an annual basis
to ensure that they comply with the conditions and that there are no adverse impacts to the community.
If we find that either the music or the arts and crafts are a problem from either a City or community
perspective, then we will revise the permit accordingly. We feel the existing conditions will be adequate to
at least let them do a trial run.
So, is this something that everyone can live with?

The following are comments from P.D. & Lt. Shipley.
1.1 recommend against extending the hours so they will be there after dark, even to clean up. Also
recommend against the arts and crafts. This is a farmers market next thing you know it will be a weekly
flee market with some farm produce.
2.1 do not understand why they need or want amplified music at a farmers market. The idea is to provide
a opportunity to sell and buy produce are they trying to make it a carnival?
3. My recollection, any signs on state right-of-way will require their approval. Also, I don't think the signs
requested will fall with in the sign ordinance. Also recommend, if okay by ordinance, they be smaller than
4X4 and we arrange for specific locations not on the sidewalk and not in the bike lane. I'm fairly sure the
banners will not conform. It think that is a planning department call.

Jefferson & Marron Rd., Carlsbad Bl and State St. both north and south bound and one banner sign at the
event. They also want a 4x4 sign & a banner at the Coaster station. We've told them they need to get
NCTD approval for signs on their property.
The last time they extended the permit, no other departments had any new conditions or comments. So,
my question to everyone is, would anyone like me to route their letter requesting these changes and you
can respond in writing or is this e-mail sufficient. Of course, they've only recently submitted their request
& we don't have much time to get this to the Design Review Board so they can start this in June. Thus
the need for the quick turn-around.

I see no reason not to allow them to extend the event. However I have serious reservations about having
off-site signage allowed in the right of way every week. That clutter would look unsightly and could
compromise our signs in the ROW Council Policy. I would say "yes" to the extension , but "no" to the
additional signs in the ROW. Signs on private property may be allowed if the property is not already
maxed out in their own signage.

My only comment would be related to the proposed signs. Is there a sign permit required these these?
Are all these signs proposed on private property or within the City right-of-way?
I would condition them that the signs not interfere with sight distance zones per Caltrans corner sight
distance standards.
I would also like to see an exhibit depicting the location of each signs so that engineering can evaluate
safety concerns.
I am copying Ed Davidson for an FYI since he gets calls regarding signs and banners.

RE: REQUEST FOR MAJOR REDEVELOPMENT PERMIT AMENDMENT
FOR FARMER'S MARKET (RP 94-05)
Dear Louise:
Thank you for your correspondence of April 16, 2004 regarding the Carlsbad Village Business
Association's request to amend the major redevelopment permit for the weekly Farmer's Market
to add some special events for the summer months. Enclosed is an application that must be
completed in order for staff to continue its effort to process the requested amendment. Please
retum as soon as possible to my office. Because the amendment must be approved by both the
Design Review Board and the Housing and Redevelopment Commission, I believe that it is very
unlikely that you will have an approved permit in time for you to begin the desired special event
at the end of June, 2004. It typically takes several months to process these type of permit
amendments. However, we will process as quickly as possible. You should have a contingent
plan which initiates the events towards the middle of July rather than the end of June for this first
year. In future years, you will be able to begin in June. You should not advertise the event until
you have an approved permit.
In response to your correspondence, I wanted to let you know that staff will support the
following activities as related to the amended permit:
1. The permit for the market will be extended for another five years. The current expiration
date is September 27, 2004. The amended expiration date will be September 27, 2009.
Please include this request in your permit amendment application.
2. The boundaries of the market and special event area will remain limited to the public
parking lot located on the east side of Roosevelt Street (mid-block), west of the alley,
between Carlsbad Village Drive and Grand Avenue. At this time, it would be my
suggestion to delete the reference to sidewalk sales in front of area businesses. There is
inadequate time to work through the details of this activity. Therefore, I would suggest
that this activity be reconsidered for next year when we have more time to work through
the details.
3. The total number of booths at any given time shall not exceed 33 booths/spaces. If you
wish to amend this number, you will need to indicate the total desired number in your

application and ensure that the number can be accommodated within the limits of the
parking lot boundaries. The alley will need to remain open.
4. The hours of operation for the market shall be 2pm to Spm during the summer months
(June, July, and August), and 2pm to 6pm during all other months of the year. The
parking lot will be closed for set up, the event and clean up from 1pm to 9pm. The CVBA
will be required to reimburse the City for the costs of installing revised signage within the
parking lot to indicate the new hours for the parking lot closure.
5. The current condition indicating that there shall be no craft booths, antiques or other
retail items will be revised to allow for arts and craft booths during the summer months
only. A limited number of food booths will also be permitted during the sunmier months
only. However, these art and craft and foods booths will need to provide their own
electrical generation. The City will not provide this service for these booths.
6. The additional signage is acceptable. However, we need information on the dimensions
for the banners at the Village Coaster Station and the Farmer's Market. The CVBA will
need to obtain written permission from North County Transit District to place signage on
their property. In addition, the CVBA will continue to be responsible for posting parking
directional signage for the attendees of the event as noted within the current permit.
7. Amplified music will be allowed during the hours from 5pm to Spm only, and only for
the special event(s). Any amplified music provided in the past has been a violation of the
permit. Therefore, it should not have been provided. However, we have indicated to the
CVBA that non-amplified music could be allowed on a temporary basis for special
events. The amplified music is very distracting for office businesses within the area.
Therefore, it will be limited to hours after most offices have closed in the area. Non-
amplified music will be permitted during the earlier hours throughout the year.
S. All other operational conditions of the permit including clean up of the parking lots,
posting of no-parking signs, etc. shall remain in full force and effect.
Please note that the above conditions are those that will be proposed by staff. The Design
Review Board and Housing and Redevelopment Commission must approve these conditions and
the permit before you may proceed with your event(s). The Board and/or the Commission could
add additional/revise conditions or make other changes to the permit during their review and
action. The public will be given the opportunity to speak on the proposed permit amendments
and share any concems and/or support for the project.
Thank you for your interest in adding fun activities to the Village Area to enhance the
environment. Best of luck to you in your endeavors! Please forward the completed application
with any additional information requested to my office as soon as possible so that we may
complete our reports for review purposes. The meeting for the Design Review Board is
scheduled for May 24, 2004. We must have our completed report and the public notices sent out

permit, the hours stated for the Farmers' Market are from 2:00 PM to 6:00 PM. The permit also states
that the parking lot is reserved for the Farmers' Market from 1:00 PM to 8:00 PM, however the signs in
the parking lot state that the parking lot is reserved for the Farmers' Market from 12:00 noon to 7:00 PM.
Because there are so many different time spans stated on the permit, we would like to request the
following:
"Summer MarketProposal
1. During the summers, we would like the option to extend the hours for the Farmers' Market from
the last Wednesday in June to the first Wednesday in September. (A total of ten Wednesdays.)
The current hours are from 2:00 pm to 5:00 pm. We would like to extend the hours to 8:00 pm.

two at 101 and State Street (where the 101 splits off to State Street - one on the west side of
101 and the other on the east side of State Street, facing southbound traffic into Carlsbad
Village, avoiding the center divide); and, one at the train/Coaster station.
3. Allow Carlsbad Village merchants to feature sidewalk sales in front of their businesses for the
above-mentioned days and hours.
4. Allow for amplified musicians at the Farmers' Market and non-amplified, meandering musicians/
performers within in the Village. In the past, there have been amplified musicians at the Farmers
Market. Cynthia Bueker, the Farmer's Market manager will manage the Summer Market
amplified musicians located in the Farmer's Market parking lot. There will be both stationary and
meandering musicians alternating throughout the 10-week period.
5. Allow for arts & crafts booths from 2:00-8:00 pm. These booths would be located in the
Farmers' Market parking lot. Not all farmers will remain on Summer Nights. Cynthia Bueker will
arrange for a specified number of farmers to remain each Wednesday. As they farmers leave,

6. Allow food vendors, with valid health permits, to be located within the confines of the Farmers'
Market. These vendors will be managed by Cynthia Bueker, and monitored by a designated
representative of the CVBA.
This Summer Market project is going to be project managed by the CVBA. Each week, the CVBA Project
Manager and the Farmer's Market manager will review the vendors and musicians participating that week
and monitor their participation so that we can guarantee a good time is had by all our guests and
merchants. We anticipate that this Summer Market will lend a festive atmosphere to the Village on
Wednesday nights during the summer and hope that other Village merchants will also keep their doors
