SUBJECT: Carlsbad Village Farmers Market (RP94-05X4)
Dear Christy,
While visiting the farmers market the past couple of weeks I have noticed that there
have been booths set up that are not permitted under the above referenced
Redevelopment Permit. Most notably were the Countrywide real estate booth and the
AT & T cellular phone booth. The most recent amendment to your Redevelopment
permit allows for 33 booths at the Wednesday and Saturday Farmers Market. Out of
those 33 booths, 25 can be dedicated towards produce vendors, 4 for non-produce
vendors (food), 2 arts and craft vendors, 1 for an educational booth, and 1 for a CVBA
member informational booth. In addition, I would like to remind you that each vendor
must have a business license on file with the City of Carisbad.
I have enclosed the most recent Design Review Board Resolution with the conditions
for the operation of the Farmer's Market. If you have any questions and/or comments

approved Major Redevelopment Permit No. RP94-05X4 for the continuation of the
Farmers Market. Enclosed please find a copy of the resolution that has been approved
for the project (Farmer's Market Permit), which includes conditions for approval of the
project and the Fire conditions for open cooking at the market. All previous non-
amended conditions of approval are still in effect and available upon request.

STAFF REPORT AND INFORMATION ON VILLAGE FARMER'S MARKET
Per your request, atiached please find a copy of the agenda bill being processed for Housing and
Redevelopment Commission consideration of the revisions to the Major Redevelopment Permit for the
Village Farmer's Market which includes a copy of the Design Review Board (DRB) staff report and draft
minutes from the DRB meeting. The DRB considered the proposed revisions and recommended approval
on July 24, 2006.
The Major Redevelopment Permit amendment will be submitled to the Housing and Redevelopment
Commission for consideration in September, 2006. The Carlsbad Village Business Association requested
some revisions to their redevelopment permit in order to enhance the Farmer's Market. The revisions
primarily relate to the hours of the Wednesday market as well as the number of non-produce booths and
open cooking (for both markets). The CVBA would like to open the market an hour earlier and close an
hour earlier on Wednesdays. They would like to operate from 1pm to Spm rather than 2pm to 6pm. This
means lhat Ihey would close the parking lol al noon. They have also proposed lo eliminate the summer
hours, which allow ihem to operate until Spm. TTiere are no proposed change in hoiu-s for the Saturday
market. The CVBA would also like lo increase the number of non-produce vendors from 4 to 6 tolal, and
allow for open cooking at these booths. The total number of booths would remain al 33. Wilh the
changes, the markets would be allowed lo have a maximum of: 6 non-produce booths (i.e., prepared
foods, meal, breads, etc), 2 arts & crafts booths, 1 educational booth, 1 Village business information
booth, and 23 produce/flower booths.
A few adjacent businesses have expressed concem regarding the Saturday Farmer's Markel, and some
have objected lo the revisions to allow a greater number of non-produce booths. The primary concem is
lhat lhe non-produce and/or arts and crafts booths are beginning to outnumber the produce booths on
Saturday. It is a fact lhat the Saturday market is nol doing well in lerms of the number of produce booths.
Apparently the farmers do not believe there is adequate customer traffic on Saturday and therefore are nol
participating. Senior Police Volunteers inspected the Saturday market on July 29 and Augusi 5, 2006. 1
inspected the market on August 12, 2006. There were 11 booths total on July 29* and 12 booths total on
both Augusi 5* and 12*. On all three Saturdays noted, the tolal number of produce booths was 5. They
did not exceed the number of non-produce (4 total) and craft booths (2 total) that they are permitted.
However, the total number of these booths did exceed the number of produce booths. This is nol a
violation of their pennit but it is an indication that the Saturday event may nol be successful as a Farmer's
Market. Slaff has asked the CVBA to monitor the event for six (6) months. If it does not improve, the
CVBA has been asked to discontinue or redefine the event. The Wednesday event is generally in
compliance with the permit. On a fairly frequent basis, the farmers do begin selling before the 2pm slart
time. However, this is generally due to the fact that customers show up early and want to buy. There has
also been the tendency through the years for the Farafier's to begin setting up before ihey are permitted.
Slaff has spoken to the market manager several limes about this issue. This is one of the reasons lhat the
CVBA is requesting a change in the Wednesday markel hours. An earlier slart and fmish lime appears lo
be more preferable to both the consumers and the farmers.

We have been asked to help the Housing and Redevelopment Department re-
evaluate the Saturday morning Farmer's Market. The event takes place
downtown Carisbad in the public parking lot on Roosevelt (near Grand) between
the hours of 9 AM and 1 PM. The organizers have petitioned the Council to
extend their operational times by one hour. There have been a couple complaints
received from business owners regarding the make-up of the market. It is
suppose to be primarily produce vendors, but complaints allege there is mostly
"other" type vendors. There is some discrepancy between what the complainant
says is at the market and what the organizers say is there. No contact is
necessary with the vendors or with the organizers. We want this to be as
inconspicuous as possible.
They are asking that the Patrol visit the market during operational hours and
record the types of booths on site. Attached is a form to fill out. It also explains
the different types of booths. If you see other problems, such as parking, loud
noise, etc., please note them on the form.
Cliff Jones of Housing and Redevelopment really appreciates the help on this
issue. He would be doing this himself, but he is getting married and leaving on a
two we^k honeymoon.

Thanks, Mikki. It is unfortunate that there was not compliance with the permit for so many years. But, thank you for your efforts
to bring the market into immediate compliance with the permit. As an additional note, we received a call from Mrs. Wise
yesterday complaining that someone came into her store and yelled at her for complaining about and/or opposing the Farmer's
Market. She (Mrs. Wise) was very upset. The woman who yelled at her said she was the "publicist" for the CVBA/market. I don't
know who this person is, but it was really not appropriate (if it happened) and it was not appropriate for information to be
shared about who was complaining (if that is being shared by anyone from the CVBA). The blame for the enforcement could
have been placed on the City without the need to share that the Wise's were the reason or in opposition to the market. Good
relationships with surrounding business owners is going to be important for the continued success of the Farmer's Market. Any
effort that can be made by the CVBA to "extend an olive branch" to Mrs. and Mr. Wise would probably be helpful. Thanks.

Thanks for the heads up, we expected as much. Unfortunately we couldn't reach ail the vendors beforehand to stop them from
doing what some of them have been doing for many, many years, however rest assured that every single vendor was told today
and additionally will be sent a letter advising them that there must be strict adherence to the current rules.

Hi Mikki. I would like the Farmer's Market to be on the Board agenda if possible.
Also, could you please call the owner at the Artist Gallery and Salon next to our office as soon as possible? Mrs. Weiss (sp?), I
believe is her name. She was at the Council meeting last night and spoke under public comment. She was asking the Council to
deny any changes to the Farmer's Market permit. Her complaint was that the Saturday market is becoming a "swap meet" and
"sells primarily things like tupperware, timeshare sales, etc. and basically no produce or flower sellers". Our office has received
similar comments from other people. She was also complaining that the craft sales at the Farmer's Market take away from her
business. She said they pay rent and don't believe it is fair that the businesses at the Market are allowed to compete against her
and pay such a small fee. The Council asked if she had been in touch with you. She said no. They encouraged her to contact
you. But, I think it would be better if you gave her a call and tried to work through her issues. It puts the City in a difficult
position between the CVBA and a Village business otherwise. Thanks!

Dear Mayor Lewis and Carlsbad City Council Members:
The Carlsbad Village Business Association's request to extend the hours of the Carlsbad
Fanners' Market on Wednesdays and to have open cooking is of great concern to me. I
own the business directly across the'street from the Farmers' Market, Artist Salon &
Gallery, and am writing to inform you that the vendors have already taken it upon
themselves to operate under these new hours without the authority of the City of Carlsbad.
As it is, as a Village business, we are negatively and directly impacted by the use of the
public parking lot during business hours on both Wednesday and Saturday. In fact, my
customers have driven around for thirty minutes trying to find parking on those days of
the week. Moreover, on Wednesdays, the vendors arrive to set up and close the parking
lol as eariy as 11:00 a.m. and are slow to re-open the parking lot in the afternoon. This
behavior essentially prevents the use of the lot for my entire business day. On July 5,
2006, the Carlsbad Village Business Association employee who directly manages the
Farmers' Market had the audacity to threaten to tow my customer's car from the lot at
12:30 p.m. When confronted that she had no right to tow a car until 1 p.m., the posted
time, she became very hostile. This behavior is unacceptable.
I pay very high rent, insurance and taxes and have worked extremely hard for the last
three years lo build a profitable business in the Village. I resent that these out-of-town
vendors come lo our cily, set up their wares on our street, take away our business, are
essentially subsidized by our tax dollars and only pay a measly set-up fee. Simply put,
this is inequitable and unjustifiable.
Moreover, calling the Saturday free-for-all a Farmers' Market is misnomer. The fact is it
is nothing more than a swap meet. The following wares and services were available
Saturday morning:

I am not a new-comer to Carisbad and I recognize that City has a rich agricultural history
and culture. 1 lived in Carlsbad for 26 years, worked for the Carlsbad Unified School
District and raised two children in Carlsbad. I am not opposed to a Farmers' Market that
operates on Wednesdays at the posted time and sells local produce.
I am opposed to (1) an extension ofthe farmers' market's hours, (2) closing the parking
lot before the posted times and (3) non-agricultural vendors. These non-agricultural
vendors give the Farmers' Market a swap meet-feel. The Carlsbad Village Business
Association that operates this eyesore, is actually damaging the Carlsbad village
businesses that they purport to promote. It does not help us any to shut down the public
parking lot two times a week, especially Saturday, and set up tent-village in front of our
businesses. On the contrary, these vendors damage the image that my business and thc
City of Carlsbad wish to portray.
U is clear to me that this Farmers' Market has run amok. These vendors make our
otherwise attractive upscale city center look like a shanty town. Please reign them in.

Thank you for applying for a land use permit in the City of Carisbad Redevelopment
Area. The Redevelopment Department, together with other appropriate city
departments, have reviewed your application for the fourth amendment to the existing
Major Redevelopment Permit No. RP 94-05 to determine its completeness for further
processing.
The application has been deemed complete, as submitted, for further processing
purposes. Although the initial processing of your application may have already begun,
the technical acceptance date is acknowledged as June 14, 2006, the date that the
applicatton was found complete. The City may, in the course of processing your
application, request that you clarify, amplify, correct or otherwise supplement the basic
information required for the application. In addition, you should also be aware that
there may still be issues/comments on your application which may need resolutton

I support the suggested amendments, and believe the "Farmer's Market" should not become the "Weekly
Downtown Arts & Crafts Faire." I do not know the objections in the past from PD, but will find out.

objections. We also have been concerned about "open cooking". They currently have one vendor that
makes kettle corn and would like to expand that option. Let me know the collective thoughts of the group

Thanks for your recent email regarding the Farmer's Market. The enclosed safety guidelines should help ensure
continued success of the Farmer's Market.
Fire safety conditions:
1. Event coordinator shall ensure that all vendors who use canopies use only canopies which are flame
retardant and bear a California State Fire Marshal's seal. (There are several bugles shaped in a circle on this
seal.) No vendor shall use any canopy that does not bear this seal. This will be the event coordinator's
responsibility to monitor such canopies. Should any questions arise, the fire prevention division may be called
at 602-4665 and an inspector will respond to the location to assist.
2. Cooking is not permitted under any canopy or tent.
Please ask the event coordinator to list these requirements in a letter or brochure and provide them to all
vendors.

No prob from Bldg or Code Enforcement. The non-produce vendors get us closer to routine street vending
and a claim of unequal protection for people that want to do vending on public property. But I don't want to
awful-ize a potential successful attraction in the Village. Can you come up w/ a winery maybe? <just
kidding...a little>

don't see kettle corn as a big deal. Most places do that and it seems pretty innocuous to me since that is
a big open asphalt parking lot. We would want to make sure they won't be cooking under flammable
awnings or any place where someone could accidentally brush up against a hot cooking surface. But
then, that part is up to Karyn.

Dear CUff:
This letter is regarding the Carlsbad Farmers' Market held every Wednesday & Saturday in the public parking lot located mid-block on
the east side of Roosevelt Street, west of the alley, between Carlsbad Village Drive and Grand Avenue.
The Carlsbad Village Business Association (CVBA) is requesting that:
1) The "No Parking" times listed for the parking lot be amended to read 12-6pm for the Wednesday Farmers' Market
2) The times for the Wednesday market be amended to l-5pm
3) "Open Cooking" be permitted at both markets
4) The number on the non-produce vendor limit be increased to 8 vendors.
Also note that a feasibility study is underway to determine whether to request moving the Saturday Market to another location.
DETAIL
1) The 'TSIo Parking" times listed on the Major Redevelopment Permit No. RP 94-05(A)X3 (amendment to Major Redevelopment
Permit RP 94-05(A)X2) for the Wednesday market are l-7pm. Prior to December 2005 when new "No Parking" signs were installed,
the "No Parking" signs Usted the times as 12-7pm. The additional hour between 12 and 1pm was used to contact the Carlsbad poUce
and clear the parking lot of illegally parked cars. The additional hour of no parking from 6-7pm is unnecessary, since the market closes
at Spm and all the vendors are gone by 6pm.
Not having access to the parking lot at 12 noon has had a negative impact on the set up of the Wednesday market. The Carlsbad poUce
cannot be contacted and illegaUy parked cars cannot be removed before 1pm. The vendors are not able to set up until the cars are
removed which can take up to 45 minutes. This delays the opening of the market.
2) In addition, the CVBA requests that the operating hours for the Wednesday farmers' market be modified to read l-5pm. The earUer
opening time would aUow appropriate selling time for those customers who prefer to shop earUer. The modified hours of l-5pm
would more accurately reflect the actual time the market is in operation.
3) The Health Department has approved both markets for Open Cooking. The City has approved a popcorn vendor for open cooking.
We would like to allow other vendors the abiUty to do the same as approved by the Health Department. This change would increase
and lengthen customer visits.
4) Currentiy we are aUowed 4 vendors who are non-produce and 2 arts and crafts vendors. We have a good number of customers who
greatiy enjoy those vendors and would like more variety in our non-produce/ arts and crafts area. We have a long waiting Ust of non-
produce and arts and crafts vendors that would Uke to join us. This increase in aUowable vendors would gready improve our abiUty to
fiU empty spaces and grow the Saturday market and give us more flexibiUty in keeping the Wednesday market fuU.

on site. That type of thing."
Also, I would encourage the CVBA to be careful about
bringing in a vendor who does open cooking that could
be perceived as proving direct competition with an
existing restaurant downtown. Please explain how this
situation will be avoided in an attachment to the
application.

SUBJECT: Flre Conditions - Village Farmers Market
The purpose of this correspondence is to remind you of the conditions that the Fire
Department has placed on the operations of the Village Farmers Market. The Fire
Department has determined that the Farmers Market Manager shall be responsible for
assuring that the three conditions below are met:
1. Event coordinator (Farmers Market Manager) shall ensure that all vendors who
use canopies or tents shall have flame retardant canopies which bear a

circle on this seal.) No vendor shall use any canopy that does not bear this seal.
Event coordinator shall be responsible for certifying that all vendors are using the
appropriate tents with the required seal.
2. Cooking is not permitted under any canopy or tent at any time.
3. These requirements shall be listed in a letter or brochure distributed to market
vendors and shall be incorporated into the Farmers Market Rules & Regulations.
These conditions must be enforced by the CVBA immediately and will be included in
the resolution to the Housing & Redevelopment Commission regarding the proposed
amendment RP94-05x4. If the vendors do not conform to the above conditions the
market may be subject to Fire Department inspections (to assure that the above
conditions are met) and the CVBA would be subject to the costs associated with the
related Fire Department inspections or the Market permit may be subject to revocation.
Should any questions arise regarding the above mentioned conditions, the Fire
Prevention Division of the City Fire Department may be contacted at 602-4665 and if
necessary an inspector will respond to the location to assist.
