The attached original environmental documents are being retumed to you for fmal processing. Please let me know if there is anything else I should do in regard to these environmental documents. I made copies of them and placed them in the file. It was my understanding that Planning would, however, complete the processing of the documents and forward them to the appropriate agencies. Thanks! JUNE 28, 1995 TO: DEBBIE FOUNTAIN, REDEVELOPMENT FROM: Brian Hunter, Planning RE: RP 95-01 - PARKER OFFICE BUILDING RECOMMENDED CONDITIONS 1. The Housing and Redevelopment Commission does hereby approve the Major Redevelopment Permit for the medical office structure relocation project entitled "Parker Office Building". Exhibit _ on file in the Redevelopment Department and incorporated herein by reference, dated ,1995), subject to the conditions herein set forth. Staff is authorized and directed to make or require the Developer to make all corrections and modifications to the Redevelopment Permit Documents, as necessary to make them internally consistent and conform to the Housing and Redevelopment Commission's final action on the project. Development shall occur substantially as shown on the approved exhibits. Any proposed development substantially different from this approval, shall require an amendment to this approval. 2. If any of the foregoing conditions fails to occur; or if they are, by their terms, to be implemented and maintained over time; if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of ail future building permits; deny, revoke or further condition all certificates of occupancy issued under the authority of approvals herein granted; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. No vested rights are gained by Developer or a successor in interest by the City's approval of this Resolution. 3. The Developer shall comply with all applicable provisions of federal, state, and local ordinances in effect at the time of building permit issuance. 4. The Developer shall provide the City with a reproducible 24" x 36", mylar copy of the Site Plan as approved by the final decision making body. The Site Plan shall reflect the conditions of approval by the City. The Plan copy shall be submitted to the City Engineer and approved prior to building, grading, final map, or improvement plan submittal, whichever occurs first. 5. The Developer shall include, as part of the plans submitted for any permit plan check, a reduced, legible version of the approving resolution(s) on a 24" x 36" blueline drawing. Said blueline drawing(s) shall also include a copy of any applicable Coastal Development Permit and signed approved site plan. 6. Building permits will not be issued for development of the subject property unless the District Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. MEMO - RP 95-01 - CONDITIONS JUNE 28, 1995 PAGE TWO 7. The Developer shall pay the public facilities fee adopted by the City Council on July 28,1987 (amended July 2,1991) and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or Facilities and Improvement Plan and to fulfill subdivider's agreement to pay the public facilities fee dated , a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are not paid, this application will not be consistent with the General Plan and approval for this project will be void. 8. This project shall comply with all conditions and mitigation measures which are required as part of the Zone 1 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. 9. Approval of RP 95-01 is granted subject to approval of CDP 95-01. 10. Prior to the issuance of the stnjcture relocation permit, Developer shall submit to the City a Notice of Restriction to be filed in the office of the County Recorder, subject to the satisfaction of the Housing and Redevelopment Director, notifying all interested parties and successors in interest that the City of Carlsbad has issued a Redevelopment Permit by Resolution No. on the real property owned by the developer. Said Notice of Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specific for inclusion in the Notice of Restriction. The Housing and Redevelopment Director has the authority to execute and record an amendment to the notice which modifies or terminates said notice upon a showing of good cause by the developer or successor in interest. 11. The Developer shall prepare a detailed landscape and irrigation plan in conformance with the approved Preliminary Landscape Plan and the City's Landscape Manual. The plans shall be submitted and approved by the Housing and Redevelopment Director prior to the approval of the grading or building permit, whichever occurs first. The Developer shall construct and install all landscaping as shown on the approved plans, and maintain all landscaping in a healthy and thriving condition, free from weeds, trash, and debris. The Engineering Department is recommending that the project be approved subject to the following conditions: 45. Prior to building permit issuance, the applicant shall pay the local drainage area fee in conformance with the Master Drainage Plan. 57. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the applicant shall submit to and receive approval from the City Engineer for the proposed haul route. The applicant shall comply with all oonditions and requirements the City Engineer may impose with regards to the hauling operation. 4 Concurrent with on-site construction and prior to occupancy, the applicant shall install the following improvements in accordance with City standards: a. Removal of the existing driveway apron located at the north end of the project site on Madison Street, and replacing it with sidewalk. b. Removal of the existing driveway apron located at the south end of the project site on Madison Street, and relocating it to serve the adjacent parcel to the south. For the installation of these improvements, concurrent with building permit issuance, the applicant shall obtain a City right-of-way permit. B • Carlsbad, CA 92008-2389 • (619) 434-2810/2811 • FAX (619) 720-2037 ^ MINOR REDEVELOPMENT/COASTAL DEVELOPMENT PERMITS 95-01 RELOCATION OF PARKER OFFICE BUILDING ISSUES OF CONCERN The following issues must be resolved or adequately addressed before conditions can be assembled for the project and the item can be presented during a public hearing to the Design Review Board: ENGINEERING: 1. The site plan must indicate removal of the existing driveway apron fronting the lot on Madison Street, and replacing it with sidewalk. 2. The site plan indicates that drainage will be conveyed within the 5' wide sideyard on the north side of the lot. However, the City requires that lots are to be graded so that drainage is directed to a swale located a minimum of 5' from a building. In situations such as this one, where this is not possible, the City requires a letter from the applicant's soils engineer indicating his/her concurrence with the lot drainage layout. 3. In order to comply with surface pollutant mitigation requirements, all surface drainage from this lot should be directed to flow thru a natural or landscape area prior to discharge into the existing concrete swale in the alley. Engineering suggests that the applicant consider providing an additional landscape planter area along the north side of the lot for such purposes. The Engineering Department has provided a redlined check print set of the project. This set of plans must be retumed with the corrected plans to assist in continued review. PLANNING: 1, The site plan "notes and symbols" reflects a minor error. The numbers 2 and 4 on the plan do not correspond to the appropriate note; they have been reversed. The #2 is suppose to identify the concrete walk but on the plans it is related to the trash enclosure #4. This error should be corrected on the fmal plans submitted to the City. MINOR REDEVELOPMENT/COASTAL DEVELOPMENT PERMITS 95-01 RELOCATION OF PARKER OFFICE BUILDING COMMENTS The following comments are provided to assist you in obtaining building permits for the project and addressing security issues for the relocated building: BUILDING: The proposed sideyard setbacks do not comply with the Uniform Building Code requirement for the type of occupancy. This means that the exterior walls that are within twenty (20) feet of the property lines must be one-hour fire walls. These exterior walls must also have parapets, although there are some other ways to work around this requirement. Additionally, the openings in those walls (i.e., windows, doors, vents, etc.) must be "protected". This generally means that the openings have a particular fire rating. A condition will be placed on the project which will read as follows: "The applicant shall modify the existing structure to meet all current adoptive building codes of the City of Carlsbad." WATER DISTRICT: The Water District has agreed to waive the requirement for an Irrigation System designed to accept reclaimed water. Please note the Water District's comment regarding the "plotting of the project." LANDSCAPE CONSULTANT: The Plans must include information on the "Water Conservation Plan" for the project. Also, the Plans should indicate that the planting areas shall be irrigated with a permanent, automatic irrigation system. Please note the other comments made by the Landscape Consultant in regard to the plans submitted with your application. POLICE DEPARTMENT: Attached is a copy of a memo received from the Police Department's Crime Prevention Specialist, Jodeene Sasway. This memo includes recommendations from the Police Department regarding general building security and security for employees and patrons. March 29, 1995 To: Debbie Fountain From: Principal Building Inspector RP 95-01/CDP95-01 In reviewing the above application's plans for relocating an existing office to a new location, I noted that the building's proposed sideyard setbacks do not comply with the Uniform Building Code requirement for this type of occupancy. But, in case this verbal exchange gets lost (as they sometimes do), please incorporate some language in the conditions that reads like, "The applicant agrees to modify the existing stmcture to meet all current adoptive codes of the City of Carlsbad." This should assure that this matter will eventually get resolved at plan check for building permits. Aisles, passageways, and recesses related to and within the bulling complex shall be illuminated with an intensity of at least twenty-five one hundredths (.25) footcandles at the ground level during the hours of darkness. Lighting devices shall be protected by weather and vandalism-resistant covers. Open parking lots shall be provided with a maintatined minimum of one (1) footcandle of Hght on the parking surface during the hours of darkness. The numbers shall be not less than four (4) inches in height and be of a contrasting color to the wall in which they are affixed. Doors. Wood doors shall be of solid core construction with a minimum thickness of one and three-fourths inches. All swinging exterior wood and steel doors shall be equipped with a dead bolt. All doors shall be equipped with an astragal constructed of steel a minimum of .125 inch thick which will cover the opening between the door and frame or other door. The astragal shall be attached to the outside by means of welding or with non-removable bolts spaced apart on not more than ten inch centers. The jamb on all aluminum frame swinging doors shall be so constructed or protected to withstand 1600 pounds of pressure in both a vertical distance of three inches and horizontal distance of one inch each side of the strike, to prevent violation of the strike. Panic hardware shall be installed whenever it is required by the Uniform Building Code. All roof openings shall be secured. Windows. Moveable windows shall be equipped with security hardware.
