A requirement of the permit is that the City of Carlsbad and the Carlsbad Redevelopment Agency be listed as Additional Insured on your insurance policy. The most recent certificate of insurance on file expires or expired on 10/01/2003. If the certificate of insurance on file has not yet expired, please ask your insurance provider to ensure that a new certificate is sent to us upon renewal. If there is no certificate of insurance on file or if it has expired, please submit a current certificate of insurance within ten davs (10). If a current certificate of insurance is not received by the Carlsbad Redevelopment Agency, your permit may be revoked and/or the Outdoor Table & Chairs may be confiscated by Code Enforcement. Based on our discussion, it is my understanding that you desire to install a 'lemporary" transparent plastic curtail around the perimeter of the outdoor dining area, which will be lowered to provide protection for your customers against rain and wind. The position of the Housing & Redevelopment Department is that no additional materials may be added to your outdoor dining area to increase the degree of enclosure, including the installation of the aforementioned "temporary" curtain. Your outdoor dining area was approved through an administrative redevelopment permit (SRP97-01), which allowed a low railing to be installed on the public sidewalk in order to insure the tables and chairs within the outdoor dining area would not impede pedestrian traffic. However, all outdoor dining within the Village is intended to be seasonal in nature. In fact, this was one of the arguments presented to the City Council upon their approval of the use of outdoor cafes within the Village Redevelopment Area. Your outdoor dining area is located on public property and was intended to be a seasonal compliment to your indoor dining area; it was not intended to become a permanent addition to your restaurant. In our telephone conversation earlier today you mentioned leaves and flowers from the trees along Grand Avenue falling onto your outdoor dining area creating slippery conditions on the ground and impacting the service of food. As part of the redevelopment permit for the outdoor cafe you are responsible for maintaining a clean and safe outdoor dining area for your customers and staff. The City cannot prevent the natural cycle of the street trees, which were in place prior to your request to add the outdoor dining area in 1997. However, I will notify the Public Works Parks Division to sweep up the flowers that create the slippery condition along the sidewalks to prevent any trip hazards. The application and plans submitted for this project are complete and suitable for further engineering review. In addition, the Engineering Department made a preliminary review of the project for Engineering issues. Engineering issues which need to be resolved or adequately addressed are as follows: y\. Please have the applicant revise the site plan to indicate that a 5' clear distance is to be maintained between the seating area and the existing street elements, such as the light pole and the tree.
