Dear Bill:
On April 18, 1997, a notice was forwarded to you indicating that the City of Carlsbad's
Housing and Redevelopment Director approved Administrative Redevelopment/Coastal
Development PermitNo. 97-01. The approval was granted on April 3, 1997. The action
of the Director was subsequently appealed to the Design Review Board and a public
hearing was held on April 28, 1997. The Design Review Board made a determination at
the public hearing that the proposed project was not eligible for an administrative
redevelopment permit and required the applicant to proceed through the process for a
minor redevelopment and coastal development permit. The public hearing to consider the
minor redevelopment/coastal development permit is scheduled for Thursday, May 29,
1997. Attached is a copy of the notice for the hearing.
The proposed project is not appealable to the Califomia Coastal Commission. However,
we will forward a copy of the final action taken by the Design Review Board following
the May 29th public hearing.

Dear Bill:
On May 29, 1997, the City of Carlsbad's Design Review Board took action to deny the
Minor Redevelopment/Coastal Development Permit No. 97-01 for the conversion of a
medical office to a coffee house at 2924 Carlsbad Boulevard. The Board denied the
permit on the grounds that it did not provide for adequate parking. The decision was
appealed to the Housing and Redevelopment Commission and the Commission found
that the Board had erred in its decision because the project met the applicable parking
requirements. The Commission subsequently approved the permit with conditions,
following a public hearing on July 8, 1997.
Enclosed please find the "Notice of Final Action" with a copy of the application and the
staff report presented to the Commission on this item. If you need any additional

APPEALABLE TO THE COASTAL COMMISSION pursuant to Coastal Act Section
30603. An aggrieved person may appeal this decision to the Coastal Commission within ten
(10) working days following Coastal Commission receipt of this notice. Applicants will be
notified by the Coastal Commission as to the date the Coastal Commission's appeal period
will conclude. Appeals must be made in writing to the Coastal Commission's district office
at the following address: Califomia Coastal Commission, 3111 Camino Del Rio North,
Suite 200, San Diego, Califomia 92108-1725, Telephone (619) 521-8036.
The time within which judicial review ofthis decision must be sought is governed by Code of Civil Procedures, Section 1094.6,
which has been made applicable in the City ofCarlsbad by Carlsbad Municipal Code Chapter 16. Any petition or other paper
seeking judicial review must be fded in the appropriate court not later than ninety (90) days following the date on which this
decision becomes final; however, if within ten (10) days after the decision becomes final a request for the record of the
proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of such a
record, the time within which such petition may be filed in court is extended to not later than thirty (30) days following the date
on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. A written
request for the preparation of the record ofthe proceedings shall be filed with the City Clerk, City of Carlsbad, 1200 Carlsbad
Village Drive, Carlsbad, California 92008.
