Previously, staff had discussed holding a special meeting of the Design Review Board on December 15, 1997, to discuss your application. However, at their meeting on November 20, 1997, the Board decided to hold their next meeting at the regularly scheduled date of December 22, 1997. B • Carlsbad, CA 92008-2389 • (619) 434-2810/2811 • FAX (619) 720-2037 ROJAI^PPEAL ON REQUEST FOR VARIUVCE REDEVELOPMENT PERMIT 97-09 Following is a brief bullet point summary on the Rojas Appeal (RP 97-09) scheduled for the City Council meeting of February 10, 1998: • September, 1997, construction plans were submitted to the Building Department for a permit to add a 202 square foot room to an existing single family home located at 2650 Roosevelt Street; plans submitted by Contractor, Ideal Construction. • As part of its review of the building permit plans, Housing and Redevelopment determined that the plans did not conform to the requirements of the Carlsbad Village Master Plan and Design Manual because the site did not meet the applicable parking requirement - a two car garage. • Housing and Redevelopment Department Staff informed the applicant that the plans must be amended; they could not be approved as presented. • The Contractor amended the plans to include the two car garage. The plans were then • processed for approval of the building permit. • Upon inspection of the site, the Building Department discovered that the plans incorrectly indicated that the work was to be done entirely on one parcel of land. In fact, the garage was proposed for construction on a separate legal lot which was ovmed by the same property ovmer. The building permit was subsequently not issued; previous approval was revoked. • Since the same property ovmer ovms both lots, staff suggested that the property ovmer process a parcel merger so that the house and garage would be located on a single parcel. The Carlsbad Municipal Code does not allow a garage to be located on a separate lot. The merger of the lots would correct the problem. • The property owner does not wish to merge the two lots and has chosen, instead, to process a request for a variance from the parking requirement. • The request for a variance was reviewed by Staff and then forwarded to the Design Review Board for consideration. • Staff recommended denial of the variance because it could not be shown that there were exceptional circumstances or conditions applicable to the property that do not apply generally to other property in the same vicinity. Also, it could not be shown that the variance is necessary for the enjoyment of a substantial property right. • The property ovmer does not wish to merge the two parcels which would allow for construction of the required garage due to the cost associated with the processing. Also, the owner does not wish to expend the funds required to construct the garage. • The Design Review Board held a public hearing on December 22, 1997 to consider the request for the variance. The Board denied the variance with a 4-0 vote. Member Savary was absent. The Board indicated that they were sympathetic to the applicant's predicament, but did not feel that is was appropriate to grant the variance from the parking requirement. Memorandum TO: Management Analyst, Craig Ruiz FROM: Associate Engineer, Clyde Wicl<ham DATE: December 1, 1997 RE: RP 97 - 09, Rojas Room Addition We have completed our review of the redevelopment permit identified above. The proposed room addition is acceptable from an Engineering standpoint. We have a few comments that should be resolved before approval. The right of way for Roosevelt should be at least 60' wide. I believe it exists as 80' wide from the original development but the plans reflect a substandard street width. Ifthe roadway is 80' wide, similar to the adjacent properties, then the (23') setback shown is also incorrect. Proposed drainage or grading was not shown on the site plan submitted, and is considered an issue until it is resolved. We have no comment to the variance request for lack of parking or a 2 car garage. Shea: The application for the Variance on property located at 2958 Roosevelt Street cannot be accepted as submitted^ There are a few items missing from the submittal package. The application requires; eight sets of plans where four were submitted; the Variance justification form needs to be completed; the disclosure statement needs the applicant information on the front sheet (shown incorrectly as N/A); and three copies of a title report current within the last six months. The property owners list and labels should not be submitted with the initial application. They will be requested of the applicant when the project is scheduled to be heard by the decision making body. Please find enclosed a Variance submittal checklist for your reference. It has been discovered that your site plan does not accurately reflect your lot configuration. Until this matter has been resolved, all construction shall cease.
