This agreement is a condition of the issuance of this permit for the subject sidewalk/freestanding sign to be placed on the public right-of-way. I understand that an approved sidewalk/freestanding sign permit shall remain in effect for as long as sidewalk/freestanding signs are permitted within the Village Redevelopment Area and the permittee remains in compliance with the subject approved permit. We are requesting that you take into consideration the unique physical lay-out of our center in detennining your interpretation and application of the sandwich-board sign regulation. It is our belief that the sidewalk sign law which mandates that sidewalk signs be placed directly in front ofthe store, was intended for the typical situation where the store's entrance fronts on the street where the sandwich board sign would be placed, the same street where the owner derives his business. For example, if a store were located on Carlsbad Village Drive, it would make sense that the sandwich-board sign would be placed directly in front of that store on Carlsbad Village Drive, as that is the logical location for the sign to draw business visibility, without the sign being in front of the store of the merchant next door. Our center represents unique and unusual circumstances because the front of our center and the entrance to our center is at the side. This being true, all merchants in this center must be treated equally in order to be treated fairly. For example, if one tenant were to be allowed a sandwich board sign to be displayed on Carlsbad Blvd. at the comer of Carlsbad Blvd. And Oak, (We were told by Craig Ruiz, Redevelopment, that Kink's Beauty Salon sign is approved for visibility on Carlsbad Blvd.), then the other tenants should have the same right since the front of our center and the entrance to our center for all merchants in the center, is the same as it is for Kink's Beauty Salon: Carlsbad Boulevard. The side of our center is the front of our center and the front for every business in this center. Oak Street, is the side street, not the front street, because it has no entrance to our center. It is not the front of our businesses. Oak street always has cars parked along the curb, totally blocking any sidewalk sign, and it would render a sandwich board sign as totally useless. Requiring us to move our signs from our entrance at our front, would cause a very substantial loss of business to us. We have had no complaints from anyone regarding our present location of sandwich board signs located on Carlsbad Blvd., nor do they restrict passers-by in any way. It is very important that the signs remain at the main entrance to our center, Carlsbad Blvd. Our center does not front on the the side street (Oak). We feel that our center represents unique circumstances due to the unique way the center is laid out. We believe that placing our sandwich board sign at the entrance to our center, on Carlsbad Blvd., complies with the city ordinance requiring that the sign be placed directly in front of the business, because the side of our center is in fact the front of the business. We believe that we have the same right as the city has granted to other merchants, to place our sandwich board sign on the street that represents the front, the entrance, and the traffic and visibility for the business. To deny us this, we believe would represent selective enforcement ofthe sandwich board sign law. Page 2 Due to the unique lay-out of our center, to draw business, we must rely heavily on exposure to fraffic on Carlsbad Blvd. Our sandwich-board signs are the lifeblood of our business. When we signed the long term leases on our businesses here, we relied and trusted in the fact that we would be able to exercise the same right as other merchants, to have our sandwich board sign to be displayed at the entrance to our businesses. We do not believe that it was the intention of the drafters of the sign law, to force merchants to cause their signs TO FACE AWAY from the entrance to their business. Due to our unique situation, it would cause an unnecessary and very detrimental decrease in business if we were to be required to place our sidewalk signs to be totally blocked from visibility, behind cars and not on the main street which is the entrance and in fact the front to our center. We hope that the City of Carlsbad will consider the hard work and substantial investment that it took for us to totally transform this center from one that was boarded up and graffiti covered, into the modem and respectable looking center is today. Due to the unique layout of this center, the very survival of a business in this center depends upon adequate signage at the entrance to our center, and not on a minor side street. Because of the critical importance of this issue to us and to the city as it relates to the fiature success or failure of this shopping center, I am requesting that we be afforded the opportunity of a sit-down meeting with you, in order to discuss the issues. We are tmsting that the City of Carlsbad will try to work with us as a team to promote the appearance and welfare of our fine community.
