10. FINDINGS/CONDITIONS OF APPROVAL (IF APPLICABLE)
Findings:
1. The Planning Director has determined that the subject project is exempt from environmental
review per the California Environmental Quality Act (CEQA), Section 15301(e).
2. This approved permit serves as the required redevelopment and coastal development permits
for the subject project.
3. The Housing and Redevelopment Director has determined that the project is consistent with all
applicable development standards and land use policies set forth within the Village Master Plan
and Design Manual and Village Redevelopment Plan.
4. The Housing and Redevelopment Director has determined that the project is consistent with the
Carlsbad General Plan.
5. The approval of this administrative redevelopment permit is granted upon the condition that the
exterior improvements for the outdoor patio area at 390 Grand Avenue shall be made specifically
as noted on the approved project plans and the proposed business shall be operated as stated
within the subject permit application. Any changes to the outdoor patio and/or operation of the
business shall require prior written approval by the Housing and Redevelopment Director as an
amendment to this permit.

Conditions:
1. The project shall be completed according to, and be consistent with, the plans approved by the
Housing and Redevelopment Director on the date noted above. The approved plans have been
stamped by the Housing and Redevelopment Director and indicate the approval date of 8/11/98.
2. The project must comply with the latest State Disabled access regulations for existing buildings.
3. The applicant shall obtain all appropriate building and health department permits for
construction of the patio area, including the cooking facility (BBQ) and gazebo structures.
4. The applicant shall obtain an encroachment permit from the City of Carlsbad Engineering
Division, Public Works Department for any work to be completed within the public right-of-way.
5. The applicant shall pay all current fees and deposits required for any subsequent permits.
6. The applicant shall obtain a license from the State Department of Alcohol and Beverage Control
for the outdoor patio in order to serve alcoholic beverages within this area.
7. No outdoor storage of materials shall occur onsite unless required by the Carlsbad Fire Chief. In
such instance, a storage plan will be submitted for approval by the Fire Chief and the Housing
and Redevelopment Director.
8. Gates for the outdoor patio area shall be equipped with panic hardware. No other lock, latch,
deadbolt or similar security device is permitted.
9. Use of the subject outdoor patio area shall cease by no later than 10:00pm Sunday through
Thursday and by 12:00am (midnight) on Friday and Saturday evenings.
10. There shall be no food or drink service permitted to, or within, the patio area after 10:00pm every
night of the week, Sunday through Saturday. This means that no waiter or waitress, or other
employee or worker, of the business establishment may take orders for food or drink from, or
deliver food or drink to, the patio area after 10:00pm.
11. The City of Carlsbad and the Carlsbad Redevelopment Agency reserve the right to modify the
hours for operation of the outdoor patio area at any time based on citizen complaints, and/or
health, safety, or public welfare concerns.
12. There shall be no music of any type, or other entertainment of any type, allowed within this
outdoor patio area at any time of the day or week.
13. The applicant shall provide for at least twelve (12) new private (off-street) parking spaces within
at least 600 feet of the subject property within one (1) year of the date of approval of this permit.
The applicant shall be required to obtain approval of a separate administrative redeveiopment
permit from the Carlsbad Redevelopment Agency/City of Carlsbad for the required parking
facility and appropriate building permits to demolish the existing building on the subject site and
construct the required parking spaces.

applicant fails to conform to any of the above conditions of approval.
