Dear Mr. Burnette:
Enclosed please find a copy ofthe approved administrative coastal development/redevelopment permit
for the outdoor patio area for the existing Boar Cross'n located at 390 Grand Avenue. Please review the
conditions of approval carefully. You will be expected to fully comply with all conditions of approval for
the subject permit.
The final notice for your project approval was initiated on August 11, 1998. Please note that the public
has been given 10 days within which to appeal the Director's decision to approve your permit. If an
appeal is submitted, your permit will not be final until approved by the Design Review Board. You will
be notified if any appeals are submitted to the Housing and Redevelopment Department on or before
August 21st. If no appeals are submitted on or before August 21, 1998, your permit will be final as of the
date noted on the permit (8/11/98). Enclosed is a copy of your final plans approved by the Housing and
Redevelopment Director. All building permit and/or other applications must be consistent with these

ADDITION OF OUTDOOR PATIO AREA - BOAR CROSS'N

NOTICE IS HEREBY GIVEN that the Housing and Redevelopment Director of the City of Carlsbad has
nnade a final decision to APPROVE an Administrative Redevelopment and Coastal Development Permit
(RP/CDP 98-01) for installation of an outdoor patio area at Boar Cross'n, 390 Grand Avenue, which is
located on the northeast corner of Grand Avenue and Washington Street. The assessor parcel number is
203-173-04. The Housing and Redevelopment Director has determined that the proposed project does
meet all applicable development standards and is consistent with the Village Master Plan and Design
Manual.
The applicant for the administrative redevelopment permit is Ralph F. Burnette Jr. (property and business
owner).
The permit will allow for installation of a maximum of 39 seats outside the existing facility and within the
outdoor patio area. The outdoor patio area will be approximately 1160 square feet in size and will include
a cooking facility (outdoor BBQ and cabinet) and a Gazebo structure. The outdoor patio area will be
completely enclosed with a 5 foot, 6 inch block wall.
If you wish to appeal the decision of the Housing and Redevelopment Director on this matter to the
Design Review Board, you must file a written appeal with the Housing and Redevelopment Department
within ten (10) calendar days of the date of this decision/notice. The written appeal must be submitted
no later than 5:00pm on Friday, August 21, 1998. Appeal forms are available at the Housing and
Redevelopment Department located at 2965 Roosevelt Street, Suite B. The fee for filing an appeal of the
Director's decision to the Design Review Board is $400 plus public hearing noticing costs. The fee is
refunded if the appeal is won. If you have any questions regarding this permit or the final action, please

The Engineering Department has completed its review of the above referenced project for
compliance with the previously determined issues. The project appears to comply with City
engineering standards and all issues have been addressed. Please add the following conditions
of approval to the approving resolution or letter:
1. The developer shall pay all current fees and deposits required.
2. The owner of the subject property shall execute an agreement holding the City harmless
regarding drainage across the adjacent property.

COMPLETENESS & ISSUES REVIEW
Engineering Department staff has completed a review of the above-referenced project for
application completeness. The application and plans submitted for this proposed project are
considered complete. Additionally, staff has conducted a review of the project for engineering
issues of concern. Engineering issues which need to be resolved or adequately addressed prior
to staff making a determination on the proposed project are as follows:
/ O Show surface drainage patterns on property. Minimum flow permitted is at a 1 % grade.
— Surface drainage must flow to an authorized drainage course (i.e. public street, drainage
easement, etc.)

MEMORANDUM

Below are the Planning Departments comments regard the Boar Cross'n patio
expansion.
The plan should reflect the 20 foot easement at the rear of the property (at
existing driveway).
Please have applicant show that there is adequate parking to serve the new
patio area. 1 understand that Village Faire took 90 spaces out of the Grand
Av. parking lot. Per the Chapter six of the Redevelopment Master Plan and
Design Manual, it appears that there are various options on meeting the
parking needs. The new area will generate a demand for 24 new parking
spaces based on the 1:50 ratio.
There is a concern of the outdoor use adjacent to the residential use behind
the patio area. There could (will) be a conflict of use. There should be a
condition thatthe patio cease operation at 10:00 p.m. (or whatever time is
reasonable and could be agreed upon)
It appears that the new proposed trash enclosure is placed over the property
line of the adjacent property.
The project will be exempt from CEQA review (15301(e)) and a notice of
exemption will be sent out upon approval of the project.
