Please remove the tables and chairs that are placed in front of the adjacent business to the west on Grand Avenue. Your permit only allows the tables and chairs to be placed in front of your restaurant. In addition, the outdoor tables and chairs do not comply with the location and development criteria for sidewalk cafes. Most notably, the tables and chairs do not comply with the following critena: • Per condition number six (6), you are allowed to place a maximum of 8 tables and 18 chairs outside of your restaurant along Roosevelt Street and Grand Avenue • A clear area of at least five feet In width must be maintained for pedestnan use over the entire length of the sidewalk in front of the business. As a courtesy to you, I am sending you this letter before this becomes a code enforcement issue. An ongoing requirement of the permit is that you maintain a valid certificate of insurance for the item(s) within the public right-of-way naming the City of Carisbad and the Carisbad Redevelopment Agency as additional insured. The certificate of insurance we currently have on file expired on September 5, 2002. If you would like to continue to display the outside table and chairs within the public right-of-way, please have your insurance carrier forward to us an updated insurance certificate within 10 business days of the date of this letter. Othen/vise, the items must be removed from the public right-of-way. Thank you for your immediate attention to this matter. A requirement of the permit is that the City of Carlsbad and the Carlsbad Redevelopment Agency be listed as Additional Insured on your insurance policy. The most recent certificate of insurance on file expires or expired on 09/05/89. Ifthe certificate of insurance on file has not yet expired, please ask your insurance provider to ensure that a new certificate is sent to us upon renewal. If there is no certificate of insurance on file or if it has expired, please submit a current certificate of insurance within ten davs (10). If a current certificate of insurance is not received by the Carlsbad Redevelopment Agency, your permit may be revoked and/or the Outdoor Table & Chairs may be confiscated by Code Enforcement. Staff can now proceed with the final process to approve your permit. The next step is a 10 day notice to all property owners within 300 feet of your business establishment.
