The City of Carlsbad's Redevelopnnent Agency has completed the review and
processing of your application for an Administrative Redevelopment Permit to
allow tables and chairs to be placed within the public right-of-way for use as a
sidewalk cafe at Don's Country Kitchen located at 2885 Roosevelt Street. The
permit has been approved. A copy of the approved permit and corresponding
site plan are enclosed for your records. Please read all conditions contained
within the permit carefully. It is very important that you understand these
conditions and that you comply with them. Violation of the conditions could
result in revocation of this permit. In addition, please be aware that the site plan
shows the approved location of the outdoor tables and chairs. Adherence to the

NOTICE IS HEREBY GIVEN that the Housing and Redevelopment Director of the City of Carlsbad has made a
final decision to APPROVE an Administrative Redevelopment Permit (RP 98-06) for the installation of tables
and chairs for a Sidewalk Cafe at Don's Country Kitchen, 2885 Roosevelt Street, which is located on west side
of Roosevelt Street between Grand Avenue and Beech Street. The assessor parcel number is 203-291-01.
The Housing and Redevelopment Director has determined that the proposed project meets all applicable
development standards for sidewalk cafes and is consistent with the Village Master Plan and Design Manual.
The applicant for the redevelopment permit is Rosa Hernandez (restaurant owner).
The permit allows for the installation of 5 tables with umbrellas and 20 seats outside the existing restaurant,
within the identified sidewalk area. The tables will be located along the east side of the building and will be
placed as close to the building as possible. The seats shall be placed in a manner which allows for a clear
pedestrian area of at least 5 feet.
If you wish to appeal the decision of the Housing and Redevelopment Director on this matter to the Design
Review Board, you must file a written appeal with the Housing and Redevelopment Department within ten (10)
calendar days of the date of this decision/notice. The written appeal must be submitted no later than
5:00pm on October 11, 2001. Appeal forms are available at the Housing and Redevelopment Department

Dear Ms. Hemandez:
The purpose of this letter is to inform you that the processing of the pennit for the
placement of tables and chairs on the public sidewalk adjacent to your restaurant was
never completed. While this has in no way affected your ability to use the outdoor tables
and chairs in conjunction with your restaurant, there is the potential for it to affect the on-
going use of the outdoor dining area. Therefore, the Housing & Redevelopment
Department is committed to providing as much assistance as possible to aid in the
completion of the pemiit process for the benefit of all parties involved.
To assist you in the final completion of the permit process, Linda Holmes, a recent
addition to our staff, has been assigned the task of working with you to complete the
application process. Within the next few weeks she will be contacting you to schedule a
site visit and discuss any additional information needed to complete the approval process
for your application.
Please accept our apology for the lengthy delay in getting your permit application for
sidewalk table and chairs processed. Thank you for your patience and cooperation in

Dear Ms. McAnally:
Thank you for submitting the revised site plan as requested in my letter to you dated November 13,
1998. As stated in my letter, the revised site plan was required along with a couple of other items
in order to complete the administrative redevelopment permit application to allow outdoor tables
and chairs within the public right-of-way for your business located at 2885 Roosevelt Street. The
purpose of this letter is to update you on the necessary items still needed to complete the
application.
First, as we discussed in our telephone conversation last week, I have received the Certificate of
Insurance from your insurance company with the required original signature. Also, as previously
stated, I have received the revised site plan showing the umbrellas as having a 5 foot diameter
when fully extended. However, I am still waiting on the following information to complete the
processing of the permit:
• Photographs or brochures of the tables and chairs showing their design and color. I understand
that, as of last week, you have been unable to acquire this information from local vendors.
Since this information is necessary in order to complete the application process, you may want
to seek an altemative design for the tables and chairs if the ones you have chosen are
unavailable.
• The following information is still needed on the site plan:
• Clearly show a 5 foot wide unobstructed walkway, measured from the end of the fullv
extended umbrellas to the edge of the curb:
• The height of the umbrellas; and
• A description of the umbrella materials (e.g. fabric or canvas with plastic or metal
base and pole) and colors.
Once the additional information is submitted I can finalize the processing of your application.

This letter is a follow-up to the letter sent to you on June 22, 1998 addressing the status of
your application for an administrative redevelopment permit to allow outdoor tables and
chairs within the public right-of-way as related to your eating establishment located at 2885
Roosevelt Street. The previous letter, which has been attached for your review, identified
several items of additional information which are required before your application may be
approved. To date, none of the items listed have been received by our department. An
original Certificate of Insurance naming the City of Carlsbad and the Carlsbad
Redevelopment Agency as additional insured, along with photographs of the tables and
chairs, and a revised site plan containing the information as outlined in the attached letter
are still required.
Please submit the requested information to the Housing and Redevelopment Department as
soon as possible, but no later than 30 days from the date of this letter. If you have any
questions regarding the information contained in this or the previous letter, please contact

Dear Mr. & Mrs. McAnally
Thank you for submitting your application for an administrative redevelopment permit to allow
outdoor tables and chairs within the public right-of-way as related to your eating establishment
located at 2885 Roosevelt Street. The permit application and related plans you submitted on June
5, 1998 have been reviewed by the Departments of Planning, Engineering and Redevelopment.
The application has been deemed complete for further processing. However, additional
information is required before your application may be approved.
First, an original Certificate of Insurance in the amount of $1 million, naming the City of
Carlsbad and the Carlsbad Redevelopment Agency as additionally insured, must be submitted to
the Housing and Redevelopment Department as part of the application package. The Certificate
received by the Redevelopment Department does not have an original signature. In addition, the
City of Carlsbad and the Carlsbad Redevelopment Agency have not been specifically listed as
"additional insured" on the certificate submitted with your application. An original Certificate of
Insurance will be required before final approval can be given for the subject permit. Second,
since the site plan you submitted is the official document approved which regulates the location,
design, etc. of the tables and chairs, the followiiig additional information must be submitted as a
formal supplement to it:
• Additional Information is still needed on the design of the tables and chairs, including their
color. If you wish to do so, you may provide photographs (or brochure pictures) of the tables
and chairs to be used as exhibits to your plans. If used, the photographs must clearly show the
design and colors of the tables and chairs. This information will be needed before the permit
can be approved and issued. I understand that you did not have this information when the
application was submitted, but it will be needed in order to final the permit. Please indicate
what your intent is at this time. If it changes at a later date, an amendment can be processed
to your approved permit.

• If you will continue to use umbrellas, information is required on the umbrellas to determine
whether or not they meet the requirements. Please provide information on the height and
diameter of the umbrellas when fully extended. Also, please indicate the diameter of the
umbrella on the site plan itself. If the umbrella, when open, extends past the tables, we need
to determine whether or not this interferes with the pedestrian traffic. Therefore, it is
important that you provide this information visually on the plans. In addition, please provide
information on the umbrella materials (e.g. fabric with plastic base and pole) and color(s).
Again, thank you for your cooperation in submitting the required application for a permit to
maintain placement of your tables and chairs within the public right-of-way. The Carlsbad
Redevelopment Agency will continue processing your permit application as soon as we receive
the additional information requested above. Please submit the required information directly to
the Housing and Redevelopment Department as soon as possible, but not later than 30 days from
the date of this letter. If you have any questions regarding this correspondence, please contact

I offer the following comments:
1. Per the Redevelopment Master Plan and Design Manual (Manual), have the
applicant show on the plans:
a. The five foot clear area to the building entries.
b. The color of the proposed furniture and of the building to ensure
uniform colors are being used.
X c. The location of trash receptacles provided.
2. It appears that the Manual does not require any additional parking for the
sidewalk tables and chairs.
Applicant should be conditioned to adhere to the Location and Development
. Criteria as stated in the Manual.
^ 4. The proposal is Exempt from CEQA review and a notice of exemption will be
filed upon approval. (Let me know when it is approved.)
