The change in land use of the property required approval of an administrative redevelopment permit. The applicant applied for said permit and it has been finalized. A copy of the conditions of approval are attached for inclusion into the building permit. In particular the following conditions are to be incorporated into the building permit process: 1. Sign permits have not been approved as part of the administrative redevelopment permit. The business owner shall be required to submit a separate sign permit application and obtain separate approval from the City of Carlsbaci prior to installation of any new signage on the subject property and/or buildings. 2. All thirteen (13) required parking spaces shall be installed to the satisfaction of the Engineering and Building Departments prior to the issuance of the certificate of occupancy for Phase I. 3. The administrative redevelopment permit approval shall become null and void if building permits are not issued within twelve (12) months from the date of project approval for Phase I and eighteen (18) months from the date of project approval for Phase II. Attached is a copy of the approved permit authorizing the requested change in land use from retail/office and residential to medical therapy office. Please review all conditions carefully. Violation of the conditions could result in revocation ofthis permit. Please note that the permit does not provide approval for any signs related to the business to be established on the property. The business/property owner will be required to complete a separate application and obtain separate approval from the City of Carlsbad for any signs to be installed on the property or buildings. In addition, the conditions of approval include specified periods of time for the completion of both phases of the project. Before initiating any construction on the site, you must complete the process to obtain the appropriate building permits to construct the improvements both inside and outside the buildings. The Redevelopment Department, together with other appropnate city departments, have reviewed your Administrative Redevelopment Permit application No. RP 98-12 to determine its completeness for further processing. Your redevelopment permit application was received for processing on October 6, 1998 and has been deemed incomplete for further processing as of the date of this correspondence. The items listed below fall into two categories. The first items contain information which must be submitted to complete your application. No processing of your application can occur imtil the application is determined to be complete. The second list of items are issues of concem as identified by staff When all required information and materials are submitted, the City has 30 days to make a determination of completeness. If the application is deemed complete, processing for a decision on the application will be initiated. ITEMS NEEDED FOR COMPLETENESS 1. A completed Environmental Impact Assessment Form - Part I. (Form has been attached for your use.) 2. Four (4) copies of a revised site plan with the following additional information: Dimensions of vehicular access points and all off-street parking spaces; Distance between buildings and/or structures; Building setbacks (front, rear, and sides); Height, materials, and location of all walls and fences (label existing or new); Include a reference to Land Use District 1 in the summary table; A breakdown of the proposed uses showing square footage totals for each use; Name of sewer, water and school districts providing service to the site; Show drainage pattems; and Indicate project location on vicinity map. 1200 Carlsbad Village Drive • Carlsbad, CA 92008-1989 • (760) 434-2821 • FAX (760) 720-9461 ^ David Haltunnen OCTOBER 22, 1998 Page 2 3. Four (4) copies of existing and proposed floor plans for all buildings on the site. 4. Three (3) copies of the Preliminary Title Report (current in the last six (6) months). 5. One set of mailing labels containing the names and addresses of all property owners within a 300 foot radius of the subject property. (Note: Two separate sets of labels are required and only one set was submitted with the original application.) Also, please include two sets of mailing labels for yourself and the property owners. 6. The addition of any new signage or changes to existing signage requires approval of a separate sign permit prior to installation. Otherwise, if you choose to process the sign permit concurrently with the Redevelopment Permit the following information must be added to the plans: • Location of all existing and proposed signs for the property. • Distance to the property line(s) for all proposed freestanding signs. • Elevations for all proposed signs which specifies the following: a) dimensions and area for all existing and proposed signs; b) materials the sign(s) will be constructed of; and, c) proposed sign copy. • A summary table which includes: a) total building street frontage; b) total signage allowance based on Village Master Plan and Design Manual; c) the amount of all existing signage and type; d) the amount of signage to be removed and type; e) the amount of new signage proposed and type; and f) notes on existing sign permits for the site. ISSUES OF CONCERN Building Department: The buildings need to be upgraded in all respects to comply with the Uniform Building Code standards for a type B occupancy. These issues include, but are not limited to: • Side yard setbacks and the fire resistivity of the exterior walls; • Accessibility to all buildings on-site; • Fully accessible interior spaces; and • Electrical and mechanical systems that comply with commercial standards. These issues will be required to be addressed in the building plans for the project and will be reviewed for code compliance by the Building Department during plan check. Engineering Department: 1. The parking spaces in the alley must be moved deeper into the lot to allow for a full 24 feet of backup space from the rear of the parked vehicle to the far edge of the alley. This should be shown on the revised site plan. David Haltunnen OCTOBER 22, 1998 Page 3 2. The driveways on Madison Street should conform to City standards, mainly the top of flares of the driveways should be a minimum of three feet away from the projected property line. 3. Drainage patterns should be shown on the site plan. Pay particular attention to make sure that the drainage is directed either towards the alley or towards the street and does not cross property lines nor pond on-site. 4. Any broken or damaged curb, gutter, sidewalk or alley on the frontage of the property will be required to be repaired with the construction of this project. A "red-lined check print" of the plans has been attached for additional clarification of the issues identified above. Please return the "red-lined check print" with the four (4) sets of revised plans in order to expedite the review process. Once the additional information is received the application will be deemed complete for further processing. Staff will then distribute a notice initiating the ten (10) day public review and comment period on the proposed project. Once the public review and comment period is complete, staff will present the project to the Housing and Redevelopment Director for final decision. The decision of the Housing and Redevelopment Director is subject to a ten (10) day appeal period. The parking spaces in the alley must be moved deeper into the lot to allow for a full 24 feet of backup space from the rear of the parked vehicle to the far edge of the alley. It appears from the site layout that this can easily be achieved. The driveways on Madison Street should conform to City standards, mainly the top of flares of the driveways should be a minimum of three feet away from the projected property line.
