FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 2 The following findings have been made in order to approve the Administrative Redevelopment Permit for the addition of outdoor tables and chairs and a wind screen around the existing patio area on the south side of Dini's By The Sea restaurant: 1. The Housing and Redevelopment Director has determined that the project is consistent with all applicable development standards and land use policies set forth within the Village Master Plan and Design Manual and Village Redevelopment Plan. 2. The Housing and Redevelopment Director has determined that the project is consistent with the certified local coastal program and the goals and objectives of the Coastal Commission for the portion of the Village Redevelopment Area which lies within the Coastal Zone Boundaries. 3. The Housing and Redevelopment Director has determined that the project is consistent with the policies, goals and action programs set forth within the Carlsbad General Plan. ^ Page 2 of 2 4. The Planning Director has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301 (e), of the State CEQA Guidelines and will not have an adverse significant impact on the environment. The following conditions have been approved for the subject project: 1. This approved permit serves as the required redevelopment and coastal development permits for the subject project. 2. The project shall be completed according to, and be consistent with, the plans approved by the Housing and Redevelopment Director on the date noted above. The approved plans have been stamped by the Housing and Redevelopment Director and indicate the approval date of 7/12/99. The originally proposed awning has been removed from the plans and is not approved as part of this permit. 3. Prior to the placement of tables and chairs in the existing patio area, the applicant shall submit building plans to the Building Department for approval of proposed occupancy and exiting requirements. The number of seats permitted in the patio area shall not exceed the maximum number of seats set forth by the Building and Fire Departments based on Uniform Building Code occupancy load requirements. 4. A minimum 42" wide unobstructed path of travel shall be provided from entrance door to stairway. Other exiting requirements shail be reviewed by the Fire Marshall during plan check. 5. The project must comply with the latest State Disabled access regulations for the existing building. 6. The appiicant shall obtain a license from the State Department of Alcohol and Beverage Control for the outdoor patio in order to serve alcoholic beverages within this area. 7. As stipulated in the project description, the use of the subject outdoor patio area shall cease by no later than 10:00 p.m. Sunday through Saturday. 8. The City of Carlsbad and the Carlsbad Redevelopment Agency reserve the right to modify the hours of operation of the outdoor patio area at any time based on citizen complaints, and/or health, safety, or public welfare concerns. 9. This permit shall be subject to revocation by the Housing and Redevelopment Director if the applicant fails to conform to any of the above conditions of approvai.
