Re: Outdoor Dining Enclosure
Dear Robbie,
I am sending this letter to inform you that the addition of the plastic curtain around your outdoor
dining area at Vigilucci's Cucina Italiana located at 2943 State Street is in violation of your
administrative redevelopment permit (RP99-10) and must be removed immediately. I
understand your reasons for wanting to install the transparent plastic curtail around the
perimeter of the outdoor dining area in order to provide protection for your customers against
rain and wind. However, it is the position of the Housing & Redevelopment Department that no
additional materials may be added to your outdoor dining area to increase the degree of
enclosure, including the installation of the transparent curtain.
Your outdoor dining area was approved through an administrative redevelopment permit, which
allowed a low railing to be installed on the public sidewalk in order to insure the tables and
chairs within the outdoor dining area would not impede pedestrian traffic. However, all outdoor
dining within the Village is intended to be seasonal in nature. In fact, this was one of the
arguments presented to the City Council upon their approval of the use of outdoor cafes within
the Village Redevelopment Area. Your outdoor dining area is located on public property and
was intended to be a seasonal compliment to your indoor dining area; it was not intended to
become a permanent addition to your restaurant. Therefore, the plastic enclosure must be
removed.
Please understand we have denied requests to install similar enclosures at other restaurants
with comparable outdoor dining areas. The Housing & Redevelopment Department has
considered these requests, but has maintained the position that windscreens or enclosures of
any kind shall be prohibited for the reasons discussed above. Your cooperation in resolving
this matter in the most expeditious manner possible is requested.

Dear Roberto:
Enclosed please find your approved permit for the sidewalk cafe for Vigilucci's
Cucina Italiana restaurant located at 2943 State Street. Please review the
conditions of approval carefully and contact my office if you have any questions
about the conditions for the subject project. You my now proceed with the
installation of the fencing around the sidewalk cafe area, as set forth on your
approved plans. Please note that prior to the installation of the iron fencing, the
City's Parks Crew will have to relocate the two landscape planters presently in
front of the existing restaurant. I have contacted our Parks Supervisor and 1
have been told that he neejls a 1-2 day lead time to coordinate the use of a fork
lift to move the planters. We will try to have the planters moved as early as
Tuesday morning, October 5*^ 1 will notify you as soon as possible if this date
changes.

Recording of Encroachment Agreement for Vigilucci's Cucina Italiana
Your assistance is requested in taking the action necessary to record the
attached encroachment agreement against the property located at 2943 State
Street. All signatures have been acquired, except the City Attorney's. The City
Attorney's office must still review the document for proper form before it is sent to
the County Clerk for recordation. It is my understanding that you will handle the
routing of the document through the City Attorney's office before preparing it for
recordation. In the interest of expediting this project, please call me to pick up a
copy of the signed document following the City Attorney's approval. Please
forward a copy ofthe final recorded document to my office upon completion.

Re: ENCROACHMENT AGREEMENT FOR SIDEWALK CAFE
VIGILUCCI'S CUCINA TALIANA
Dear Roberto:
As a condition of approval for the outdoor cafe permit (RP99-10), you and the
property owners are required to enter into, and record, an encroachment
agreement between you, the property owners and the City of Carlsbad for the
installation of the enclosure for the sidewalk cafe. This agreement is required
due to the permanent nature ofthe enclosure within the public right-of-way.
I have enclosed the applicable Encroachment Agreement for your review. The
agreement must be signed by both you and Leor & Ophira Lakritz, as the
property owners. Please note that all signatures must be notarized. Once the
agreement has been signed and notarized, please return it to my office for final
execution.
As soon as the agreement has been forwarded to my office, I will be able to
complete the processing of the administrative redevelopment permit for the
sidewalk cafe. If you have any questions regarding the enclosed document,

SUBJECT: Vigilucci's Cucina Italiana, 2943 State Street, Carlsbad, CA
Request For Outdoor Tables and Chairs (RP99-10)
Thank you for applying for a Land Use Permit in the City of Carlsbad. The Housing and
Redevelopment Department, together with other appropriate City departments has
reviewed your Administrative Redevelopment Permit, application no. RP 99-10, as to its
completeness for processing.
The application has been found compiete for further processing. However, additional
information is required before your application may be approved. Although the initial
processing of your application may have already begun, the technical acceptance date is
acknowledged by the date of this communication. Before the first ten-day public review
period can commence you must submit the following information to the Housing and
Redevelopment Department:
1) A revised site plan showing the location of the existing street tree and the surrounding
tree grate in front of the business. The location of the metal railing surrounding the
outdoor tables and chairs may not be any closer than 5 feet to the perimeter of the tree
grate.
2) A drawing (or photograph) of the proposed tables and chairs and a notation on the
plans indicating the color of the building facade. In approving the permit, we are
required to ensure that the colors of the tables and chairs are consistent with the
building color(s).
3) The regulations for the outdoor tables and chairs require that there be 5 feet of
clearance around all entrances and exits from the building. Therefore, please indicate
on the plans that you have provided for this clearance on both sides of the doors and in
front of the doors. No tables or chairs are allowed to encroach into this 5 feet of
clearance.
4) Public notification package including radius map and two separate sets of the property
owners list and mailing labels. The property owner list must be typed and contain the
names and addresses of all property owners within a 300 foot radius of the subject
property (including applicant and/or owner). The list shall include the San Diego County
Assessor's parcel number from the latest assessment rolls. Except for single family
residences, the apartment or suite number must be included on the address mailing
labels for property owners within 300 feet of the subject property; the parcel number
should not be typed on the address labels. The radius map must be provided with a
scale not less than 1" = 200' showing each lot within 300 feet of the exterior

boundaries of the subject property. This information can be obtained from a Title
Company.
5) An original Certificate of Insurance in the amount of $1 million, naming the City of
Carlsbad and the Carlsbad Redevelopment Agency as additionally insured.

I offer the following comments:
1. Per the Redevelopment Master Plan and Design Manual (Manual), have the
applicant show on the plans:
a. The color of the building and outdoor furniture to ensure uniform colors
are being used.
b. The permit should not be issued until the planter boxes have been
removed. (Why are the planters being removed?)
2. It appears that the Manual does not require any additional parking for the
sidewalk tables and chairs.
3. Applicant should be conditioned to adhere to the Location and Development
Criteria as stated in the Manual.
4. The proposal is Exempt from CEQA review and a notice of exemption will be
filed upon approval. (Let me know when it is approved.)
