For your information, ESA has already placed an order for four (4) site light deflectors which we are told have a lead time for delivery of about 4 to 6 weeks. ESA agrees that once they arnve, we shall have them installed and reviewed by planning to ensure compliance with applicable regulations. As we already have all necessary inspection sign-offs on our building inspection card, we do not expect this matter to hold us up from opening for business. A copy of my September 24*^ letter is attached for reference purposes. The purpose of this letter is to confirm that, as of October 11, 2001, I received verbal support from all affected neighbors (Lough, Calabrese, Dailey, and Adams) for Option 2 as outlined in my September 24*' correspondence. This option will increase the height of the proposed retaining wall along the easterly property line in order to incorporate an additional six (6) foot high wall as measured from finished grade of the Extended Stay America Hotel site. The wall will consist of a decorative two-sided split-face concrete block. The consensus from everyone involved is that the higher wall is greatly preferred to a retaining wall/fence combination, described under Option 1 of the attached letter, and will serve to better mitigate noise and light impacts from the hotel parking lot. I have also attached a copy of the approved building plans showing the varying heights of the wall as viewed from your property. These plans are now the property of the City of Carlsbad and have been filed for permanent record with this office. The City of Carlsbad requires that contractors obtain a right-of-way permit prior to constructing any improvements within putilicly dedicated streets or easements. Since the improvements reflected on your improvement plans fall within this category, you must first obtain a right-of-way permit prior to initiating your construction activities. You may obtain a right-of-way permit by making application at our Engineering Development Services Counter at 1635 Faraday Avenue. This is a "no-fee" permit. A Right-of Way Permit Submittal Package is attached for your convenience. The following items need to be submitted and/or approved prior to the issuance of a right-of-way permit: 1. Completed application form. 2. Contractors state license number and class (type). 3. City of Carlsbad Business License number. 4. Certificate of insurance in the amount of $1,000,000 naming the City of Carlsbad as "additional insured" and as "certificate holder". 5. Five (5) blueline sets of the signed improvement plans (one set of bluelines is for the Utilities Department). 6. As part of your permit approvai, application with the Utilities Department will be required to tap into sewer, water and/or reclaimed water lines. In addition, if your project requires a grading permit you must complete the items listed on the completion of Grading Plancheck Letter and receive approval on a grading permit prior to or concurrent with the issuance of a right-of-way permit. You may obtain the blueline sets and any other plan reproductions you desire through one of the several bonded blue print firms in the area at your cost. Your Right of Way Permit will be issued when all the above noted requirements have been completed. After permit issuance, contact the Engineering Inspection Request Line at 760-438- 3891 to set up a preconstruction meeting with your inspector. You will receive your copy of the permit during the preconstruction meeting with your inspector. In addition, I intend to clarify the Redevelopment Agency's position on the proposed retaining wall along the westerly property line of the Extended Stay America site. In accordance with the City Council/Housing & Redevelopment Commission approval of the Extended Stay America project, a 6 foot high wall is to be instailed along the entire west side of the property. The purpose of the wall is to help mitigate light and noise from adjacent parking spaces. Extensive landscaping is to be installed along the east side of the wall to further buffer the residential homes from activity on the hotel site. As the project has moved into the construction phase, it has become apparent that a retaining wall will be needed along a majority of the westerly property line. The height of the retaining wall varies from 0 to 6 feet, with the lowest points of the retaining wall along Laguna Drive and Grand Avenue and the highest points of the retaining wall at the center of the property. To mitigate impacts from drainage, noise and light staff has been working with Extended Stay America to come up with a solution to insure adjacent residential properties are protected to the fullest degree possible. Taking into consideration specific constraints, such as the required landscaping on the east side of the wall and the physical ability of the retaining wall to withstand the load of a separate 6' high concrete block wall on top of it, a retaining wall/fence combination was determined to be the most aesthetically appealing as viewed from the single family residences to the west of the subject property. In a joint meeting between City staff and representatives of Extended Stay America it was decided that a 6-foot high double-sided "fence" setback one foot from the top of the retaining wall would be installed. The fence would be constructed out of white Trex fence material. The one foot setback from the retaining wall would allow landscaping to be planted on the west side of the fence helping to break-up the overall height of the wall/fence combination. Again, it was staff's position that this would be the most aesthetically appealing as viewed from the neighbors to the west. Extended Stay America proceeded with the processing of the building plans with the incorporation of this fence/wall combination. After building plancheck was initiated, the neighbors to the west have found staff's decision on the fence/wall combination to be unacceptable. In the public hearing for Staybridge Suites, the prior developer on the site, they were assured by both the City Council and the developer of the project that a 6-foot wall would be installed at the top of the slope separating their properties from the hotel site. This wall was also shown on the plans submitted by Extended Stay America. As stated previously, it wasn't until the construction phase that we realized a retaining wall would be needed as well. 2965 Roosevelt St., Ste. B • Carlsbad, CA 92008-2389 • (760) 434-2810/2811 • FAX (760) 720-2037 While a building permit for the retaining wall/fence combination is currently being processed, I am requesting that Extended Stay America modify the retaining wall permit to incorporate an additional 6-foot high concrete block wall as measured from the hotel site. The upper 6 feet of the wall will block light and noise from the hotel property, but will result in varying heights as viewed from the residential properties. It is also requested that the wall consist of two-sided split-face concrete block as currently shown on the plans. The overall height of the wall should be no higher than the retaining wall/fence combination as previously shown on the plans prepared by Wallace Wong. I have spent a considerable amount of time reviewing the varying heights of the increased height retaining wall with the neighbors to the west. They believe this is the best solution to meet their concerns and agree to the additional height. I believe this is the most expeditious solution to this matter. The neighbors originally felt the retaining wall/fence combination did not resolve their concerns and was inconsistent with the plans approved by the City Council. Until we came up with this solution, they were intending to ask the City Council to reinvestigate this issue, which could have potentially added considerable time to the process. To assist with expediting the change to the retaining wall permit I have received authorization from the Building Department to process the revisions internally, which may require a turn around time of a few days. The Building Department will need a copy of the site plan with a wall detail at each section where it is applicable. The wall design must be stamped by a structural or civil engineer and include a structural detail. The overall height will not change if the height of the retaining wall is increase to 6 feet above the finished grade of the hotel property (Option 2). Your assistance is being requested in reviewing the enclosed plans and informational handout on Trex fencing. Please discuss the options amongst yourselves and get back to me verbally by telephone with your preference. As you know the grading is almost completed on the hotel site and the developer will be moving fon/vard with construction of the retaining wall in the very near future. BERNARDO DRIVE, #239D SAN DIEGO, CA 92127 Subject: Determination of Substantial Conformation for Extended Stay America (PRE 00-65) Dear Mr. Carpenter: This letter shall serve to inform you that following a detailed staff review of the plans submitted in conjunction with the Extended Stay America Hotel Project (PRE 00-65) to be located on property located west of Interstate 5 between the terminus of Grand Avenue and the terminus of Laguna Drive (APN 203- 130-15, 18, 20, 34), staff has determined that the modified plans are not in substantial conformance with the project plans approved by the Housing and Redevelopment Commission on August 1, 2000. A copy of the Guidelines for Substantial Conformance Determinations (Policy No. 35) has been attached for your review. The Guidelines establish ten findings/criteria for determining the substantial conformance of a modified project. Of the ten required findings, the one that staff cannot make is the last finding that reads: 'The proposed change would not be readily discernible to the decision makers as being substantially different from the project as originally proposed." It is staff's opinion that the modifications made to the site plan constitute a significant improvement to the overall project layout, especially in terms of vehicular circulation, increased setbacks, and increased landscaping. However, the reduced building mass, reduction in the number of windows, and modified architectural elements on the ends of the building result in the revised project being "readily discernible" from the approved project. At this point staff does not see any way to further modify the plans to make all the necessary findings for substantial conformance. As the applicant, you have the following options to further pursue approval of the modified plans: 1) process an application for an amendment to the approved major redevelopment permit to allow for the new design; or 2) appeal staff's decision on substantial conformance to the Housing and Redevelopment Commission. Since you have already prepared the necessary plans to process an amendment to the approved major redevelopment permit and you have stated that time is of the essence, staff recommends submitting an application for the amendment and taking the project forward for final decision by the Housing & Redevelopment Commission. We did receive a letter dated July 12, 2000 from the applicant, Sandor Shapery, stating he was entering into an Irrevocable Offer of Dedication (IOD) and a slope rights/drainage easement in order to begin construction of the motel. However, we have not received a copy of a Site Plan showing the right of way dedication. Please fonA/ard to us a copy of the Site Plan so we may complete our files on this project, and be assured that the right of way will be available to Caltrans when we begin the 1-5 widening project.
