10. FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 2
The following findings have been made in order to approve the Administrative Redevelopment
Permit for the addition of two modular classrooms to provide temporary classroom space for the
Army and Navy Academy:
1. The Housing and Redevelopment Director has determined that the project is consistent with all
applicable development standards and land use policies set forth within the Village Master Plan
and Design Manual and Village Redevelopment Plan.
2. The Housing and Redevelopment Director has determined that the project is consistent with the
certified local coastal program and the goals and objectives of the Coastal Commission for the
portion of the Village Redevelopment Area which lies within the Coastal Zone Boundaries.
3. The Housing and Redevelopment Director has determined that the project is consistent with the
policies, goals and action programs set forth within the Carlsbad General Plan.

4. The Planning Director has determined that the project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15304, Class 4, subsection (e) of the
State CEQA Guidelines and will not have an adverse significant impact on the environment.
The following conditions have been approved for the subject project:
1. This approved permit serves as the required redevelopment and coastal development permits
for the subject project.
2. The project shall be completed according to, and be consistent with, the plans approved by the
Housing and Redevelopment Director on the date noted above. The approved plans have been
stamped by the Housing and Redevelopment Director and indicate the approval date of 8/17/99.
3. Prior to the placement of the modular buildings on the subject property, the applicant shall
acquire all required building permits from the Building Department. The buildings shall meet all
current disabled access regulations. State law also requires that the buildings be placed on
either permanent foundations or be installed with approved, earthquake bracing systems.
4. Recent and future conversions of classrooms and dormitories to uses other than those
originally approved must be reviewed by the Building Official and Fire Marshall. All converted
uses on the subject property (including the conversion of classroom and/or office space to
dormitories) not previously permitted through the building permit process shall be included in
the plan check review for the modular classrooms and shall meet all related Model Code
regulations.
5. Modular buildings shall conform to Title 24 Part 2 (State Building Code) requirements for
classroom location, design and construction. Complete building plans must be submitted and
approved prior to construction.
6. Fire alarm system plans must be approved prior to installation.
7. Prior to issuance of any building permit, the developer shall comply with the requirements of the
City's anti-graffiti program for wall treatments if and when such a program is formally
established by the City.
8. Prior to hauling dirt or construction materials to or from any proposed construction site within
this project, the developer shall submit to and receive approval from the City Engineer for the
proposed haul route. The developer shall comply with all conditions and requirements the City
Engineer may impose with regards to the hauling operation.
9. The developer shall pay all current fees and deposits required.
10. The developer shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit. The developer shall provide best management practices as
referenced in the "California Storm Water Best Management Practices Handbook" to reduce
surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such
improvements shall be approved by the City Engineer. Said plans shall include but not be
limited to notifying prospective owners and tenants ofthe following:

A. All owners and tenants shall coordinate efforts to establish or work with established
disposal programs to remove and properly dispose of toxic and hazardous waste
products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil, antifreeze,
solvents, paints, paint thinners, wood preservatives, and other such fluids shall not be
discharged into any street, public or private, or into storm drain or storm water
conveyance systems. Use and disposal of pesticides, fungicides, herbicides,
insecticides, fertilizers and other such chemical treatments shall meet Federal, State,
County and City requirements as prescribed in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce surface pollutants when
planning any changes to the landscaping and surface improvements.
11. Modular units shall have skirting, matching paint, trim and roof colors which complement the
existing buildings on-site.
12. This Administrative Redevelopment Permit/Coastal Deveiopment Permit is granted for a period
of one (1) year beginning on August 27, 1999 and ending on August 27, 2000. The modular
buildings and any related improvements shall be completely removed from the site and the
property restored to it's previous condition within sixty (60) days of the expiration date of the
permit or upon issuance of a Certificate of Occupancy for North Hall, whichever occurs first.
This permit may be extended by the Housing and Redevelopment Director upon written
application ofthe permittee made no less than 90 days prior to the expiration date.
13. This permit shall be subject to revocation by the Housing and Redevelopment Director if the
applicant fails to conform to any of the above conditions of approval.
