Happy New Year! Hope you're having a good one so far. For RP 99-16, the most appropriate CEQA
Exemption would probably be Section 15303 ofthe State CEQA Guidelines (Conversion of Small
Structures) since it involves conversion ofthe use in a commercial building occupying less than 2,500
square feet in area.
For RP 99-17, the Planning Department really doesn't have any standards. The cell sites are supposed to
be "stealth" and that's about it The proposed AirTouch dish antenna and equipment room don't look too
stealth, but it's your part of town, so I figure that's your call. We do have a standard condition that goes on
cell site projects, namely:
The Developer/Operator shall comply with ANSI/IEEE standards for EMF emissions. Within six
(6) months after the issuance of occupancy, the Developer/Operator shall submit a project implementation
report which provides cumulative field measurements of radio frequency (EMF) power densities of all
antennas installed at the subject site. The report shall quantify the EMF emissions and compare the
results with currently accepted ANSI/IEEE standards. Said report shall be subject to review and approval
by the Planning Director for consistency with the Project's preliminary proposal report and the accepted
ANSI/IEEE standards. If on review, the City finds that the Project does not meet ANSI/IEEE standards,
the City may revoke or modify this conditional use permit.
As far as CEQA is concerned, we've been exempting cell sites through Section 15303 ofthe State CEQA
Guidelines (Installation of Small New Equipment).
I also got comments from Kathy Farmer in Engineering (x4374). The hard copy of the memo is in
interoffice mail, but here's a copy of her comments:
"Please clarify method proposed and location for undergrounding cable. Will undergrounding be done in
City right-of-way?"

On January 12, 2000 the Housing and Redevelopment Director conditionally
approved Administrative Redevelopment Permit No. RP 99-16 for property located at
3095 State Street, Suite B. The decision ofthe Housing and Redevelopment Director is
subject to a ten (10) day appeal penod. The appeal penod has elapsed and no appeals
were filed. Attached is a copy ofthe approved permit authorizing the requested change
in land use from a commercial retail use to a palm reading establishment. Please
review all conditions carefully. Violation of the conditions could result in revocation of
this pe'rmit.
Please note that the conditions of approval require that you obtain a sign permit pnor to
the installation of any signs advertising the proposed use. Additionally, before
engaging in the use, you are required to obtain a fortunetelling permit from the Cartsbad
Police Department. Please contact the Police Department at 931-2131 for further
information on this permit. The Finance Department has been notified that you have
received the required redevelopment permit and the Redevelopment Department has

The following findinas have been made in order to approve the Administrative Redevelopment
Permit for a change in land use from office to fortune teller:
1. The use is compatible with the land use district and adjacent development. The proposed use is
a provisional use in Land Use District 1. Surrounding uses include antique shops, a holistic
health/herb retailer, and some offices.
2. The use will not adversely affect retail intensity or retail continuity in the Village. The subject
property is located on the perimeter of District 1 where there is less pedestrian activity and
businesses tend to be more destination oriented. The proposed use is located within a business
arcade and does not front directly on the public street The former retail use which occupied the
subject suite has moved to an adjacent suite which fronts on the public street
3. Adequate parking exists to serve the needs of this use. The new use will not generate a higher
parking demand than the prior use.

4. The project is exempt from the requirements of the California Environmental Quality Act (CEQA)
per Section 15303 of the State CEQA Guidelines (conversion of small structures) and will not
have an adverse significant impact on the environment
The following conditions have been approved for the subject project:
1. This approved permit serves as the required redevelopment permit for the subject project
approving a change in land use to a provisional use (fortune teller as defined in Carlsbad
Municipal Code Section 5.50.010 (c)).
2. The use shail be conducted according to, and be consistent with, the redevelopment permit
application approved by the Housing and Redevelopment Director on the date noted above.
3. The use shall be operated in a manner that is consistent with the project description provided by
the applicant and contained within this approved permit Any changes to the operations of the
subject facility or provision of intended services shall require prior written approval by the
Housing and Redevelopment Director. Certain changes to the proposed use may require an
amendment to the approved permit
4. A separate sign permit shall be required prior to the installation of any signs advertising the
proposed use.
5. Before engaging in the proposed use, the applicant shall obtain a fortunetelling permit from the
Carlsbad Police Department as set forth in Carlsbad Municipal Code Section 5.50.
6. Before engaging in the proposed use, the applicant shall obtain the appropriate business license
