RPOO-04 permitting the installation of Internet antennas on the Carlsbad Inn, both your verbal and written comments were received following completion of the 10-day public review period and Housing and Redevelopment Director's approval of the project, but prior to the expiration of the appeal period. All administrative decisions are appealable to the Design Review Board. Therefore, if you wish to appeal the Housing and Redevelopment Director's decision on the subject project, the proper application and filing fee must be submitted to the Housing and Redevelopment Office by 5:00 p.m. on Monday, June 5, 2000. I have enclosed the appeal application for your use. The appeal fee is $400, plus noticing costs. Administrative Redevelopment Permit application no. RP99-17 also requested the installation of cellular antennas on the Carlsbad Inn. Both your verbal and written comments were received and considered prior to the Housing and Redevelopment Director rendering a final decision to approve the subject application. The appeal period for RP99-17 expires at 5:00 p.m. on June 12, 2000. If you wish to appeal the Housing and Redevelopment Director's decision on the project, the proper application and corresponding filing fee, as described above, must be submitted prior to the expiration date to the Housing and Redevelopment Department, 2965 Roosevelt Street, Suite B, Carlsbad, CA 92008. The subject applications were approved in accordance with the Federal Telecommunications Act which prohibits local jurisdictions from regulating the placement, construction, and modification of personal wireless service facilities on the basis of environmental effects of radio frequency emissions to the extent that such facilities comply with the Federal Communications Commission's (FCC) regulations concerning such emissions. The FCC is the designated body ensuring that such facilities comply with established standards. The site-by-site licensing process that the telecommunications carriers must go through with the FCC includes verification of compliance with adopted emissions standards. A local jurisdiction is limited to zoning laws that regulate the location and placement of wireless service facilities on the basis of conformance with established development standards and design guidelines applicable to the entire area. We believe that all current research is showing that all free radicals are extrennely dangerous to humans and animals and antennas would most certainly fall into this category. Cell phones are currently being proven to cause brain tumors. Putting these antennas in such a densely populated (or in any populated area) area can be extremely hazardous to human health. This piece of legislation preempted local governments from regulating wireless facilities on the basis of radio emissions (see highlighted item on attached sheet). FACILITIES SHTNG; RADIO FREQUENCY EMISSION STANDARDS. (a) NATIONAL WIRELESS TELECOMMUNICATIONS SITING POLICY- Section 332(c) (47 U.S.C. 332(c)) is amended by adding at the end the following new paragraph: T7) PRESERVATION OF LOCAL ZONING AUTHORTTY- TA) GENERAt AUTHORITY^ Except as provided in this paragraph, nothing in this Act shall limit or affect the authority of a State or local government or instrumentality thereof over decisions regarding the placement, construction, and modification of personal wireless service fecilities. •(B) LIMITATIONS- '(i) The regulation ofthe placement, construction, and modification of personal wireless service facilities by any State or local govemment or instrumentality thcreof- '(I) shall not unreasonably discriminate among providers of functionally equivalent services; and TH) shail not prohibit or have the effiect of prohibiting the provision of personal wireless services. '(ii) A State or local government or instrumentality thereof shail act on any request for authorization to place, construct, or modify personal wireless service facilities within a reasonable period of time after the request is duly filed wilh such govemment or instrumentality, taking into account tbe naturc and scope ofsuch request. '(iii) Any decision by a State or local govemment or instrumentality thereof to deny a request to place, construct, or modify personal wireless service facilities shall be in writing and supported by substantial evidence contained in a written record. '(v) Any person adversely affected by any final action or failure to acl by a State or local govemment or any instrumentality thereof that is inconsistent with this subparagraph may, within 30 days afier such action or failure to act, commence an action in any court of competent jurisdiction. The court shall hear and decide such action on an expedited basis. Any person adversely affected by an act or fiiilure to act by a State or locad government or any instrumentality thereof that is inconsistent with clause (iv) may petition the Commission for relief. \C) DEFINITIONS- For purposes ofthis paragraph- Xi) the term 'personal wireless services' means commercial mobile services, unlicensed wireless services, and common carrier wireless exchange access services; '(ii) the term 'personal wireless service facilities' means facilities for the provision of personal wireless services; and '(Ui) the term 'unlicensed wireless service' means the offering of telecommunications services using duly authorized devices which do not require individual licenses, but does not mean the provision of direct-to- home sateUite services (as defined in section 303(v)).'. (b) RADIO FREQUENCY EMISSIONS- Within 180 days after the enactment ofthis Act, the Commission shall complete action in ET Docket 93-62 to prescribe and make efifective rules regarding the enviromnental effects of radio frequency emissions. (c) AVAILABILITY OF PROPERTY- Within 180 days ofthe enactment ofthis Act, the President or his designee shall prescribe procedures by which Federal departments and agencies may make available on a fair, reasonable, and nondiscriminatory basis, property, rights-of-way, and easements under their control for the placement ofnew telecommunications services that are dependent, in whole or in part, upon the utilization of Federal spectrum rights for the transmission or reception of such services. These procedures may establish a presumption that requests for the use of property, rights-of-way, and easements by duly authorized providers should be granted absent unavoidable direct conflict with the department or agency's mission, or the current or planned use of the property, rights-of-way, and easements in question. Reasonable fees may be charged to providers ofsuch telecommunications services for use of property, rights-of-way, and easements. The Commission shall provide technical support to States to encourage them to make property, rights-of-way, and easements under their jurisdiction available for such purposes. Section 332(c) (47 U.S.C. 332(c)) is amended by adding at the end the following new paragraph: '(8) MOBILE SBRVICES ACCESS- A person engaged in the provision of commercial mobile services, insofar as such person is so engaged, shall not be required to provide equal access to common carriers for the provision of telephone toll services. Ifthe Commission determines that subscribers to such services are denied access to the provider of telephone toll services ofthe subscribers' choice, and that such denial is contrary to the public interest, convenience, and necessity, then the Conunission shall prescribe regulations to afford subscribers unblocked access to the provider of telephone toll services ofthe subscribers' choice through the use of a canier identification code assigned to such provider or other mechanism. The requirements for unblocking shall not apply to mobile satellite services unless the Commission finds it to be in the public interest to apply such requirements to such services.'. SEC. 706. ADVANCED TELECOMMUNICATIONS INCENTIVES. (a) IN GENERAL- The Commission and each State commission with regulatory jurisdiction over telecommunications services shall encourage the deployment on a reasonable and timely basis of advanced telecommunications capability to all Americans (mcluding, in particular, elementary and secondary schools and classrooms) by utilizing, in a manner consistent with the public interest, convenience, and necessity, price cap regulation, regulatory forbearance, measures that promote competition in the local telecommunications market, or other regulating methods that remove barriers to infi^tructure investment. (b) INQUIRY- The Commission shall, within 30 months after the date of enactment ofthis Act, and regularly thereafter, initiate a notice of inquiry conceming the availability of advanced telecommunications capability to all Americans (including, in particular, elementary and secondary schools and classrooms) and shall complete the inquiry within 180 days after its initiation. In the inquiry, the Commission shall determine whether advanced telecommunications capability is being deployed to all Americans in a reasonable and timely fashion. Iflhe Commission's determination is negative, il shall take immediate action to accelerate deployment ofsuch capability by removing barriers to infi:astructure investment and by promoting competition in the telecommunications market. (c) DEFINITIONS- For purposes ofthis subsection: (1) ADVANCED TELECOMlvlUNlCATIONS CAPABILITY- The term 'advanced teleconununications capability is defined, without regard to any transmission media or technology, as high-speed, switched, broadband telecommunications capability that enables users to originate and receive high-quality voice, data, graphics, and video telecommunications using any technology. After receiving your comments that the project radio equipment could not be supported as previously proposed since the equipment shelter appeared to encroach into the setback, we have redesigned the shelter to obseiTe the required setback, as per the attached plans. Note that the existing low masonry wall will not be modified. We have also provided details showing the existing configuration of the southerly building wall, as per your direction. Note that the equipment shelter will follow existing building walls, i.e., the shelter will not project out beyond any existing building planes. The equipment shelter will incorporate the following features: The equipment shelter will utilize a stone fascia, consistent with the primary / adjacent building. - The equipment shelter will incorporate a shed roof, consistent with the primary building. Please note that we have reduced the size of the digital dish antenna from 6 ft. in diameter to 4 ft. in diameter in response to your concems. Although this element will technically project above the roof parapet, the previously submitted line-of-sight illustration should support that this feature will generate negligible visual impact. Since the project now before you reflects comments and concems received from your department, we would greatly appreciate it if you could start the fmal routing and public notification as soon as possible. We would request that, if possible, these processes might by mn concurrently. If there is any further fine-tuning required, I am sure that we will be able to make any such adjustments through the upcoming review process. In drafting your notice of approval, I would recommend the following conditions, in addition to any other standard conditions from your department: - The radio equipment shelter shall incorporate a siding of stone fa9ade, consistent with the existing adjacent primary building, to the satisfaction of the Carlsbad Redevelopment Department. - The radio equipment shelter shall incorporate a roofing material and color consistent with the existing adjacent primary building and with the electrical room enclosure located just west of the project site, to the satisfaction of the Carlsbad Redevelopment Department. - The existing landscape screening shall be maintained at approximately the same height and density as the existing adjacent landscape materials. The application and plans submitted for this project are incomplete and unsuitable for further review due to the following missing or incomplete items: 1. Please clarify the method proposed and location for undergrounding cable. Will the undergrounding be done within the public right-of-way? ISSUES OF CONCERN Housing & Redevelopment and Planning: 1. The height of the equipment shelter designed for the roof of the building exceeds the 35 foot maximum height limit allowed for Land Use District 9. The structure is shown as 38'-4" high and extends 5'-6" above the adjacent parapet. Please revise the plan to reduce the height of the equipment room so that it is no higher than the existing parapet wall. 2. Roof Form Design Guideline #5 of the Village Redevelopment Master Plan specifies that roof mounted equipment should be integrated into the roof form or screened from view with elements appropriate to the building's form and appearance. The proposed roof top dish antenna is not adequately screened and therefore does not satisfy this design objective. Please relocate the antenna or redesign to screen this use from view. 3. The five panel type antennas on the south elevation and the five panel type antennas on the north elevation with corresponding chimney extensions are sufficiently architecturally integrated and staff supports approval of these designs. 4. Photo simulations showing the redesign of the equipment shelter and the screening of the roof top dish antenna should be submitted with the revised plans. The maximum building height permitted in District 9 ofthe Village Redevelopment Master Plan is 35' with a 5:12 roof pitch. The proposed roof top equipment room measures 38' 4" and is therefore inconsistent with this development standard. Please revise the plan to reduce the height of the equipment room to 35'. 2. Roof Form Design Guideline #5 of the Village Redevelopment Master Plan specifies that roof mounted mechanical equipment should be integrated into the roof form or screened from view with elements appropriate to the building.s form and appearance. For RP 99-16, the most appropriate CEQA Exemption would probably be Section 15303 ofthe State CEQA Guidelines (Conversion of Small Structures) since it involves conversion ofthe use in a commercial building occupying less than 2,500 square feet in area. For RP 99-17, the Planning Department really doesn't have any standards. The cell sites are supposed to be "stealth" and that's about it. The proposed AirTouch dish antenna and equipment room don't look too stealth, but it's your part of town, so I figure that's your call. We do have a standard condition that goes on cell site projects, namely: The Developer/Operator shall comply with ANSI/IEEE standards for EMF emissions. Within six (6) months after the issuance of occupancy, the Developer/Operator shall submit a project implementation report which provides cumulative field measurements of radio frequency (EMF) power densities of all antennas installed at the subject site. The report shall quantify the EMF emissions and compare the results with currently accepted ANSI/IEEE standards. Said report shall be subject to review and approval by the Planning Director for consistency with the Project's preliminary proposal report and the accepted ANSl/lEEE standards. Please note the following: Number of Project Antennas The number of antennas as identified in the Project Description on the project plans has been amended to correspond with the number of antennas depicted on the site plans and elevations. Specifically, a total of ten panel type antennas are proposed for the project, with five antennas measuring 1 ft. wide by 4 ft. high to be located on the south elevation, and five antennas measuring 1 ft. wide by 2 ft. high to be located on the north elevation. These antennas will be painted to match the existing stmcture. One digital dish antenna is proposed at this time to be located on the roof area. Please note that although this antenna appears prominent on the east elevation, the antenna is actually to be located at the westerly edge of the roof area (see site plan), such that this device will not be visible from Carlsbad Blvd. This (dish) antenna will be up to 6 ft. in diameter. A second dish anterma is also part of this application request for possible fiiture installation. Should AirTouch wish to install this element at a future date, Carlsbad Redevelopment Department staff review would first be required in order to address planning / siting issues. It is not possible to provide a potential location at this time since only future user demand and system build-out would dictate the antenna design and placement. Any Resolution of Approval may contain a condition requiring staff review prior to any such future modifications. Design of Equipment Shelter JM and AirTouch planning & technical staff have reviewed carefully your request to consider the design of the equipment shelter proposed for the roof area of the building. Initially, let me say that this project has been the subject of approximately one year of detailed review and planning with the owner and architect of the Carlsbad Inn. Our efforts from the outset have been to design a project which minimizes as greatly as possible any visual impacts to the site and surrounding area. Although it may seem like the easy solution to place the proposed equipment shelter in the proposed location, it actually became the only technically feasible placement of this element. First, of course, we investigated the possibility of employing a ground-mounted design. No location was found which would meet the size requirements of the radio equipment without adversely impacting the functioning of the existing site. We also considered utilizing the two buildings to the west between to pool area over the parking stmcture. Stmctural analysis determined that the parking stmcture would not carry the load of the equipment shelter, which weighs several thousand pounds. The roof mount as proposed was found to be the only feasible design available, and this element has been depressed into the existing stmcture to the greatest degree possible. We carefully analyzed the design and found that we could not depress the proposed equipment shelter into the building any further. The overall height of the proposed AirTouch equipment shelter is determined by the height of the steel support stmcture of the building itself, and by the height of the intemal equipment and required safe work space above the equipment. The steel support is minimum of 12" thick with a support pedestal, which varies in height depending on roof pitch. The building itself has a floor stmcture of a minimum 8". The equipment is 96" tall and the minimum working space of 16" above the equipment. Then there is the roof stmcture and mansard fagade. This will give the proposed building over-all height of approximately 12' 9", which are reflected on the project plans. Any visual impacts associated with the equipment shelter will be mitigated by the following factors: - The proposed stmcture will incorporate siding and roofing materials to match the existing stmcture in color and texture. - The proposed stmcture will incorporate a mansard roof pitch to match the existing stmcture. - The proposed stmcture will have a height just two feet (approximately) above the height of the adjacent dormer element, and 4.2 ft. below the level of the adjacent chimney(s). The proposed stmcture, although appearing prominently on the east elevation, will actually be far less prominent from surrounding areas since this element is actually to be placed centrally in the roof area, i.e., the stmcture will not appear to be standing on the edge of the roof as shown on the east elevation of the project plans. As viewed from the adjacent street level, the top of the proposed stmcture will only begin to come into view as one is positioned beyond approximately 1,100 ft. Based upon the preceding, this proposed stmctural addition will not generate a significant visual impact to the site or to the surrounding area. Please contact me if you need any further information. After receiving your comments that the size of the proposed radio equipment could not be supported in the proposed location, we have worked with the equipment nianufacrurcr to try and reconfigure the radio equipment. The result has been the following: - The 3x3x7 "Power Box" can be eliminated (incorporated into the primary equipmenl cabinet), - The primary equipment cabinet can be lowered to a maximum height of 6.5 feet from the adjacent grade. Please note that this area is actually 6"-12" below the level of the grade ouiside the landscaped hedge, such that the equipment cabinet will actually have a maximum heighl of 6 f\. as measured from the grade adjacent to the public slreet. All other dimensions of the cabinet will remain the same. This equipment will be well-concealed behind the exisling dense 8-ft. landscape hedge. We are confident lhai these project modifications will significantly reduce any visual impacts associated with the ground-mounted equipment. As discussed previously, we would welcome any pemiit conditions that would ensure the continued visual screening of the project I would also suggest a condition that your department may require additional screening after the equipment cabinet has been installed, if found to be necessary. Also, as previously discussed, we have reduced the size of the digital dish antenna from 6 ft. to four feel, in order to further reduce any visual impacts. As per your request, this antenna will be screened on four sides with radio-transparent panels. These will be flat vertical elements and can be painiecl any desired color. I would recommend a medium gray. As per direction from your department, we have designed a fully enclosed equipment shelter, as per the revised plans submitted herewith. This equipment shelter will incorporate the following features: - The equipment shelter will follow existing building walls, i.e., the shelter will not project out beyond any existing building planes (see Area Site Plan, Sheet LUI). - The equipment shelter will utilize a stone fascia, consistent with the primary / adjacent building. The equipment shelter will incorporate a shed roof, consistent with the primary building. The high point of the shed roof will be 13 feet, the minimum height necessary to incorporate the radio equipment and to provide the desired pitch. The equipment shelter, including a necessary 7 ft. access door, will be largely screened with existing 6 ft. tall landscaping. All other elements of the application remain the same, including the panel antennas and the roof mounted digital dish antenna. Please note that we have reduced the size of the digital dish antenna from 6 ft. in diameter to 4 ft. in diameter in response to your concems. As requested by you, a line-of-sight illustration has been provided (LSI), depicting the visual impact of the proposed digital dish anteima / screening enclosure. In drafting your notice of approval, I would recommend the following conditions, in addition to any other reasonable conditions from your department: - The radio equipment shelter shall incorporate a siding of stone facade, consistent with the existing adjacent primary building, to the satisfacfion of the Carlsbad Redevelopment Department. - The radio equipment shelter shall incorporate a roofing material and color consistent with the existing adjacent primary building and with the electrical room enclosure located just west of the project site, to the satisfaction of the Carlsbad Redevelopment Department. - The existing landscape screening shall be maintained at approximately the same height and density as the existing adjacent landscape materials. Since it is nearly complete, I have photographed the site and am sending for your benefit some copies. As you will recall, I had agreed to have our constmction people place the digital dish antenna in a location which was the least visible and also gave us a clear interconnect. The dish is visible on the south elevation picture. The position of this photo is really the only area from which the anterma is visible. As one approaches from the north on Carlsbad Blvd., the antenna is not visible at all. Directly across the street the anterma is not visible. On the west side of the building the antenna is not visible. Closer to the building (on the sidewalk) the anteima is not visible. As one approaches from the south on Carlsbad Blvd., existing landscaping and street aligmnent screen the dish completely except for a brief moment (position of photograph). We think this works very well in all regards. I am personally pleased with how this project tumed out. The equipment room, although very tight for our standards, looks very good, and the chimney extension for our north sector came out well. We almost gave up on this site, and I'm glad I kept pushing.
