FRM0008 8/92 Page 1 of 4 ... . J .- f " ... • SATEllITE ANTENNA PERMIT Satellite antennas are pennitted in the City of Carlsbad with a satellite antenna pennit. In order to receive a pennit, certain conditions must be met. Satellite television antennae less than thirty (30) inches in diameter are pennitted in any zone and are not subject to the requirements of Zoning Ordinance Section 21.53.140, provided that such antennae are attached to a pennitted main or accessory structure on the lot. (IF YOU HAVE ANY QUESTIONS, PLEASE CONTACT THE PLANNING DEPARTMENT) 1. RESIDENTIAL ZONES Residential zone restrictions. Satellite television antennas shall be considered as accessory to the main structure and shall be pennitted in residential zones subject to the following limitations. 1. The antenna shall be ground mounted. 2. The antenna shall be located within the rear or side yard only; on corner lots the antenna shall not be located on the street side yard. 3. The antenna shall not exceed fifteen feet in height. 4. The antenna shall not be pennitted on properties which have been designated as historic sites. 5. The antenna shall be screened from adjacent properties and public view by a wall, fence, hedge, or appropriate plant or landscape material between the antenna and the property line so that no more than 25% of the antenna extends above the top of the screening material. 6. The antenna shall be located at least four feet from any property line. 7. No more than one satellite television antenna shall be pennitted per lot. 8. The antenna shall not exceed ten (10) feet in diameter. II. RESIDENTIAL AND COMMERCIAL ZONES Residential and Commercial Zone restrictions. 1. The antenna shall not be located in any public or private easements. 2. .The antenna shall not be located in any drainage channel or over a drainage structure. FRM0008 8/92 Page 2 of 4 't--:·· '~-. • f' , III. COMMERCIAL AND INDUSTRIAL ZONES Commercial and industrial zone restrictions. Satellite television antennas shall be considered as accessory to the main structure and shall be pennitted in all commercial and industrial zones subject to the following limitations: 1. Ground mounted antenna. A Ground mounted antenna shall be located in the rear 50% of the lot. B. The antenna shall not exceed 20 feet in height. C. The antenna shall not be used as a sign or contain any advertising copy. D. The antenna shall be screened from adjacent properties and public view by a wall, fence, hedge, or other appropriate plant or landscape line so that no more, than 25% of the antenna extends above the top of the screening material. E. The antenna shall not be located in any required parking area. 2. Roof mounted antenna may be pennitted subject to the following limitations: Roof mounted antennas shall not exceed 15 feet in height provided, however, iliat in no event shall the antenna extend more than 5 feet above the pennitted height of building upon which it is located. Roof mounted antenna shall be screened by recessing the antenna into the roof line or by constructing a screen out of similarly textured roofing or exterior wall material as the structure upon which it is located so that the antenna is not visible at ground level. 3. No more than one satellite television antenna shall be pennitted per lot provided, however that additional antennas may be pennitted by the Planning Director if there is more than one use on a lot which cannot feasibly be served by a single antenna. 4. The provisions of this subsection shall apply to hotels and motels located in residential zones. 5. The provisions of this subsection shall not apply to satellite television antenna used by and located upon the property of a commercial cable television operator franchised by the City. Provisions of this section shall apply to residential planned developments, planned unit devf!lopments or condominiums provided, however, that roof mounted antenna may be allowed as part of the planned development permit for the project. V. Agricultural zone restrictions. Satellite television antennas shall be considered as accessory to the main structure or use on the property and shall be permitted subject to the following limitations: 1. The antenna shall be ground mounted. 2. The antenna shall be located at least four feet from any property line. 3. The antenna shall not exceed 20 feet in height. 4. The antenna shall be screened from public view by a wall, fence, hedge, or other appropriate plant or landscape material between the antenna and the property line so that no more than 25% of the antenna is visible above the screening material. VI. Public utility zone restrictions. Satellite television antennas shall be considered a permitted accessory use in the public utility zones. VII. Nonconforming antennas. Any satellite television antenna erected prior to the effective date of this ordinance shall be brought into compliance with the provisions of this section no later than one year after the effective date of t..lUs ordinance. VIII. Whenever a discretionary permit is required for construction of a project, the satellite antenna permit may be consolidated with the discretionary permit. IX. Redevelopment zone. A redevelopment permit issued pursuant to Chapter 21.35 shall be required for any satellite television antenna located in the Village Redevelopment Zone. In addition to complying with the provisions of this section, all satellite television antennas in the Village Redevelopment Zone shall conform to the provisions of the Village Design Manual. x.. Nothing in this section shall be construed. to eliminate or change the requirement under Section 21.42.010(5) (Q) for a conditional use permit for radio or television transmitters. These pennits are essential to our core business. To follow is a specific description of our company, detailing the need for the satellite pennits, and infonnation on the proposed location. We have provided plan infonnation as requested by the Conditional Use Pennit, excluding infonnation deemed unnecessary by David Rick and Adrian Landers at the City of Carlsbad. Plan infonnation included consist of: -3 copies of grading plan: contains drainage, slopes, and easements. -3 copies of site plan -3 copies vicinity map showing major cross streets -10 photographs from various points on the El Camino Real Corridor showing the view of the proposed satellite dish location. Business Need NTN Communications, Inc. is an interactive program provider offering multiple broadcasts in conjunction with live sporting events, television programs, and other broadcasting NTN offeres interactive games, education, corporate training, and satellite auctions. NTN's subscriber base includes 2500 restaurants, bars, and taverns across the U.S. and Canada; on-line platfonns such as America Online, GEnie, and the Imagination Network; and cable and telco platfonns such as GTE Mainstreet and US West. The ability to receive a live satellite signal is imperative in broadcasting our live interactive programs. QBl, NTN's live interactive football game, is one example that demonstrates the necessity of satellite feeds. During QB 1, players on the NTN network predict the outcome of each play during a live televised football game. Before each play, players enter their prediction into an input device. When the ball is snapped, producers watching the game determine what type of play occured. NTN producers monitor the game's live backhaul feed, via the network's satellite feed, at NTN's production center in Carlsbad. The "Official Playcall" is then transmitted via satellite to all QB 1 players. In a matter of seconds, the "Official Playcall".is matched against player predictions and points are awarded for accuracy. On a given NFL Sunday, 13 separate regional and national games are broadcasted. NTN offers each NFL game to the entire subscriber base. Therefore, NTN must have the ability to receive each of the 13 live games. QBl is only one example that clearly demonstrates NTN's need for a satellite dish. Additionally, NTN requires a satellite feed for the following: • Leamstar, NTN's education division, provides live interactive material for classrooms throughout the United States. • IWN, NTN's gaming division, monitors live satellite horse racing broadcasts. • The NTN Event Network provides live Pay Per View Boxing events. Our interactive boxing game, Uppercut, requires monitoring the live network broadcast via satellite. • NTN's auction departinent operates live car auctions for Lexus dealers across the United States. The auction originates from a live satellite feed from Lexus headquarters in Los Angeles. Satallite Dish Location The satellite dishes would be located on the sub side of C line, centered on the building at 5966 La Place Court, Carlsbad, California (shown on the Elevation Prints). This location provides natural screening indicated by the provided photographs. By centering these satellites on C Line, they can not be seen from • the adjacent EI Camino Real Corridor and adjacent buildings, as seen in the photographs. The photographs were taken from EI Camino Real while Traveling North from Palomar Airport Road. Photographs The photographs submitted display the limited visibility of a single 10' satellite dish centered on C line at 5966 La Place Court. These photographs (photo A through J) show roof positioning as well as their visibility from the EI Camino Real Corridor.
