INSTRUCTIONS TO APPLICANTS
In order to streamline the application process and reduce duplication in filling out application
forms, the City has adopted a comprehensive application form to handle multiple application
submittals. The following instructions should assist you in preparing the application form for
submittal to the City:
4 Applications applied for: Check the appropriate boxes for the various application types for which
you are applying. Check with counter staff to determine required application types needed to
process your specific project.
Assessor Parcel No(s).: Include all assessor parcel numbers included within the project
boundary. The counter staff can assist you in determining the appropriate assessor parcel
number(s).
4 Project Name: Fill in the box with the name of the project, such as "Red Oak Homes" or "Benson
Commercial." If no name is proposed, write the last name of the owner or applicant plus a brief
description such as "Jones Condo Conversion" or "Smith Residential Subdivision."
4 Brief Description of Project: Write down a brief description of the project. Be specific but do not
include square footage or architectural details. For example: a neighborhood commercial center
with two restaurants; single family detached residential project; or an industrialloffice complex with
three industrialloffice buildings.
J Owner's Name, Address, Phone Number, Email address and Signature: To be filled in and
signed by the owner for all applications. Use the owner's name as it appears on the title report.
4 Applicant's Name, Address, Phone Number, Email address and Signature: To be filled in and

the name. All correspondence and contact regarding the application will be directed to the
applicant.
J Brief Legal Description: Provide a brief legal description of the property such as "Lot 6 of Map
No. 8828 Carlsbad Tract 88-3" or "Portion of Lot I of Rancho Agua Hedionda map 1717." Do not
provide bearings and distances. A full legal description will be contained within the title report
submitted with the application.
4 Location of Project: Fill in the blanks with the street address (if appropriate), direction and street
names. For projects located in undeveloped areas not adjacent to streets, use the nearest street
from which the project will take access.
4 Consent to Allow Entrance onto the Property: Signature granting members of City staff,
Planning Commissioners, or City Council members' permission to inspect and enter the property.
4 Notice of Restriction: Property owner acknowledges and consents to a Notice of Restriction if
conditioned for the applicant. Notice of Restrictions run with the land and bind any successors in
interest.
Application Requirements: Attached with the application form are the various submittal requirements
for each application type listed on the face of the application. Follow any instructions contained within
the submittal requirements and submit the information and materials required for each of the
applications for which you are applying.

IMPORTANT: Check all submittals to be sure all the required information and materials have
been submitted with your application. Incomplete submittals will not be processed or

30 days of submittal whether or not your application is complete.

lcirculation lmpact ~nalvsisl All applications which propose an increase in the traffic generation rate
of 500 vehicles or more, over existing traffic generation for the site, must submit a Circulation lmpact
Analysis. This analysis will be used to determine compliance of your project with Growth Management
Facility Standards. The analysis is not to be considered in lieu of project related traffic studies which
may be required by staff to analyze specific project related on and off site traffic issues.
Fire Departmenwater District Consultation: Prior to submittal of an application for development in
the City, you are encouraged to consult with the Fire Department and the appropriate water district in
order to design your project in compliance with their requirements. Failure to consult with either agency
could result in unnecessary delays, redesign or project denial. The purpose of the notice is to get
projects to "design in" water and fire requirements in advance.
Digital Submittals: Applicants shall submit digital files with the application at initial submittal and at
approval of tentative tract map, in accordance with Engineering Standards.

SCREENING OF EQUIPMENT
Exterior components of plumbing, processing, heating, cooling, and ventilation systems (including but not limited to piping, tanks, stacks,
collectors, heating, cooling, and ventilating equipment fans, blowers, ductwork, vents, louver, meters, compressors, motors, incinerators,
ovens, etc ...) shall not be directly visible from a height of five feet from the closest building wall on any lot. Scaled elevations of all such
equipment, as well as screening materials, are required on all site plans. See example below.

INFORMATION FORM
This Environmental lnformation Form will be used to assist staff in determining what type of
environmental documentation el Environmental Impact Report, Mitigated Negative
Declaration, Negative Declaration or Exemption) will be required to be prepared for your
application, per the California Environmental Quality Act (CEQA) and Title 19 of Carlsbad's
Municipal Code. The clarity and accuracy of the information you provide is critical for purposes

to the existing classroom and administration building for Daybreak Community Church
within your neighborhood was submitted to the City of Carlsbad on January 30, 2012.
The project application is undergoing its initial review by the City.

PROJECT DESCRIPTION: The applicant is requesting approval of a Conditional Use
Permit Amendment, Site Development Plan Amendment and Coastal Development
Permit Amendment for an 8,830 square foot, 28-foot-tall, two-story classroom, multi-
purpose room and administrative office addition to an existing building also currently
used for classrooms and administrative offices at the Daybreak Community Church site.
The proposed addition represents Phase Ill of the development of the property.
Please keep in mind that this is an early public notice and that the project design could

Engineering Conditions
NOTE: Unless specifically stated in the condition, all of the following conditions, upon the
approval of this proposed development, must be met prior to approval of a building or grading
permit whichever occurs first.
General
1. Prior to hauling dirt or construction materials to or from any proposed construction site
within this project, developer shall apply for and obtain approval from, the city engineer
for the proposed haul route.
2. This project is approved upon the express condition that building permits will not be
issued for the development of the subject property, unless the district engineer has
determined that adequate water and sewer facilities are available at the time of permit
issuance and will continue to be available until time of occupancy.
4. Developer shall submit to the city planner, a reproducible 24" x 3611, mylar copy of the
site plan, conceptual grading plan, and preliminary utility plan reflecting the conditions
approved by the final decision making body. The reproducible shall be submitted to the
city planner, reviewed and, if acceptable, signed by the city's project engineer and
project planner prior to submittal of the building plans, improvement plans, grading
plans, or final map, whichever occurs first.

Practice Maintenance Agreement.
17. Developer shall cause property owner to apply for, execute, and submit, to the city
engineer for recordation, an Encroachment Agreement covering private surface
improvements located over existing or proposed public right-of-way or easements as
shown on the site plan. Developer shall pay processing fees per the city's latest fee

Grading
27. Based upon a review of the proposed grading and the realignment of the existing 12-in.
and 15-in. private storm drain shown on the site plan, a grading permit for this project is
required. Developer shall prepare and submit a revision to approved grading plan DWG
392-68, including technical studies/reports for city engineer review, post security and
pay all applicable grading plan review and permit fees per the city's latest fee schedule.
32. Developer shall comply with the city's Stormwater Regulations, latest version, and shall
implement best management practices at all times. Best management practices include
but are not limited to pollution control practices or devices, erosion control to prevent
silt runoff during construction, general housekeeping practices, pollution prevention
and educational practices, maintenance procedures, and other management practices
or devices to prevent or reduce the discharge of pollutants to stormwater, receiving
water or stormwater conveyance system to the maximum extent practicable. Developer
shall notify prospective owners and tenants of the above requirements.
35. Developer shall complete and submit to the city engineer a Project Threat Assessment
Form (PTAF) pursuant to City Engineering Standards. Concurrent with the PTAF,
developer shall also submit the appropriate Tier level Storm Water Compliance form
and appropriate Tier level Storm Water Pollution Prevention Plan (SWPPP) as
determined by the completed PTAF all to the satisfaction of the city engineer. Developer
shall pay all applicable SWPPP plan review and inspection fees per the city's latest fee
schedule.
36. This project is subject to 'Priority Development Project' requirements. Developer shall
prepare and process a Storm Water Management Plan (SWMP), subject to city engineer
approval, to demonstrate how this project meets newlcurrent storm water treatment
requirements per the city's Standard Urban Storm Water Management Plan (SUSMP),
latest version. In addition to new treatment control BMP selection criteria in the
SUSMP, the developer shall use low impact development (site design) approaches to
ensure that runoff from impervious areas (roofs, pavement, etc) are drained through
landscaped (pervious) areas prior to discharge. Developer shall pay all applicable
SWMP plan review and inspection fees per the city's latest fee schedule.
38. Developer is responsible to ensure that all final design plans (grading plans,
improvement plans, landscape plans, building plans, etc) incorporate all source control,
site design, treatment control BMP, applicable hydromodification measures, and Low
Impact Design (LID) facilities.
40. Developer shall submit documentation, subject to city engineer approval,
demonstrating how this project complies with Hydromodification requirements per the
city's SUSMP, latest version. Documentation shall be included within the Storm Water
Management Plan (SWMP).
46. Developer shall cause owner to dedicate to the city and/or other appropriate entities
for waterline purposes as shown on the site plan. The offer shall be made by a separate
recorded document. All land so offered shall be free and clear of all liens and
encumbrances and without cost to the city. Streets that are already public are not
required to be rededicated. Additional easements may be required at final design to the
satisfaction of the city engineer.
48. Developer shall design the private drainage systems, as shown on the site plan to the
satisfaction of the city engineer. All private drainage systems (12" diameter storm drain
and larger) shall be inspected by the city. Developer shall pay the standard
improvement plan check and inspection fees for private drainage systems.
49. Developer shall prepare and process public improvement plans and, prior to city
engineer approval of said plans, shall execute a city standard Development
Improvement Agreement to install and shall post security in accordance with C.M.C.
Section 20.16.070 for public improvements shown on the site plan. Said improvements
shall be installed to city standards to the satisfaction of the city engineer. These
improvements include, but are not limited to:
Waterline extension and appurtenances
Developer shall pay the standard improvement plan check and inspection fees.
Improvements listed above shall be constructed within 36 months of approval of the
subdivision or development improvement agreement or such other time as provided in
said agreement.
Utilities
60. Developer shall meet with the fire marshal to determine if fire protection measures (fire
flows, fire hydrant locations, building sprinklers) are required to serve the project. Fire
hydrants, if proposed, shall be considered public improvements and shall be served by
public water mains to the satisfaction of the district engineer.
61. Developer shall design and construct public facilities within public right-of-way or within
minimum 20-foot wide easements granted to the district or the City of Carlsbad. At the
discretion of the district or city engineer, wider easements may be required for
adequate maintenance, access and/or joint utility purposes.
62. Prior to issuance of building permits, developer shall pay all fees, deposits, and charges
for connection to public facilities.
63. The developer shall design landscape and irrigation plans utilizing recycled water as a
source and prepare and submit a colored recycled water use map to the Planning
Department for processing and approval by the district engineer.
64. Developer shall install potable water and/or recycled water services and meters at
locations approved by the district engineer. The locations of said services shall be
reflected on public improvement plans.
65. The developer shall install sewer laterals and clean-outs at locations approved by the
city engineer. The locations of sewer laterals shall be reflected on public improvement
plans.
66. The developer shall design and construct public water, sewer, and recycled water
facilities substantially as shown on the site plan to the satisfaction of the district
engineer and city engineer.
Code Reminders
The project is subject to all applicable provisions of local ordinances, including but not limited
to the following:
80. Developer shall pay traffic impact and sewer impact fees based on Section 18.42 and
Section 13.10 of the City of Carlsbad Municipal Code, respectively. The Average Daily

SITE PLAN
1. Access:
Fire Department access inadequate. Provide fire access road in accordance
with CMC 17.04.010. This access shall provide an unobstructed width of 24
feet, and an unobstructed vertical clearance or "clear-to-sky" this include tree
canopies.
Fire Lanes. If fire lanes are designated they shall become the responsibility of
the developer to have said access restrictions recorded, that the owner is
responsible to provide and maintain to identify and ensure enforcement of
those designated access.

WATER IMPROVEMENT
1. Hydrants
Additional on-site public water mains and fire hydrants are required.
The required Fire Flow for this building once completed is 4500 GPM. This
required fire flow shall require the installation of at least one additional fire
hydrant unless it is agreed that the fire sprinkler system to be installed is
designed to Ordinary Hazard Group 2.
Provide one- (1) additional fire hydrant at intervals of 300 feet along private
driveways. Hydrants should be located at intersections when possible, but no
closer than 100 feet from the terminus of a street or driveway.
LANDSCAPE
Access for emergency vehicles and maintenance of fire protection water
supplies. Remove any trees within ten- (1 0) feet of any Fire Hydrant or
backflow prevention device for fire sprinkler service.
Provide a concrete pad no less than four- (4) inches thick that extends no less
than thirty-six- (36) inches in all directions under and around all fire hydrants
and backflow prevention devices.
FIRE SPRINKLERS
1. An automatic fire sprinkler system is required for this project.
As cited above, the option of installing an additional fire hydrant onsite and
spaced no more than 300 apart maybe waived if the applicant agrees to
install a fire sprinkler system based on the design demands of an Ordinary
Hazard Group 2.
2. Provide notes on all plans submitted for review that indicate that fire sprinklers are
required.
3. Please indicate the proposed location of the fire sprinkler riser. CFD requires that all
fire sprinkler risers, fire alarm control panels and any other life safety system be

SECOND REVIEW
Engineering Department staff has completed a review of the above-referenced project for
application completeness. The application and plans submitted for this project are from an
Engineering standpoint considered complete. The following are issues remaining before we can
recommend conditional approval:
1. Add to the site plan (A010) the sewer (edu) and potable water (gpm) generated or
required by the proposed addition.
2. The new and relocated water services and other utilities shown in sheets 1 & 2 of the
preliminary grading plan are inconsistent. Clarify by showing the work in only one sheet,
or make them consistent.
3. The roof drains from the existing Building B should be redesigned to tie into proposed
Building C so they are not located under the new building.
4. Move the proposed grate inlet in the proposed bio-retention area so it is outside the
existing water easement.
5. As a Priority Development Project, per the city's Standard Urban Stormwater
Management Plan (SUSMP), flow control (hydromodification) might be required if
impervious area is increased. Consider increasing pervious area by adding pervious
pavement where feasible to have no net increase in imperviousness.

Plan Review Recommendations
Carlsbad Police Department's Crime Prevention Unit has provided the following optimal security
recommendations. The purpose of this document is to safeguard property and public welfare by regulating and
reviewing the design, construction, quality of materials, use and occupancy, location, and maintenance of all
buildings and structures. The standards used in this document represent model national standards.
Crime Prevention through Environmental Design
The proper design and effective use of the built environment can lead to a reduction in the fear and incidence of
crime and an improvement in the quality of life. The proper design influences this by positively affecting human
behavior. The design includes the physical environment, the planned behavior of people, the productive use of
space and an effective crime/loss prevention program.
Natural Surveillance
1. Place and design the physical features to maximize visibility. This will include building orientation,
windows, entrances and exits, parking lots, walkways, landscape trees and shrubs, fences or walls, signage
and any other physical obstruction.
2. Design the placement of person and or activities to maximize surveillance possibilities.
3. Design lighting that provides for appropriate nighttime illumination of parking lots, walkways, entrances
and exits.
Natural Access Control
1. Use sidewalks, pavement, lighting and landscaping to clearly guide the public to and from entrances and
exits.
2. Use fences, walls or landscaping to prevent and or discourage public access to or from dark and or
unmonitored areas.
Provisions for territorial reinforcement
1. Use pavement treatments, landscaping, art, signage, screening and fences to define and outline
ownership or property.
Maintenance
1. Use low-maintenance landscaping and lighting treatment to facilitate the principles of natural
surveillance, natural access control and territorial reinforcement.
Lighting
1. All types of exterior doors should be illuminated during the hours of darkness, with a minimum
ground level.
2. Recessed areas of buildings or fences, which have a minimum depth of two feet, a minimum height of five
feet, and do not exceed six (6) feet in width and are capable of human concealment, should be illuminated
with a minimum maintained 0.25 foot-candles of light at ground level during the hours of darkness. This
recommendation applies to defined recessed areas, which are within six feet of the edge of a designated
walking surface with an unobstructed pathway to it, not hindered by walls OF hedgerow landscaping a
minimum of two (2) feet in height.
3. All exterior pedestrian walkways, interior common corridors, and open parking lots should be illuhinated
with a minimum maintained one (1) foot-candle of light on the walking or driving surface during the hours
of darkness.
4. Overhead light poles should not be placed in an area planted with shade trees or other canopy producing
species. Only basic ground cover, including but not limited to hedges and shrubs, should be used.
5. The parking and drive surface lighting should have a rated average bulb life of not less than 10,000 hours.
6. Accessible luminaries should have vandal resistant light fixtures and be not less than three feet in height
from ground level when used to illuminate walkways and a minimum of eight feet in height from ground
1 level when illuminating surfaces associated with vehicles. Light fixtures should be deemed accessible if
mounted within fifteen feet vertically or six feet horizontally from any accessible surface or any adjoining
roof, balcony, landing, treads, platform or similar structure.
Landscaping
1. To provide greater visibility, demonstration of ownership (territorial reinforcement), an enhanced
pedestrian environment, and a suitable buffer with the adjoining properties, the basic landscaping theme
should consist of low ground cover with a maximum height of 2 feet and canopy trees with a minimum
lower canopy of 6 feet.
2. Overhead light poles should not be placed in an area planted with shade trees or other canopy producing
species. Only basic ground cover, including but not limited to hedges and shrubs, should be used.
3. Use security landscaping'in areas to deter loitering or entrance where pedestrians are not wanted.
Addressing
1. Numerals should be located where they are clearly visible from the street on which they are addressed.
They should be of a color contrasting to the background to which they are affixed.
2. Numerals should be no less than six inches in height, if located less than 100 feet from the centerline of
the addressed street or 12 inches in height if placed further than 100 feet from the centerline of the
addressed street.
3. The numerals should be illuminated during the hours of darkness.
4. The rear doors of all building should have address numbers not less than six inches in height and be of a
color contrasting to the background to which they are affixed.
Doors
1. Use hollow steel doors that are a minimum sixteen (16) U.S. gauge and have sufficient reinforcement to
maintain the designed thickness of the door when any locking device is installed.
2. Use only glass doors with fully tempered glass or rated burglary resistant glazing. Protect all exterior doors
with security hardware.
3. Equip all doors with a latch cover constructed of steel. Ensure the latch cover is a minimum of .I25 inch
thick. Attach the latch cover to the outside by welding or with non-removable bolts spaced apart on not
more than ten-inch centers.
4. Construct the jamb of all aluminum frame-swinging doors to withstand 1600 pounds of pressure in both a
vertical distance of three inches and horizontal distance of one inch each side-of the strike, to prevent
violation of the strike.
5. Equip rear doors used for shipping and receiving and employee entrances with a viewer.
6. Equip a single or double door with a double cylinder deadbolt with a bolt projection exceeding one inch or
a hook-shaped or expanding deadbolt that engages the strike sufficiently to prevent spreading. The
deadbolt lock shall have a minimum of five-pin tumblers and a cylinder guard.
Windows
1. Equip movable windows with security hardware and burglar resistant glazing.
2. Cover other vulnerable non-movable windows with burglar resistant glazing. Windows of commercial
buildings are vulnerable to breakage during the hours of darkness when the business is non-operational
especially windows within 40 inches of any door locking mechanism
3. Glaze should be constructed of either two part laminated glazing with a 0.60 inch inner layer or burglary

Roofs
1. All skylights on the roof of any building should be provided with rated burglary resistant glazing material
securely fastened with bolts that are non-removable from the exterior.
2. All hatchway openings on the roof of any building should be secured as follows:
a. If the hatchway cover is of wooded material, it should be covered on the inside with at least
sixteen (16) gauge steel metal or its equivalent and attached with screws.
3. All air duct or air vent opening exceeding ninety-six (96) square inches on the roof, exterior doors, or
exterior walls of any building should be secured by covering the same with the following:
a. Iron bars of a least number four (4) steel or equivalent, spaced no more that five (5) inches apart
on center, at each direction, welded at all point of intersection, or one by one-fourth (1 X %) inch
flat steel or equivalent, spaced no more the five (5) inches apart on center, welded at all points of
intersection.
Alarm Systems
1. When considering an alarm system, the police department recommends a "verified system" in an effort to
eliminate false alarm activations and increase breach detection. A verified system is verified through
audio or visual components.

FIRST REVIEW
Engineering Department staff has completed a review of the above-referenced project for
application completeness. The application and plans submitted for this proposed project are
currently incomplete and unsuitable for further review due to the following incomplete items:
1. All easements and encumbrances as identified in Schedule "B" of the PTR must be indicated
on the site plan. The future disposition of any easements and encumbrances must also be
identified. Some of the existing water easements will need to be modified.
2. Show (screened) the existing topography under and around the proposed addition. A
grading permit might be required for this project for the redesigned private storm drain.
3. Submit a copy of the original soils report and an update letter from the soils engineer
indicating that its findings and recommendations are still valid.
4. Show and indicate how the existing site drainage system will be affected by the proposed
addition. Submit appropriate calculations. The original drainage study is available in our
files. Show invert elevations for the relocated storm drain.
5. The Storm Water Standards Questionnaire is filled out incorrectly. This is a redevelopment
project that will create, replace or add at least 5,000 square feet of impervious surfaces on
existing developed property. As such, it is a Priority Development Project. A Preliminary
Storm Water Management Plan (SWMP) needs to be submitted. Refer to the city's Standard
Urban Stormwater Management Plan (SUSMP) to determine if flow control
(hydromodification) requirements apply. Consider using pervious pavement where feasible
or draining areas to pervious surfaces such as adjacent landscaping. You may want to
schedule a meeting to discuss the storm water ramifications of your project, and possible
strategies for meeting the requirements most efficiently.
6. Incorporate Low Impact Development (LID) standards into the design of this project.

Additionally, staff has conducted a preliminary review of the project for engineering issues of
concern. Some of the engineering issues that need to be resolved or adequately addressed prior to
staff making a determination on the proposed project are as follows:
ENGINEERING ISSUES
1. Add the application numbers to the top right hand corner of the drawings.
2. Show in the site plan (A030) the sewer (edu), potable water (gpm), and reclaimed water
(gpm) generated or required by the proposed addition.
3. The existing public water main easement will have to be modified to match the relocated
appurtenances. Show the new easements required and the quitclaims of the obsolete
portions.
4. Verify with the Fire Department the necessary fire protection measures required for this
project (access, fire hydrants, sprinklers, etc.). The second phase addition required last
minute revisions due to additional fire hydrant requirements.
A redlined check print is enclosed for the applicants use in making the requested revisions. This
check print should be returned with the formal application submittal to facilitate continued staff
review.

c. Written description of water conservation features including addressing
xeriscape principles (see Appendix B) within the project.
d. Provide a colored or hatched plan clearly showing where recycled versus
potable water is proposed to be used.
10. Please revise the MAWA calculation using an Eto of 47.00 and using recycled water
which is currently used on site.
11. As required by the State of California, the City of Carlsbad has adopted a water efficient
ordinance. All requirements of this ordinance are to be met. Concept plans shall include
calculations which document the maximum allowed annual water use for the landscaped
area or maximum applied water allowance (MAWA) and estimated total water use
(ETWU). A landscape project shall not exceed the MAWA. The ETWU shall be
determined by the following calculation as defined in the City ordinance:

In addition to the calculations, include a statement on the plans signed under penalty of
perjury by the person who prepared the plan that provides:
"I am familiar with the requirements for landscape and irrigation plans contained in the

Manual. I certify that the plans will be prepared implementing those regulations to
provide efficient use of water."

Hi Don,
I am following up to the Planning Commission's recent request that city traffic engineering staff observe the traffic
situation at the Daybreak Church driveway on Ambrosia Ln. on a Sunday morning to determine what would be
appropriate to address any sight distance or safety concerns. There is concern that church-goers are having difficulty
exiting the driveway due to limited sight distance caused by vehicles parking north of the church driveway on the west
side of Ambrosia Ln. The Planning Commission has requested that the curb on the west side of Ambrosia Ln. north of
the driveway to Poinsettia Ln. ("240 feet) be painted RED to address this concern. Currently, there is 40 feet of existing
RED curb on the north side of the driveway that was painted by the city in 2011 in response to sight visibility concerns
raised by Pastor Webb at Daybreak Church.
In response to the Planning Commission's request, I conducted field observations on Ambrosia Ln. at the Daybreak
Church driveway on Sunday, July isth. My observations started at 10:15 am and ended at 11:OO am (the first church
service starts at 9:30 am, ends at 10:30 am, and the second service starts at 11:OO am). My observations covered the
time period when vehicles were exiting the driveway from the first service and when vehicles were entering the
driveway for the second service. When I arrived, five vehicles were parked on the west side of Ambrosia Ln. north of the

driveway, the closest vehicle being awoximately 80 feet north of the driveway fVd feet north of the existing RED
curb). On the church property, I observed two parking lot attendants with orange vests at the top of the driveway
directing entering vehicles to available parking spaces. During the peak vehicle "exit"/"arrival" time ("10:45 am to "
11:OO am) exiting vehicles wanting to turning left from the driveway backed-up on-site past the church parking lots at
the top of the driveway. The left-turning vehicles waiting to exit the church driveway onto Ambrosia Ln. sometimes had
to wait for a gap (up to 10 - 15 seconds) in northbound through and northbound traffic turning left into the church
driveway, while watching for approaching southbound vehicles on Ambrosia Ln. (which could be momentarily partially
hidden from view due to parked vehicles north of the driveway). During this peak vehicle "exit"/"arrival" time, vehicle
queues on northbound Ambrosia Ln. waiting for a green light to turn left at the Poinsettia Ln. traffic signal backed up
two times to the church driveway, but cleared as soon as they received the green light.
Based on my field observations, and the Planning Commission's concern and request for (additional) RED curb on
Ambrosia Ln., we will be making the following changes to improve traffic operations on Sunday mornings at the
Daybreak church driveway on Ambrosia Ln.:
A work order will be sent to paint an additional 200 feet of RED curb north of the driveway on the west side of
Ambrosia Ln. to Poinsettia Ln.
Staff will make adjustments to the traffic signal timing at Poinsettia Ln./Ambrosia Ln. on Sundays when church
services end/vehicles are exiting the driveway to help reduce the length of the northbound/left turn queue on
Ambrosia Ln. at Poinsettia Ln.

The Aviara Premier Collection Board of Directors was recently notified, at a community meeting held on
March 6,2012, the Daybreak Church is planning to open a school on the premises, It has also been noted
yellow construction signs have been put on the slope on Poinsettia which states the Daybreak Church has
applied for a permit for a new building which will be constructed in the parking lot adjacent to the
administrative building. Please note last time Daybreak Church applied for a building permit, the City
a required Aviara Premier Collection's approval prior to beginning the project, and APC would expect to
approve any new building construction, as well,
APC's Board of Director's is concerned about any new buildings due to the fact the new building's footprint
would be built in the current parking lot and take up additional parking spaces for church members. The
Aviara Premier Collection is concerned about the reduced parking spaces from the recently built second
building, and the church's increased meeting times and membership which is already impacting traffic.
Also APC is opposed to the Daybreak Church operating a school on the premises, because Aviara Premier
Collection is not zoned for commercial activities. Furthermore, the Aviara Premier Collection CC&Rs
prohibit commercial activity within the Association and the Daybreak Church is within these boundaries.
The construction of a new school will cause a significant amount of additional traffic in the form of buses
and early morning and afternoon vehicles on Ambrosia on a daily basis, which is a violation of the 7.8
Nuisance clause of the APC CC&R1s:
"No obnoxious, offensive or illegal activity shall be carried out upon any portion of the Project,
nor shall anything be done or placed within the Project which is or may become a nuisance or
cause unreasonable disturbance or annoyance to other persons within the Project or creates a
risk which is uninsurable or beyond the extended coverage insurance customarily obtained for
residential projects."
In addition to being a Nuisance, the construction of a school is a use violation within APC, due to Aviara
Premier Collection's CC&R's, Section 7.2.1.
"Except for the use and development permitted in the Commercial Area as set
forth in the Master Plan, the Aviara Premier Collection shall be limited to use
for residential purposes."
APC Rules & Regulations, Commercial Use Section, page 2:
"No part of a lot or dwelling shall be used or caused to be used, or
allowed, or authorized in any way, directly or indirectly, for any business,
commercial, manufacturing, mercantile, storing, vending or other such
nonresidential purpose unless all requirements within Section 7.2.1 are
met."
As you know, Aviara Premier is a very quiet, residential neighborhood where children walk to and from
school. Any additional traffic and on-street parking, is not only a nuisance, but a safety hazard to our
children and residents. The APC Board has worked very hard to maintain the quiet, beautiful character of
this residential neighborhood over the past 9 years, and our main focus and concern is preserving the
quality of life for APC residents. The APC Board has been continually focused on upholding the high
standards of the Aviara Community.
While APC very much appreciates Daybreak's honorable contribution to the community by offering religious
services, APC reserves the right to approve any new construction within its boundaries, and we do not
authorize any commercial activity within our boundaries, or any additional traffic generated by those
commercial activities, and we would certainly hope that Daybreak, as a member of APC, would be a good
neighbor and honor the CC&R1s and Rules & Regulations of Aviara Premier.

1. We wish to confirm that we are requesting to change the age of the students
that will be provided with instruction (associated with Phase II) to elementary
school (instead of high school or preschool/nursery). We have noted this on the
appropriate lines of the Parking Tabulation on our Site Plan sheet A030.
2. The typical weekly schedule is attached.
3. Project Description on sheet A030 has been revised to show the correct proposed
height (maximum) of 30'.
4. Minimum dimensions for compact, standard and parallel parking stalls have been
provided in the Proposed Parking Spaces Tabulation on sheet A030.
5. Sheet A201 has been revised to note the existing and proposed grades, and to
identify the overall height of each elevation.
6. See Site Section A-A on the bottom of sheet A030. This section has been

I am in receipt of the document titled "lst Review for CUP 00-06(B)lSDP 00-
06(b)/CDP 00-09(B)", as prepared for Daybreak Community Church and dated
February 27, 2012. As requested in said review, the following is my type written
response to the engineering department comments as they relate to my plans.
ENGINEERING.
1. All easements within the limits of the project are shown and the disposition
of the waterline easement has been noted as requested.
2. The screened improvements have been identified as constructed by 392-
6B and notes added to the legend.
3. Soils report to be provided by the architect with the resubmittal ...
4. The proposed drainage system is shown and invert elevations have been
provided as requested. Please refer to the accompanying preliminary
hydrologylhydraulic calculations for system justification ...
5. Please refer to the revised city form E-34 as accompanying. As a
redevelopment of an existing priority project the existing SWMP applies and will
be the preliminary SWMP for this project. This project follows the same
recommendations and format with the inclusion of a bio-filtration system as
shown on the preliminary grading plan. As identified within the existing SWMP
and currently utilized on the site, the proposed building addition will incorporate
pavers within the walkway and court yard area to provide a pervious surface.
Drainage from these areas, as well as the building court yard and roofs, will be
directed to the bio-filtration area thus creating the desired disconnect between
pervious areas. As noted within the accompanying hydrology study,
hydromodification may be required ...
6. The proposed project is the redevelopment of an existing site
incorporating the above noted facilities, thus incorporating LID standards to the
greatest extent possible.

To address post-development pollutants that may be generated from development projects, the City requires that new
development and significant redevelopment priority projects incorporate Permanent Storm Water Best Management
Practices (BMP's) into the project design per the City's Standard Urban Stormwater Mamgement Pkrn (SUSMP). To
view the SUSMP, refer to the Engineering Standards (Volume 4, Chapter 2) at www.carlsbadca.aovlstandards.
Initially this questionnaire must be completed by the applicant in advance of submitting for a development application
(subdivision, discretionary permits andlor construction permits). The results of the questionnaire determine the level of
storm water standards that must be applied to a proposed development or redevelopment project. Depending on the
-, your projed will etther be subject to 'Standad aormwater Requirements' or be subjed to additional criteria
called 'Prkrfty Development Project Requirements'. Many aspects cf project sL design are dqmndd llporr ths

2. The new and relocated water services and other utilities shown in sheets 1 & 2 of the
preliminary grading plan are inconsistent. Clarify by showing the work in only one sheet,
or make them consistent.
3. The roof drains from the existing Building B should be redesigned to tie into proposed
Building C so they are not located under the new building.
4. Move the proposed grate inlet in the proposed bio-retention area so it is outside the
existing water easement.
5. As a Priority Development Project, per the city's Standard Urban Stormwater
Management Plan (SUSMP), flow control (hydromodification) might be required if
impervious area is increased. Consider increasing pervious area by adding pervious
pavement where feasible to have no net increase in imperviousness.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Division has
reviewed your Conditional Use Permit Amendment, Site Development Plan Amendment and Coastal
Development Permit Amendment, application nos. CUP 00-06(B), SDP 00-06(B), CDP 00-09(B), as
to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information which
must be submitted to complete your application. The second list is project issues of concern to staff.
In order to expedite the processing of your application, the "incomplete" items and your response to
the project issues of concern to Staff must be submitted directly to your staff planner; therefore,
please contact your staff planner directly to schedule a re-submittal appointment. As part of your re-
submittal package, please prepare and include with your re-submittal: (1) a copy of these lists, (2) a
detailed letter summarizing how all identified incomplete items andlor project issues have been
addressed; and (3) five (5) sets of revised plans. No processing of your application can occur until
the application is determined to be complete.
When all required materials are submitted, the City has 30 days to make a determination of

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION
Engineering:
1. All easements and encumbrances as identified in Schedule "B" of the Preliminary Title
Report must be indicated on the site plan. The future disposition of any easements and
encumbrances must also be identified. Some of the existing water easements will need
to be modified.
2. Please identify (screened) the existing topography under and around the proposed
addition. A grading permit may be required for this project for the redesigned private
storm drain.
3. Please submit a copy of the original soils report and an update letter from the soils
engineer indicating that its findings and recommendations are still valid.
4. Please show and indicate how the existing site drainage system will be affected by the
proposed addition. In addition, please submit the appropriate calculations. The original
drainage study is available in our files. Please also show the invert elevations for the
relocated storm drain.
5. The Storm Water Standards Questionnaire is filled out incorrectly. This is a
redevelopment project that will create, replace or add at least 5,000 square feet of
impervious surfaces on existing developed property. As such, it is a Priority
Development Project. A Preliminary Storm Water Management Plan (SWMP) needs to
be submitted. Refer to the city's Standard Urban Stormwater Management Plan
(SUSMP) to determine if flow control (hydromodification) requirements apply. Consider
using pervious pavement where feasible or draining areas to pervious surfaces such as
adjacent landscaping. You may want to schedule a meeting to discuss the storm water
ramifications of your project, and possible strategies for meeting the requirements most
efficiently.
6. Please revise the project plans to incorporate Low Impact Development (LID) standards
into the design of this project.
ISSUES OF CONCERN
Planning:
1. A total of 18 parking spaces were required for the classrooms associated with the previous
amendmentlphase 11 (137 high school or preschool students with 4 teachers; 1
spacelemployee plus 1 space110 students = 18 spaces). Based on the information
provided on the plans for the proposed project (i.e., Phase Ill), a total of 6 parking spaces
(noted as "existing") are allocated for the same classrooms associated with the previous
phase (i.e. Phase 11). However, it is noted that a majority of the classrooms associated
with Phase II will accommodate elementary-age children, which do not require parking for
the students (only for teachers). Please confirm that as part of your proposal for Phase Ill,
you are requesting to change the age of the students which will be provided instruction
associated with Phase II to elementary school (instead of high school or
preschool/nursery). As an alternative, please revise the plans to provide the 18 parking
spaces originally required for preschool or high school-aged children.

2. To assist with staffs parking analysis for the staff report, please submit a typical
dailylweekly schedule for the classes, age group associated with each class, and services
proposed to be held on-site.
3. Please revise the Project Description (A030) on the cover page to note the correct
proposed height (maximum) of the addition (i.e., 30' instead of 28').
4. Please revise Sheet A030 to identify the minimum dimensions for a compact, standard
and parallel parking stall.
5. Please revise the elevations (Sheet A201) to note the existing and proposed grade.
Please identify the overall height of each elevation, taken from existing grade.
6. Please provide cross sections which demonstrate how the roof equipment will be
screened.
7. Please correct the project application numbers in the upper right hand corner of the plans
to reflect the znd amendment: SDP 00-06(B), CUP 00-06(B), and CDP 00-09(B) to the
upper right hand corner of the plans. Please ensure that the project numbers are also
added to the grading plans. In addition, please note that the current CUP project no. is
CUP 00-06 instead of CUP 00-26.
8. Staff has been contacted by a resident of the neighboring residential community to the
west, off of Fisherman Drive, regarding concerns the community has with the overflow
parking for Daybreak Church and the future intention to provide secondary access through
their community. It is staff's understanding that the applications for the next phase of
development, which includes obtaining the necessary permits to pave the overflow parking
area, will be submitted within the year. You are strongly encouraged to discuss the
proposed improvements with the HOA for this community as part of the future planning
process (i.e. in advance of application submittal) and address any concerns the
community may have to the maximum extent feasible.
Landscaping:
Numbers below are referenced on the red line plans where appropriate for ease in locating the
area of the comment concern.
I. Washingtonia robusta is listed as an invasive species. Please provide an appropriate
substitute (i.e. Queen Palm to match others existing on site).
2. Please label the SDG&E easement and insure that inappropriate treeslpalms are located
outside of the easement.
3. Please show and label the water easement and insure no trees are located within this
easement (see preliminary grading plans for easement location).
4. Please coordinate the landscape design with the bio-retention. area using appropriate
plants and layout.
5. Please coordinate landscape plans with the civil plans.

9. Please provide a complete Water Conservation Plan as required by the Landscape
Manual. Please note that the site currently uses recycled water. All landscape areas are
to continue this use. Plans shall include but not be limited to:
a. Extent of Planting Zone 1 (Lush) - Indicate percentage of Zone 1 planting (per
Appendix A) of the total landscaped area (as defined in Appendix G). Provide
justification for the appropriateness of where Zone 1 plantings are used in terms of
water conservation. (For example, are Zone 1 plantings in areas of shade where they
will use less water andlor has the soil been suitably amended so as to retain relatively
greater moisture?)
b. Accommodations for recycled water (existing or future) and outline planting areas
proposed to use recycled water.
c. Written description of water conservation features including addressing xeriscape
principles (see Appendix B) within the project.
d. Provide a colored or hatched plan clearly showing where recycled versus potable
water is proposed to be used.
10. Please revise the MAWA calculation using an Eto of 47.00 and using recycled water which
is currently used on site.
11. As required by the State of California, the City of Carlsbad has adopted a water efficient
ordinance. All requirements of this ordinance are to be met. Concept plans shall include
calculations which document the maximum allowed annual water use for the landscaped
area or maximum applied water allowance (MAWA) and estimated total water use
(ETWU). A landscape project shall not exceed the MAWA. The ETWU shall be
determined by the following calculation as defined in the City ordinance:
