First, Pacifica Enterprises continues to remain excited about this development and we look forward to tiie day we will be able to proceed. However, due to the downturn in market rates for class "A" office space we are compelled to hold off imtil the office market recovers and stabilizes at an asking rate in the $2.25 p. s.f fiill service gross. Therefore, we respectfiilly request a three year extension to the Site Development Pemiit and the Coastal Development Pemiit. In the mean time we are continuing to work with JRM Real Estate (the Kellys) regarding the off-site improvement work along Laurel Tree Lane and Palomar Airport Road, and expect to have the all of the off- site plans completed next week. We should be ready to submit the off-site plans to the City of Carlsbad in the very near fiiture. Also enclosed herewith are two checks in the amount of $2,362.50 payable to the City of Carlsbad for the Coastal Development Permit Extension and another check in the amount of $1,960.00 payable to the City of Carlsbad for the SDP extension. The conditions of approval state that the project shall become null and void if building permits are not issued within two years from the date of approval. The project will have to be extended by an amendment to the Site Development Plan (SDP) permit to extend the expiration date. The application must be made no sooner than 90 days or no less than 30 days prior to the expiration date. The application fees for the amendment will be $1,960.00 for the SDP and $2,362.50 for the Coastal Development Permit extension (25% of current fee and a 25% discount for multiple applications). Please find attached the application form and a new disclosure statement that should accompany the application. II. INTRODUCTION This is a proposed two-year extension of SDP 01-01 for the construction of a 120,000 square foot, three-story office building proposed on the south side of Palomar Airport Road and east of Aviara Parkway from September 19, 2003 through September 18, 2005. III. PROJECT DESCRIPTION AND BACKGROUND On September 19, 2003 the Planning Commission approved SDP 01-01 to permit a 120,000 square foot, three-story office building located on the south side of Palomar Airport Road and east of Aviara Parkway. The project's resolution of approval contained a condition. No. 29, which states, "This approval shall become null and void if building permits are not issued for this project within 24 months from the date of project approval." This application is to modify that condition to allow an additional 24 months to exercise the permit. The applicant has been processing required permits for the project. The Army Corps of Engineers and Califomia Department of Fish and Game will be prepared to issue permits once the conceptual wetlands mitigation and monitoring plan, which is currently being prepared by the project's consultant, has been submitted. Upon provision of this plan, the applicant should receive their permits from those agencies. The Regional Water Quality Control Board has already indicated to the applicant's environmental consultant that the Section 401 permit is prepared, but they need to review the conceptual wetlands mitigation and monitoring plan prior to certification to ensure that all of their requests have been accommodated. The applicant also notes that the market for Class "A" office space is soft and is holding off on construction until the office market recovers and stabilizes. The Pacifica Palomar Office Building project is still consistent, as conditioned, with all applicable plans, policies and regulations described below: 1. Plaimed Industrial (PI) and Open Space General Plan land Use Designations; 2. Plaimed Industrial, Qualified Development Overlay Zone (P-M-Q); 3. Site Development Plan findings required by the Qualified Development Overlay Zone, Carlsbad Municipal Code, Chapter 21.06, Section 21.06.020; 4. Comprehensive Land Use Plan for McClellan-Palomar Airport; 5. Mello II Segment ofthe Local Coastal Program, the Coastal Agricultural Overlay Zone - Carlsbad Municipal Code, Chapter 21.202 and the Coastal Resource Protection Overlay Zone - Carlsbad Municipal Code, Chapter 21.203; and 6. Growth Management Ordinance (Local Facilities Management Plan Zone 5). B. The adopted project findings for SDP 01-01, which are contained in Planning Commission Resolution No. 5041, still apply to this project (SDP Ol-Ol(A)). C. V. ENVIRONMENTAL REVIEW The proposed project has been reviewed pursuant to the Califomia Environmental Quality Act (CEQA). On July 5, 2001 the Planning Director issued a Mitigated Negative Declaration, Addendum, and Mitigation Monitoring and Reporting Program for the proposed project.
