County.

PRELIMINARY REPORT
In response to the above referenced application for a policy of title insurance, this company hereby reports that it is prepared to issue, or
cause to be issued, as of the date hereof, a Policy or Policies of Title Insurance describing the land and the estate or interest therein
hereinafter set forth, insuring against loss which may be sustained by reason of any defect, lien or encumbrance not shown or referred to as
an Exception below or not exduded from coverage pursuant to the printed Schedules, Conditions and Stipulations of said Policy forms.
The printed Exceptions and Exclusions from the coverage and Limitations on Covered Risks of said policy or policies are set forth in Exhibit A
attached. The policy to be issued may contain an arbitration clause. When the Amount of Insurance is less than that set forth in the
arbitration clause, all arbitrable matters shall be arbitrated at the option of either the Company or the Insured as the exclusive remedy of the
parties. Limitations on Covered Risks applicable to the CLTA and ALTA Homeowner's Policies of Title Insurance which establish a Deductible
Amount and a Maximum Dollar Limit of Liability for certain coverages are also set forth in Exhibit A. Copies of the policy forms should be
read. They are available from the office which issued this report.
Please read the exceptions shown or referred to below and the exceptions and exclusions set forth in Exhibit A of this
report carefully. The exceptions and exclusions are meant to provide you with notice of matters which are not covered
under the terms of the title insurance policy and should be carefully considered.
It is important to note that this preliminary report is not a written representation as to the condition of title and may not
list all liens, defects, and encumbrances affecting title to the land.
This report (and any supplements or amendments hereto) is issued solely for the purpose of facilitating the issuance of a policy of title
insurance and no liability is assumed hereby. If it is desired that liability be assumed prior to the issuance of a policy of title insurance, a
Binder or Commitment should be requested.

Section 12413.1 of the California Insurance Code, effective January 1, 1990, requires that any title insurance
company, underwritten title company, or controlled escrow company handling funds in an escrow or sub-escrow
capacity, wait a specified number of days after depositing funds, before recording any documents in connection
with the transaction or disbursing funds. This statute allows for funds deposited by wire transfer to be disbursed
the same day as deposit. In the case of cashier's checks or certified checks, funds may be disbursed the next day
after deposit. In order to avoid unnecessary delays of three to seven days, or more, please use wire transfer,

1. Governmental police power, and the existence or violation of those portions of any law or government regulation concerning:
(a) building; (d) improvements on the Land;
(b) zoning;
(c) land use;
(e) land division; and
(f) environmental protection.
This Exclusion does not limit the coverage described in Covered Risk B.a., 14, 15, 16, 18, 19, 20, 23 or 27.
2. The failure of Your existing structures, or any part of them, to be constructed in accordance with applicable building codes. This Exclusion
does not limit the coverage described in Covered Risk 14 or 15.
3. The right to take the Land by condemning it. This Exclusion does not limit the coverage described in Covered Risk 17.
4. Risks:
(a) that are created, allowed, or agreed to by You, whether or not they are recorded in the Public Records;
(b) that are Known to You at the Policy Date, but not to Us, unless they are recorded in the Public Records at the Policy Date;

EXCLUSIONS FROM COVERAGE
The following matters are expressly excluded from the coverage of this policy, and the Company will not pay Joss or damage, costs, attorneys'
fees, or expenses that arise by reason of:
1. (a) Any law, ordinance, permit, or governmental regulation (including those relating to building and zoning) restricting, regulating,
prohibiting, or relating to
(i) the occupancy, use, or enjoyment of the Land;
(ii) the character, dimensions, or location of any improvement erected on the Land;
(iii) the subdivision of land; or
(iv) environmental protection;
or the effect of any violation of these Jaws, ordinances, or governmental regulations. This Exclusion l(a) does not modify or limit the
coverage provided under Covered Risk 5.
(b) Any governmental police power. This Exclusion 1(b) does not modify or limit the coverage provided under Covered Risk 6.
2. Rights of eminent domain. This Exclusion does not modify or limit the coverage provided under Covered Risk 7 or 8.
3. Defects, liens, encumbrances, adverse claims, or other matters
(a) created, suffered, assumed, or agreed to by the Insured Claimant;
(b) not Known to the Company, not recorded in the Public Records at Date of Policy, but Known to the Insured Claimant and not disclosed
in writing to the Company by the Insured Claimant prior to the date the Insured Claimant became an Insured under this policy;
(c) resulting in no loss or damage to the Insured Claimant;
(d) attaching or created subsequent to Date of Policy (however, this does not modify or limit the coverage provided under Covered Risk 11,
13, or 14); or
(e) resulting in loss or damage that would not have been sustained if the Insured Claimant had paid value for the Insured Mortgage.
4. Unenforceability of the lien of the Insured Mortgage because of the inability or failure of an Insured to comply with applicable doing-
business laws of the state where the Land is situated.
5. Invalidity or unenforceability in whole or in part of the lien of the Insured Mortgage that arises out of the transaction evidenced by the
Insured Mortgage and is based upon usury or any consumer credit protection or truth-in-lending law.
6. Any claim, by reason of the operation of federal bankruptcy, state insolvency, or similar creditors' rights laws, that the transaction creating
the lien of the Insured Mortgage, is
(a) a fraudulent conveyance or fraudulent transfer, or
(b) a preferential transfer for any reason not stated in Covered Risk 13(b) of this policy.
7. Any lien on the Title for real estate taxes or assessments imposed by governmental authority and created or attaching between Date of

NOTICE IS HEREBY GIVEN to you that the Planning Commission of the City of Carlsbad will hold a public
hearing at the Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:00 p.m. on
Wednesday, April 3, 2013, to consider a request for the following:

DESCRIPTION: Request for approval of a Site Development Plan and Coastal Development Permit to
allow for the construction of 4 single family homes on property generally located on the northeast
corner of Hummingbird Road and Rock Dove Street within the Mello I Segment of the Local Coastal
Program and within Local Facilities Management Zone 19.
Those persons wishing to speak on this proposal are cordially invited to attend the public hearing and
provide the decision makers with any oral or written comments they may have regarding the project.

This early public notice is to let you know that a development application for a Site
Development Plan and Coastal Development Permit project within your neighborhood
has been submitted to the City of Carlsbad on January 16, 2013. The project
application is undergoing its initial review by the City.
LOCATION: The north east corner of Rock Dove Street and Hummingbird Road.
PROJECT DESCRIPTION: The construction of four single-family homes on four
existing lots within Aviara Planning Area 3.
Please keep in mind that this is an early public notice and that the project design could
change as a result of further staff and public review. A future public hearing notice will

Plan Review Recommendations
The City of Carlsbad Police Department's Crime Prevention Unit has provided the following optimal security
recommendations. The purpose of this document is to safeguard property and public welfare by regulating and
reviewing the design, construction, quality of materials, use and occupancy, location, and maintenance of all
buildings and structures. The standards used in this document represent model international standards.
Crime Prevention through Environmental Design
The proper design and effective use of the built environment can lead to a reduction in the fear and incidence of
crime and an improvement in the quality of life. The proper design influences this by positively affecting human
behavior. The design includes the physical environment, the planned behavior of people, the productive use of
space and an effective crime/loss prevention program.
Natural Surveillance
1. Place and design physical features to maximize visibility. This will include building orientation, windows,
entrances, walkways, landscape trees and shrubs, fences and any other physical obstruction.
2. Design the placement of persons and or activities to maximize surveillance possibilities.
3. Design lighting that provides for appropriate nighttime illumination of walkways, entrances and
driveways.
Area of concern-Courtyards separate a resident from the street. Separation limits a resident's ability to be the
eyes and ears of the neighborhood. Separation causes a more secluded atmosphere and limits neighborhood
collaboration. Separation limits surveillance into and out of the property. These elements are necessary for the
health and safety of the neighborhood and can lead to an increase in the opportuni~y for crime.
Natural Access Control
1. Use walkways, pavement, lighting and landscaping to clearly guide guests to and from selected entrances.
2. Use real or symbolic barriers like fences or landscaping to prevent and or discourage access to or from
dark and or unmonitored areas.
Provisions for territorial reinforcement
1. Use pavement treatments, landscaping and fences to define and outline ownership or property.
Lighting
1. Equip building on all sides with light fixtures. White florescent lights allow the best vision.
2. Install lights on the building in the eaves to illuminate the perimeter of the house.

3. Choose light fixtures with dawn to dusk sensors or timers not motion sensors.
Landscaping
1. Plan a landscaping design that enhances surveillance and security.
2. Tree canopies should be no lower than six (6) feet and should not allow access to roofs or balconies.
3. Ensure landscaping plan does not deter from lighting and addressing.
4. Plant only low profile shrubs that can be maintained below two (2) feet.
5. Use security plants where necessary to prevent entering and tampering.
6. Install walls and fences that are see-through and enhance surveillance.
7. Install lockable gates that allow surveillance.
Addressing
1. Locate numerals where they are clearly visible from the front street
2. Contrast the numeral's color to the background on which it is affixed.
3. Numerals shall be no less than four (4) inches in height and illuminated during the hours of darkness.
Entrances
1. Design front entrances to provide vision from the front door to the front access street.
2. Keep entranceways clear of clutter.
Doors
1. Do not use of glass within 42 inches of a locking device.
2. A single or double door shall be equipped with a double cylinder deadbolt with a bolt projection
exceeding one inch or a hook-shaped or expanding dead bolt that engages the strike sufficiently to prevent
spreading. The deadbolt lock shall have a minimum of five-pin tumblers and a cylinder guard.
3. Install wooden doors of solid core construction with a minimum thickness of one and three-fourths (1-3/4)
inches.
4. Provide a double door inactive leaf with metal flush bolts having a minimum embedment of five-eighths
(5/8) of an inch into the header and footer of the doorframe.
Strike Plates
1. Reinforce all deadbolt strike plates. Choose Strike plates constructed of a minimum 16 u.s. gauge steel,
bronze, or brass and secure it to the jamb by a minimum of two screws, which should penetrate at least
two (2) inches into the solid backing beyond the surface to which the strike is attached. Re-enforcement
of the door area around the lock is also suggested.
Viewer
1. Arrange entrance doors so that the occupant has a view of the area immediately outside the door without
opening the door. Except doors requiring a fire protection rating that prohibits them, such a view may be
provided by a door viewer having a field of view of not less than 190 degrees. Mounting height should not
exceed fifty-four (54) inches from the floor.
Windows and sliding glass doors
1. All exterior sliding glass doors and windows should be equipped with locking devices which will keep the
sliding panel of the door or window from being opened from the outside horizontally or vertically.

2. Ensure windows have security features preventing the window from being forced to slide or rise.

modifications to the documents and plans as requested. To this end, attached with this cover

Below are responses and methods that we are addressing the City comments, in the order of

ISSUES OF CONCERN
Planning:
1. On the Title Sheet (TS) and Site Plan (SP), the lot coverage square footage and therefore
lot coverage percentage are incorrect for all lots. For example, Plan I identifies 2,592 square
feet for lot coverage calculation when the home is listed as 2,590 square feet without the 450
square foot garage. Please calculate the square footage subject to lot coverage based on the
following definition:
"Building coverage" means the total ground area of a site occupied by any
building or structure as measured from the outside of its surrounding external
walls or supporting members. Building coverage includes exterior structures such
as stairs, arcades, bridges, permanent structural elements protruding from
buildings such as overhanging balconies, oriel windows, stories which overhang a
ground level story, garages and covered carports. Building coverage also includes
the perimeter area of a basement. Excluded from building coverage are roof eaves
extending less than thirty inches from the face of any building, awnings, open
parking areas, structures under thirty inches in height and masonry walls not
greater than six feet in height such as wing-walls, planter walls or grade-
separation retaining walls "

Response: The lot coverage square footages and percentages have been corrected on
the TS for each lot based on the definition provided.
2. On Sheet TS, under the Residential Parking Section, please add that that the parking
spaces are located within a garage.
Response: The words "located within a garage" have been added to each home in
this section on the TS.
3. On Sheet SP, please show the outline of the alfresco living area and covered porches on
lots I24, I25 and I26 as applicable.
Response: The outline of the alfresco living area and covered porches have been
added on the SP sheet, as requested.
4. On Sheet SP, the home on lot I24 is shown 22.I 'from the property line. However, on the
grading plan, the setback shows 20.6 '. Please update the two sheets so that they are consistent.
Response: The two sheets are consistent now at 22.0 feet.
5. On Sheet SP, the home on Lot I23 typically requires an 8.I 'side yard setback on each
side. It is my understanding that this lot is proposed for a "side yard swap". However, this
would require a minimum of 5' on one side (shown) and a minimum of II.2 'on the other.
Currently II. 0' is shown on Sheet SP but II.4 is shown on the grading plan. Please update the
two sheets so they are consistent and show at least 5. 0' and II.2' on the sides.
Response: The two sheets are now consistent at 5' on the inside side and 11.4' on
the outside side.
6. On Sheets A2.I, A2. 2, A2. 5, A2. 6, A2. 9 and A2.I 0, please incorporate the "options" into
the floor plans.
Response: The options have been incorporated into the sheets, as requested.
7. On Sheet A2.3, verify the front elevation is accurate.
Response: I am informed by the architect that the front elevation is accurate.
8. Sheet A2. 4 does not show the right elevation accurately. The alfresco living area is not
shown and it looks similar to the elevation for lot I26. Please correct the right elevation.
Response: The right elevation on Sheet A2.4 is now shown accurately.
9. The Policy 44 compliance analysis table on Sheet TS requires the following corrections:
a. Number 4 states that Plan I is 27'9". However, Plan 2RA is 27'9" and Plan 2RB is
27 '2 ". Plan I is I7 '9 ". Please revise to correct the information stated
b. Number 9 needs a checkbox for the first standard as the two-story homes have courtyards
at least I5 ' wide.

c. Number 10 states that all homes meet the plane requirements for the .front. Plan 1 does
not comply since the front and rear planes do not meet the 10' requirement. However,
only 66% need to comply and 7 5% (3 of 4) of the homes do comply.
d. Number 11 states that only Plan 1 complies with the rear yard plane requirements.
However, Policy 44 states that a different roof plane can count as long as it is greater
than 30 s.f Therefore, all of the Plan 2 's comply as well and ultimately comply with this
requirement.
e. Number 15 states that 75% of the 4 homes meet this requirement, but then states "1 out
of 4 ". Please revise to read "3 out of 4 ".
Response: All of the above changes have been made to the Policy 44 table on the TS.
We are hopeful that the modifications to the plan set as requested will satisfY the information
needed for scheduling the project for April 3 Planning Commission hearing. Please let us know if

Policy 44 and Policy 66. The proposed project does not meet requirements #9, 10 and 11
of Policy 44.
Response: Table analyses of project compliance with Council Policy 44 and 66 are included
on the TS. We conclude that the homes comply with all of Council Policy 44, except for
Guideline # 11. Pursuant to Guideline #II, the single story unit contains 8 rear wall planes, two
of the two~story units contain 3 rear wall planes, and the last unit contains 2 rear wall planes. But
these units are all consistent with the A viara Master Plan and the A viara Residential Design
Guidelines, which are specific to the subject neighborhood and community. Thus, the proposed
homes are consistent and compatible with the subject neighborhood. Also this side elevation
contains six wall planes, including a courtyard, and thus will result in a good amount of
shadowing, in addition to the added architectural features.
7. Identify any street trees and proposed locations.
Response: Proposed street trees have been shown on the SP. We were advised by City Staff
that no specific landscape plan was required or necessary.
8. The Master Plan requires 15% open space in the rear of each lot. Please show
compliance.
Response: Rear yard open space calculations are shown on the SP. Minimum rear yard
open space calculates at 26.9% on Lot 126. All other have a greater percentage of open space.
Fire Prevention:
1. Water Improvement
a. Hydrants
i. Additional on-site public water mains and fire hydrants are required. Provide additional
fire hydrants at intervals of 300 feet along public streets and/or private driveways.
Hydrants should be located at street intersections when possible, but no closer than 100
feet from the terminus of a street or driveway.
Response: A fire hydrant exists directly across Hummingbird Road from Lot 126. This
hydrant is within 150 feet of the furthest of the proposed structures.
2. Landscape
a. Distance from structure or building to brush.
Response: No native habitat or significant brush community exists adjacent to the proposed
homes. Erosion control plantings of primarily an exotic nature and a public trail exist within the
SDG&E easement behind Lot 123. This erosion control and domestic planting is 16 feet from the
proposed home at Lot I23. This information is shown on the SP.
i. Indicate the distance from each structure to existing native vegetation or wild-land area
if there are any.
Response: No native vegetation or wild-land area exists adjacent to the proposed homes.
Erosion control plantings exist within the SDG&E easement, but these do not constitute a native
vegetation community.
ii. Rear yard setbacks. Provide dimensions from rear property line to structure.
Response: Setback dimensions to the rear property lines are now shown on the SP and on
the Engineering Sheet.
iii. Fire control planting. Indicate how the proposed plan conforms to the City of Carlsbad
Landscape Guidelines by depicting various fire control plantings or management zones
which buffer structures from the hazards of undisturbed native vegetation.
Response: No undisturbed native vegetation exists adjacent to the subject lots. The SDG&E
easement contains largely non-native domestic and erosion control plantings.
iv. Fire Control maintenance responsibility. Provide a maintenance plan which identifies
who will be responsible for periodic fire control maintenance, how it will be
accomplished, what maintenance benchmarks or standards are proposed and how they
will be documented.
Response: The SDG&E easement is and will continue to be maintained by the A viara
MasterHOA.
v. Access for emergency vehicles and maintenance. Provide access to all designated fire
suppression zones for emergency vehicles and maintenance.
Response: Convenient vehicular access to the SDG&E easement exists via the public trail
gate area located approximately 140-feet northerly of the Lot 126 structure on Rock Dove Street.
3. Fire Sprinklers
a. An automatic fire sprinkler system is required for each of the residences.
Response: This comment is acknowledged by the applicant.
b. Provide notes on all plans submitted for review that indicate that fire sprinklers are
required.
Response: A note requiring that fire sprinklers are required in the proposed homes has been
added to the plan set.
c. Deferred submittal of fire sprinkler plans to the Fire Department for review.
Response: Fire sprinkler plans will be submitted with the Building Plans.
4. Water Meters
a. You will be required to install a one inch (1 '') or greater water service and water meter.
This is to ensure that there is adequate water provided in the event of a fire sprinkler
activation during periods of other uses and/or demands, e.g. irrigation.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Division has reviewed
your Site Development Plan and Coastal Development Permit, applications no. SOP 13-01/CDP 13-03, as
to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information which
must be submitted to complete your application. The second list is project issues of concern to staff. In
order to expedite the processing of your application, the "incomplete" items and your response to the
project issues of concern to Staff must be submitted directly to your staff planner; therefore, please
contact your staff planner directly to schedule a re-submittal appointment. As part of your re-submittal
package, please prepare and include with your re-submittal: (1) a copy of these lists, (2) a detailed letter
summarizing how all identified incomplete items and/or project issues have been addressed; and (3) five
(5) sets of revised plans. No processing of your application can occur until the application is determined
to be complete.
When all required materials are submitted, the City has 30 days to make a determination of
completeness. If the application is determined to be complete, processing for a decision on the
application will be initiated. In addition, please note that you have six months from the date the
application was initially filed, January 16, 2013, to either resubmit the application or submit the
required information. Failure to resubmit the application or to submit the materials necessary to
determine your application complete shall be deemed to constitute withdrawal of the application. If an
application is withdrawn or deemed withdrawn, a new application must be submitted.
At this time, the City asks that you provide 5 complete sets of the revised development plans so that the
project can continue to be reviewed. The City will complete the review of your resubmittal within 25
days.

2. On the Site Plan sheet (SP), please make the following corrections:
a. Include the correct scale. The current one does not scale properly.
b. Identify the actual distance from the property line to the house (some of this is shown
and some is not) .
. c. Show the location, type and height of proposed walls and fences.
d. Add lot line dimensions.
e. Add lot width measured at the front setback line.
f. Add lot area.
3. On the floor plan sheets, please make the following corrections:
a. Include a scale and show main dimensions of the floor plan. Porches, courtyards and
garages, at a minimum, need to be dimensioned.
b. Incorporate the "options" shown into the floor plans if they are already predetermined.
Internal options that don't change the building footprint or elevations can be excluded.
4. On the elevations, please make the following corrections:
a. Include the correct scale and label building height on all elevations.
b. Include elevations for the front, both sides, and the rear of each lot.
c. Enhance the west elevation of the home on lot 26 since this elevation is clearly visible
from Rock Dove Street.
