Include any details necessary to adequately explain the scope and/or operation of the proposed project. Description/Explanation: Develop the site for the storage of up to approximately 320 new regular passenger vehicles. The parking perimeter will be surrounded by a masonry waU along-Dvyden and a security fence on the other three sides of the property. The vehicles will be screened by the wail on Dryden, vegetation on the west side (the corporate office building) and the slope and vegetation on the slope on the east side (Palomar Oaks Way). The surface material will be gravel, with the exception of the concrete entrance driveway apron, for the short distance between the street and the gate of the masonry wall along Dryden. Appropriate storm runoff mitigation measures will be used per the engineering plan. I disagree with the preliminary review assessment that a masonry wall would be an appropriate visual screening requirement for the east and west sides of the property, and would appreciate a reconsideration of this request based on the following: Section IV, H, 1. (General Development Standards, Storage Areas) ofthe Carlsbad Airport Centre Specific Plan distinctly carves out a visual screening exception to a wall, for "regular passenger vehicles". This is the type of storage that is defined and intended for this development permit. It is apparent that the Planning Department of the City of Carlsbad had already determined this is a correct interpretation, due to the fact that it had approved a permit and is allowing the operation of an identical development two parcels down, for the Hoehn Auto Group, whereby it was deemed appropriate to utilize vegetative screening on the east and west sides of that development. For the City to now require the Bob Baker Auto Group to unnecessarily endure the economic hardship of building an additional 600 feet of masonry wall, when it allowed a different standard two parcels down for an identical use, would be overtly arbitrary, unreasonable and could be interpreted as being manifestly prejudicial and thus illegal. Revised 07/10 In addition to the fact that the specific plan does not require a visual screening wall for this use, based on a prior interpretation by the Planning Department, the tenants of the office building and the community at large would be better served with an environmentally friendly balance of vegetative screening on both sides of the building, rather than a wall. The office building consists of a ground floor only, and the line of sight for those tenants is of the slope between their parking and the proposed development, not of the area intended for storage. Under section IV, E, 3, c. (General Development Standards, Landscaping, Interior Setback, Screening) of the Carlsbad Airport Centre Specific Plan, it states; "Plant material used for this purpose shall consist of lineal or grouped masses of shrubs and/or trees." We have fulfilled this requirement with our proposed lineal planting of shrubs. This not only screens the vehicles, but the security fence as well. The owner ofthe office building supports the proposed plans and is opposed to a masonry wall. Please see the attached letter. On the west side, it has been widely agreed that due to the setback, the placement of a wall would not create any level of screening from Palomar Oaks Way, due to the fact that it would sit at the base ofthe slope. The only basis for requesting a wall, as has been communicated to me, is the misinterpretation that the specific plan requires it regardless of its effectiveness for the purpose defined. Due to the fact that the suggested wall will not serve any purpose, and the specific plan does not require the wall for this use, I feel that the additional vegetation as presented in the landscape plan will effectively screen the development from Palomar Oaks Way, and thus there is no basis for a masonry wall at the foot ofthe slope. Standard 1 - Cover Crop/Reinforced Straw Matting: Cover crop shall be a seed mix typically made up of quick germinating and fast covering grasses, clovers, and/or wild flowers. Submit the specific seed mix for City approval prior to application. The cover crop shall be applied at a rate and manner sufficient to provide 90% coverage within thirty (30) days. Type of reinforced straw matting shall be as approved by the city and staked to the slope as recommended by the manufacturer. Reinforced straw matting shall be required when planting occurs between August 15 and April 15. The cover crop and/or reinforced straw mat shall be used the remainder of the year. b. Standard #2 - Ground Cover One hundred (100%) percent of the area shall be planted with a ground cover known to have excellent soil binding characteristics (planted from a minimum size of flatted material and spaced to provide fiall coverage within one year). c. Standard #3 - Low Shrubs Low spreading woody shrubs (planted from a minimum of 2-3/4 inch liners) shall cover a minimum of seventy (70%) percent of the slope face (at mature size). d. Standard #4 - Trees and/or Large Shrubs Trees and/or large shrubs shall be (planted from a minimum of 1 gallon containers) at a minimum rate of one (1) per two hundred (200) square feet. Civil plans appear to show storage parking up to the west property line leaving no room for the proposed Ligustrum screen shrubs. Please coordinate plans to allow for screen shrub installations. Please allow for an 8 foot wide planter along this property line to allow the proposed Ligustrum to mature and provide an appropriate screen. 13. Please provide a copy of plans that specifies all storage surfacing. Civil plans show a gravel driveway but do not indicate surfacing of the storage parking areas. 14. The subject property is an existing 2.71 acre previously graded lot located at 5815 Dryden Place, in the Planned Industrial (P-M) Zone and Local Facilities Management Zone 5. Dear Mr. Baker, The City Planner has completed a review of your application for a Minor Site Development Plan No. SDP 14-07 located at 5815 Dryden Place. A notice was sent to property owners within a 300 foot radius ofthe subject property requesting comments regarding the above request. No comments were received within the ten day notice period (ending on February 2, 2015). Furthermore, the proposed project is in compliance with the ALUCP airspace protection surfaces because a determination of no hazard to air navigation has been issued by the FAA; and the ALUCP identifies automobile surface parking uses located within Safety Zone 1 as conditionally compatible with airport uses, provided that the use is located outside the Object Free Area (OFA) of the Runway Protection Zone (RPZ); the proposed use is located outside the OFA and RPZ. That the street system serving the proposed development or use is adequate to properly handle all traffic generated by the proposed use; in that the "local" street with a capacity of 2,000 maximum Average Daily Traffic (ADT) is more than adequate to handle the 14.6 ADT the proposed project is expected to generate. 7. That the project is consistent with the City's Landscape Manual and Water Efficient Landscape Ordinance (Carlsbad Municipal Code Chapter 18.50). 8. That the request for a Minor Site Development Plan was adequately noticed at least ten (10) calendar days before the date of this decision pursuant to Section 21.54.060 ofthe Carlsbad Municipal Code. 9. That the City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15332 ofthe state CEQA Guidelines as an infill development project. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 ofthe state CECiA Guidelines do not apply to this project. 10. Conditions: Note: Unless otherwise specified herein, all conditions shall be satisfied prior to issuance of a building permit or approval of final landscape plans. 1. Approval is granted for Bob Baker Vehicle Storage - SDP 14-07 as shown on Exhibits "A - D" dated February 15,2015 on file in the Planning Division and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. This project is approved solely for the storage of new inventory automobiles. No used cars, RV's, boats, etc., or employee parking shall be permitted on site. 3. No automobiles storage shall occur onsite until all screening measures (i.e., solid masonry wall, solid access gate, fence, landscaping and irrigation) as shown on the approved plans have been installed and planted to the satisfaction of the City Planner. 4. If any of the following conditions fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of all future building permits; deny, revoke, or further condition all certificates of occupancy issued under the authority of approvals herein granted; record a notice of violation on the property title; institute, and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. No vested rights are gained by Developer or a successor in interest by the City's approval of this Minor Site Development Plan. 5. Staff is authorized and directed to make, or require the Developer to make, all corrections and modifications to the Minor Site Development Plan documents, as necessary to make them internally consistent and in conformity with the final action on the project. Development shall occur substantially as shown on the approved Exhibits. Any proposed development, different from this approval, shall require an amendment to this approval. Developer shall comply with all applicable provisions of federal, state, and local laws and regulations in effect at the time of building permit issuance. 7. If any condition for construction of any public improvements or facilities, or the payment of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project are challenged, this approval shall be suspended as provided in Government Code Section 66020. If any such condition is determined to be invalid, this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. 8. Developer/Operator shall and does hereby agree to indemnify, protect, defend, and hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and representatives, from and against any and all liabilities, losses, damages, demands, claims and costs, including court costs and attorney's fees incurred by the City arising, directly or indirectly, from (a) City's approval and issuance of this Minor Site Development Plan, (b) City's approval or issuance of any permit or action, whether discretionary or nondiscretionary, in connection with the use contemplated herein, and (c) Developer/Operator's installation and operation of the facility permitted hereby, including without limitation, any and all liabilities arising from the emission by the facility of electromagnetic fields or other energy waves or emissions. This obligation survives until all legal proceedings have been concluded and continues even if the City's approval is not validated. 9. Developer shall submit to the City Planner a reproducible 24" x 36," mylar copy of the Site Plan reflecting the conditions approved by the final decision-making body. 10. Developer shall include, as part of the plans submitted for any permit plancheck, a reduced legible version of all approving resolution(s) in a 24" x 36" blueline drawing format. 11. Prior to the issuance of a building permit, the Developer shall provide proof to the Building Division from the Carlsbad Unified School District that this project has satisfied its obligation to provide school facilities. 12. This project shall comply with all conditions and mitigation measures which are required as part of the Zone 5 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. 13. Building permits will not be issued for this project unless the local agency providing water and sewer services to the project provides written certification to the City that adequate water service and sewer facilities, respectively, are available to the project at the time of the application for the building permit, and that water and sewer capacity and facilities will continue to be available until the time of occupancy. 14. This approval shall become null and void if building permits are not issued or fmal landscape plans are not approved for this project within 24 months from the date of project approval. 15. Developer shall submit to the City a Notice of Restriction to be filed in the office of the County Recorder, subject to the satisfaction ofthe City Planner, notifying all interested parties and successors in interest that the City of Carlsbad has issued a Minor Site Development Plan on the property. Said Notice of Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction. Developer shall submit and obtain City Planner approval of a Final Landscape and Irrigation Plan showing conformance with the approved Preliminary Landscape Plan and the City's Landscape Manual. Developer shall construct and install all landscaping and irrigation as shown on the approved Final Plans. All landscaping shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. All irrigation systems shall be maintained to provide the optimum amount of water to the landscape for plant growth without causing soil erosion and runoff. 19. The first submittal of Final Landscape and Irrigation Plans shall be pursuant to the landscape plancheck process on file in the Planning Division and accompanied by the project's building, improvement, and grading plans. 20. Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy #17, the License Tax on new construction imposed by Carlsbad Municipal Code Section 5.09.030, and CFD :tl special tax (if applicable), subject to any credits authorized by Carlsbad Municipal Code Section 5.09.040. Developer shall also pay any applicable Local Facilities Management Plan fee for Zone 5, pursuant to Chapter 21.90. All such taxes/fees shall be paid at issuance of building permit. Ifthe taxes/fees are not paid, this approval will not be consistent with the General Plan and shall become void. Engineering: 21. Incorporate Low Impact Design features/standard BMPs in the final Landscape Plan including but not limited to gravel drive aisle and parking spaces, rock lined swale and catch basin filter insert as shown on the approved site plan. 22. FAR Part 77 regulations require that anyone proposing to construct an object, which could affect navigable airspace around an airport, submit information about the proposed construction to the FAA. The FAA will then conduct an aeronautical study, the outcome of which is a determination as to whether the object would be a potential hazard to air navigation. Please submit for our review copies of the most recent FAR Part 77 covering the proposed project. SDP 14-07 - BOB BAKER VEHICLE STORAGE July 11, 2014 Page 3 ISSUES OF CONCERN Planning: 1. The City Planner can support the proposed use of a 6 ft. tall chain link fence in place ofthe requirement for a 6 ft. tall masonry wall along the north, east, and west property lines ofthe subject vehicle storage lot provided that all of the following occurs, 1) all required setbacks are maintained (see below); 2) use of black vinyl coated chain link fence is used and indicated on the site plan and fence details; and 3) adequate landscaping is provided within the setbacks to fully screen both the chain link fence from public view and the storage of vehicles to a level of screening equal to what a solid 6 ft. tall masonry wall would provide. 2. Please plot the limits of all setbacks on the proposed site plan in accordance with the following: a. The street side setback from Palomar Oaks Way and Dryden Place shall be 30 ft. b. The interior side setback along the west property line shall be 10 ft. c. The rearyard setback along the north property line shall be 25 ft. All proposed parking spaces, walls, fences, gates, etc. located within these minimum setbacks shall be revised to comply. 3. The required 10 ft. wide interior side yard setback required along the west property line and adjacent to the existing business shall be fully landscaped. Please revise plans to adjust parking configurations and landscaping along this property line. The density of landscape planting and type of species needs to be such that both the vehicle storage and chain link fence are fully screened. 4. Please update the legend for the "6' HIGH FREE-STANDING WALL" to indicate masonry construction per the Project Description (Form P-IB) included as part ofthe Land Use Review Application (Form P- !)• 5. Please include an architectural detail and cross section of the proposed 6 ft. tall masonry wall. Be sure to include a description of the proposed finish and color. As part of the proposed masonry wall design, please consider a decorative cap and pilasters. At a minimum, pilasters should be placed at the ends of each wall segment (i.e., a minimum of four pilasters). 6. Please include an architectural detail of the proposed access gate at the entrance to the storage lot off Dryden Place. Be sure to include a detailed description ofthe proposed finish and color. Please insure that the proposed access gate is of a solid construction material such that stored vehicles are not visible from Dryden Place when the gate is closed. 7. To maximize and further screen the vehicle storage lot from public views looking north across the lot from the intersection of Palomar Oaks Way and Dryden Place, please extend the easterly segment of the proposed masonry wall out to the limits ofthe 30 ft. setback along Palomar Oaks Way. We suggest that this end segment also be revised to follow more closely in-line with Dryden Place instead of sharply bending north at the end as presently shown. 8. Please note that the project site is located within the Runway Protection Zone (Safety Zone 1) of the McClellan-Palomar Airport Land Use Compatibility Plan (ALUCP); and pursuant to ALUCP Section 2.6.2(e), land use actions associated with projects within the Runway Protection Zone are subject to H^E .L SDP 14-07 - BOB BAKER VEHITLE STORAGE July 11, 2014 Page 4 the Airport Land Use Commission's (ALUC) review for a determination of consistency. City Staff will file an application with the ALUC following a determination of application completeness. PELA: Please note that the numbers below are referenced on the attached set of red line plans where appropriate for ease of locating the specific area ofthe comment concern. 1. Per the Carisbad Airport Centre Specific Plan, IV.E.l.b: "A minimum of 15% of each building site area shall be reserved for irrigated landscaping which shall be maintained in a neat and orderly manner..." Please provide a calculation indicating the proposed percentage of irrigated landscape area. 2. Per the Carisbad Airport Centre Specific Plan, IV.E.l.d, Berms: "The landscaping in all street side setbacks shall include berms as noted below. The average height of berms shall be 42 inches for special landscape streets and 30 inches for all other streets. The height of the berm shall be measured from the street curb or parking lot curb, whichever is higher. When the parking area is more than 36" below street level, the berm may be 18 inches. Berms are not required where the entire area between the street and building is to be landscaped and free of parking." Please show berming as required. 3. Per the Carlsbad Airport Centre Specific Plan, IV.E.I.e, Intersections: "Landscaping and berms, not including trees, along all streets shall be limited to a height of 2.5 feet within the triangle formed by a line extended between points 35 feet distant from the intersection of the right-of-way lines prolonged." Please show and label the right-of way-lines and sight triangle lines and insure no landscaping or berms over 2.5 feet are located within this zone as indicated above. 4. Please provide Ligustrum continuous along the west property line. 5. Per the Carisbad Airport Centre Specific Plan, IV.E.3.a. Interior Setback: "All designated undeveloped areas such as setbacks and areas not used for parking or storage shall be landscaped with ground cover, shrub, and tree materials." Please address landscaping up to the proposed masonry wall and security fencing. Insure all areas are landscaped per the above requirements. 6. Per the Carisbad Airport Centre Specific Plan, IV.E.3.C, Screening: "Areas used for parking shall be landscaped in such a manner as to interrupt or screen said areas from view from access streets and adjacent properties. Plant materials used for this purpose shall consist of lineal or grouped masses of shrubs and/or trees." The applicant proposes Rhaphiolepis indica along Dryden Place. Please provide taller/larger screen shrubs (i.e. Cotoneaster lacteus, Dodonaea viscosa, Heteromeles arbutifolia, etc.) to fully screen the storage area from view. Please fill all voids between the proposed and existing shrubs in all areas. Please also fill all voids along Palomar Oaks Way towards the top of slope to provide full screening of the storage area below. 7. Per the Carisbad Airport Centre Specific Plan, IV.E.5, Slope Banks: "All slope banks greater than 5:1 or 6 feet in vertical height and adjacent to a public right-of-way shall be stabilized, planted with a combination of trees, shrubs, and ground cover, and irrigated as required by the City Engineer." Please address re-vegetation of all bare slope areas and insure all Landscape Manual slope revegetation requirements are addressed. Please add the following notes to the plans and insure all requirements are met: SDP 14-07 - BOB BAKER VEHICLE STORAGE July 11, 2014 Pages Slopes 6:1 or steeper requiring erosion control measures as specified herein shall be treated with one or more of the following planting standards: a. Standard #1 - Cover Crop/Reinforced Straw Matting: Cover crop shall be a seed mix typically made up of quick germinating and fast covering grasses, clovers, and/or wild flowers. Submit the specific seed mix for City approval prior to application. The cover crop shall be applied at a rate and manner sufficient to provide 90% coverage within thirty (30) days. Type of reinforced straw matting shall be as approved by the city and staked to the slope as recommended by the manufacturer. Reinforced straw matting shall be required when planting occurs between August 15 and April 15. The cover crop and/or reinforced straw mat shall be used the remainder of the year. b. Standard #2 - Ground Cover- One hundred (100%) percent ofthe area shall be planted with a ground cover known to have excellent soil binding characteristics (planted from a minimum size of flatted material and spaced to provide full coverage within one year). c. Standard #3 - Low Shrubs: Low spreading woody shrubs (planted from a minimum of 2-3/4 inch liners) shall cover a minimum of seventy (70%) percent of the slope face (at mature size). d. Standard #4-Trees and/or Large Shrubs: Trees and/or large shrubs shall be (planted from a minimum of 1 gallon containers) at a minimum rate of one (1) per two hundred (200) square feet. Slopes - 6:1 or steeper and: a. 3' or less in vertical height and are adjacent to public walks or streets require at minimum Standard #1. b. 3' to 8' in vertical height require Standards #1 (erosion control matting shall be installed in lieu of a cover crop), #2 and #3. c. In excess of 8' in vertical height require Standards #1 (erosion control matting shall be installed in lieu of a cover crop), #2, #3, and #4. Areas graded flatter than 6:1 require Standard #1 (cover crop) with temporary irrigation when they have one or more ofthe following conditions: a. Sheet graded pads not scheduled for improvements within 6 months of completion of rough grading. b. A potential erosion problem as determined by the City. c. Identified by the City as highly visible areas to the public or have special conditions that warrant immediate treatment. 8. Please provide evergreen trees at the bottom of slope (behind the existing Oak trees) at the corner of Palomar Oaks Way and Dryden Place to screen views through the Oaks and to the storage area. 9. The Landscape Manual indicates that plans shall be prepared by a licensed landscape architect, licensed civil engineer, licensed architect, or other qualified professional licensed by the state to do this work. Plans shall be drawn on a 50% screen ofthe civil engineering grading plans. Please provide landscape plans on a 50% screen of the civil plans. 11. Existing conditions to include grades, property lines, right-of-ways, existing and proposed easements, etc. Insure no trees are located within public utility easements. b. Drainage elements and utilities. Insure no conflicts with plantings. c. All vehicular sight lines, including intersection site distance corridors (see Figures 3-A and 3-B in the Landscape Manual) and CalTrans sight distance standards (i.e.: stopping sight distance). d. Project address and vicinity map. e. Bar scale. f. Proposed grading consistent with grading plans for the project. 12. Civil plans appear to show storage parking up to the west property line leaving no room for the proposed Ligustrum screen shrubs. Please coordinate plans to allow for screen shrub installations. Please allow for a 10 foot wide planter along this property line to allow the proposed Ligustrum to mature and provide an appropriate screen. 13. Please provide a copy of plans that specifies all storage surfacing. Civil plans show a gravel driveway but do not indicate surfacing of the storage parking areas. 14. The planting plan shall consist of a drawing that illustrates, on a page or pages, the conceptual locations of all existing vegetation to be retained or removed. Please clearly locate and show all existing plantings that are to remain. Clearly distinguish between existing versus proposed plantings using different symbols on the plans. 15. Generally identify all existing woody plant material to be removed or retained. Trees over 12" in caliper diameter shall be identified on the plan individually as to caliper size and type and labeled to be retained or removed. 16. Please provide a Maintenance Responsibility Exhibit. The Maintenance Responsibility Exhibit shall be prepared at a scale and size (preferably one sheet) that provides an overall view ofthe project land shall clearly identify the various areas of landscape maintenance responsibilities (private, common area/homeowners" association (HOA), City, etc). 17. Please show and label all bio-swales/detention basins or underground drainage collection systems (in or under planting areas that could impact the planting) and provide appropriate landscaping. 18. Please provide a Water Conservation Plan in conjunction with the Landscape Concept Plan. This plan shall demonstrate to the City how the proposed development will use all practical means available to conserve water in the landscape. Please provide/address the following: a. Indicate the existing and/or future recycled water systems. b. Provide a colored or hatched plan cleariy showing where recycled water, graywater and potable water are proposed to be used for irrigation. c. Irrigation systems for all projects, except for service to a single-family residence or front yard irrigation on individually metered condos, shall be designed to use non-potable, treated recycled water, unless an exemption is approved by the City Utilities Department. Written description of water conservation features including addressing xeriscape principles (see Appendix A of the Landscape Manual) within the project. e. Hydrozone diagram: Include one "hydrozone diagram" which identifies grouping of plants within the individual hydrozones (high, moderate, low, very low or special landscape areas) and which indicates the square footage and irrigation method of each area. f. Separate water service for landscaping (including, but not limited to connections, water meters, and back flow preventers) shall be provided for all commercial/industrial projects, golf courses, parks, and residential common areas in projects over four (4) dwelling units. g. Concept plans shall include calculations which document the maximum allowed annual water use for the landscaped area or maximum applied water allowance (MAWA) and estimated total water use (ETWU). A landscape project shall not exceed the MAWA. The MAWA for a landscape project shall be determined by the following calculation as defined in the City ordinance: MAWA = (ETo)(0.62)[(0.7 x LA) + (0.3 x SLA)]. City of Carlsbad May 15,2014 Plarming Department RE: 5817 Dryden Place (Lot 24) and the Proposed Baker Vehicle Storage Development on Lot 25 The purpose of this letter is to voice my support for a vegetative screening solution as opposed to a masonry wall between the existing building at 5817 Dryden Place and the proposed Baker vehicle storage lot on Lot 25. The existing vegetative screening solution on the west side of 5817 Dryden Place has provided a pleasant, environmentally friendly screening for my tenants from the Hoehn vehicle storage lot on Lot 23. I would hope that the same treatment could be achieved on both sides of my building. Beyond the fact that also utilizing a landscape screening solution on the east side would be much more pleasing and environmentally appropriate, I and my tenants would expect there to be material continuity on both sides of my property. The current view from the east side office windows of the building is of a landscaped slope, due to the fact that Lot 25 is at a higher elevation. It would be aesthetically undesirable to have a solid masonry wall on the top of that slope as a screening mechanism. I appreciate your consideration of this matter.
