We were provided a title policy prepared by First American Title Insurance Company dated: August 3, 1984, a copy is enclosed for your reference, (see attachment No. 1). The original parcel was created as a remainder parcel by the State of California in June, 1963 with their Interstate 5 R/W acquisition, (see attachment No. 2). In February 1982 Paul Ecke Sr. et al conveyed title to this parcel to Palomar Venture as a single metes and bounds parcel, (see attachment No. 3). In Feburary, 1985 Palomar Venture con- veyed title to Pacific Center Associates as a single metes and bounds parcel, (see Attachment No. 4) Mr. Jerry McDaniels of First American Title Company researched the origin of the assessor parcels at the County Assessors office. He was informed that this property was located in two different tax rate areas and this was the reason for the two tax parcels. The County Assessor provided to Mr. McDaniels a form, (see attachment No. 5), for the owner's use to combine the two tax parcels into a single parcel. A close review of this form shows that property falling in two different tax rates cannot be combined for taxation purposes. Since the current owners have an A.L.T.A. Title Policy for a single parcel of land, and the two tax parcels have been created for taxation purposes only; we are of the opinion that the requirement for a parcel map is not justified. Engineering Department recently engaged a consultant to review (independently) the alignment of Palomar Airport Road from Carlsbad Boulevard to 1-5. The result agreed with the applicant's engineer as to the alignment of Palomar Airport Road. Staff feels, with the setback variation of this development, the road should be built now, including necessary retaining wall (20+ feet). The adjacent project to the east (Grosse & Watkins) also has the same type of condition, requiring adjacent improvements of Palomar Airport Road (although the site is not as low as the Newport National site). While our memorandum of August 16, 1985, may npss the point of appeal, our position remains the same. Another note is, memo from Ron Beckman, dated December 14, 1984, reiterates the same position. Based upon this review, it has been determined that there are major problems associated with your application which must be addressed before this application can be scheduled for a Planning Commission hearing. The problems or issues are listed below. Also, the name of the project planner and project engineer is provided. You should set-up a meeting to discuss the issues with the appropriate staff member. Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department. Additional public and/or on site fire hydrants shall be provided if deemed necessary by the Fire Marshal. The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and on site roads and drives to the Fire Marshal for approval. An all weather access road shall be maintained throughout construction. All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site. Proposed security gate systems shall be provided with "Knox" key operated override switch, as specified by the Fire Department. All private driveways shall be kept clear of parked vehicles at all times, and shall have posted "No Parking/Fire Lane-Tow Away Zone" pursuant to Section 17.04.040, Carlsbad Municipal Code. Fire retardant roofs shall be required on all structures. Brush clearance shall be maintained according to the specifications contained in the City of Carlsbad Landscape Guidelines Manual. All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction. All roof-top appurtenances shall be architecturally integrated into the design of the building and shielding to prevent noise and visual impacts, subject to approval before issuance of permit. Building exceeding 10,000 sq. ft. aggregate floor area shall be sprinklered or have four-hour fire walls with no openings therein which shall split the building into 10,000 sq. ft. (or less) areas.
