Developer is the owner of certain real property which is located north of Palomar Airport Road, between Armada Drive and Hidden Valley Road (Lot 18 of Carlsbad Tract C.T. 94-09), within Site Development Plan (SDP 96-14) which provides approval for the construction of the LEGOLAND family park (collectively, "Project"). B. Conditions of Approval for SDP 96-14 state that the Project must offset the conversion of non-prime agricultural land to urban land uses by providing payment of an agricultural mitigation fee, the amount of which shall not be less than $5,000 nor more than $10,000 for each net area of non-prime agricultural land ("Mitigation Fee"). The amount of the Mitigation Fee shall be determined by the City Council. Developer has deposited with the Coastal Conservancy, pursuant to applicable state legislation, $5,000 per net acre of non-prime agricultural land for 31.12 acres which shall be credited to the Developer's Mitigation Fee. C. A study and subsequent peer review (collectively "Mitigation Fee Study") to determine the amount of the Mitigation Fee have been completed and accepted by the City. The parties expect the City Council to determine the Fee prior to August 31, 1997. Prior to the determination of the Fee by the City Council, Developer intends to obtain City permission to commence construction of the Project. D. The purpose of this Agreement is to provide for the payment of the balance of the Mitigation Fee (the "Additional Mitigation Fee"), if any, upon determination of the Mitigation Fee by the City Council and to satisfy Condition 20 of the Conditions of Approval. NOW, THEREFORE, incorporating the foregoing Recitals and in consideration of the mutual covenants contained herein, the parties agree as follows: 1. Satisfaction of Condition 20 (SDP 96-14). Performance under this Agreement satisfies 31.12 acres of Developer's obligation for payment of the Mitigation Fee on 93.35 acres as applied to the land covered by Carlsbad Tract No. 94-09 Lot 18 and all other related permits or applicable approvals. of 4 2. Developer's Payment of $155,600.00 to the Coastal Conservancy. Concurrent with signing of this Agreement, Developer has provided evidence to City of its deposit with the Coastal Conservancy of $155,600.00 ("Coastal Conservancy Payment"), which is $5,000 per net acre for 31.12 acres of non-prime agricultural land which is being converted to urban land uses with the development of the Project. City recognizes, accepts and agrees that the Coastal Conservancy payment shall be credited to the total Mitigation Fee for the Project. 3. Payment of Additional Mitigation Fee. Within ten (10) days following the determination of the Mitigation Fee by the City Council, City shall deliver written notice to Developer of the total Mitigation Fee per acre adopted by the City Council based on the Mitigation Fee Study. Developer shall pay within thirty (30) days after such notification the Additional Mitigation Fee, if any, for the 31.12 acres covered by this Agreement. Notwithstanding any provisions of this Agreement to the contrary, the City shall have no claim or right to any additional payment from Developer which exceeds a total of $10,000 per acre. 4. Termination of Agreement.. This Agreement shall terminate and Condition 20 of SDP 96-14 shall be deem satisfied on the earlier of (i) payment by the Developer of any Additional Mitigation Fee owed pursuant to this Agreement, (ii) determination by the City Council that the Mitigation Fee does not exceed $5,000 per acre or (iii) December 31, 1997. 5. Remedies. Failure by the Developer to perform in accordance with this Agreement will constitute failure to satisfy the requirements of Condition 20 of SDP 96-14. Such failure will allow the City to exercise any and all remedies available to it including but not limited to withholding the issuance of building permits for the Project. 6. Hold Harmless. Developer will indemnify and hold harmless (without limit as to amount) City and its elected officials, officers, employees and agents in their official capacity (hereinafter collectively referred to as "Indemnities"), and any of them, from and against all loss, all risk of loss and all damage (including expense) sustained or incurred because of or by reason of any and all claims, demands, suits, actions, judgments and executions for damages of any and every kind and by whomever and whenever made or obtained, allegedly caused by, arising out of or relating in any manner to Developer's defaults under this Agreement, and shall protect and defend Indemnities, and any of them with respect thereto. 7. Insurance. Developer shall obtain, at its expense, comprehensive general liability insurance for development of the Project naming Indemnities as additional insureds with aggregate limits of not less than three million dollars ($3,000,000) purchased by Developer from an insurance company with a current Best's Key Rating of not less than A-V, such insurance to be evidenced by an endorsement which so provides and delivered to the City Clerk concurrent with the signing of this Agreement. 2 of 4 8. Notices. Successors. This Agreement shall benefit and bind Developer and any successive owners of the Project. 11. Severability. In the event any provision contained in this Agreement is to be held invalid, void or unenforceable by any court of competent jurisdiction, the remaining provisions of this Agreement shall nevertheless, be and remain in full force and effect. 12. Attorney Fees and Costs. A prevailing party in any action, including but not limited to arbitration or litigation, to enforce the provisions of this Agreement, shall be entitled to recover its reasonable attorney fees and costs arising from the action. The plan set you reviewed contains a plant legend on Sheet N102 which applies to the inner park areas. The plant legend contains a list of the trees, shrubs, groundcover, ferns, vines and grasses to be used in landscaping the inner park area. Should you wish to review the planting legend the plans can be viewed at the Planning Department office. I have provided a copy of your letter to Larry Black the City's Landscape Architect who will be checking the landscape construction documents for his consideration of your comments as he checks the plans. In addition, I have forwarded your letter to Richard Apel of LEGOLAND Carlsbad who is responsible for landscaping of the project. Both parties can consider the comments you have made and incorporate them into the plans should they agree with you. The City's review and approval of the documents is primarily involved in ensuring compliance with the Landscape Manual. Should you wish to contact Mr. Apel he can be reached at 438-5570. First, however, I have another question. Will the detailed planting plans for the interior part of the park be made public? The drawings you showed me showed the detail for the exterior portions which showed good compliance to the Landscape Manual, however the drawings of the interior portions were only a schematic with no planting plans. Now for my suggestions which are in three general categories • Safety • Water Use • Habitat SAFETY The Lego park is being advertised as a park for children, particularly small children. One trait we all know small children have is that they like to put everything in their mouths. For this reason I question the use of oleander plants in the plan since they are toxic to people. I also noticed that there is extensive use of plants that are known to harbor garden snails such as agapantha. Why would this be a safety problem? Because to control the snails will probably mean the wide use of snail bait which of course is toxic to people and of great danger to children. I suggest the use of alternate, more woody plants to avoid the snail problems. I was pleased to find that there was no mention of the use of eucalyptus trees in the plan. These trees are listed on the list of Restricted High Fuel Species in the Carlsbad Landscape Manual. The danger of the explosive flammability of the trees has been demonstrated again and again in the brushfires that hit southern California annually. Never was this more clear than in the loss of homes in Carlsbad last October. However I did note that on the landscaping plan for the exterior of the Lego park that over 400 pine trees were to be used. All pine species are also on the Restricted High Fuel Species and I suggest that these pose a fire hazard and should be replaced by alternate trees. WATER USAGE It appears from the plan that all cool season grasses are to be used in the park. If dry season grasses are used much less water would be used. The only down side to dry season grass is that they go through a dormant stage in the winter. I know the point will be brought up that reclaimed water is being used. I still argue that all water must considered scarce and valuable because even with full use of reclaimed water the state will be in a deficit situation in another twenty years. HABITAT I observed from the landscape plan that very few plants were used that are native to the area. The result of this will probably be that little food and habitat will be provided to native birds and small wildlife. I believe if appropriate native plants are used habitat can be provided in a large park such as this that will help mitigate the effects of development in the area, at no additional cost to anyone. In particular I noticed in the exterior portions (again, there is no detail for interior portions) that many quercus ilex or Holly Oak were to be planted. This is an oak native to the Mediterranean area which has also been planted in Carlsbad along Palomar Airport Road. Judging by the very poor condition of these trees in Carlsbad it does not look like a good choice. I suggest that instead Coast Live Oak or Canyon Oak should be planted as they would grow better and provide much better habitat for birds. Please contact me to see how these suggestions could be discussed with the landscape architect. DESCRIPTION AND INTENDED PURPOSE The Main Lake at the LEGOLAND Carlsbad is a 74,000 (1.70 Acre) acre water body. It is intended as an aesthetic and recreational amenity. Recreational features in the lake and along the lake Frontage include a Boat Ride. Waterfalls, Marshes and numerous miniature model displays. To serve these functions, the Main Lake must be designed, constructed and maintained as a water body with consistent high aesthetic water quality - meeting or exceeding standards of the best public theme park lakes in California. The Legoland Lake will be designed, constructed and maintained as a natural aquatic' system. IA. LAKE STATISTICS Area 75,000 sq ft (1.70 Acres) Shoreline Perimeter 3,200 ft Edge Depth 1 ft Max. DESIGN CRITERIA FOR THE LAKE The Lake System shall be designed and constructed to meet or exceed the following criteria: (1) The Lake System shall be designed and constructed to meet the character and aesthetics of the water element as defined by the specific exhibit, and display the water quality required of the highest quality Theme Park attraction, as defined in Section III (following). (2) The Lake System shall be designed to meet the requirement of a Public Park operating on a 365 day/year basis while subject to heavy public access and traffic. To minimize water usage, a geomembrane liner system will limit the Lake System's demand to initial fill up and make up water for evaporation losses and incidental seepage losses. (In the event of a storm, the lake shall have the capacity to retain 2 inches of direct rainfall before it is discharged into the Lake Storm Overflow Structure build into the lake edge). (5) The Lake System shall be designed as a "Natural System"", meaning an environment that provides a suitable habitat to permit fish and aquatic plant life. The Lake System shall be operable as a balanced ecosystem by including features such as colonies of aquatic plants for the uptake and absorption of soluble nutrients to eliminate dependence on chemical treatment control methods. (6) The Lake System design shall incorporate design features to: (a) Control and divert nutrient loading from aquatic animals, grass clippings, landscape Fertilizer entering the water feature, and various debris or nutrient loadings introduced by the public viewing the exhibits. (b) Inhibit potential buildup of salinity, thermal gain, acidity, ammonia, dissolved organic carbon, phosphate and nitrate in the system and depletion of Dissolved Oxygen (c) Reduce the potential for foaming, at waterfall locations particularly (d) Deter build up of sedimentation (7) The Lake System shall be designed and constructed to meel all safety codes, laws, rules, regulations, guidelines and ordinances in effect at the time the required permits and approvals are issued. (8) The Lake System shaJl have no discharge to sewer system (No sand filters are proposed for the lake system and therefore there are no backwash requirements). Draining the lake is not considered as a necessary procedure. WATER OUALTTY DESIGN CRITERIA FOR THE LAKE The Lake System shall be designed and constructed in such a manner that: (1) No obnoxious odor shall emanate from the water. (2) There shall be minimal turbidity. The required clarity of the water in the features shall be measured by a turbidity level not to exceed 4.0 NTU - (Nephelometric Turbidity Units) - which approximates to a Secchi Disc reading of 1 M. (3) There is adequate water circulation throughout the Lake and no noticeable water stagnation shall be evident. (4) There shall be minimal attached filamentous or suspended algae in the water column. (5) There shall be adequate control for nuisance aquatic insect growth, particularly midges and mosquitoes. IV. PROPOSED LAKF. SYSTF.M To meet the Lake Design Criteria as established above and to ensure a Lake System with sustainable high water quality, the proposed lake will include features that have been adopted in many successful lake projects. These include: 1. LAKE GRADING: Optimum lake section and water depth to meet requirements of water quality, construction, maintenance, and water safety. 2. LAKE WALL: A concrete lake wall for shoreline erosion protection. The lake wall will also provide sufficient freeboard to absorb the energy imparted by wind generated wave action. 3. LAKE LINING SYSTEM: A geomembrane liner, protected from mechanical damage by a concrete cover shall be installed to minimize seepage losses. The operating surface of the Lake shall be maintained within a narrow range of+/- 1/2". HARDENED TREATMENT FOR LAKE BOTTOM Included to minimize turbidity, retard the rooting of aquatic weeds, deter proliferation of nuisance insects, and facilitate maintenance operations. 5. LAKE WATER SUPPLY: A reliable, clean source of water supply, sufficient to replenish seepage and evaporation losses. Potable water will be used for lake fill up and make up. The necessary mechanical devices to maintain the lake operational water surface shall include: a) Water Supply/Level Control device b) Storm Flow box structure (routed to the Storm Drain system) 6. CONTROL OF SEDIMENT AND NUTRIENT INFLOW INTO THE LAKE: Runoff from surrounding landscape shall be diverted away from the Lake basin by including a perimeter interception drainage swale. The watershed surrounding the lake basin shall be designed to a minimum to reduce drainage towards the basin. 7. RECIRCULAT10N PUMPING SYSTEM: To provide a high rate of water circulation (to prevent "dead spots" and stagnant waters) and water mixing (to promote uniform water quality) of the lake waters. Artificial aeration is also provided (by the mechanism of water cascading over the waterfalls) for sustaining high Dissolved Oxygen levels throughout the water body. 8. IN-POND BIOFILTRATION & MECHANICAL FILTRATION: Biofiltration beds in the lake - essentially consisting of gravel filter beds with downflow water circulation through the filter bed. This aerobic, natural process is designed to facilitate the breakdown of nitrogenous waste (nitrogen ammonia to nitrate) in the water. The filter beds also acts an excellent mechanical filter to remove turbidity in the water column 9. WATER SOFTENING The Carlsbad domestic water is hard water. In order to reduce or minimize the scaling on the plastic models in the lake, water softening by ionic exchange shall be incorporated. nPR-15-1997 13:16 STO DESIGN GROUP, INC. 7144765048 P.86/06 LEGOLANDPARK April 15, 1997 p5 WATER FEATURE DESIGN CRITERIA & WATER QUALITY B. Other Water Feature Systems including: MINILAND, FAIRYTALE BROOK, BOAT SCHOOL, ENCHANTED WALK STREAM, WATER WORKS, GEM WASH, (AND OTHER MISCELLANEOUS SMALL FOUNTAINS & WATER ATTRACTIONS) These features are relatively small bodies of water. They are closed, recircuiated systems and their operation and maintenance will be similar to that of a swimming pool. (1) Potable water shall be used for fill up and make up (2) The pond waters will be recircuiated, filtered and chemically treated with bromine - (Chlorine shall not be used) - similar to that of a Swimming Pool system. (3) Chemical treatment will be required for control of algae growth. The maximum required bromine residual for this purpose is 1.5 parts per million (PPM), which is typically one third that level required for a swimming pool. These water features system shall be equipped with ORP measuring devices for automatically determining and adjusting bromine levels in a consistently low level range. (4) The recircuiated water in these systems shall be filtered using commercial "Hi-Rate" sand filters. Periodic backwash discharges shall be routed to the sanitary sewer. (5) The domestic water, which is hard, will be treated for softening to minimize scaling on the Lego Plastic Model exhibits (in the water). The proposed water softening treatment is with the use of Culligan commercial water softeners- involving the same maintenance operation as that adopted in residential units - including disposal of the brine waste in compliance with the Water District's requirements. (6) Draining or lowering the Water Feature for Maintenance: This maintenance procedure is estimated to be similar to that required for a swimming pool in terms of frequency of occurrence. The basin waters will be drained to the main Lagoon. The already low bromine level in the system will be reduced to undetectable levels by allowing the released water to reside in the Lagoon basin for extended periods of time. In addition, several internal meetings have been held to review the request with the Community Development Director and City Attorney. The Development Agreement (DA 94-01) between the City and LEGO, the Carlsbad Ranch Specific Plan Amendment (SP 207(A)), and the Zoning Ordinance have been reviewed for provisions which apply to this subject. The development agreement refers to the applicable rules (Section 2.1) which includes the Carlsbad Ranch Specific Plan Amendment (SP 207(A)) and the ordinances of the City such as the Zoning Ordinance. The right to develop parcel 18 contained in Section 3.1.1 of the development agreement also refers to the specific plan, zoning ordinance and Site Development Plan review. Finally Section 3.1.2.5 , Standard of Review, states the following: "The City shall have the right to disapprove or condition approval of a proposed Site Development Plan in accordance with planning and design standards and criteria generally applied by the City in reviewing Site Development Plans in the City". As demonstrated by the above referenced section compliance with the requirements of the specific plan and the zoning ordinance is required in order for the City to approve a Site Development Plan for the project. The Carlsbad Ranch Specific Plan contains a listing of the number of parking spaces required on opening day. The totals are listed on page 123. The paving requirement is listed in Section 21.44.080(1). Therefore it is the City's normal practice that in the review and approval of Site Development Plans that all parking areas have a paved surface. City staff's conclusion is that in order to permit your request an amendment to the Carlsbad Ranch Specific Plan would be necessary. Any amendment to the specific plan also requires the approval of a Local Coastal Program Amendment by the City as well as the California Coastal Commission. Our position remains that City staff would not be supportive of such an amendment. Relief in the area of parking requirements has already been provided by not requiring turf to be planted in the parking expansion area. The City will proceed with the processing of the application as depicted on the project plans which show paving for all of the required parking areas. DEFINITIONS For purposes of this Agreement, except as otherwise expressly provided or unless the context otherwise requires: 2.1 "Applicable Rules" means the ordinances, resolutions, rules, regulations, requirements and official policies of City in force as of the "Effective Date" (as hereinafter defined), governing Development Agreements, permitted uses of Parcel 18, density and building intensity, growth control, subdivision, zoning, grading, landscaping, signage and design, improvement and construction standards and specifications applicable to development of the Project, and shall also include the Project Approvals. 2.2 "City" means the City of Carlsbad, California. 2.3 "Coastal Commission Approval" shall mean certification of the local coastal program or approval of this Agreement by the California Coastal Commission, as required by California Government Code Section 65869. 2.4 "Code" means the City of Carlsbad Municipal Code. 2.5 "Commencement of Construction" shall mean the start of construction of LEGOLAND CARLSBAD on Parcel 18, including grading in advance of actual construction or installation of improvements pursuant to a grading permit required to be obtained by LPPI for Parcel 18. 2.6 "CRC" shall mean the Carlsbad Ranch Company or other master developer of the Carlsbad Ranch Specific Plan (not a party to this Agreement). 2.7 "Development Agreement Act" means Sections 65864, et seq., of the California Government Code. 2.8 "Development Agreement Ordinance" means City Ordinance No. NS-302, adopted by the Carlsbad City Council February 14, 1995. 2.9 "Development Impact Fees" shall mean and include all fees charged by the City in connection with the application, processing and approval of a Site Development Plan or issuance of permits for cbadvlego\da.6 Cancellation of a Land Conservation Contract on portions of Parcel 18 and Amendment to the Preserve Boundaries; Master Tentative Map; Non-Residential Planned Unit Development; Hillside Development Permit; Development Agreement; and also including action by the City Council approving the Environmental Impact Report for the Project and making findings in connection therewith; amendments to any of the foregoing approved by the City which are in compliance with this Agreement; and all conditions of approval adopted by the City Council in connection with any of the foregoing. 2.20 "Specific Plan" means the Carlsbad Ranch Specific Plan, as amended by the Specific Plan Amendment. 2.21 "Specific Plan Amendment" means the amendment to the Specific Plan approved by City in conjunction with this Agreement, to allow for the development of the Project. 2.22 "Term" means the term of this Agreement, as provided in Section 4.2 of this Agreement. 3. DEVELOPMENT OF PARCEL 18 3.1 Land Use Approvals and Covenants 3.1.1 Land Uses'. Densities and Intensities 3.1.1.1 Right to Develop Parcel 18. City agrees that during the Term of this Agreement, LPPI and its successors and assigns approved by City in accordance with Section 3.1.5 hereof, shall have the right to develop and use Parcel 18 in accordance with the land uses, densities and intensities, the zoning, and the development standards, conditions and improvement requirements specified in the Specific Plan, the other Project Approvals and the Applicable Rules (collectively, "Vested Rules"), subject to Site Development Plan review in accordance with Section 3.1.2 hereof. The Vested Rules' shall include the standards and requirements for public facilities, parking, open space, setbacks, landscaping and signage set forth in the Specific Plan. 3.1.1.2 Certain Changes Prohibited Without Consent of LPPI. Except as otherwise provided in this Agreement, during the Term of this Agreement, the City shall not, as to Parcel 18, without the prior written consent of LPPI: (a) change the Vested Rules, so as to prevent or materially, adversely affect development, construction or operation of Parcel 18 in accordance with the Vested Rules; or (b) apply to Parcel 18 any new or amended ordinance, resolution, rule, regulation, requirement or official policy that is inconsistent with the Vested Rules, so as to prevent or materially, adversely affect development, construction or operation of Parcel 18 in accordance with the Vested Rules; or (c) apply to Parcel 18 any new or amended ordinance, resolution, rule, regulation, requirement or official policy that requires additional cbad\lego\da.6 .-6- 18, and LPPI shall not be permitted to commence construction of LEGOLAND CARLSBAD, unless and until all applicable Development Impact Fees are paid to the City to the extent such fees are due and payable prior to the time such construction is to commence, and all other applicable requirements are satisfied. 3.1.2.4 Approval of Site Development Plans. The City shall promptly review and approve, approve with conditions, or disapprove a proposed Site Development Plan submitted pursuant to this Agreement. The City shall not unreasonably disapprove, condition or delay approval of a proposed Site Development Plan, and once a matter is approved, it shall not subsequently be disapproved by the City. The process for approving a Site Development Plan shall be as set forth in the Applicable Rules, as modified or supplemented by the Specific Plan. During the preparation of all drawings and plans, the City and LPPI shall hold regular progress meetings to coordinate the preparation of, submission to, and review of Site Development Plans and related documents by the City. The City and LPPI shall communicate and consult informally as frequently as is necessary to insure that the formal submittal of any documents to the City can receive prompt and speedy consideration. 3.1.2.5 Standard of Review. The City shall have the right to disapprove or condition approval of a proposed Site Development Plan in accordance with planning and design standards and criteria generally applied by the City in reviewing Site Development Plans in the City. Provided, however, that in its review and approval of Site Development Plans submitted pursuant to this Agreement, the City shall be bound by, and shall not disapprove or condition a Site Development Plan in a manner that is not consistent with the uses permitted in the Specific Plan, the Applicable Rules, the Project Approvals and this Agreement. Provided further, the City shall be bound by, and shall not disapprove or condition a Site Development Plan in a manner that is not consistent with, the "Development Standards and Design Guidelines" for Parcel 18 set forth in the Specific Plan. 3.1.2.6 Preemption. Notwithstanding any provision to the contrary contained herein, Site Development Plan review and issuance of permits shall be subject to applicable federal or state laws, codes or regulations which preempt local jurisdiction (including by way of example, and without limiting the generality of the foregoing, the California Environmental Quality Act, building codes, safety regulations), and to development moratoria in accordance with Section 3.1.1.6 hereof. 3.1.2.7 Reservation of Right to Impose Certain Conditions. If the provisions of any such conditions, covenants and restrictions are less re- strictive than the ordinance codified in this section, then the provisions contained herein shall apply. (3) Inoperable Vehicles. Storage or parking of inoperable, wrecked, dismantled or abandoned vehi- cles shall be regulated by Chapter 10.52 of this code; provided, however, that not more than two vehicles in any inoperable, wrecked or dismantled condition may be parked in the side yard or rear yard while said vehicles are being repaired or re- stored by the owner of the property provided the vehicles are visually screened from the public right-of-way. (4) Heavy-Duty Commercial Vehicles. No heavy-duty commercial vehicles as defined by Sec- tion 10.40.075 of this code except for trailers as permitted in subsection (2) above shall be parked on any residential lot except while loading or unloading property; or when such vehicle is parked in connec- tion with, and in aide of, the performance of a ser- vice to the property on which the vehicle is parked. (5) Multiple-Family Projects. The location of vehicle parking for multiple-family residential pro- jects shall be regulated by Sections 21.44.050, 21.44.060 and 21.44.070 of this code. (6) Planned Development For residential projects developed under Chapter 21.45, parking shall be regulated by the planned development permit (7) Administrative Hearing. Any person objecting to a decision made pursuant to subsection (2)(Q above may request in writing within ten days of the determination by the planning director, an adminis- trative hearing with the planning director. The plan- ning director shall apply the criteria of this section in making his determination. The decision of the director shall be final unless the director's decision is appealed to the city council within ten days fol- lowing said decision. (Ord. 9804 § 4 (part), 1986) 21.44.070 Comprehensive planned facilities. Areas may be exempted from the parking require- ments as otherwise set up in this chapter, provided: (1) Such area shall be accurately defined by the planning commission after processing in the same manner required for an amendment to the zoning title; (2) No such district may be established and ex- empted from the provisions of Section 21.44.130 unless sixty percent or more of all record lots com- prising such proposed district are zoned to uses first permitted in a commercial (C) or industrial (M) zone; (3) Such exemptions shall apply only to uses first permitted in the commercial (C) or industrial (M) zones; (4) Berore^uch*defiried district shall be exempt as provided in this isecti6n,!^ctiverproceeding under any applicable legislative authority shall be institut- ed to assure that the^exempted area shall be provid- ed with comprehensive parking facilities which will reasonably serve the entire district (Ord. 9804 § 4 (part), 1986) 21.44.080 Required improvement and maintenance of parking area. Every lot used as a public or private parking area and having a capacity of five or more vehicles shall be developed and maintained in the following man- ner (1) Surfacing. Off-street parking areas shall be paved or otherwise surfaced and maintained so as to eliminate dust or mud and shall be so graded and drained as to dispose of all surface water. In no case shall such drainage be allowed across sidewalks or driveways; (2) Border Barricades, Screening and Landscap- ing. (A) Every parking area that is not separated by a fence from any street or alley property line (Ctrt»tad 10-94)706 21.44.080 upoD which it abuts, shall be provided with a suitable concrete curb or timber barrier not less than six inches in height: located not less than two feet from such street or alley property lines and such curb or barrier shall be securely installed and maintained; provided no such curb or barrier shall be required across any driveway or entrance to such parking area, (B) Every parking area abutting property located in one of the residential zones shall be separated from such property by a solid wall, view-obscuring fence or compact evergreen hedge six feet in height measured from the grade of the finished surface of such parking lot closest jo the contiguous residential zone property; pro- vided, that along the required front yard the fence, wall or hedge shall not exceed forty-two inches in height. No such wall, fence or hedgeneed be provided where the elevation of that portion of the parking area immediately adjacent to a residential zone is six feet or more below the elevation of such residential zone property along the common property line, (C) Any lights provided to illuminate any public parking area, semi-public parking area or used car sales area permitted by this chapter shall be so arranged as to reflect the light away from any premises upon which a dwelling unit is located: (3) jntrances and Exits. The location and design of all entrances and exits shall be subject to the approval of the planning director or other designated person, provided no entrance or exit other than on or from an alley shall be closer than five feet to any lot located in an "R" zone. (Ord. 9804 § 4 (pan), 1986) 21.44.090 Parking areas in R-3, R-P and R-T zones. Every parking area located in an R-3, R-P or R-T zone shall be governed by the following provisions in addition to those required above: (1) No parking lot to be used as an accessory to a commercial or office/professional establish- ment shall be established until it shall first have been reviewed by the planning commission and its location approved. Such approval may be conditioned upon the commission's requiring the planting and/or maintenance of trees, shrubs or other landscaping within and along the bor- ders of such parking area; (2) Such a parking lot to be used as an accessory to a permitted commercial or office/ professional establishment shall be so located that the boundary of such parking lot closest to the site of the commercial or office/professional establishment to which it is accessory shall be not more than fifty feet distant; (3) Such parking lot shall be used solely for the parking of private passenger vehicles; (4) No sign of any kind, other than one desig- nating entrances, exits, conditions of use or the location of visitor parking spaces in residential projects shall be maintained on such parking lot. Any such sign shall not exceed eight square feet in area. (Ord. 9804 § 4 (pan), 1986) 21.44.100 Landscaping of parking areas. Every required parking area having a capacity of five or more vehicles, except in R-A. Size and Access The size and access of all parking spaces and aisle-ways shall follow the standards as provided in Section 21.44.050(a)(1) of the Carlsbad Municipal Code. c. Parking Overhang 1. No parking overhang will be allowed into any required setback area. 2. Parking overhang will be allowed only in special, specific situations as reviewed and approved by the Planning Director on a case by case basis. 3. In no case shall parking overhang be allowed for compact car spaces. d. Landscaping Section 9,b. of this chapter identifies the landscaping standards within the parking lot areas. Also see Figure 27 regarding the landscape concept for parking structures. e. Parking Structures Parking structures shall be located away from LEGO Drive and Armada Drive and shall be screened from public view to the maximum extent possible. Above ground structures should utilize landscaped earth berms around the edges to reduce the apparent height of the structures. Architectural treatment, building materials and colors shall be consistent with surrounding buildings. Architectural treatment (e.g., moldings and joints) should be utilized to provide relief on large walls. Decorative screen and trellis elements of durable high quality materials and vine planting are also required on each level to screen and soften the appearance of parking structures, as shown in Figure 27 on page 67. Recreation Vehicle parking stalls shall be 34' x 11'. Bus parking stalls shall be 40' x 12'. All bus aisles shall be a minimum of 75 feet in width. If tandem bus parking occurs, there shall be a minimum of 3 feet between buses. All handicapped parking stalls shall meet the requirements of the Americans With Disabilities Act. The proposed parking concept shall meet or exceed the City of Carlsbad landscape requirements of 1 tree per 4 parking stalls. Bicycle access to the parking lot shall be provided at the trail connections off LEGO Drive and off Hidden Valley Road. Bicycle racks shall be provided within the parking area. Parking expansion will be provided within the LEGO site adjacent to the Palomar Airport Road buffer zone. This area will be landscaped, and parking will occur in the grass/turf portions of this area which will also serve as space as needed for parking overflow. The City may require the paving of the parking overflow area when warranted by traffic usage, but not before. This overflow parking area will accommodate an additional 1,150 parking spaces. The City will conduct traffic counts periodically to determine the adequacy of the parking lot with respect to health and safety standard to determine if this overflow area needs to be paved. The City shall advise LEGO of any health and/or safety problems and, at the direction of the City Engineer, may require any necessary remedies to correct the problems. 4 The City of Carlsbad does not have a specific parking standard for a theme park such as LEGO. These standards are derived based on the justification and analysis contained in the traffic report prepared by KAKU Associates, Inc. (Traffic Study for the Carlsbad LEGOLAND Carlsbad, dated April 1994, pages 59 to 62). This report is available at the City of Carlsbad Planning Department and is incorporated herein by reference. Carlsbad Ranch Specific Plan T23 The parking lot layout and design are shown on Figure 38 on page 125 and the parking lot geometries are illustrated in Figure 39 on page 126. These Figures are intended to show that it is feasible to design a parking layout to accommodate the required parking on the LEGO site. It is not intended to be a final design. The actual design may vary subject to the review of the Site Development Plan. The final parking lot layout shall be subject to City approval at the time of Site Development Plan review. Directed parking may be necessary during certain peak season days. A requirement for directed parking will be based on the final design of the parking lot and determined if necessary at the time of the Site Development Plan review. f. Circulation Plan The Circulation Plan is shown in.Figure 40 on page 127. The Circulation Plan establishes the roadway network and the basic standards for safe automotive, bicycle and pedestrian movement within the LEGO site and as it relates to the proposed circulation system of the adjacent Carlsbad Ranch Planning Areas. Figure 40 on page 127 of this document illustrates the overall circulation plan for the Carlsbad Ranch Specific Plan. In order to comply with the established performance standard for circulation facilities contained in the Local Facilities Management Plan, Zone 13, the only directional signing allowed on Palomar Airport Road will be a directional sign for west bound vehicles directing them to go north on Armada Drive to LEGO Drive. All directional signage located along the I-5 corridor shall direct visitors to the Cannon Road off ramps. All promotional material, television and radio advertising, shall direct visitors to access the Park using the I-5 and Cannon Road interchange. LEGOLAND Carlsbad will be built with a fiberoptic loop infrastructure for a maximum of for voice, video and data monitoring capacity. These systems will be complemented by 24 hour security at the Hidden Valley Road gate and parkwide patrols. Currently, while the Operations team is being assembled, the design team is including the infrastructure to accommodate this advanced technology and is creating a park which is well- monitored by both police and employees, based on the experience gathered at the parks in Denmark and England. Security System Highlights: By way of example, the following is a description of security systems for LEGOLAND Windsor. Implementation of similar systems is planned for LEGOLAND Carlsbad. The monitoring system is a highly flexible assemblage of software and hardware, with a single touch-screen monitor at appropriate locations capable of displaying multiple images and audio for: • overview of various device locations • camera remote control • VCR control (real-time and time-lapse) • public address system announcement (single or multi-zone) • radio linking • phone linking • alarm display and follow-up protocols • messaging and follow-up • event log • system-status monitoring The system is connected to police and fire reporting lines either directly or through a security service. The system retains and displays call information. The park will have redundancy in its monitoring functions, with full-time monitoring locations: • Security (located at The Beginning cluster) • Hidden Valley Road gate • additional monitoring status as needed Security Planning Provisions Page 1 Active Patrols: In addition to this sophisticated electronic system, the park will be patrolled 24 hours a day. As with any employer in a public-related business with many staff, LEGOLAND will have ongoing training programs, including one for the security personnel. They will be trained in patrolling procedures, safety protocols, dealing with various situations, securing various areas, notification procedures, reporting, etc. Staff will also be trained to politely and tactfully inquire of guests in various situations to ascertain important information and prevent theft. The training curriculum will be coordinated with the Carlsbad Police and Fire Departments in order to assure that a reasonable and close interface exists between the park and the City with regard to safety and security. A Park Manager will be on duty at all times who will have authority to act on behalf of LEGOLAND Carlsbad in the event of any emergency or response. Other Provisions: Emergency lighting will be provided in the park by a system of emergency generators at about six locations around the park (exact locations are currently being studied). In addition to lighting, emergency power will be provided for any attractions which could strand guests should the power fail. Security systems will also be provided with UPS units and emergency power in the event of a failure. Various departments (not just security personnel) will also have prescribed procedures such as food service and any cash-handling areas. All appropriate staff will be trained to restore Parkwide Systems expeditiously following a power failure. Night lighting will be provided to the extent required for proper security of guests arriving, within the park, and upon leaving the park. We will be providing security cameras in the parking lot, in addition to the locations around the park perimeter and inner entrance areas. Currently, the exact location of security lighting, motion detectors, CCTV cameras, fencing and patrol routes is in formulation and will be completed before the end of 1997. A security consultant has been retained for this effort. A Disaster Plan will also be created for the park, in order to evacuate the park in an orderly manner and to be prepared for various events that could befall the park. This plan will be prepared by the Operations group in conjunction with Police and Fire Departments to assure as smooth an interface as possible in the event of a disaster. The disaster/evacuation plan will prescribe staff assignments and security system settings for assuring that guests flow to exits and out of the park in an orderly safe manner, and that trained staff and equipment are located to provide for assistance in the event of injury or disabled guests. There will also be a follow-up procedure to assure that all buildings have been safely evacuated, and that they are then secured. Security Planning Provisions Page 2 The plan will also seek to assure that procedures are in place for Police to take over as guests leave the park in such an event. LEGOLAND is dedicated to operating as safe a park as possible for many good and obvious reasons. We anticipate being able to present draft security plans before construction gets underway, and to engage the City departments in further dialogue concerning features of the project in the near future as the Design phase progresses. The vertical distance is measured from all points at grade along and within the building coverage to the highest point of structure directly above that point of measurement. 2- No architectural feature can exceed the height of forty-five feet. The distinction between building and architectural feature is that an architectural feature cannot function to provide usable floor area. Our Site Development Plan submittal for LEGOLAND Carlsbad shows asphalt paving for 100% of the required 3,500 guest parking spaces. This excludes the future parking expansion area which is not required to be paved until the inner park expands in the future. We kindly request Planning Commission and City Council approval of the attached condition which will allow a portion of the guest parking spaces (848 spaces) to be temporarily surfaced in gravel until such time as the use of that area exceeds eighteen (18) days per year. For our first phase of development, we do not foresee continual use of this portion of the guest parking lot except during limited "peak" periods of the season—i.e., summer weekends. Until such time as a greater frequency of use is demonstrated, we prefer to surface the area in gravel. Our two parks in Billund and Windsor successfully utilize gravel parking lots for peak periods. Please note that the above proposal is based on an expected frequency of use. We have not decreased our projected total annual attendance levels for the park. The northbound bus turnout located at the farside of "D" Street at station 36+00.00, meets the location and design requirements of NCTD. It is our understanding that this bus turnout was moved to this location due to the improved roadway grade and adequate line of sight. While NCTD had wished to be in closer proximity to the LEGOLAND entrance, in addition to sidewalks, walkways will be built through the LEGOLAND parking area to the entrance. NCTD is satisfied that accommodations will be made to facilitate pedestrian circulation. 2. Since NCTD does not have short range plans to serve the Carlsbad Ranch Development, additional transit improvements were not required of the developer at this time. In the future, if and when service is provided on Armada Drive, additional bus stop improvements will be desirable. These include the placement of shelters, benches and trash receptacles. The estimates were prepared by our consulting engineers (for facilities), our irrigation design consultant (for reclaimed water), and our water feature consultant (for the lake and water attractions). The most direct, "apples to apples" comparison with the water estimate in the EIR can be made between the "Average Daily Use (GPD)" figures in our estimate, with the "Average Water Use (GPD)" figures in the EIR. Please note that our estimate for potable water is for the initial phase of park development at opening day, i.e., that shown in the Site Development Plan. We are not able to estimate future park buildout any more precisely than what is already in the EIR at this time, since the future expansion areas have not been designed. We are, however, able to estimate reclaimed water at full park buildout (since landscaping is fairly predictable), and have done so herein. This is primarily to address CMWD's request for that information so that they can size the City's delivery system to our project at this time. You will note that both figures for potable and reclaimed water are well within the EIR estimates. Potable water will be used for all building facilities. The main lake, various water attractions, fountains, and other water features will use potable water in lieu of reclaimed due to the high nutrient load found in reclaimed water and the resulting problems with maintaining the required high level of water quality in those features. INTRODUCTION Landscapes are essential to the quality of the environment for the LEGOLAND Carlsbad project. They provide areas for recreation and can enhance the environment. In addition, landscapes offer people respite and psychological benefits as well as cultural and social framework and character. With careful planning and maintenance, landscapes can be safe, attractive, useful, and environmentally sound. It is the intent of this Irrigation Design Concept Plan to promote the values and benefits of our landscapes while recognizing the need to use water as efficiently as possible. The irrigation design concept plan has been broken down into both graphical and text document. The irrigation site master plan graphical document shall consist of the following: 1. Proposed location of irrigation points and washdown connection 2. Zone land boundary limits for each point-of-connection 3. Proposed location of field satellites and Cluster Control Units (CCU) 4. Proposed location of backflow preventers for each point-of-connection The text documents included herein provide back-up and design information for the graphical documents. To eliminate water waste through the long-term monitoring of plant needs and appropriate adjustment of irrigation systems. C. STATEMENT OF SITE CONDITIONS 1. PROPOSED WATER SOURCE AND DEMANDS: a. Reclaimed Irrigation Water Source 1i Irrigation water for the LEGOLAND outer park Landscape and most of the LEGOLAND inner park Landscape will be reclaimed water. The reclaimed water shall be supplied from the proposed Carlsbad Municipal Water District's (C.M.W.D.) off-site reclaimed water system. Irrigation water meters will be required at various locations throughout the project as required to accommodate anticipated irrigation water needs of the area landscaping. Information pertaining to water meter installation requirements and procedures shall be included as a part of the irrigation drawings. b. Domestic Irrigation and Washdown Water Source Irrigation water for some specifically selected LEGOLAND inner park Landscape areas, such as Miniland, will be domestic water. Water for washdown of inner park guest and food court areas will be domestic water. The domestic water shall be supplied from the proposed Carlsbad Municipal Water District's (C.M.W.D.) off-site domestic water system. Irrigation water meters will be required at various locations throughout the project as required to accommodate anticipated irrigation water needs of the area landscaping. Information pertaining to water meter installation requirements and procedures shall be included as a part of the irrigation drawings. c. The irrigation system will be serviced from C.M.W.D.'s 375 pressure zone. Elevations at project site vary from a low of 80 feet to a high of 185 feet. Watering Time and Peak Irrigation Demands: Based on historic evapotranspiration rate, the peak water requirement for irrigated landscaped areas is anticipated to be approximately 1.0 to 1.25 inches of water per week during the hot summer months. The irrigation system will be designed to apply this weekly requirement in a six (6) -day period, with a maximum watering time of six (6) hours per day for inner park landscape areas and eight (8) hours per day for outer park landscape areas. This will allow irrigation cycles to be completed during the late night hours when evaporation, site outdoor activities and blowing winds would be at a minimum. e. The following charts provide recommended point of connection sizes and peak flow demands in gallons per minute (GPM) plus additional preliminary irrigation system statistics. f. The peak irrigation demand has been estimated using the calculation parameters listed in the charts. Changes in the calculation parameters may effect the estimated peak irrigation demand. Recalculation of peak inigation demands will be required. g. Two methods were utilized to determine flow requirements. For the purposes of this report, the highest estimated flow has been chosen. h. Due to the fluidity of the landscape at this time, the quantities of inigation equipment and the peak irrigation demands shown in the charts are based on the worse case scenario. Submit information dealing with all the water and sewer use needs for the project consistent with the units of measurement and categories utilized in the Carlsbad Ranch Specific Plan Amendment Program EIR. If the water and sewer use exceeds the projections in the certified EIR and the threshold for determining significance for water supply/reclaimed water the project cannot be found to be in prior compliance with the EIR. A subsequent EIR would then be required to be prepared. 9. Please submit three sets of plans for the project immediately so they can be sent to the Palomar Airport Manager and SANDAG for review and comment relative to the project's compatibility with the Airport Land Use Plan for Palomar Airport. The third set is needed so that the City has a set on file for public inspection. 10. On the Title Sheet, "T" some minor corrections are needed including adding sheet A 202 to the drawing list. Please refer to the sheet for all corrections. 11. The following revisions are needed for sheet PW 001 : A. Provide the boundaries forjthe expansion area west of "The Beginning." B. The setback labeled as 20 feet east of the service and administration area scales to 30 feet. Please revise. C. In the legend change the existing land use to agriculture and the proposed use to LEGOLAND. D. Revise the building area calculations for several of the clusters as noted on the sheet. E. Change the total count for the guest parking spaces provided to 3,560. F. For the average daily traffic generated by the project include the totals for August Friday and Sunday for the year 1999 as well as August Friday and Sunday for buildout. Refer to sheet PW001 for the numbers from the KAKU report and the footnote to that study required by the city. G. Add a note under the grading quantities that the number listed includes mass grading for Lots 18 and 19 of CT 94-09 - DWG No. 333-2Y. 12. On sheet PW 002 the following revisions are needed: A. An upgraded type of fencing must be used adjacent to Armada Drive in the location noted on this sheet. Wrought iron would be an acceptable type of fencing for this location. B. Policy 3-8 (Buffer Zones) of the Mello II Segment of the Local Coastal Program requires a 50 foot buffer around all riparian areas. The parking expansion area encroaches into the required buffer which is not permitted. Include the 50 foot buffer on this sheet and remove the parking area shown as encroaching into the buffer. C. Specify the contrasting type of material to be used for the pedestrian sidewalk where it crosses the main entrance drive aisle and revise the connection to the pedestrian spine to show the sidewalk going straight across or revise the parking counts to reflect the loss of several spaces. D. Revise sheet references on the plan as noted. 13. On sheet PW 005 the following revisions are needed: A. Specify the color for the vinyl coated chainlink. B. Include a different fence detail for the fence type to be used adjacent to Hidden Valley Road and note the area for it's use with a new symbol. 14. Revise the percentage of area for Zone 1 and 3 landscaping as noted on sheet N102. 15. On all sheets showing the sidewalk adjacent to the private section of LEGO Drive please label the location of the sidewalk. 16. On sheet OP 100 the following revisions are needed: A. Provide calculations demonstrating that the 3% of the parking area landscape requirement is being met. B. Revise the references to the sheets containing the sections referenced. 17. On all plans that include the area for the Hidden Valley Road basin and the pedestrian access from Armada Drive show both of these features. 18. Provide a grading index key map on all grading plan sheets. 19. All plan references to the 140 foot setback from Palomar Airport Road should not label this setback as an easement. 20. On all plans dimension the width of driveways to Hidden Valley Road. 21. Revise the sheet and cross section references on sheets OP 120 through OP 122. Also several of the berms heights are proposed as 30 inches while exhibits in the Specific Plan show 36 inches. 22. On sheet OP 123, Outer Park Signage Layout, the following revisions are needed: A. Dimension the maximum flag pole height at the toll plaza booths and provide dimensions for the banners. B. Specify the color for all light poles and light fixtures. C. Revise the signage matrix as shown on the sheet. 23. The outer park light fixtures must be a neutral color and not the bright primary colors proposed on sheet OP 124. The proposed banners for these poles will serve the function of attracting attention and providing a festival atmosphere. The bright colors conflict with the efforts to screen the parking area. 24. Provide a detail for the pedestrian spine lights listed in the legend on sheet OP 124. 25. Numerous revisions need to be made to the Parking Layout on sheet OP 125. Required revisions include the following: A. The width of the space adjacent to handicapped parking is 5 feet not 4 feet, 6 inches according to the Uniform Building Code. B. A dashed in layout of the parking expansion area with aisle counts is required to verify that the required number of spaces can be accommodated in the area provided. C. The parking table should be revised as noted on the sheet. 26. A solid block wall textured to match the Administration Building is needed between the Maintenance Building and the Electrical Pad parallel to Hidden Valley Road as well as between the Gardeners Shed and the Electrical Pad parallel to the main employee/service area entrance. The Specific Plan requires the use of block walls to screen service/trash handling areas. The proposed open sided design of the refuse facility further supports the need for block walls in the perimeter locations indicated. 27. Provide elevations for the Security Booth. 28. Within several of the cluster plans revisions to the building area tables are needed. Please refer to the plan set. 29. The offsite trail area northeast of the site contains a slope which exceeds the 30 foot maximum height. Please revise. 30. Numerous grading plan sheets contain finish floor elevations. The City's building height ordinance requires height measurements to be from finish grade. Please revise the plans to comply with the required method of measurement. 31. Information is missing for the proposed building elevations. The elevations appear to lack detailing. It cannot be determined if the lines on the elevations are meant to represent score lines, accent reveals or some similar feature. Building color is also not specified. Painted tilt up concrete panels will not be supported for this area due to its visibility. The panels must have one of the surface treatments listed on the plan applied in keeping with the design standards being utilized for the Carlsbad Ranch. The buildings in this area should be consistent with the level of quality required in the other areas of the Carlsbad Ranch Specific Plan. 32. Roof equipment screening should be incorporated into the building design. The design of equipment should match the building in the type of material used, color, and the use of score lines or other detailing. 33. The building areas containing LEGO themed colored metal panels, columns, and entry features must be detailed on the project plans. 34. For the proposed Maintenance Building show roof equipment screening or include a note indicating that equipment will be at grade, showing the locations and necessary screen walls. 35. For buildings in the Service and Administration Area specify the color proposed for all exterior building surfaces including overhead doors, man doors, and metal roof canopies. 36. The landscape sheet included within each cluster plan includes references to information not included within the plan set. All of these references must be deleted from each of the cluster landscape plans as specified in an earlier city comment letter on a preliminary review plan. 37. Within several of the cluster plans the area to be landscaped shown on the site plan sheet is inconsistent with the area on the landscape plan provided for the cluster. Please revise as necessary to resolve. 38. The castle flag pole on sheet C 203 is over the 45 foot height limit for architectural features which includes flag poles. Please revise the plan so-that no architectural features including flag poles exceed 45 feet in height. 39. Accurately locate the northbound Armada Drive bus turnout on the plans per City Drawing No. 333-2J, Sheet 9. 40. Enclosed is a set of the project plans containing Planning Department review comments. Please revise the project plans to incorporate all the revisions noted and return these plans with your resubmittal. If these plans are not returned it will significantly delay the City's processing of the project. 41. Landscape plancheck comments are provided on a separate set of plans which are being returned to you for your use. Please return these plans with your revised plan set. 42. Enclosed are comments from several City departments which should be incorporated into the revised plan set. Engineering: 43. Show easements on the grading plan sheets OP 110 - OP 114, on the two page site plan sheets PW 001 and PW 002 and on the landscape plan. 44. The existing and future utilities shown on the grading plan need to be shown more clearly. Verify the undergrounding currently being performed by SDG&E along Palomar Airport Road will not construct any vaults that will interfere with the toe of slope. 45. Show the distance between the two driveways off Hidden Valley Road on the Site Plan. 46. Show the sight distance corridor at the two driveways off Hidden Valley Road (using 25' from BCR triangle) and at the Palomar Airport road intersections with Hidden valley Road and Armada Drive (intersection sight distance) on the grading, site plan and landscape plan. 47. Nonstandard streetlighting is proposed on Lego Drive. The portion from the public Lego Drive, including Lot 19, to the toll booths must meet City standards. It is fine to use nonstandard streetlighting as long as specifications are provided to show the lumination meets City standards. Verify the lumination travels as far as the sidewalk. The sidewalk meanders quite a ways away from the street at one point. 48. Provide a different paving surface for the bus stop pedestrian access through the entrance. Provide the grades of the sidewalk through the pedestrian spine circulation. 49. We suggest you consider making a break in the median to the north of the bus stop pedestrian walkway to allow early arrival cars shorter route to front parking spaces and allow pedestrian less hazardous access. The area would be closed off when not in use. 50. Since no changes were made to the plan for the Administration Cluster since the preliminary review, the plans were not reviewed. All comments made previously still apply. 51. Use new handicap ramp design from Caltrans for any ramps you are proposing. Two copies have been provided for your use. 52. There is a waterline currently running through the inner park. Indicate what will happen to the line. I.e. - remove at grading permit or building permit. 53. Provide oil/water separator/trap within storm drain system. Some information has been provided to Nolte 1/13/97. 54. Please address the following issue from the soils report: a. Have the soils engineer prepare an addendum to the soils report stating the new plans have been reviewed and any additional recommendations. b. Address issues raised in the attached soils report on pages 13, 19, 20, 17 and Plate 2. c. Address more specifically the deed restricted area along Palomar Airport Road. It needs to be shown and the area within deed restricted area can not be graded. Address impact on site. d. I did not see how "R" value of 40 was determined, please address. 55. Identify on the site plan where the excess soil will go. 56. Top of slope along Lego Drive between the R&D and Lot 18 and 19 meanders on and off the property. Carltas, LLCI and the City have agreed that property owners will record a private drainage and maintenance easement over the slope on the R&D lots since it drains onto Lot, 18 and 19. The slope needs to be reflected on the site development and grading plans. 57. Offsite grading for Hidden Valley Road is approved with City Engineer signature on the grading plans. No additional easements are required. City staff working on the City golf course have been to the site and reviewed the proposed grading in the field and do not have any issues. 58. If construction phasing is planned, address at this time. 59. It has been agreed that construction access will be through Lot 5 from Cannon Road. No construction traffic will be permitted in the roundabout. 60. Please provide a copy of the following documents from the title report: Reimbursement agreements F/N 86-349360, F/N 88-557946, F/N 86-349359, F/N 88-557947, covenant and agreement F/N 95-0245821 and 95-0245822, Notice of Restriction on Property F/N 96-0450388. 61. Verify that there are not any conflicts with the toe of slope of the basin along Palomar Airport Road and vaults from the undergrounding of overhead utilities currently underway along Palomar Airport Road. 62. Show desilt basin required for Hidden Valley Road. Show access points to basin along Palomar Airport Road from Hidden Valley Road and Palomar Airport Road. 63. The sidewalk from the NCTD bus stop on Palomar Airport Road needs to be shown consistently on all sheets. Parking lot space count needs to be corrected to reflect two spaces lost for pedestrian pathway. 64. Provide the grid on the grading plan consistent with the other sheets. 65. Show the existing stockpile and refence by plan number (DWG 285-2B and 2D). 66. An NPDES requirement will be to provide an operating manual on-site dealing with day to day activities of the park. We have hired a consultant to assist us in the preparation of City NPDES documents. If you or your representative would like to confer with our consultant, please contact me and I will set something up. 67. Provide information on the water quality of the water features. If water goes into sewer system, need Industrial Waste Permit. If water goes into storm drain, need discharge permit from the Regional Water Quality Board. 68. Provide the traffic control signage standard drawing number or detail indicating what the signs will say. 69. General comments to the inner park cluster submittals: a. Verify that the landscape plan, grading plan and site plan consistently show building pad locations, pathways, etc. b. Clearly indicate the storm drain and sewer system are private. c. Indicate which water line are for fire service and will require an easement. If the easements are in areas of landscaping, note constraints to planting and irrigation on the landscape plan. d. Contours between Imagination Center Cluster grading plan and Miniland Cluster grading plan do not line up. e. Building square footages from the floor plan do not match those on the site plan. f. Prepare an Excel file with all buildings, building types, use, square footage and number of seats when applicable. Plan to bring in diskette and spreadsheet to meet with City (Sherri Howard, Mike Peterson and Mike Bock) week of January 20, 1997. The City will use this information to determine which buildings will have impact fees associated with them. g. It is difficult to differentiate the existing topography from the proposed topography. Either darken the proposed or lighten the existing. h. The drawing numbers refenced on the landscape plans do not match those in the set. i. In the Beginning, what is the Market Place, Area development? j. In Funtown, where is the birthday pergola? Is there water, sewer or food service? k. The project description for Castle Hill includes attractions not identified on the plans: Royal Pavilion, Green Room, Puppet Show Cart, Outdoor Show, Birthday Tent. I. In the Imagination Center project description, are Free Play, Learning Center and Structure Play all considered LEGO workshops? Note: References to Lot 18 and 19 are future Lot 18 and 19 to be created with the recordation of CT 94-09 Unit 2 and 3. 70. Attached is a redlined check print of the site plan. This plan is given to the applicant for corrections and changes as noted. The applicant must return the redlined checkprint with the corrected site plan to assist us in our continued review. 71. From: Virginia Me Coy, Community Services Dept, Special Projects COMMENTS ON SDP 96-14/CDP 96-16 - LEGOLAND Thank you for the opportunity to review the referenced set of plans for Legoland. This sections main concern will be the portions of the project that will require maintenance by the City Street Section such as the storm drain system lying within public easements. Although storm drain maintenance easements will be shown on additional improvement plans for the area, we find it convenient to also have them labeled on the drawings included in this set; OP 110, 111 and 112 as we will retain a final copy of these plans in our office for future maintenance calls. For this reason we request that easement areas be shown for all areas of the storm drain that the City is to maintain. It is understood the street lighting system for Lego Drive as shown on drawings OP 123 and 124 will be a private system maintained by Legoland staff, however after reviewing the system two questions arise. 1. Pole height is inconsistent. The profile gives a 35' proposed height while the Legend lists the proposed height as being 30'. A 30' height at maximum is recommended as the street is only 50' wide and a taller mounting height would reflect too far beyond the traveled right of way. 2. The lighting fixture as shown is a double luminaire with one of the heads mounted over the street side and the other mounted over a unpaved area. Is their a reason to illuminate the untraveled side? December 30, 1996 TO: DON NEU FROM: Captain George Suttle, Police Department SUBJECT: LEGOLAND CARLSBAD - PLAN REVIEW Senior staff of the police department reviewed the plans for Legoland Carlsbad. Two areas of concern were addressed. First, on Drawing number PW005 the emergency access plan, it appears that emergency vehicles entering the park from the Lego Drive side of the park, once inside would have to drive across the entrance way (The Beginning) to get to the First Aid Station. This of course is directly in the path of park visitors entering the park. While crossing pedestrian pathways is not the best scenario it would be acceptable if the security/communications plan calls for park security to control pedestrian ingress/egress during emergency vehicle operations. Secondly, on Drawing number OP125, Parking Layout South. It appears that there is a pedestrian crossing that traverses Lego Drive at the main ingress- egress point to the park. It appears that this pedestrian walkway is only a marked (painted) crossing. We are concerned that if there is any amount of pedestrian traffic during peak vehicle traffic that without better traffic controls this would be a hazardous situation particularly with small children. Are there plans to staff this with a crossing guard - parking control person? Other than those two issues the plans look good. Date: January 13, 1997 To: Planning Department From: Police Department/Crime Prevention Subject: Plan Review-SDP 96-14/CPD 96-16 Plan Review Recommendations The following are optimal security suggestions provided by the Carlsbad Police Department. The purpose is to create an atmosphere that is free from crime opportunities. The recommendations are presented in two sections, site considerations and building recommendations. A. Site Issues A-1 Lighting It is suggested that aisles, passageways, and recesses related to and within the building complex should be illuminated with an intensity of at least twenty-five one hundredths (.25) footcandles at the ground level during the hours of darkness. Lighting devices should be protected by weather and vandalism-resistant covers. Open parking lots should be provided with a maintained minimum of one (1) footcandle of light on the parking surface during the hours of darkness. White lights provide better vision and surveillance capabilities than do yellow lights. Lighting devices should be protected by weather and vandalism covers. The main entry and rear dock areas should be given additional lighting during hours of darkness. A-2 Landscaping The exterior landscaping should be kept at a minimal height and fullness giving police, security services and the general public surveillance capabilities of the area. Landscaping should be designed to not detract from lighting. Low level plants should be planted in front of windows so as to not cover windows. All entrances shoror be kept clear of clutter. 'Wrimeter landscaping should not take away from vision into the property. Trees should have a canopy of not less than five feet. Shrubs and bushes should not be higher that three feet. Walkways should be clear providing surveillance capabilities and should be lined with low level ground cover or trees with high canopies. Security plants should be applied where necessary to prevent loitering and tampering. Burms should b kept at a minimum when they detract from surveillance. A-3 Addressing A street number should be displayed on a prominent location on the street side of the building. The number should be placed in a position that is easily visible to emergency vehicles to hasten their approach. The numbers should be no less than four (4) inches in height and should be of a contrasting color to the building to which they are attached. A diagrammatic representation of the park should be placed at all emergency entrances to speed response. B. Building Recommendations B-1 Doors Hollow steel doors shall have a minimum sixteen U.S. gauge and have sufficient reinforcement to maintain the designed thickness of the door when any locking device is installed. Glass doors shall have fully tempered glass or rated burglary resistant glazing. All exterior door should be protected with security hardware. All doors shall be equipped with an astragal constructed of steel a minimum of .125 inch thick which will cover the opening between the door and frame or other door. The astragal shall be attached to the outside by means of welding or with non-removable bolts spaced apart on not more than ten inch centers. The jamb on all aluminum frame swinging doors shall be so constructed or protected to withstand 1600 pounds of pressure in A both a vertic^tlistance of three inches anSWorizontal distance of one inch each side of the strike, so as to prevent violation of the strike. B-2 Windows Movable windows should be equipped with security hardware. B-3 Roofs All roof openings shall be secured. B-4 Gates and Fences All gates, fences and walls should be constructed to allow surveillance into park areas. B-5 Loading and Unloading Areas All loading areas should maintain additional lighting and cargo roll-up doors should be equipped with security hardware. Rear pedestrian doors in this ares should be equipped with a viewer. Trash areas should be positioned away from areas of loading and unloading.
