Subsequent to my letter of April 15 summarizing the pads needing certification, Mike Peterson called to question the absence of several food cart service buildings. After researching status on those buildings, we found only one which should be added, and another that should be deleted. By way of copying the various attendees of the April 14 meeting, I am submitting a revised list for verification. I believe this list is comprehensive and should hold for the second construction change plan check process. Public Facilities Fee The Public Facilities Fee will be 1.82% of the building permit valuation. Traffic Impact Fee The letter requested removal of a traffic impact fee for the Service and Administration Cluster. The Service and Administration Cluster is subject to impact fees as well as the other clusters. The ADT's for the Service and Administration area were calculated based on use as defined in City Code for office use. The Service and Administration Cluster has buildings that are defined within our code. The building uses are all office and have an ADT of 638. The remaining clusters impact were determined by subtracting the Service and Administration Cluster from the overall ADT of 8,132 as determined in the Kaku traffic study and used consistently in the EIR and LFMP for Zone 13. This ADT is peak Friday ADT that has been used in the Assessment District because the business park peak use is Fridays. The following formula was used to determine Traffic Impact Fees: (8,132 ADT - 638 ADT for Service & Admin. Cluster )(Cluster Acreage /Overall site acreage) Sewer Fee City staff is waiting for additional information regarding the types of uses of building in LEGOLAND Billund. Sewer fees in restaurant uses are based on the type of restaurant and number of seats. The City will consider metering to determine the actual sewage outflow. July 23, 1997 TO: SENIOR BUILDING INSPECTOR - MIKE PETERSON FROM: Associate Engineer - Sherri Howard CT 94-09/SDP 96-14 - LEGOLAND CARLSBAD SEWER FEES I have reviewed the information provided by LEGOLAND Carlsbad regarding the sewer fee the City will collect as a deposit. The City has agreed that we will meter the sewage outflows to determine the actual sewage usage. We also agree that our current Sewer Ordinance does not address the theme park usage. Staff has, since the beginning of the year, tried to work with LEGOLAND Carlsbad to determine a sewage fee that would be appropriate. LEGOLAND Carlsbad has provided us information for the park in Billund Denmark in response to our request. I have reviewed the information provided by LEGOLAND Carlsbad regarding the building square footages and usage for the park in Bllund. In my opinion the uses are different for the two parks and should not be compared for the' purpose of determining sewage impact fees. I recommend the City determine the sewage fees based on the uses as defined in the Municipal Code. The actual building square footages are coming in less than originally estimated. The building square footages have been requested for the remaining clusters through you. Once these square footages are available, a revised fee estimate can be made available. At this time the only fee estimate engineering staff is confident of is the one for the Service and Administration Area. There have been substantial changes in the remaining clusters requiring a recalculation of the fees. If the sewage outflow metering proves there is less impact on City facilities than estimated by using the Municipal Code, LEGOLAND Carlsbad can apply for a reimbursement or use the fees as a credit toward the second phase or expansion area development. I appreciate the fact that we have been able to work through the issues related to the Community Facilities District (CFD) and Sewer fees for the LEGO project. The purpose of this letter is to confirm our understanding of the agreement between LEGO and the City on these fee programs, and to clarify for both parties what is expected in the future. This will help avoid any confusion in the future and will keep your project moving rapidly toward completion in early 1999. With regard to the CFD fees, Mike Peterson's schedules provided at our last meeting explain in detail how the CFD fees will be computed. From your most recent letter, it is my understanding that both LEGO and the City agree that the methodology Mike has outlined in those tables is acceptable. I have attached a copy of his work to this letter for your records. Although these schedules are based on a prior CFD tax schedule, Mike's work clearly shows the methodology we will use. The CFD rates used in the computation will be the rates in effect at the time the building permit is pulled. With regard to the Sewer fees, I believe I understand the terms of the agreement you have spelled out in your recent letter. And, in an effort to be clear on this point, I would like to provide you with an outline of our agreement, as I understand it. Sewer fees will be collected on the following basis: 1. Sewer connection fees will be collected on a pro rata basis as the park develops using the EIR (Environmental Impact Report) estimate of 356 Equivalent Dwelling Units (EDUs) as the assumed total for the finished park. During the construction of phase I of the park, LEGO will pay for 274 EDUs, with the remainder to be paid as the expansion areas are built out over time. 2. LEGO will work with the Engineering Department to establish a sewer metering program for LEGO park which will monitor the sewer flow from the park for a period of three years. At the end of the three year period the City will determine the average consumption per attendee, and will use this average consumption for computing any future sewer demands created by the park. I think we have made excellent progress in defining how the sewer fee system will work for both LEGO and the City. Lloyd Hubbs and I have talked about your comments and agree that your comments regarding the sampling period are correct. Lloyd reminded me that there had been prior discussion about sampling for Fridays during June, July and August, just as you have suggested. These samples would then be averaged to determine the sewer flow for LEGO. The City agrees that this is a fair sampling period and computation method. I believe that with this change LEGO and the City are largely in agreement on the sewer fee computation method. Lloyd and I are ready to meet with you at your convenience to complete the implementation plan. In your letter you suggested that a work session might be valuable. When you are ready to move forward please give Frank Jimeno a call at 438-1161 x4501. He will coordinate with all parties to make whatever arrangements are necessary. Change San Diego County Department Health Services to San Diego County Department of Environmental Health on the Declaration of Responsibility on the Title Sheet. The Declaration must be signed. 3. Show all potable feeds to buildings. 4. The legend on Sheet 2 includes a symbol for "Do Not Drink" sign locations. Call out the sign locations on the Enlarged Plan of Project Area. 5. Include recycled water standard notes 23, 24 and 25 (see attached). 6. Indicate on the plans any designated outdoor eating areas or drinking fountains. Verify these areas are protected against contact with recycled water overspray, mist or runoff. 7. Add a note to the quick coupler detail on Sheet 7 (Detail 10) stating that "quick coupler valves shall be of a type approved for recycled water use". The recycled water quick couplers must by easily distinguished from the potable washdown quick couplers in the same vicinity. 8. What is the point of connection for the potable washdown on Sheet 12? Irrigation during public use periods with disinfected tertiary recycled water shall be under the supervision of the designated user supervisor. Irrigation with water of a lesser quality than disinfected tertiary recycled water shall be between the hours of 10:00 p.m. and 6:00 a.m. 9. Burial of all wiring and piping shall meet NAME OF WATER DISTRICT'S Rules and Regulations. 10. Non-designated use areas shall be protected from contact with recycled water, whether by windblown spray or by direct application through irrigation or other use. Lack of protection, whether by design, construction practice or system operation, is strictly prohibited. 11. Irrigation heads shall be relocated or adjusted to minimize or eliminate over-spray-ing on sidewalks, streets and non-designated use areas. 12. Recycled water quick coupling valves shall be of a type designed for the use on recycled water distribution systems per NAME OF WATER DISTRICT'S Rules and Regulations. 13. On recycled water systems, all appurtenances (sprinkler heads, valve boxes, etc.) shall be color-coded purple per AWWA guidelines and Section 116815 of the California Health and Safety Code. 14. All irrigation pipes shall be stenciled with the warning, "NON-POTABLE or RECYCLED WATER," color-coded (purple) and laid with warning tape and stenciling oriented toward the top of the trench per the.NAME OF WATER DISTRICT'S Rujes and Regulations. * •», 15. On new on-site systems (post-meter), potable water, constant pressure recycled water and sewer lines should be placed a minimum of four feet apart or as directed by the project engineer and/or regulatory agency. Measurements shall be between facing surfaces, not pipe center lines. 16. Constant pressure recycled water lines shall cross at least twelve inches below potable water lines and maintain at least twelve inches crossing separation between other utilities. 17. If a constant pressure recycled water line must be installed above a potable water line or less than twelve inches below a potable water line, then the recycled water line shall be installed within an approved protective sleeve as per the NAME OF WATER DISTRICT'S Rules and Regulations. 18. Developer/contractor shall conduct a cross-connection test and coverage test as directed by the NAME OF WATER DISTRICT and/or the San Diego County Department of Environmental Health prior to any use of recycled water. 19. The required cross-connection inspection shall be done by either the NAME OF WATER DISTRICT and/or the San Diego County Department of Environmental Health. Copies of inspection reports will be forwarded to the non-inspecting party. 20. The design and locations proposed for recycled water "Do Not Drink" signs shall be called out on the plans. 21. When recycled water becomes available, an on-site user supervisor shall be designated in writing. This individual shall be familiar with plumbing systems within the property, with the basic concepts of backflow/cross-connection protection, the recycled purveyor's rules and regulations and the specific requirements of a recycled water system. Copies of the designation, with contact phone numbers shall be provided to the NAME OF WATER DISTRICT and/or the San Diego County Department of Environmental Health. We understand that you have allocated all of the mitigation fees associated with the eastern expansion area to this building. We are not constructing the entire cluster at this time, therefore we would like to adjust the mitigation fees to more closely reflect the work that is being done under this permit. The Technic coaster and the Technic Diner are the first phase of a cluster, which will ultimately include 8 attractions. The remaining attractions shown on our SDP plan are phased and will be built over time. We anticipated paying the fees as the attractions are built. Therefore, we would like to defer some of the impact fees until such time as we build out the remainder of the cluster. The following is our proposal: We expected the payment of building department fees and are prepared to cut a check immediately for the following amounts, which are directly related to the Technic Diner. Since traffic impacts and sewer impacts are based on a theoretical capacity of the expansion area (EDU's and ATD's) it is reasonable to assume that a partial build out would represent a partial capacity in terms of establishing the mitigation fees. The following is a list of Attractions and their associated hourly capacities. We would like to base the payment of mitigation fees on the percentage represented by each of these attractions as they are built out.
