I am asking that you review the following request and respond to me relating to the following fees. PUBLIC FACILITY FEE/VALUE OF UNIT I request the City use the apartment house square footage rate for determining the Public Facility Fee because the owner of a second unit has to agree to rent the unit as rates in order to obtain the building BRIDGE AND THOROUGHFARE FEE I request to pay the apartment rate above. TRAFFIC IMPACT FEE I request to pay the apartment rate above. an apartment for affordable permit. for the reasons as stated for the reasons as stated SEWER CAPACITY FEE I reauest this fee be reduced to one-half the normal fee. Leucadia County Water District has a special rate of 0.55 EDU's for guest homes with,:kitchens. Guest homes without kitchens pay a rate of 0.33 EDU'sL HOME (619)729-3327 WORK (619)438-3182 FAX (619)431-2205 Mr. Marty Orenyak Page 2 July 27, 1994 Vallecitos Water District states that if a living unit is added and attached to an existing house, that no fee or charges are required for sewer or water. However, if a detached living unit is added, existing water service is considered adequate but additional sewer service is required but at one-half the cost. This assumes the new unit hooks into the existing services. WATER CONNECTION FEE I request that this fee be eliminated. As stated above Vallecitos does not charge a fee if the existing service is utilized. Also, Olivenhain Municipal Water District does not charge a fee if existing facilities are used and the second unit and property remain under one ownership. The Carlsbsd City Council over the years has made a considered effort to be sure its citizens are treated equal in all parts of the City. Because there are numerous school and utility districts within the City, this has not always been an easy task. The City is now the only agency that has not taken a position, that I am aware of, on addressing fees as they apply to affordable second units or small units. As you can see from the above positions of the various districts, it is time for Carlsbad to determine what fees will be charged for second units . I believe the staff has the ability to respond to my request as stated above without Council approval. When you receive this letter I will be in for building permit plancheck on my second unit. Hopefully, you can instruct your staff to prepare the fee list for my building permit consistent with my request as stated above. My permit should be ready for payment of fees during the week of August 8, 1994. I have also enclosed with this letter, copies of letters from Olivenhain, Vallecitos, and Leucadia Districts for your information. If you have any questions, please call me. Sincerely, Robert C. The Olivenhain Municipal Water District believes that the most "affordablet1 way to connect 2nd units to existing potable water facilities is to utilize the water meter presently serving the improvements on the property. By utilizing existing facilities substantial costs are avoided. It seems that the most practical solution to maximizing the advantages of a 2nd unit are to maximize the use of the present capital facilities in place. Additionally, fewer construction related impacts such as to paving streets and other public improvements will result from the installation of a 2nd unit. The Olivenhain Municipal Water District's current policy(8) would allow a 2nd unit to receive service from an existing water meter without paying additional fees, as long as the property and/or the 2nd unit remained under one ownership. The District would continue to send the water bill to that owner who would, if desired, recover additional water costs via whatever lease or rental agreement might be entered into with the occupants/tenant of that 2nd unit. Under current District policy, if an owner wanted a separate water meter installed to the 2nd unit, the cost of labor and materials to make an installation to .the existing water main would necessarily need to be covered by the applicant/owner. Under most circumstances this would be an unnecessary expense and not particularly conducive to holding down the cost of housing. Notwithstabaing, if the owner insisted on two meters, the District would be pleased I, to oblige the owner's request. Based on tpe proposed maximum square footage of the 2nd units at 640 square feet, the District would expect that a 5/Sn meter would A Public Agency incorporated on March 24.1959: formed under,the Municipal Water District Law of 191 1 Section 71000 et. seq. of the State of Callfomia Water Code d h be more than adequate for the service and the capacity fees would be less than one equivalent dwelling unit (EDU) . The District's current policy is to charge capacity fees based on 7/10's of an EDU, which corresponds to the relative capacity of a 5/8-inch meter versus a 3/4-inch meter. The District also has an inclining block water rate by meter capacity size, seasonally adjusted, that will equitably balance the increased usage on an existing meter and lower costs for de minimis demands that would occur on a separate 5/8-inch meter if that arrangement were chosen. These policies seem to provide the owners and prospective builders . of 2nd units with an opportunity to have the best of both worlds. Ladwig Ladwig Oesign Group, Inc. 1947 Camino Vida Roble, Suite 108 Carl sbad, CA 92008 Dear Mr. Ladwig: The District is in receipt of your correspondence dated April 21, 1994, regarding potential reduction of the District's fee structure when an additional living unit, whether:attached or detached, is built on a single family lot which cannot be further subdivided. Attached for your reference is a District map outlining that portion of the City of Carlsbad which lies within the Vallecitos Water District, as well as a larger scale map of that area. As you can see, only a very small amount of acreage falls into this category. Under current District ordinance, if a living quarter is added and attached to an existing house, the existing water meter and sewer lateral are considered sufficient to serve the addition, and no additional fees and charges are required. However, if a detached separate living unit is constructed on the property, existing water facilities would again be considered adequate, but purchase of additional sewer capacity would be required. Assuming this additional capacity is added to the existing sewer service lateral for the house under the same ownership within the existing legal parcel, the additional Dwelling Unit Equivalent (DUE) would currently be purchased at one half the cost ($1200) of a normal DUE ($2400). We believe this provides the appropriate level of service and commensurate cost thereto without attempting to socially prioritize what types of customers should be subsidized for purposes other than uti 1 i ty cost recovery.
