December 13, 1994 Ms. Beatrice Carlson 3390 Adam Street Carlsbad, CA 92008 RE: SDU 9443 - OSBURN SECOND DWELLING UNIT Dear Ms. Carlson: This letter is in response to your letter, dated December 9, 1994, regarding the SDU 94-03 - @bum Second Dwelling Unit application. The subject property at 3456 Adams Street (APN: 205-120-20) is zoned R-1-7500 and has a lot area of 17,385 square feet. Although the property is not proposed for subdivision at this time, it could technically be subdivided into two single family lots (minimum 7500 square feet in area) under the existing zoning and General Plan designation (RLM - Residential Low Medium - 3.2 DUIAC). The proposal under consideration (SDU 94-03) is to develop a detached Second Dwelling Unit over a new three car garage which is proposed to be located on the existing single family lot. Second Dwelling Units are permitted to be developed in single family residential zones of the City, subject to the provisions of Section 21.10.015 of the Carlsbad Municipal Code. You are correct in noting that the Second Dwelling Unit may be rented but may not be sold separately from the main dwelling unit unless the subject property is subdivided. The project applicant has indicated that family members will live in the Second Dwelling Unit. A second story may be added to a single story, single family residence through the processing of a building permit at the City. The maximum permitted structural height in the R-1-7500 zone of the City is 30 feet. If the Second Dwelling Unit application is approved, the property owner will be conditioned to enter into a lien contract with the City for the future public improvement of Adams Street along the project frontage for a half street width of 20 feet.
