The Planning Department has reviewed your Second Dwelling Unit, application no. SDU 97-13, as to its completeness for processing and issues. The drawings are complete, as submitted, however there are components of the application which are missing or need revision. They are as follows: 1. 2. 3. An The Public Facilities Fee Agreement must reflect the ownership of the property as stated on the title report. The developerlowner of the property is the Franklin Family Trust dated April 30, 1990. The signature page must have both Michael's and Sandra's signatures as trustees with notaries. Postage in the sum of $12.48 must be submitted to cover the cost of mailing notifications to property owners within a 300 foot radius. An Affidavit of Compliance (enclosed) must be completed and submitted. issue with the proposed design of the second unit is what appears to be an encroachment of the six foot retaining wall into the'required front yard setback. Please provide additional details regarding the transition of the retaining wall as it relates to the existing slopes. Notices have been sent and two letters of opposition were received. The letters brought two issues to light which should be resolved prior to the City issuing an approval of the Second Dwelling Unit Permit. Both issues regard the Declaration of Restrictions for the subdivision (Brentwood Heights). Article V; USE RESTRICTIONS; Section 5.1 state that no building shall be erected other than a single residence for a single- family. Section 5.2 of the same article requires written approval of the ARC prior to any construction on the lot. An approval of the proposal by the Architectural Review Committee will be sufficient proof that both issues have been resolved and that the second unit is not in conflict with the CC&R's.
