PROJECT NAME: Village H Second Units
APPLICANT NAME: Toll Brothers
This application is for a Second Dwelling Unit Administrative Permit for second units in Village
H of Rancho Carrillo. Five second units are proposed to be developed on any five of the fifteen
lots as shown on the exhibits that accompany this application. All fifteen lots are greater in size
than 7500 square feet and any of these lots will accommodate a second unit. These fifteen lots
comprise the fmt phase of development in Village H.
Future homeowners will be required to sign an appropriately completed copy of the enclosed
‘City of Carlsbad - Affidavit of Compliance for a Second Dwelling Unit’ at the time of purchase
of each lot that has been developed with one of the five second units. The rental price for each
second unit shall not exceed the rate as established by the City of Carlsbad for a 80% low income
household. Currently, as shown on the chart accompanying this application, this maximum
rental rate is $797.00.

CITY OF CARLSBAD - AFFIDAVIT' OF COMPLIANCE
FOR A SECOND DWELLING UNIT
3. The Properly Owner(s) agrees to the following terms and conditions:
a. The property and residence rcfmnced above must not contain a second residential dwelling unir
uniess it is in compliance with the second dwelling unit administrative permit provisions of the
Zoning Ordinance of the City of Carisbad.
b. The Properry Owner(s) shall reside in either the main dwelling unit or second dwelling unit
described zbove, now, and for the life of this agreement. "Owner" shall include a lessee if the
leasehold includes both the main dwelling unit and the second dwelling unit.
c. The Second Dwelling Unit may only be renbd and shall not be sold separateiy fiom the main
dwelling unit, unless the lot on which such units are located is subdivided.
d. The Property Owner@) agree to rent the Second Dwelling Unit at a monthly rental rate which
shall not exceed an amount equal to 30% of the gross monthly income of a low-income
household, adjusted for household size, at 80% of the San Diego County median income.
e. A copy of this agreement and Affidavit must be given by the Property Owner(s) to prospective
purchasers of the properry prior to entering into a sales contract for said propeq.
