described zbove, now, and for the life of this agreement. "Owner" shall include a lessee if the
leasehold includes both the main dwelling unit and the second dwelling unit.
c. The Second Dwelling Unit may only be rented and shall not be sold separatei\r from the main
dwelling unit, unless the lot on which such units are located is subdivided.
d. The Properry Owner(s) agne to rent the Second Dwelling Unit at a monthly rental rate which
shall not exceed an amount equal to 30% of the gross monthly income of a low-income
household, adjusted for household size, at SO% of the San Diego County median income.
e. A copy of this agreement and Affidavit must be given by the Property Owner(s) to prospective
purchasers of the property prior to entering into a sales contract for said propem.

PROJECT DESCRIPTIONEXPLANATION
PROJECT NAME: Village H Second Units
APPLICANT NAME: Toll Brothers
This application is for a Second Dwelling Unit Administrative Permit for second units in Village
H of Rancho Canillo. Five second units are proposed to be developed on any five of the fifteen
lots as shown on the exhibits that accompany this application. All fifteen lots are greater in size
than 7500 square feet and any of these lots will accommodate a second unit. These fifteen lots
comprise the first phase of development in Village H.
Future homeowners will be required to sign an appropriately completed copy of the enclosed
‘City of Carlsbad - Affidavit of Compliance for a Second Dwelling Unit’ at the time of purchase
of each lot that has been developed with one of the five second units. The rental price for each
second unit shall not exceed the rate as established by the City of Carlsbad for a 80% low income
household. Currently, as shown on the chart accompanying this application, this maximum
rental rate is $797.00.
