Hagaman, Planning Director FROM: VP\ Bud Plender, Assistant Planning Director SUBJECT: S.P. 142, EXPIRATION The subject Specific Plan was adopted June, 1974, Ordinance 9392. Condition One indicates that unless construction commences within one year from approval, the Specific Plan becomes null and void. This Specific Plan was extended by Ordinance 9431 to January 18, 1977. Since nothing has been done on the property, the Specific Plan is technically null and void. Very interesting. Since there is no requirement in the zone code on the property that a Specific Plan be in effect prior to development, a building permit may now be requested meet- ing zone requirements (presuming sewer is available). At the time of Specific Plan approval the zone was changed to R-P. There is no statement of contract zoning on the action, Ordinance 9393. The subject property fronts on Elm, located just east of the main Fire Station, with access to Oak. The present property owner wishes a drive-through bank. We should have some site review for this use on this property. I therefore suggest we ask City Council to initiate a zone change to apply Q overlay on this site and any other in the area that may have similar concerns. BP:ms 4/25/79 c: City Attorney
