Mr. Lloyd Hubbs City Engineer City of Carlsbad 2075 Las Palmas Carlsbad, CA 92009 RE: ROAD CONSTRUCTION SPOIL SITE Dear Lloyd: " ~ SDG&E's preference is to make application for the required land development permits that would allow for the permanent placement of the concrete riprap and soil on our property. It is our belief that obtaining a grading permit from the City and a coastal development permit from the State Coastal Commission will be necessary to do this. While it is our preference to do this, our opinion is that it will be impossible to avoid public interest because of the coastal development permit public hearing process. This being of certain potential creates the problem that the City and SDG&E desire to avoid. Therefore, it is our recommendation that the safest course of action is to have the fill material removed from the site. It is our intention to request the City's contractor to perform the removal work given that they dumped the material without obtaining the necessary permits per our direction and City regulations. The willingness of the contractor to do this is unknown at this time. In the event the contractor is not willing to comply with our request, we would appreciate the City's intervention in getting the removal of the material accomplished. Mr. Lloyd Hubbs City Engineer City of Carlsbad 2075 Las Palmas Carlsbad, CA 92009 Dear Lloyd: At our meeting on May 4, we discussed various conditions proposed by the City associated with SDG&E's application for a specific plan amendment to modify our wastewater treatment system at the power plant. The City and SDG&E agreed at the meeting that standard engineering conditions No's 17 and 22 should be deleted. We also explained that SDG&E believes that all of the custom conditions are inappropriate conditions of approval because they have no relationship to the project or impacts created by the project and therefore can not be conditions attached to the approval of the amendment. However, we recognize your concern about providing for necessary future public improvements adjoining our property. In the spirit of cooperation, we are willing to work with you toward pursuit of your objectives by doing the following: 1. SDG&E agrees to consider granting the City additional street dedications along Carlsbad Boulevard and Cannon Road in the event the City approves specific public works projects for the affected area; SDG&E determines the requested dedications are not detrimental to its operations; and SDG&E receives benefits from the City equal in value to the property dedicated. 2. SDG&E agrees to cooperate with City initiated and approved underground projects pursuant to electric rule 20a conversions. We want you to know that as concerned citizens in Carlsbad, we are anxious to cooperate with you and other City represen- tatives regarding your future proposals. As was discussed at the meeting, this is to inform you that any future request for improvement to the Encina Fewer Plant will require a complete major anendment to the Specific Plan processed in accordance with Chapter 21.36 of the Carlsbad Municipal Code. Staff is requesting additional time to research this matter. Box 1831 San Diego, California 92112 RE: ENCINA POWER PLAN SPECIFIC PLAN AMENDMENT Dear Mr. Parrott: I regret that SDG&E has decided, by virtue of your hand delivered letter of May 26, 1989, to make a legal issue out of staff's recommended conditions of approval for the above referenced project. I think it is unfortunate that SDG&E has rejected my suggestion that the policy makers of our respective agencies meet and, as good neighbors, find a common ground. I don't think any useful purpose will be served by answering your letter in detail, however, "for the record" your characterization of the situation and our conversation is not correct. The City is not satisfying any "wish list." I didn't attempt to "justify" anything nor did I ask you to "capitulate." I think your letter demonstrates a "bunker mentality" and a complete failure to understand the situation. Staff's conditions simply ask the company to acknowledge that they will comply with the same obligations of every other property owner in the City of Carlsbad and that is to be responsible for property dedication and improvements to City standards including curb, gutter, sidewalk, paving and underground utilities on their property frontages. Legalities aside, I can't imagine why the company would want to make an issue out of that. Nevertheless, at your request, I will undertake to review the legalities of the two conditions. At a meeting in my office on June 1, 1989 I asked the City Engineer and the Planning Director to transfer their files on the matter to my office for review. Bernstein Governmental Representative North Coast District San Diego Gas & Electric Company 5315 Avenida Encinas Carlsbad, CA 92008 Dear Robbie: As a follow-up to our telephone conversation, the City of Carlsbad has long expressed interest in acquiring, in fee, easement, or other operating agreement, the SDG&E "fishing parking lot" along the east side of Carlsbad Boulevard, south of the Agua Hedionda bridge. It is our understanding that there have been discussions between City and SDG&E personnel for years regarding the concept of improving this area to provide structured beach parking and safer access across Carlsbad Boulevard. With the City's current improvements of Carlsbad Boulevard well underway, it seems that the time is right to reach some conclusion to our discussions in an effort to improve this area and provide increased beach parking. The City of Carlsbad is interested in acquiring the right from SDG&E to improve this facility. Some years ago, engineering plans were completed by the City which would install approximately 116 parking spaces in the lot, parking lot lights, a surrounding concrete sidewalk/walkway, and other related landscaping and safety improvements. The City of Carlsbad's existing permits from the California Coastal Commission and the U.S. Army Corps of Engineers for the Carlsbad Boulevard project could be quickly amended to include these improvements. We believe that substantial public benefit and increased public safety would be derived from a joint City/SDG&E agreement for the improvement of this area.
