Based upon your letter to me outlining the minor specific plan amendment
application requirements, attached are:
1. Minor specific plan application

The colored site/elevation plan requested will be submitted prior to the
Planning Commission hearing as allowed under the application requirements.
You also already have in your possession slides that demonstrate the
visibility of the proposed improvements from Carlsbad Boulevard and the extent
of screening that can be accomplished through site perimeter planting and
painting of the tanks. Painting would involve use of a color that is
compatible with the existing background landscaping. Your staff (Dee Landers)
has photographs of the project site.
Mike, with regard to the Public Facility Agreement, we believe that the
wastewater project should be exempt from payment of the fee because it is an
accessory use to the power plant that has almost no public facility/service
issues associated with its operations. Specifically, its operation places no
burden at all upon police or fire protection services or upon the use of
public facilities such as roads, sewers, storm drains, parks, libraries, etc.
Minor water usage does presently occur for periodic (4—5 time per year)
rinsing down sediment that collects in some of the ponds. This water usage
will significantly decline with the use of tanks. They are much smaller in
size (diameter and capacity) compared to the ponds and they are designed with
the capability to recirculate wastewater to accomplish the rinse water func-
tion.
The intent of Council Policy 17 is to assure that new development that neces-
sitates increased public facility/service requirements does provide financial
assistance for the construction of needed facilities concurrent with need.
This policy recognizes that there are accessory uses to an existing use that
do not necessitate the payment of the fee because they do not cause any
significant public facility/service impacts. Such accessory uses are exempted
under Section 5(b) of the policy. It is our contention that our wastewater
facilities are an accessory use consistent with the intent and meaning of
Section 5(b) and are, therefore, exempt from the public facility fee.

PART A MODIFICATIONS: SAN DIEGO GAS AND ELECTRIC, ENCINA POWER PLANT
(CAT000618900) , AND SOUTH BAY POWER PLANT (CAT000619056)
This is in response to the revised Part A you submitted on June 24, 1988.
You requested permission to replace surface impoundments with the
above-ground tanks at the above facilities as described in Appendix C of the
submittals. This request is part of your effort to comply with the Toxic Pit
Clean Up Act (TPCA) .
The Department approves your proposals for both facilities subject to the
requirements that new tanks will comply with 40 CFR, Part 265, Subpart J.
