Thus, the letter asking for your verification that the proposed building area was in conformance with SP 146-A should be disregarded. We appreciate your cooperation and regret any unnecessary work on the part of the City relating to this matter. We also show Building Area A slightly different than you show on your file copy of the original approved plan. We do not now have a tenant for that Building Area A, but since both Building Areas 4 and A as shown would seem to be noncontroversial and minor changes, we would like to verify that these are minor modifications and that our plans are approved as to those building areas. Nothing shown on this plan shall be intended to modify or affect the specific layout use in relation to provisions of the Specific Plan regarding Building Area 1 . We are now attempting to finalize a lease for a 9,840 square foot building area with Big 5 Sporting Goods on Building Area 4, and if our plan is construed to be in conformance with SP 146~A in accordance with the City's approval and our previous discussions with the City of Carlsbad, we would like verification of this so that we can commence building plans and approval of architectural elevations. Our obvious concern with that building area is to speed up the time frame for commencing construction so that our shop contractor would still be on the site, which would be beneficial to us. EAST SIDE OF EL CAMINO REAL BETWEEN HAYMAR DRIVE AND MARRON ROAD. APPLICANT: AZALEA, INC. 1 ' . ' ' The City Council of the City of Carlsbad, California, does ordain as follows : SECTION 1: A Specific Plan (SP-146A) is hereby adopted to allow the Kelly-Kurlander-Vanderberg Shopping Center project to be constructed in five phases on property located on the east side of El Camino Real between Haymar Drive and Marron Road, more particularly described as: Parcels 1 and 2 of Parcel Map No. 487 as shown on map recorded at Page 487 of Parcel Maps, records of San Diego County, State of California. Also, a portion of Lot 4, fraction Section 32, Township 11 South, Range 4 West, San Bernardino Meridian, said plan to consist of a plot plan marked Exhibit D, dated . January 21, 1975, and an application with attachments on file in the office of the City Planning Department and incorporated by reference herein, subject to all terms and conditions of this ordinance. SECTION 2: Findings. The approval of Specific Plan (SP-146A) is justified by the following findings: 1.. The proposed phasing will not adversely affect the approved Specific Plan, and is in accord with the General Plan. » SECTION 3; Development Conditions. The Specific Plan (SP-146A) is approved subject to the following conditions and restrictions and the development of the property, as described in Section 1 hereof, shall be subject to all such conditions and restrictions which are in addition to all requirements, limita- tions and restrictions of all municipal ordinances and state and federal laws now in force or which may hereafter be in force: 1. The Specific Plans are granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A, dated October 23, 1973, except or unless indicated other- wise herein. 2. Prior to the issuance of any permits, a parcel map outlining parcels shall be submitted.to the City of Carlsbad for consideration and approval. 3. Prior to the issuance of any permits, abandonment proceedings shall be completed on Osuna Drive or an encroachment permit must be obtained. The encorachment permit shall be temporary in nature only and may be utilized only in conjunction with vacation proceedings and pending their completion. 4. Except for approved accesses, all vehicular access rights to public streets should be dedicated to the City of Carlsbad as a part of the consideration of any parcel map. 5. The developer shall be required to install in a manner acceptable to the City Engineer any necessary improvement to provide for protection from potential flood- ing, including a desilting basin at the beginning of con- struction, or thereafter as required by the City Engineer. 6. Storm drains shall be constructed in a manner acceptable to the City Engineer in conformance with the City's master drainage plan. 7. No development shall occur until sewer capacity is available in the Vista trunk line or other provision acceptable to the City Engineer is made to provide sewer to the subject property. 9. Upon availability of sewer capacity, the developer shall install a sewer line to serve the subject property which shall be compatible with the City's Master Sewer Study for the area and does conform to City standards. 10. Haymar Drive shall be dedicated and improved to City standards on the basis of a 40-foot curb-to-curb street section. , 11. Marron Road shall be dedicated and improved to City standards on the basis of an 84-foot right-of-way width for the full frontage of the subject property. 12. The developer shall.participate in the construc- tion and/or revision of the traffic signal system on El Camino Real to accommodate the subject development. 13. Unless the construction of the structure or fac- ility is commenced not later than one year after the date the approval is granted and is diligently pursued there- after, this approval will automatically become null and void. 14. Any minor change may be approved by the Planning Director. All requirements of any law, ordinance or regula- tion of the State of California, City of Carlsbad and any other governmental entity shall be complied with. 16. No signs or advertising of any type whatsoever shall be erected or installed until plans therefor have been approved by the City of Carlsbad. Prior to issuance of any permits for signs, a sign program for the total development shall be submitted to the Planning Commission for consideration and approval. Said sign program shall conform to the City's sign limitations in effect at the time of development. Said development for sign purposes shall be considered a single development. 17. All areas shown as parking areas shall be sur- faced with asphaltic concrete and shall be visibly marked outlining individual parking spaces and traffic flow. Said surfacing and marking shall be completed prior to final inspection of the structure or structures by the Building Department. The surface shall be kept in a reasonably good state of repair at all times. Parking for the total development shall be provided on the basis of a minimum of one parking space for each 400 square feet of gross floor area. 18. Prior to obtaining a building permit and within 30 days hereof, the applicant shall file with the Secre- tary of the Planning Commission written acceptance of the conditions stated herein. 19. Compliance with and execution of all conditions listed hereon shall be necessary, unless otherwise speci- fied, prior to obtaining a final building inspection clearance. Deviation from this requirement shall be per- mitted only by written consent of the Planning Director. 20.. Any mechanical and/or electrical equipment to be located on the roof of the structure shall be screened in a manner acceptable to the Planning Director. De- tailed plans for said screening shall be submitted, in triplicate, to the Planning Director. 21. The lighting of all signs shall be accomplished in such a manner that there shall be no reflection on adja- cent property owners or hazardous to motorists. 22. Said landscaping shall be provided in the following manner:' (a) A perimeter planter of a size of 10 feet wide shall be provided,except for approved openings, adjacent to all public streets. (b) A minimum of 5% of the total parking areas shall be landscaped. Said areas shall be so located as to break up the massive expanse of paved area. (c) The sum of all the landscape areas shall not be less than 15% of the total net land area. (d) Concrete curbing shall be provided for plant- ers located in parking areas. 23. Prior to final building inspection clearance for each phase, all landscaping shall be installed. Said landscaping shall, at all times, be maintained in a manner acceptable to the Planning Director. 24. All utilities,including electrical, telephone and cable television, shall be installed underground and/or shall be completely concealed from view. 25. All public improvements shall be made in conform- ity with the City of Carlsbad Engineering Design Criteria and other City standards, and the Subdivision Ordinance to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encum- brances. Improvement plans for water and sewer systems- shall meet the requirements of the respective service districts. 26. The architecture of the development shall be of the Hispanic character as established in the scenic corri- dor along El Camino Real. Building elevations shall be submitted to the Planning Commission for consideration and comment prior to any development. 27. Phasing of SP-146A shall be according to those phases numbered A through E as shown on the plot plan labelled Exhibit D, dated January 21, 1975, on file in the Planning Department. 28. ' : (b) Construct complete storm drain from Marron Road to downstream connection to existing drain, subject to approval of City Engineer, and dedicate easements from same. (c) Construct complete public improvements (including curb, gutter, sidewalk, any additional fire hydrants and mission bell street lights) along entire El Camino Real frontage. (d) Extend all utilities, including sewer and water, required for ultimate development and dedicate easements for same through Phase A. (e) Construct public improvements at Marron Road entrance. (f) Waiver direct access rights to El Camino Real and Marron Road except at entrances shown. • Phase B: (a) Construct complete public improvements along entire Marron Road and Haymar Drive frontage. Access to Haymar Drive from El Camino Real shall be right turn-in and right turn-out only. (b) Construct all water and sewer lines and dedicate easements for same. (c) Redesign and revise existing intersection improvements across from Phase B access to El Camino Real to integrate traffic movements across and onto El Camino Real. Such work shall include rechannelization, restrip- ping, signal and utility relocation as approved by the City Engineer. (d) Convert Phase A access to El Camino Real to right turn-in and right turn-out only. The Building Department shall not approve any building for occupancy until the Planning Director has certified that all the conditions of this ordinance have been satisfied. EFFECTIVE DATE; This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adop- tion. The circulation and ingress-egress problems for this development are so touchy that I would be very reluctant to approve a change without a D.C.C. review. Lets discuss. The Santa Anita Development Corporation has requested a modi- fication to their commercial development proposed at the east side of El Camino Real between Haymar Drive and Marron Road. Planning Director Don Agatep reviewed this request and deter- mined that it was minor in nature and would not need a public hearing. The reasons for this decision are that the changes are detailed modifications necessitated by final site plans and there are no changes to the basic parking layout and basic circulation system. Staff has submitted the plans to the Commission for your in- formation because you will be reviewing design criteria in the future for each building and a sign program for the entire site The modifications are on buildings one through six as in- dicated on the attached plan. Staff will have available at the meeting a copy of the approved plan for your comparison. No action is needed by the Planning Commission. A brief explanation of each sub- mi ttal follows: Site Plan Review We are submitting the enclosed 10 prints of the site plan for review by the Planning Commission. It is our position that the revisions are minor and with the Planning Commission's approval we would expect the Planning Director to so certify, as per Ordinance No. 9419, Item No. 14. The only changes in this plan, as compared to the plan submitted to the Planning Director previously, are a reduction in the size of building number 5 and the addition of a drive-thru lane for building number 1, McDonald's. An earlier version of this plan was sub- mitted to the Engineering Department for review. The current plan responds to all of the concerns expressed by the Engineering Department, both in their letter of May 13, 1976, and in previous discussions. Our program is a comprehensive, coordinated attempt .to control all signing for the betterment of the entire Center. Colors, materials, sizes, and styles shall all be controlled as per the plans and specifica- tions which we are submitting. Box 33326 San Diego, CA 92103 Attention: Ron Roberts Dear Ron: We have received and reviewed your modification of the proposed drive-through restaurant facility site plan at the Carlsbad Plaza and find the geometries greatly improved from the first submittal, However, we still have several objections to providing drive- through service at this location: 1. No safe walkways have been provided for pedestrians. Only 13 parking spaces will be adjacent to the restaurant (all the pede- strians from vehicles parked in these will have to cross through the drive-through traffic), which means most of the foot traffic from parked vehicles will have to cross a main aisle of shopping center traffic. 2. The drive-through lane itself eliminates most of the parking that could be adjacent to the restaurant. 3. The traffic data you sent us substantiates our position that this type of restaurant facility generates large volumes of ve- hicular traffic. The plan states the restaurant will be 4,065 sg. ft., but the dimensions indicate 2,574 sq.ft. Even with the lower gross area this facility should generate more than 2,000 veh./day with peaks of more than 300 veh./hour. 4. No turn-out openings have been provided in the drive-through lane, which would create problems in emergencies, or if any ve- hicles stalled or ran out of fuel. Schoell, Geritz, Paul and Allard, Inc. Drive-through service at the proposed restaurant location in the Carlsbad Plaza is unacceptable for the following reasons: 1. Pedestrians will constantly have to contend with moving ve- hicles. 2. In order to provide adequate storage for drive-through vehi- cles, too much regular parking would be eliminated. 3. The turning radius for vehicles turning from the entrance of the shopping center into the drive- through lane has to be 25 feet. 4. The drive-through entrance would create too many hazardous turning movements if it is located close to the shopping center entrance (especially if backed-up vehicles block the through movements of the other shopping center traffic.) 5. El Camino Real is a scenic route, and all the vehicles stacked in the storage lane would be a real eye-sore as would the proposed trash storage area. 6 . No data has been made available for the amount of drive-through traffic that would be generated by this type of facility (espe- cially if it were a McDonald's). 7. There should be turn-out provisions in the drive-through lane for special orders or emergencies. 8. The area appears too small for all the proposed facilities. The City will allow Santa Anita Development Corporation to provide the required public improvements along Haymar Drive for both Parcels 1 and 2. The scope and design of these improvements will be determined after a review by the City Engineer and the Developer. A cost estimate will then be prepared. The improvements will be covered by an acceptable agreement between the City and Santa Anita Development Corporation, possibly cash deposit or bonding. 2. The City will request that the Owner of Parcel 4 sign an agreement for future improvements. This will be the stan- dard City agreement with possible minor revisions. These revisions would condition the issuance of any building per- mits on agreements guarantying the concurrent construction of the required public improvements. 3. Santa Anita Development Corporation will apply for a Special Use Permit to allow construction of the shopping center in the flood plain overlay zone. The City Engineer recognizes that the Army Corps of Engineers maps show the property not to be within the 100-year flood plain, and therefore it does not properly belong in the flood plain overlay zone. At a future date Santa Anita Development Corporation will file for a rezoning to remove the propert] overlay zone. The Floodplain Overlay Zone requires the issu- ance of a special use permit prior to the issu- ance of building permits. The purpose of the permit is to ensure that structures are made safe from flood damage. In the case of the Carlsbad Plaza Shopping Center, the City Engineer feels that the grading which recently occurred on the site, and which has been designed for'the project, may have removed the project site from the Flood- plain. I would therefore suggest that you apply for a change of zone to remove the site from the Floodplain Overlay Zone. I am enclosing a Change of Zone application for your use. If you wish to pursue this change of zone, I would suggest you talk with the City Engineer about the extent to which the site may be removed from the Floodplain The site of the permanent Bank of America appears to be within the Floodplain Zone. Building permits for this structure will not be issued until a special use permit for the building is issued, or until the Overlay Zone is removed from the site. Because continued use of the temporary Bank of America is predicated on approval of building per- mits by June 30, 1976, you may wish to work with Continental Services Corporation on this matter. Bussey, City Manager City of Carlsbad 1200 Elm Avenue Carlsbad, California 92008 Re: PS 230, Carlsbad Plaza Dear Mr. Bussey: We have encountered a major roadblock in the potential development of the Carlsbad Plaza shopping center, which is that property included within Parcels 1 and 3 of the above referenced Tentative Parcel Map and which was considered along with Specific Plan 146. Our company's present interest is for the development of that shopping center on which we are now in plans, as you are aware. We do not have, nor will we have, any interest in Parcel 2 of that map, which is the Azalea property located to the east. We have an Option Agreement on what is Parcel 4 of the Parcel Map with Mr. Vanderburg, but as yet do not have our plans in sufficient form to apply to the City for the necessary governmental approvals, although we hope to have them in such form shortly. The staff of the City has been most cooperative in working with us towards the development of this project, but the improvement agreements which have been submitted to us require improvements on the properties which are not ready to be developed now. Such requirements stand in the way of our proceeding on the portion which we do wish to develop and in which we are quite willing to install the required improvements. Unfortunately, this has now reached a state of urgency in that we must exercise our option to ground lease the subject property from Azalea (and effect concurrently our Development Agreement with Home Federal on the Vanderburg-owned Parcel 3). In addition to the problem of the requirements for the recordation of the Parcel Map, we have two problems which the timing of the Parcel Map affects. We would like to take this opportunity to elaborate on this matter. As previously mentioned, due to financial difficulties which have been encountered to develope the total center at one time, our client is desi- rable to obtain permission to construct this project in phases. While the phasing plan denotes the phasing by alphabetical letters, it is not known at this time in which sequence the phasing will be performed, except that phase "A" is to be first. Permission is therefore desired by the developer to construct the project in the phases indicated with only the portion of the conditions imposed by Planning Commission Resolution No. 1009, which are directly attributable to each phase being built In concurrence therewith. An example of this would be that for phase "A" the improvements on Haymar Drive would not have to be constructed but would later be built in conjunction with phase "B". In order to present a more complete analysis on this matter we have enclosed a copy of the resolution and have outlined the1 desired phasing effect for each item below: 1. Permission is requested for phasing of the approved specific plan as shown on the phasing map. 2. The parcel map will be submitted for consideration, however it is desired that the construction and building permits be granted upon the submission of the parcel map with the occupancy permit being defrayed until after the map records. This will enable the construction to commence sooner than having to wait for the recordation procedures and the City will still be assured of the map recording prior to the issuance of the occupancy permits. The revised specific plan has been submitted arid approved. 5. At this time the only known location of access points are for phase "A". It is requested that the access rights be dedicated at this time for the phase "A" portion with the remainder of Haymar and Marron Rd. to be dedicated at the time the corresponding phases are developed. 6 & 7- It is requested that storm drain facilities be installed for the phase "A" portion only at this time, with the remainder being constructed with the corresponding phases. Phase "A" facilities shall be designed to be sufficient to disperse the storm water properly during the interum of the phasing and for the future storm drain connections to be made in conjunction with the future phases. 8. Requested to be done in conjunction with phase "B" and not as a condition of phase "A". 9 & 10. Phase "A" is desired to connect to the existing main in Osuna and El Camino Real. The remaining phases are to connect to the Vista trunk line except that phase "C" may connect to either system, depending upon the scheduling of the phase construction. 11. The portion of Marron Rd. appurtinent to phase "A" is all that is desired to be constructed at this time with the remainder to be built during phase "B" or "C". 12. Haymar Dr. to be constructed during phase "B". 13. Signal and island modification are desired to be built during phase "B". For phase "A" existing islands are to remain as theypresently are with no signal required for this stage. One-half of the main entrance drive is desired to be built at this tome with phase "A". We feel that the amount of traffic generated and the traffic pattern from the bank and savings building in phase "A" do not warrant the island modification or signal installation at this time nor should this phase be burdened with the additional cost for this installation, which would better be necessitated by phase "B". 14. Phase "A" is to commence as soon as permits are available. The remaining center is to be built in phases. If possible a time period of more than one year is desired for the remaining phases. 15. The only minor change thus far anticipated are the phasing of the project and the addition of the exit from the bank parking area to the entrance drive to the south thereof as shown on the phasing plan. This exit from the parking area will be designed in a manner to be used for parking egress only. 16. To be complied with. 17. Signing to be by phases. 18. Total site to be done by phases with each phase to comply with requirements either on its own or in conjunction with phases previously constructed. 19. Written acceptance to be filed. 20.
