Members of the Council :
We would like this letter to serve as our formal request that
the City Council consider an appeal of Planning Commission
Resolutions No. 1360 and No. 1361. These resolutions relate
to the specific plan amendment for Carlsbad Plaza and to the
Conditional Use Permit for the McDonald's restaurant on the
same site.
We are submitting this letter in accordance with the procedural
information we were given by the Planning Department. If any
additional information is required, please contact me at your
earliest convenience. We would appreciate the scheduling of
this item on the Council agenda at the earliest possible date.

SUBJECT: Proposed Sambo's Restaurant
I have reviewed the plans for the proposed Sambo's
Restaurant located within the shopping center in terms
of the relationship with the approved Specific Plan.
In the approved Ordinance 9419 Condition No. 14 indicates
that minor changes can be made by the Planning Director.
The proposed Sambo's contains the same number of parking
spaces and no increase in square footage than the commercial
structure approved in the original Specific Plan although
the building configuration and parking are different.
My determination is that this minor change can be processed
without returning the entire Specific Plan to the Planning
Commission for the amendment review. It should, however,
be noted that the building elevation of the proposed restaurant
(Condition No. 26) would have to be submitted to the
Planning Commission for consideration and comment prior to
any development. The building elevation will be considered
on the basis of its relationship to the Hispanic architecture
required for the area.

SUBJECT: Sewer Allocation System - Carlsbad Plaza
North - SP 146
The architect for Carlsbad Plaza (East side of El Camino Real
between Haymar and Marron) has submitted the attached letter
requesting to discuss a particular problem that is not clear
in the sewer allocation system.
The allocation system requires that all discretionary action
be completed to apply for allocation rating. The subject
shopping center has been approved by SP 146 and is over 60%
completed. One site not complete is on the north side of the
main entrance drive and El Camino Real. (McDonald Restaurant
was denied). The SP shows the site as commercial building.
The applicant has a tenant for the site, but the tenant does
not wish the building configuration as shown on the approved
SP and wishes an amendement to the SP to change the building
configuration, landscape and parking layout. The overall on-
site traffic pattern will remain basically the same.
The question, therefore, is, Does the original approval suffice
as meeting the intent of the sewer allocation program or does
the amendment mean that discretionary action is not complete?
The applicant suggests two alternatives for the City Council.
One is to apply for sewer allocation subject to completion of
the SP amendment. If seweri. and SP were granted, the building
could be built. If neither are granted, the building cannot
be built. If sewer were granted and the SP was continued any
length of time or denied, the City would have granted sewer to
a use that could not qualify under the terms of the allocation
system. The applicant feels this amendment would be processed
relatively easily since the proposal meets Staff's general ap-
proval. This is true for the preliminary review, but the final
decision is made by City Council at a Public Hearing.
The second alternative suggested by the applicant is to consider
the change minor and not require a SP amendment. Staff is not

prepared to discuss the change in the plan in detail, but would
indicate that it is the key site >at this shopping center as it
relates to traffic and visual appearance and therefore believe
all but the most minor change should be made through SP amend-
ment. The preliminary plans are in Staff's view major and re-
quire SP amendment.
The tenant is a restaurant which normally has greater sewer
demands and traffic input than general retail. Since the SP
only indicates "Commercial", a restaurant should be reviewed
in more detail than a minor change.
If application is made for amendment, the earliest it could be
processed by the Planning Commission would be December 28 or
possibly January 11. This would mean City Council action in
late January. The sewer allocation system acceptance closes
on November 28 with decision to be made the end of December.
Therefore, sewer would have to be allocated prior to amendment
decision.
RECOMMENDATION
It is recommended that the City not accept application for sewer
permit for a restaurant at Carlsbad Plaza because discretionary
action cannot be completed prior to granting allocation.

SUBJECT: Proposed Marie Callender's Restaurant in the
shopping center located south of Marron Road

The Planning Commission has previously approved Resolution
1359 for the proposed shopping center on this site. It
was indicated at the time of approval that a site was
reviewed for a restaurant but no specific configuration or
design of the building was available. The restaurant is
a different shape than the commercial structure shown on the
plans; however, it has less square footage and therefore
in my opinion is not a significant variation from the
intended proposal of the site plan approved by the Planning
Commission. There was some redesign of parkingin the
number and relocation of parking spaces which should in
my opinion be reviewed and approved by the Planning Commission
for possible effects on the circulation patterns.

Dear Paul:
The deadline for submitting applications for Sewer Application
Permits is November 28, 1977. A question has developed regard-
ing the processing of an application for the proposed Sambo's
Restaurant. The Planning Director, Jim Hagaman, has recommended
that we obtain clarification from the City Council at this even-
ings meeting. He suggested that the item be considered under
"Oral Communication" .
The question relates to the processing of a Sewer Application
Permit concurrent with the processing of an Amendment to the
Specific Plan. Since the Amendment must be considered by the
City Council and the Planning Commission, the time required
would not allow us to complete the process prior to the November
28th deadline.
There are a number of actions that the Council could take which
would allow us to submit for a Sewer Allocation Permit. Since
the proposed revision does not involve a Conditional Use Permit,
the Council could permit us to apply for the Sewer Allocation
Permit, subject to the completion of the Specific Plan Amendment
process, if the Allocation were granted. Another approach would.
be for the Council to indicate to the Planning Director that the
requested change is minor and therefore exempt from the review
process.

Paul, as you know, we have been working with staff for several
weeks, on an informal basis, to obtain their support for the
development of this remaining building pad. Unfortunately, the •
prolonged hearings on the proposed McDonald's prevented us from
developing this area at an earlier date. The staff has indicated,
however, that they are in favor of the proposed change and the
layout meets with their general approval.
Finally, unlike Carlsbad Plaza South, the development of this
pad cannot be accomplished with septic tanks because of the soil
conditions, the ground water level, and the proposed use. We
are therefore dependent on the upcoming Sewer Allocation Program
if we are to develop this area.
We would appreciate a chance to discuss this situation with the
City Council at this evenings meeting. Thank you for your con-
tinued cooperation.

Dear Paul:
Earlier this week, Bill Hughes and I met with Jim Hagaman and
Bud Plender of the Planning Department. As a result of that
meeting, we are requesting your permission for the Planning
Department to accept our revised site development plan and our
tentative parcel map for processing. These two items are unre-
lated and should be considered separately.
The first item is for a revision to the existing site develop-
ment plan in the area of Building No. 7, the.proposed restau-
rant. We are currently negotiating with Marie Callender's
restaurant and would like to revise the approved plan to re-
flect their building layout. The net effect is a slight reduc-
tion in total building area and a slight change in the parking
layout. With your approval, the planning staff will accept the
plan and attempt to have the Planning Commission review it prior
to the November 28 sewer allocation permit deadline. Since this
is a non-public hearing item, we are hopeful it can be processed
promptly.
Our second item is somewhat more complicated but fortunately our
timing is not as critical. This item relates to our desire to
file a parcel map which would divide the property into two par-
cels. The proposed division would occur along the zoning line
which separates the C-2 area from the R-P area. The processing
of this map would allow us to resolve certain financing problems
that we have with this development. Since we have an approved
site development plan which includes the entire site, the proces-
sing of this parcel map would not change our situation with re-
spect to the sewer moritorium or the allocation program.

KFC is interested in building a retail fried chicken store on the
subject site but before proceeding further request an indication
from the City of Carlsbad on acceptance of our building.
The building would be similar to that constructed at 745 Elm Avenue.
As you know, KFC caters to the family take-home market and as a
result does not generate the traffic as does other fast food chains.
We solicit your comments as soon as possible and thank you for your
anticipated positive response.
