Job No. 7584A
Dear Paul:
The City Council is scheduled to hear the appeal of the
Planning Commission's denial of CUP^-136 and SP-146, the
McDonald's Restaurant and related specific plan revisions,
on June 7, 1977.
Jim Federhart, our traffic consultant, will not be
available for that meeting. Since traffic considerations
are of major importance, we would like this letter to
serve as our request that the meeting be postponed until
June 21, 1977.
Your cooperation in this matter is appreciated.

Members of the Council:
We would like this letter to serve as our formal request that
the City Council consider an appeal of Planning Commission
Resolutions No. 1360 and No. 1361. These resolutions relate
to the specific plan amendment for Carlsbad Plaza and to the
Conditional Use Permit for the McDonald's restaurant on the
same site.
We are submitting this letter in accordance with the procedural
information we were given by the Planning Department. If any
additional information is required, please contact me at your
earliest convenience. We would appreciate the scheduling of
this item on the Council agenda at the earliest possible date.

Proposed Council Resolution
SDP 77-2
Dear Mr. Bussey:
As we discussed, I am concerned that the proposed resolution to be adopted by the
City Council perhaps does not read 100% in conformance with what I understood
the Council to direct in the passing of the motion. Maybe there has been a mis-
understanding, but this was the one area with which I was most concerned as you
were aware, and 1 asked for clarification of the Council's position on that point
at the City Council's meeting last Tuesday night.
The resolution as now written would permit the elimination of either one of the
two driveways, whereas I believe the Council, in specific response to my voiced
concern, approved the motion in accordance with Dr. Packard's discussion and
intent that the driveway to be eliminated could be either of the two driveways
as determined by the developer/owner (in response to my suggestion that it be the
southerly of the two northerly most driveways which could be eliminated if a
problem arose.)

Your consideration of this matter would be appreciated in that to eliminate
the northerly most driveway would jeopardize some of the transactions with
our tenants - specifically Handyman - who are concerned with adequate
access.
Yours very truly,
