Dear Sirs:
In reference to the proposed "Zoning Change" of Lot #185 La Costa
South, Unit #1. I would like to voice my objections.
Many people, including myself, have purchased property and have
built homes to live in La Costa because it was a new and planned
Community. Now we find, while still in its' undeveloped stage
with every chance to mature in the right direction, the first
atempt of "Rape" is being made on its' Zoning.
How the Commission acts on this attempt will set a pattern to
encourage or halt all other developers in this area.
We have located in La Costa after living and experiencing the
same style of "Zoning attempts" in Florida as witness the
complete destruction of the natural beauty of the East Coast
of Florida, where mile after mile of High-risers now exist..
We have experienced , over crowded roads , crowded schools ,
Hospitals, Parks plus Inadequate Police protection, Ambulance
and Fire Equipment to handle any of these High Rise Units .
A colorful presentation was always made but never did the
finished product, resemble the Artists Rendition.
I sincerely feel an obligation to contact all of my representing
Officials, the local Newspapers, Neighbors, Organizations and my
Attorney to endeavor to halt this change in the Zoning.
With all of the available land In La Costa yet un-used, there
appears to be absolutely no need for the change in the existing
Zoning rules that were in effect when I and my neighbors purchased
our property. The owners of Lot #185 La Costa South, were well
aware of the Zoning Restrictions when they purchased their property
and this definately is not a hardship case. The re-zoning of
this property would devalue all the property in the area and
force a hardship on the present owners.

It has been brought to my attention that the LaCosta Land Company is
requesting approval of a Specific Plan (SP-151) which permits an increase
in the building height limit from 35 feet to 88 feet.
I wish to firmly object to this plan for two reasons:
1. The construction of a building of this magnitude could cause a view
blockage of many surrounding lots. Many of these lots were purchased
as "view" lots and any change in this status could mean a financial
depreciation of considerable magnitude.
These losses would not be for the general welfare of the area but strictly
to allow the owners of the property in SP-151 to realize a greater
profit on their investment. I fail to see the justice of this.
2. The notice I read announcing this request indicates that the LaCosta
Land Company is playing a significant role in this endeavor. I wonder
if this is the same LaCosta Land Company which sold all of the lots
they are now threatening?
If things are as they appear on the surface, then the ethics of the motives
of the LaCosta Land Company are questionable.
They certainly have considerable acreage left to sell in the LaCosta
Community and one would certainly have to pause before recommending
any investment here when it could be jeopardized by the very group that
is selling it.
My property overlooks the site in question and as such I am vitally interested.
Business, out of state, prevents me from attending the public hearing but I
would like to be on record as being strongly opposed to approval.

Gentlemen:
I wish to Thank you for the opportunity to present our
assessment, as property owners, of the request by Mr. LaCava
to Increase the height from thirty five feet to eighty eight
feet. While I and my neighbors were not in accord with your
decision we bow to your decision and trust that as Public
Servants you have weighed all the presented facts and with all
good conscience voted with the Interest best served to all
concerned. While I personnally, will have to live with your
decision, It is not the decision I find fault with but the
treatment accorded me and others while attending the hearing..
It was my personal feeling that I approached the situation as
a gentlemen but I am not used to being approached in the manner
that Mr. Dominquez. , found necessary. I presume that Mr.
Dominquez, considers himself in a very high esteem, I consider
his postilon to be of dignity and appreciate the same accorded
to any man who approaches the Planning Commission. As a
Citizen of this Country and of the State of California and
a resident of Carlsbad, I was exerting my right and so were
my fellow men, to express our opinion, if Mr. Dominquez, did
not agree with me or anyone else, so be it but retain our
dignity as a right along with our right to be heard. There
Is a way to approach one and a way to degrade an opinion and
Mr. Dominquez, chose the later. It is my sincere feeling that
if I am ever called upon to present an opinion again before
the Carlsbad Planning Commission, that I may leave with a
feeling of satisfaction that my expression was at least given
an equal consideration.

Department, dated January 16, 1974, showing where you are opposing
the above project.
I am not trying to change your opinion or your feelings on this Specific
Plan, but I would like to point out some misunderstanding relative the
owner and La Costa Land Company.
The newspaper notice of public hearing stated the application was sub-
mitted by La Costa Land Company by LaCava. The misunderstanding is

SUBJECT: Flood Hazard Report for La Costa Views CT 73-60
We acknowledge your letter of 17 December 1973 with request for
comments.
This subdivision is located on the south side of La Costa Avenue.
We have investigated the property and it is our opinion that this
property is reasonably free of a 50-year flood hazard from external
sources.
It is recommended that the following conditions be included in the
Resolution of Approval:
1. All drainage easements shall be improved by a culvert or drainage
channel of adequate size, whichever is required by the San Diego
County Department of Sanitation and Flood Control. Where a
drainage channel is required, such channel shall be lined with a
suitable material as specified by the County Department of
Sanitation and Flood Control. All easements shall be monumented
along property lines at locations approved by the County Department
of Sanitation and Flood Control. An access easement shall be
provided to each drainage system maintenance access point not
directly accessible from a public roadway; said access easement
shall be paved and aligned to the satisfaction of the County
Department of Sanitation and Flood Control.
2. Additional drainage easements and drainage structures by provided
or installed as may be required by the County Department of.
Sanitation and Flood Control.

3. All surface waters originating within the subdivision and all
surface waters that may flow onto the subdivision from adjacent
lands shall be disposed of by a drainage system satisfactory
to the County Department of Sanitation and Flood Control.
Please send us a copy of the resolution when it has been approved by
your Planning Commission.
