Dana Hield, originally were subpenaed in the above action to appear in the Long Beach Municipal Court on April 15* In my letter to you on that date, I advised that the trial had been continued until Jane 2, J976. Unfortunately on June 2 there were not any court rooms available and the matter has been continued once again for trial to Thursday, June 24 at 0:00 a. m. in Department 9 of the Long Beach Municipal Court, on which date the case will definitely commence trial. BOX 7646 March 25, 1976 Mr. Paul Bussey, City Manager City of Carlsbad Carlsbad, California Re:Grossgold Associates, Inc., etc. vs Pacific Property Trends, etc., et al Long Beach Municipal Court Case No. 194589 Dear Mr. Bussey: I am an attorney representing Ralph Irwin, Carl Seiersen, Pacific Property Trends and Poly Optics, Inc. , all of whom are defendants in the subject lawsuit. This litigation was commenced by Grossgold Associates, an architectural firm, suing the above mentioned defendants for money relating to work done on an apartment unit located on Lot "l", Rancho Agua Hedionda in the City of Carlsbad. The trial is scheduled for April 15, 1976 in Department 5 of the Long Beach Municipal Court. In order to present a proper defense on behalf of my clients, it is necessary that Donald Agatep and S. Dana Hield testify in that trial concerning the plaintiff's dealings with the City of Carlsbad Planning Department. In my opinion these are indispensable witnesses, and I would appreciate your cooperation in allowing them to testify. I will make every effort to see that they spend as little time in Court as possible so as not to interfere with their employment with the City of Carlsbad. I am in the process of having subpenas served on the above named individuals. Poly Optics, Inc. 1815 East Carnegie Avenue Santa Ana, California 92705 SUBJECT: SP-158 "Marina Shores" Dear Ralph: This letter is to inform you that the Planning Director has deter- mined that your project known as "Marina Shores" may have a significant effect on the environment within the meaning of the Carlsbad Environ- mental Protection Ordinance of 1972 and the California Environmental Quality Act of 1970. We would like to have you submit an E.I.R. which discusses the effect of the project on the Agua Hedionda Lagoon environment. There are many environmental considerations which are irrelevant to your project (e.g., impacts on wildlife and vegetation and need not be included. We would , seismicity, climate, etc.), require the following information: (1) The impacts of the project on the lagoon (changes in run-off, siltation, and human activity); (2) The impacts of grading and changes in land formation, including grading which has already occurred on the project site; (3) The effect of the project on the scenic vista from Park Drive; (4) (5) The scale and adjacent land the project); intensity of the uses, (including project in relation to vacant land to the East of The effect other p You F T ect of the project in stimulating development of roperties around the lagoon. are, of course, free to choose your own consultant to prepare the R. There are several firms in the Orange County area which we have had experience with or knowledge of that are capable of preparing the type of thorough, objective E.I.R. which we desire. I would be happy to suggest some names if you so desire. I can discuss our E.I.R. requirements and the types of information we desire with you or your consultant. We will need 15 copies of your draft E.I.R. so that they may be sent to reviewing agencies. There is a 30 day review period after completion of the preliminary E.I.R., so I would suggest that you have your draft information submitted as soon as possible, You do have the right to appeal the decision to require an E.I.R. within 10 days.
