PLACE: Council Chambers COMMISSIONERS CALL TO ORDER . ROLL CALL Commissioners Dominguez, Fikes, Jose, L'Heureux, Wrench Commissioner Watson APPROVAL OF MINUTES AND RESOLUTION The minutes of March 11, 1975 were approved with the following changes: Line 5, Page 2, should read William R. Brasher Line 11, Page 4, should read Horace Felkins Resolution No. 1142, S. L & B Service Corporation, was approved with the following change: Line 17 should read ."The proposed map is not consistent with the Circulation Element of the General Plan " WRITTEN COMMUNICATIONS . . ' Planning Director Don Agatep mentioned that written communi- cations all had a connection with items on the agenda and would" be discussed at that. time. ORAL COMMUNICATIONS None Planning Director Don Agatep suggested the items on the agenda be changed to expedite the meeting.. Item 6 should be third, item 5 should be fourth and item 3 should be fifth. The Commission accepted this order of priority. Present Absent PUBLIC HEARINGS . . .Continued 1.. Case Mo. V-248 - Albert J. and Jean Freiburner - Request for approval-of a Variance to reduce minimum street front- age from 60 ft. to 20 ft. for a proposed panhandle lot on R-l property located on the north side of Magnolia Avenue between Adams Street and Highland Drive. After hearing the explanation that neither of the appli- cants could be present at this meeting and had requested .a continuance to April 8, the Commission voted unanimously to continue this item. Planning Director Don Agatep noted that staff is conducting meetings with property owners of the block in which the applicant's property is located to consider future purposes for development. A full report on these meetings will be made at the continued public hearing on April 8. _ 2. Case No. SP-166 - Papagayo Developers/Larry D. Hunts - Request for approval of a Specific Plan to allow the con- struction of 130 units as an extension of an already approved Specific Plan consisting of 218 units on property] located on the north side of Aqua Hedionda Lagoon between 1-5 and the Santa Fe Railroad Right-of-Way. Case No. CT 74-25 - Larwin-San Diego, Inc. - Request for approval of a 211-lot tentative subdivision map over 47 acres located on the east side of El Camino Real between Elm Avenue and Marron Road. At the applicant's request, the Commission voted unanimously to continue this item to April 22, 1975 PUBLIC HEARINGS - CONTINUED Motion Ayes Absent New 4. Case No. CUP-107 - David and Olivia Maldonado - Request for approval of a Conditional Use Permit to allow con- struction of a greenhouse using sheet plastic on property located at 1590 Basswood Drive. Assistant Planning Director Bud Plender gave staff presentation, .explained graphics and recommendation for approval as outlined in the staff report. Mr. .Plender explained that the nearest residence.was approximately 140 ft. from the greenhouses. Approving a greenhouse would help preserve agricultural lands. The only.problem with this application is that the City ordinance limits building coverage on "R" zoned property to only 40% and the applicant's plan shows building on approximately 70% of the lot. Therefore, one of the conditions of the Conditional Use Permit would have to specify building coverage on only 40% of the lot. The question was raised pertaining to condition #5, • - what does staff envision in the way of periodic review to keep plastic greenhouses in repair. Mr. Plender explained that this would be simply by way of . neighbor's concern. With this condition spelled out, the City would have the leverage to act if there was a complaint; whereas, without the condition the City would have no way of requiring the applicant to comply other than requiring a new public hearing.» Phillip G. Espinoza, 1026 Hermes, Leucadia, spoke for the applicant's concern regarding the 40% building coverage restriction. A discussion followed on .whether to hear the application this evening in order that development would be feasible on the 40% and what avenues might be open to the applicant. . Condition #4 regarding the view-obscuring fence or hedge was discussed, also. The question was asked whether the applicant could use a ground cover over the balance of the lot to start his plants in order to give the Commission and. applicant time to proceed further, and the answer was no. V*\cr> W' private road with ,the name "Arenal Lane". Assistant Planning Director Bud Plender explained that after this Variance request was submitted, it was discovered that Arenal Lane is a private street, not a City street. In reviewing the zoning ordinance, the City requires a Variance from City streets only. Since the Home Owners Association would be the only regulating body, staff recommended allowing the applicant to withdraw his request with return of full fees. . After hearing the explanation that this Variance request is for a setback requirement where the front yard abuts a private road, it was moved and unanimously approved to allow the applicant to withdraw his request and refund full filing fees. Case No. SP-166 - Papagayo Developers/Larry D. Assistant Planning Director Bud Plender explained that we have received a letter from the applicant requesting a thirty "day continuance. Staff also feels a thirty-day continuance is in order inasmuch as more input is needed from the Coastal Commission. It was moved and unanimously approved to continue this item to March 25, 1975. 'Case No. ZC-151 - The Captain's Anchorage, Inc. - Request for approval of a Zone Change from, C-l to C-2 on property located on the northeast corner of Carlsbad Boulevard and Tamarack Avenue. Commissioner Watson made the comment that he would abstain from any action on this item because, (1) he lives in.direct proximity to the area, and (2) he is in a similar business. .Chairman Wrench explained that policy directs a vote of four on a public hearing item to approve it, and the applicant was asked if he would like to be heard tonight even though there were only five Commissioners present or if he would prefer a continuance. The applicant said he would like to be heard. Assistant Planning Director Bud Plender gave staff presentation, explained graphics and recommendation for approval as outlined in the staff report. Ingress and egress from the parking lot was discussed and this will be from Tamarack only. . . Mai com McCassey. 33971 Crystal Lantern, Dana Point, representing the Applicant, stated that Carlsbad Boulevard ingress and egress was closed off at the request of the Planning Department. They have already made a traffic flow study, the case already has approval from the Coastal Commission and now all they need is a change of zone in order to have on-sale liquor.
