PLANNING COMMISSION ACTION ON EIR-268 AND SP-168
The Planning Commission held a public hearing on the proposed project,
a 156 unit condominium project on eight acres south of Park Drive, on
April 22. During the April 22 meeting, a number of questions and issues
were raised with respect to public improvement and provisions for pedestrian
and bicycle lanes on Park Drive, Marina Drive and a proposed public
access (private easement on the easterly side of the property).
Another issue revolved around the height of the proposed structure as
it would relate to heights permitted in the Planned Community Zone.
Planning Commission continued the matter to the next regularly scheduled
meeting which was May 13. During the intervening three-week period, the
staff and the applicant resolved the issues with respect to public improve-
ments and height as they relate to the development. Planning Commission
is recommending approval of the subject development, subject to some twenty
conditions.
The conditions which the Planning Commission levied that relate specifically
to their original concerns are:
1) Condition No. 8 which requires bicycle parking facilities within the
right-of-way adjacent to the project.
2) Condition No. 9 which stipulates the requirements for driveways and the
relationship to parking areas.
3) Condition No. 11 which specifies height to be observed with the exception
of lofts (clorestory) which are permitted by the Specific Plan to be
41 ft. in height as defined on the plot plan.
4) Condition No. 12 provides for adequate fire protection. However, the
original condition presented to the Planning Commission on April 22
required fire retardant roofs, etc. However, the wording has been changed
to insure a combination of fire resistant material, water mains and
hydrants.
5) Condition No. 15 provides for public improvements on Park Drive and
a separate public bikeway that will be constructed within a combination
of the public right-of-way and the front yard, as permitted in the P-C
zone.

6) Condition No. 18 requires dedication and construction of a public walk-
way along the north shore of the Agua Hedionda Lagoon, as defined in the
Specific Plan.
In review of all the conditions of the proposed Specific Plan, it is suggested
by the staff that Condition No. 2 be reworded because a tentative map has not
been filed with the City and it is not realistic that the time limit of the
Specific Plan should be tied to a discretionary act which remains to be
accomplished. Therefore, it is recommended that Condition No. 2 be reworded
in the following manner:
Building permits must be issued within five years from the date of
approval of this ordinance. If building permits are not issued within
the time specified, Specific Plan 168 shall become null and void.
There was no substantial opposition at either public hearing rendered by the
public. One person spoke on the project; his basic tenant being the provision
for public accessibility and public improvements to and along the lagoon edge.

3. SP 168 - Lagoon Shores supplement.
In response to Planning's 4/25/75 memo and a 4/30 meeting with
the developer:
a. Revise Condition 8 to read - Right of way shall be dedi-
cated to provide a 42ft. half street section for Park Drive
and public frontage improvements shall be constructed as
required by the City Engineer. Rights of access to Park
Drive shall be waived. A pedestrian way and separate public
bikeway shall be provided within the 10'parkway and 15'
bu i1d i ng setback.
b. Revise Condition 9 to read - Right of way shall be dedi-
cated and public frontage improvements shall be constructed
along Marina Drive to provide a 40 foot curb-to-curb dimen-
sion, plus a 7 foot parkway. The intersection of Park Drive
and Marina Drive shall be realigned to avoid acute turning
movements and to provide a free right-turn movement on to
Park Drive, in accordance with City Standards. A 15 foot
easement and improved walkway from Marina Drive to the lagoon
shal1 be ded icated.
c. Revise Condition 10 to read - a 50 foot public parking
and access easement shall be dedicated,a1ong the eastern
boundary of the lot and privately improved and maintained,
subject to the review and approval of improvement plans by
the City Engineer. The driveway shall intersect Park Drive
at a right angle to the centerline-. An improved public walk-
way to the lagoon shall be provided.'
d. Revise Condi t ion 11 to read - A public walkway shall be
dedicated and improved to City Standards along- the toe of
the slope to the lagoon and above the mean high tide. (There-
fore, the walkway will be inundated only during a flood.)

e. Regarding your comment #5, the Engineering Department
does not feel the need for a specific plan condition requir-
ing a detailed soils study. The Map Act and our Municipa1
Code direct Engineering and Bu i Idling Department staff to
require and analyze soils reports to evaluate soil stability,
bearing capacity, and groundwater and recommendations for
mitigating measures, while reviewing the plans for the pro-
ject. If the Commission is adamant about the soils report

condition, we will gladly research and compose the condition
later.
f. Regarding your comment #6, the Engineering Department has
been gathering data to revise our grading ordinance. It may
be completed within three months and will include stronger
controls to prevent siltation, such as limiting rainy weather
grading operations. As the new ordinance will 1ike1y be in
effect prior to issuance of a grading permit for this project
we would suggest only general wording for the specific plan
such as: "Erosion control and slope planting shall be to
the satisfaction of the City Engineer pursuant to such stand-
ards as the City may adopt.31

SUBJECT: LAGOON SHORES SP-168
The Planning Commission at their April 22, 1975 meeting directed Staff to
study and revise, if necessary, the conditions of approval for SP-168.
Several of these conditions relate directly to engineering requirements. We
would appreciate receiving your written comments and suggested wording for
conditions by Friday, May 2. Specifically, the Commission was interested
in the following issues:
(1) Condition #8 - One Commissioner felt that a separate bike lane
should be specified.
(2) Condition #9 - The applicant felt that the walkway was unnecessary.
Also, a ramp connecting the walkway/bikeway from Marina to the
walkway along the Lagoon was suggested.
(3) Condition #10 - The applicant did not understand the statement that
the alignment and parking should be revised. This should be
clarified. Also, it was suggested that the walkway be connected
by a ramp, as in Condition #9.
(4) Condition #11 - The Commissioners wanted to know if the walkway
at the bottom of the slope would be inundated under normal extreme
high tide conditions or only during floods. There was concern
that the walk would be best located along the bottom of the bank
for privacy reasons and also for full access to the beach.
(5) The Commission recommended that a condition be added to require a
detailed soils study prior to grading or construction to ensure the
suitability of the site for structures. Can you suggest wording
for this?
(6) The Commission also requested that the grading be accomplished
^ during the spring and summer and slopes planted immediately in order
to minimize siltation of the Lagoon. Do you have any suggested
wording for this?

Plan No. 168, a 4-story townhouse development proposed at the south end of
Marina Drive in the City of Carlsbad.
Due to its coastal proximity and potential impact on coastal zone resources,

before the San Diego Coast Regional Commission.

SUBJECT: Lagoon Shores SP-168
The answers to the specific questions asked by the Planning
Commission are:
(1) "The Fire Department services have not kept pace with the
growth of the City. It is not sufficiently manned or
trained to confine large fires, or to provide necessary
aggressive attack and confine fires that have progressed
to the flashover stage. Apparatus is adequate and in good
condition. The number of companies is insufficient for
even median protection. Response time and distance are
excessive to many areas of the City, including several
high value areas." From the Gage-Babcock Report based on
conditions 3 years ago. Basically the only improvement we
have made since that time is to increase our on-duty man-
power by one man at the La Costa Station!
We have the approved plans, real estate, and the budget appropri-
ation to build and man Fire Station #3. With the Council's
approval we could go to bid immediately.
(.2) .Condition #15 would be clearer if it stated: The roof
covering shall be fire retardant as per the Uniform Build-
ing Code. Additional fire protection shall be ensured
through a combination of fire resistant building design
materials, construction of water mains and hydrants, and
suitable access. This shall be accomplished in a manner
acceptable to the Fire Chief.
(3) How do you judge the "economic impact" on the fire depart-
ment? The need for a second fire station*was justified
when the Plaza El Camino Shopping Center was opened. Since
that time each additional building built in the city regard-
less of size has increased that need. Taxes derived from
those buildings will help to pay the costs incurred by the
addition of another station. This particular project should
contribute more money in taxes than it requires for City
services.
I have repeatedly stated that the City has two choices pertaining
to adequate fire protection. It can either have a large fire
department (expensive to maintain) or it can require fire pro-
tection be built into the building, i.e., fire retardant construc-
tion, sprinkler systems, early warning .fire detection devices, etc.

they wanted to know:
(1) What is the capability of the Fire Department in protecting the
proposed use;
(2) Do you propose any rewording of condition #15 which states:
"Adequate fire protection shall be ensured through a combination
of fire resistant building design materials and construction of
water mains and hydrants. This shall be accomplished in a
manner acceptable to the Fire Chief."
(3) What is the economic impact of the project on the Fire Department?

In reply to your questions regarding the Police Department's ability to respond
to this proposed Lagoon Shores project, we make the following observations:
Any time you have a project such as this, which has certain areas or portions
inaccessible by vehicle, it works a hardship on the Police Department. In re-
viewing this site plan, we find two areas which would be very difficult for us
to routinely patrol; (1) the portion designated as the Boardwalk, running par-
•allel with the water's edge, and (2) the proposed sidewalk running from the end

of Marina Drive,- connecting with the Boardwalk.
We see no problem in policing the roadway to the east, which is designated Pub-
lic Access. We suggest that if a walkway is constructed from the end of Marina
Drive, it be run along the westerly edge of the proposed project; and, further
that, depending upon the width, measures be taken to exclude vehicles and/or
motorcycles. ...
We further suggest that this entire area, which would include the walkway, the
Boardwalk, and that part designated as Public Access on the east side of ,the
project, be adequately lighted.

The Planning Commission has requested that the Police Department respond as
to their ability to police the proposed Lagoon Shores project. The City is
recommending that three public walkways be dedicated as a part of this
project:
The first walkway would extend from the end of Marina Drive and
would ramp down to connect with a walk which goes along the
entire Lagoon frontage. The other walk would extend from the cul de
sac on the east side of the project and connect to the Lagoon frontage
walk at the other end.
The Commissioners were particularly concerned that, these walkways might
create enforcement problems for the Police Department. Can you comment on
this by May 2nd?
