Description The project consists of an amendment to the Car Country Specific Plan and Local Coastal Program.
The Car Country Specific Plan implements the Local Coastal Program for Car Country Carlsbad. The
original Car Country (SP 19) and the Car Country Expansion area (SP 19(C)) are currently covered by
two separate documents. The proposed Specific Plan amendment will consolidate the two
components of the specific plan into one document and will provide one set of standards for signage
and parking for the entire Specific Plan area. The amendment would also allow parking structures up
to 35 feet in height and allow for an increase lot coverage of 50% in conjuction with the construction of
a parking structure. The amendment does not propose a.comprehensive update to the Specific Plan;
however, it does address major areas of concern and conflicting standards between "old" and "new"
Car Country, and also corrects a number of typographical and other errors. The LCP amendment is
necessary to ensure consistency between the LCP and Specific Plan. The proposed amendment will
not result in any conflict with the provisions of the LCP.

As the state agency responsible for rail safety within California, we recommend that any
development projects planned adjacent to or near the North County Transit District right-of-way
be planned with the safety of the rail corridor in mind. New developments may increase traffic
volumes not only on^streets and at intersections, but also at at-grade highway-rail crossings. This
includes considering pedestrian circulation patterns/destinations with respect to railroad right-of-
way. • ' • • ' . .
Safety factors to consider include, but are not limited to, the planning for grade separations-ibr. ;
majorHhorOughfaresnmprovements'to -existing at-grade highway-rail crossings due to increase/.jn:
traffic volumes and appropriate "fencing to limit the access of trespassers onto the railroad right-of-
way.
The above-mentioned safety improvements should be considered when approval is sought for the
new development. Working with Commission staff early in the conceptual design phase will help
improve the safety to motorists and pedestrians in the City.

Thank you for the opportunity to comment on the above-referenced document
As of March 1,2005, Local Governments were required to comply with California Government
Code Section 65352,3, which requires consultation with appropriate Native American tribes regarding any
amendment to a General Plan or Specific Plan, or on Open Space designations. The General Plan
Guidelines, issued by the Governor's Office Planning and Research, have been amended to reflect the
new law, which includes a requirement to contact the Native American Heritage Commission for the
appropriate tribal contacts prior to any action on a General Plan or Specific Plan. To read a copy of the
chaptered law, please go to www.opr.ca.gov/sbl 82QQ4.html. This website also features the Tribal
Consultation Guidelines (SB 18) Addendum to the General Plan Guidelines.
Early consultation with tribes in your area is now REQUREO BY LAW for this type of action.
Consultation is the best way to avoid unanticipated discoveries once a project is underway. Enclosed is a
list of Native Americans individuals/organizations that may have unique knowledge of cultural resources
in the project area. The Commission makes no recommendation of a single individual or group over
another. By contacting all those listed, your organization will be better able to respond to claims of failure
to consult with the appropriate tribe or group. If you have not received a response within two weeks' time,
we recommend that you follow-up with a telephone call to make sure that the information was received.
Lack of surface evidence of archeological resources does not preclude the existence of
archeological resources. Lead agencies should consider avoidance, as defined in Section 15370 of the
CEQA Guidelines, when significant cultural resources could be affected. Provisions should also be
included for accidentally discovered archeological resources during construction per California
Environmental Quality Act (CEQA), Public Resources Code §15064.5 (f). Health and Safety Code
§7050.5; and Public Resources Code §5097.98 mandate the process to be followed in the event of an
accidental discovery of any human remains in a location other than a dedicated cemetery and should be

Dear Ms. Kennedy:
Enclosed is the re-submittal of the Car Country Specific Plan. The plan has been revised
per the recommended revisions identified in the City's letter dated March 10, 2005 and pursuant
to subsequent meetings and discussions with Jack Henthorn & Associates. Each of the items
contained in the letter are addressed below:
1. The 'Development Approval Procedures' for the Old Car Country area has been
revised to require a site development plan for all future development and not just
parking structures as requested.
2. As mentioned above, the 'Development Approval Procedures' section for the Old Car
Country area has been revised to be consistent with the expansion area section.
References to the architectural committee have been either removed or replaced with
the Planning Commission/Planning Director where appropriate.
3. The parking standards for both areas within the specific plan have been revised to be
consistent with the current zoning ordinance. Formatting of these sections are now
consistent with one another and were based on the recommended format.
4. The maximum building height for parking structures within the Car Country Specific
Plan area has been modified to 35 feet to the top of the roof deck with allowed height
protrusions per Section 21.46.020 of the municipal code as recommended. Both the
text and graphics have been modified.
5. The front yard setbacks for parking structures have been modified to be a minimum of
50 feet. If other uses are proposed within the parking structure, the more restrictive
setback will need to be maintained.
6. As recommended the specific plan has been revised to include a 25-foot street side
setback for both the old and new Car Country areas.
7. The minimum 10-foot side yard setback has been revised to eliminate the exception
for parking structures. The setback is now applicable to all future structures.
8. The outdoor lighting sections of the specific plan have been revised to restrict the
type of lighting for the roof level of parking structures to the use of bollards or lighting
attached to the parapet walls. However as requested, in no circumstance may the
lighting exceed the height of the parapet wall.
9. The Architectural Design and Materials sections of the specific plan have been
revised pursuant to conversations with staff. The architectural style and building

materials have been broaden to assist the car dealerships in incorporating a more
current architectural style. .
10. Part 4, Comprehensive Sign Program, of the specific plan has been revised to include
the original text as requested. The language proposed for the directional sign within
the median of Paseo del Norte has also been revised to require the approval of an
encroachment permit by the City's Planning and Engineering departments. The
intent is to provide the City with the ability to limit the sign's location and type within
the median. No development rights are being vested by the proposed language for
any subsequent approval for the encroachment permit. .

AMENDMENT
Dear Mr. Henthorn:
As we discussed last week, I have resumed working on the Car Country Specific Plan
amendment. I hope to have it scheduled for Planning Commission during the second quarter of
this year. After further review and analysis of the revisions, there are still a few items that staff
would like you to modify. There are also a couple of corrections that need to be made and I
have attached redlines of the sheets that need revisions.
The primary recommended revisions are as follows:
1. Require that an SDP application be required for all development in Old Car Country, not
just parking structures. This would be consistent with the processing of projects in new
car country. It is recommended that you add the same text as is in Part 3, II A & B
(Development Review Process).
2. You may want to consider deleting the entire existing Development Approval Process in
section in Part 2 I C since is seems that the architectural review committee is no longer
active.
3. The parking standards in sections Part 2, II F and part 3, III F should be reformatted
(similar to the Car Country expansion area format) so that they are more understandable
and consistent with the zoning ordinance requirements for parking. A recommended
format is attached.
4. Currently, old Car country has a height limit of 24 feet to the west and 35 feet to the east
of Paseo del Norte, while the expansion area has a height limit of 30 feet. Staff is
recommending that you modify the parking structure height limit to 35 feet to the top of
the roof deck (for both old and new Car Country), with allowed height protrusions (for
parapets or spandrel to screen vehicles on the upper roof deck) consistent with Section
21.46.020 of the CMC. This would be consistent with the C-2 zone 35-foot height limit.
The height for parking structures will be measured to the upper parking deck level.
5. There is some concern about the proposed front setback for parking structures. If the
1/3 of the average is used, you will need to provide a pre-determined setback for each
lot to avoid mis-interpretation in the future. A second issue concerns how setbacks
would be measured if other uses, such as vehicle repair, were integrated into the parking
structure. Which setback would take precedence? I would like to discuss how this

should be resolved before the text is revised. The goal is to formulate a standard that is
easy to analyze and implement.
6. Include a street side setback requirement for parking structures. Staff recommends that
a 25-foot street side setback for both old and new Car Country would be consistent with
the existing standards.
7. Staff recommends that the existing 10-foot side setback requirement should also be
applied to parking structures, as opposed to the zero setback standard as proposed. If a
parking structure had a zero setback, the wall along the property line would need to be a
solid, fire resistive wall and there would be no area for landscape to screen the building.
Staff believes that it is fairly unlikely that two parking structures would be constructed
concurrently, side-by-side along a property line, thereby eliminating the need for
screening. However, should this be the case, a setback variance could be considered
on a case-by-case basis.
8. Staff recommends modifying the text to prohibit light standards on the upper parking
deck and recommends the use of bollards or lights within the parapet wall instead.
Roof-top lighting should be designed so that it does not exceed the height of the
parapet. It will be difficult to screen 15-foot high light standards from the I-5 corridor as
currently proposed.
9. Addendum D relates to the building materials allowed for Car Country Expansion area.
Staff recommends incorporating the addendum into Part 3, III D where is can be found
more easily. You had also mentioned that you might want to modify the architectural
design guidelines, so that should be discussed and finalized soon. Modifications to the
architectural design can be included in Part 3, mentioned above and may also be
incorporated into Part 2, II D and III F.
10. Add in the deleted text from the sign program and delete the new provision for the
directional sign in the Paseo del Norte median (see redlines). Both the Planning and
Engineering Departments will not support a sign in the median.
When the revisions have been made, please submit one strikeout/underline version and the
final text version for review. Once the revisions have been finalized, the 6-week LCPA notice
period can commence. I hope to be able to schedule the project shortly after the LCPA notice
period ends.

F. Parking
The intent of this section is to provide sufficient parking in areas such that on-street
parking will be minimized.
1. General Parking Standards for Motor Vehicle Dealerships
a. Sales - One space per 400 square feet of gross floor area. Gross floor
area includes all interior areas that are not specified below, including but
not limited to: interior display, reception areas, private offices, and closing
rooms.
20% of the required stalls shall be designated as customer parking.
b. Repair - Four spaces per work bay for the first three bays. Two spaces
per bay for each bay in excess of three. Work bays shall not count as
parking bays.
' c. Parts -
Customer parking: 1 space per 1,000 square feet of gross floor area for
auto parts.
Employee parking: 1 space per 1,250 square feet of gross floor area for
auto parts.
d. Storage and Display (New and used Vehicle Inventory) - On-site storage
of vehicles is permitted as long as it does not encroach into any customer
or employee designated parking spaces.
e. All other uses - such parking as may be required under Section 21.44 of
the Carlsbad Municipal Code for a specific use.
f. All required customer and employee parking spaces shall be striped and
designated as such to the satisfaction of the Planning Director.

names and addresses of all occupants within a 100 foot radius of the subject
property, including the applicant and/or owner.

C) Mailing Labels - two (2) separate sets of mailing labels of the Property Owners
within a 600-foot radius and Occupants within a 100-foot radius of the subject
property. The list must be typed in all CAPITAL LETTERS, left justified, void
of any punctuation. For any address other than a single-family residence, an
apartment or suite number must be included but the Apartment, Suite and/or

Dear Mr. Henthorn:
As we discussed on the phone, this letter is intended to clarify the elements which are
necessary to proceed with your proposal for the Car Country Specific Plan Amendment.
Your proposal currently includes an amendment which would allow parking structures for the
storage of new cars, employee parking, and/or service bays. In order to accomplish this, the
proposed amendment includes provisions for increased lot coverage (up to 50') and increased
building height (up to 40') as well as modified setback requirements. The setbacks and building
heights for non-parking structures would remain unaltered.
In addition to your requested amendment, staff is also recommending that you address the
following items in the Specific Plan:
1. Parking:
The proposal should include a comprehensive amendment to the parking standards for
the Specific Plan. As it currently exists, a different standard applies to the original Car
County area and to the expansion area. Please include a proposal for new standards
which will apply throughout the entire Specific Plan area. Staff recommends that the
parking requirements should be based on the expansion area standards unless it can be
demonstrated that other standards are more appropriate. Supplemental information
should be submitted showing parking requirements for other auto malls, such as
Escondido Auto Park and National City Mile of Cars.
2. Sign Program:
Delete the text in each section which discusses signage and refer to the Comprehensive
Sign Program which was approved per Amendment SP 19(G). The Comprehensive
Sign Program should be included in a new "Part 4" which would apply to all of Car
Country. Any changes to the Sign Program which may be desired by the Car Country
dealerships should be incorporated into the proposal. In the past, I believe there may
have been some issues with directional signage to the dealerships.

3. Architectural Design:
The Architectural design guidelines appear to be somewhat dated. These should be
reviewed to determine if upgraded architectural standards/building materials are desired
for the dealerships.
4. Some additional standards for screening equipment and repair/storage areas should be
included in the plan.
5. References to names within the Specific Plan document (i.e. Auto Plaza Blvd. and Auto
Plaza del Norte) should reflect the current names.
6. The text for "Undeveloped Areas" (pages 2-19 and 2-28) in the Original Car Country
were never completed. It is suggested that you change these sections to match the text
for undeveloped areas in the expansion area.
7. In addition to the above-mentioned items, all items included in the letter of incomplete
dated January 2, 2003 should be addressed prior to submitting the revised Specific Plan.
As you know, the parking problems at Car Country have been a continuing topic of discussion
by staff, the Planning Commission, and the City Council. While your proposed amendment
would make it possible for dealerships to construct parking structures, I'm not sure if it will solve
the on-street and employee parking problems. The concern is that the dealerships will continue
to expand their inventory and use the parking structures to achieve this objective, rather than
use the parking structures to create/free up other areas for more employee and customer
parking. Therefore, at this time staff is recommending that you undertake a comprehensive
evaluation of the parking problems and develop a method to resolve these parking issues for
the dealerships.
Finally, I wanted to clarify that all of the property owners do not need to concur with the
proposed Specific Plan amendment in order to move forward with the project. It is possible for
only one property owner to propose a Specific Plan amendment which will affect all of the
properties within Car Country Carlsbad. I had mistakenly directed you to obtain letters of
support from the property owners, and incorrectly stated that if this was not possible, then the
City Council would have to authorize preparation of the amendment.

repeatedly to elicit a response from Helix Land, but to date, they have neither returned a ballot
nor indicated in any other way their position regarding the amendment. Representatives from
the Townsend Trust were approached personally by Mr. Scefonas in an attempt to address any
concerns they .may have regarding the amendment as proposed, but the contacted representatives
were not forthcoming with an explanation for their denial of support.

Pursuant to Staffs direction, Toyota of Carlsbad has contacted all owners of record within the
Car Country Carlsbad Specific Plan Area (SP 19 and 19C) to obtain their consent to amend SP
19 and 19C. In the course of these communications, a request was made of Toyota to revise the
submitted amendment to apply a constant and equitable height restriction for all parking
structures within the Car Country SP.
Currently, page 2-10 of the proposed amendment restricts the height of parking structures west of
Auto Plaza Boulevard (Paseo del Norte) to two stories, 30' maximum. All properties east of Paseo
del Norte, in both SP 19 and 19C, would be permitted to construct three-story, 40' parking
structures (see pages 2-11 and 3-11). The request would equalize this standard by applying the
same 40', three-story maximum to all properties within the SPA. Attached is page 2-10 as
revised, for your review.
We are mindful of the fact that there are adopted regulations and policies governing the heights
of structures along the Interstate 5 corridor that may ultimately determine the final building
height standards. However, given the cooperative spirit expressed by the Car Country dealerships
in their effort to help resolve the existing parking situation within the SPA, we believe that this
requested revision has merit and ask that it be given careful consideration.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Department
has reviewed your Specific Plan Amendment and Local Coastal program Amendment,
application no. SP 19 (I) and LCPA 02-11, as to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information
which must be submitted to complete your application. This list of items must be submitted
directly to your staff planner by appointment. All list items must be submitted
simultaneously and a copy of this list must be included with your submittals, including
two (2) sets of revised documents. No processing of your application can occur until the
application is determined to be complete. The second list is issues of concern to staff. When all
required materials are submitted the City has 30 days to make a determination of completeness.
If the application is determined to be complete, processing for a decision on the application will
be initiated. In addition, please note that you have six months from the date the application was
initially filed, December 2, 2002, to either resubmit the application or submit the required
information. Failure to resubmit the application or to submit the materials necessary to
determine your application complete shall be deemed to constitute withdrawal of the application.

Please find the enclosed items submitted on behalf of Lexus of Carlsbad who, in cooperation with
the Car Country Carlsbad Dealers Association, proposes an amendment to the format and
content of Specific Plans 19 and 19C. Two copies of the amended text are included, with
underlined text indicating additional language and strike-outs indicating language to be deleted.
Specific Plan 19 was approved in 1972 and established the development criteria for the area
known as Car Country Carlsbad. Specific Plan 19C, approved in 1987, annexed to the
automotive retail center the area immediately east of the existing Car Country and established
standards similar, but not identical, to those adopted for Specific Plan 19. Presently, Specific Plan
19 and 19C are maintained as separate documents.
The first part of the proposed amendment is to consolidate the two texts into one document to
be known as the "Car Country Specific Plan." Specific Plan 19 and 19C will continue to be
addressed separately, identified as "Original Specific Plan Area" and "Expansion Area,"
respectively. Since the entire area is commonly referred to only as "Car Country" the
combination of the two texts into one document is a practical recommendation that will help to
avoid confusion regarding the two plans and original versus expansion area.
The second component of the amendment request seeks to expand the list of approved structures
for Specific Plan 19 and 19C to include parking structures for the storage of new cars, employee
parking, and/or service bays, with the intent of improving the functioning of the Car Country
facility by freeing more of the existing surface parking for customers. Modifications to building
height and setback restrictions are included in the amendment as they pertain specifically to the
accommodation of parking structures within the Specific Plan Areas.

Description/Explanation:
Project is an amendment to Specific Plans 19 and 19C. Specific Plan 19, approved in 1972,
established the development criteria for the area known as Car Country Carlsbad, located east
of I-5, South of Cannon Road, west of Car Country drive, and north of the existing Carlsbad
Company Stores shopping center. Specific Plan 19C, approved in 1987, was known as the Car
Country Expansion area and annexed the area west of Car Country Drive and south of Cannon
Road into the existing Specific Plan 19 area.
The proposed amendment seeks to expand the list of approved structures for Specific Plan 19
and 19C to include parking structures for the storage of new cars, employee parking, and/or
service bays. The parking structures would improve the functioning of the Car Country Specific
Plan Area by alleviating some current parking and circulation concerns by better utilizing space
within the Car Country SPA. In order to accommodate a parking structure, the proposed
• amendment also includes provisions for increased building coverage (up to 50%) and building
height (not greater than 40 feet), as well as modified setback requirements for future parking
structure proposals, only. All setback, building height, and coverage standards for non-parking
structures remain unaltered.
A minor amendment, the proposal also seeks to combine into one physical document the
Specific Plan 19 and 19C texts, which since the approval of 19C, have been maintained as two
separate physical documents. The proposed amendment would thus result in the creation of
one "Specific Plan 19" text which contains the standards for Specific Plan 19 and 19C,
addressed separately, identified as "Original Specific Plan Area" and "Expansion Area."
Language has been added to the introduction to the combined Specific Plan explaining the
history and current (proposed) format of the document.
Subject: Car Country Carlsbad Specific Plan Amendment
Dear Sir or Madam:
In response to the widespread parking and vehicle storage hardships in Car Country
Carlsbad, Judy Jones of Toyota and Lexus Carlsbad along with the Hoehn family of dealerships
has proposed an amendment to the Car Country Specific Plan (SP 19 and 19C) that would
include parking structures as a permitted use within the Car Country Specific Plan area.
Currently, the Car Country Specific Plan prohibits building areas from exceeding 25 percent
coverage of the sites area. Additionally, parking structures are not permitted within the Car
Country Specific Plan area without an administrative permit issued by the City of Carlsbad. The
administrative permit process is costly in terms of time and money and carries no guarantee that
the proposed use will be approved.
The proposed amendment to the Specific Plan would increase the building area to 50
percent when a parking structure is included and provides uniform parking structure
development standards that would apply equally to all properties within the Specific Plan area. If
approved, the amendment will eliminate the need for expensive and risky special use permits for
parking structures by permitting parking structures by right, subject to the proposed parking
structure development standards. These standards generally establish typical site design criteria,
such as setbacks, building height, and architectural style. All other structures within the Car
Country Specific Plan area are already subject to standards similar to those proposed for parking
structures.
Bob Scefonas, Vice President of Corporate Affairs for Toyota Carlsbad and Lexus
Carlsbad and representing Judy Jones, has worked with the members of the Car Country Dealer
Association to solicit their opinions and succeeded in gaining written support from, in addition to
the Jones and Hoehn groups, Bob Baker Enterprises, Weseloh Chevrolet, Rorick Buick, Ken
Grody Automotive Group, Worthington Dodge and the Sharp Family Limited Partnership. -
The first draft of the Specific Plan amendment was submitted to the City of Carlsbad in
December 2002. The City of Carlsbad has reviewed the application and requests now that the
project sponsor, Lexus Carlsbad, provide evidence that all owners of property within the Car
Country Specific Plan Area were notified of and support the proposed amendment.
We are now in the final stages of gathering the remaining signatures of property owners in
Car Country Carlsbad. You or your company are shown as a property owner of the above listed
site. Included in this package are the Specific Plan portions that detail the changes (those
